Supreme Court objects to disqualified MP Sharad Yadav drawing salary and perks from taxpayers’ money

The Supreme Court has stated that disqualified MP Sharad Yadav cannot draw salary and perks entitled to a member of Parliament. According to reports, the apex court has, however, allowed him to retain the official residence till the pendency of the plea challenging his disqualification.


Earlier, the Delhi High Court had passed an interim order which stated that Yadav can draw salary, allowances and perks till the pendency of his plea but JD(U) Rajya Sabha MP Ramachandra Prasad Singh moved to the Supreme Court with a plea challenging the Delhi High Court order.

The Supreme Court, taking cognisance of the plea heard the matter and a vacation bench of justices AK Goel and Ashok Bhushan reportedly wondered how could the Delhi HC allow Yadav to draw salary, perks and allowances on public money.

Following the SC bench’s observation. Yadav’s lawyer reportedly pleaded the bench that Yadav is ready to forgo the salary and perks. He requested the court to allow Yadav to retain his residence. The vacation bench reportedly agreed on that. According to reports, the bench stated that they will modify the HC’s order directing payment of salary, perks and allowances but they will not object to Yadav retaining his official residence till the pendency of his plea.

Sharad Yadav was disqualified as a Rajya Sabha MP by the Rajya Sabha chairman on December 4, 2017. Yadav and another Rajya Sabha MP Ali Anwar were disqualified under the anti-defection laws after JD(U) MP Ramachandra Singh complained that they had attended the rallies of opposition parties in violation to party directives.
