In the press conference held by Congress leaders Ghulam Nabi Azad and Kapil Sibal, there was a very active attempt to indicate that their impeachment motion had nothing to do with the verdict in Judge Loya case. In all probability, it had everything to do with the Loya case. It is no coincidence or a matter of surprise to see the Congress mount a frontal attack on CJI Dipak Misra, who seems to be so aloof and unsympathetic to the causes for which the Congress stands for.
When Kapil Sibal asked for a postponement of the Ramjanmabhoomi case till 2019 Lok Sabha elections, the Chief justice had summarily rejected the proposal. In the recent judgement related to a demand for another investigation into the death of Judge Loya, the bench headed by the CJI had made scathing remarks on the political nature of the petition. The tipping point had been reached for the Congress party.
When Ghulam Nabi Azad explicitly stressed on the fact that he had asked for an appointment ten days ago, but VP was on a tour to North-east, I chuckled. When Kapil Sibal explicitly mentioned that the impeachment motion had nothing to do with Judge Loya case, it failed to convince me. In fact, I was convinced that this act of Congress and its allies were triggered by yesterday’s judgement.

The Congress party is least bothered about the constitution or the integrity of judges. In fact, Congress had saved a judge found guilty of corruption in 1993. At that time, Kapil Sibal himself had defended the judge as a lawyer. Kapil Sibal talking about “highest standards of integrity” is a perhaps, one of the best examples of shameless hypocrisy.
The Congress and its allies don’t have the numbers to impeach the CJI. This motion is not about defending the democracy or the institution of judiciary. This act of the Congress party and its allies is an act of retaliation against the judiciary. It is also a warning for future judges who dare to anger the Congress party in future.
