Accident involving Unnao victim was not planned, finds CBI: Drops murder charges against suspended BJP MLA Kuldeep Sengar

After the extensive probe into the case which was court-monitored by the Supreme Court (SC), the Central Bureau of Investigation (CBI) has found that the accident involving the Unnao rape victim was not planned by suspended BJP MLA Kuldeep Sengar but was a result of rash and negligent driving by the truck driver. As a result of this probe, while the CBI has filed a chargesheet in the case, they have dropped murder and attempt to murder charges against Kuldeep Sengar.

The truck driver who drove rashly and cause the Unnao rape victim to be severely injured and her two aunts to lose their life has been charged by the CBI under Section 304 A (causing death due to negligent or rash driving), 338 (causing grievous hurt), and section 279 (rash driving).

Reportedly, the CBI probed the case extensively. They ran simulation tests from all angles to probe how the accident happened and even probed call records to establish a link between the driver, Arun Kumar Pal and Kuldeep Sengar, however, no connection between the two was found.

Kuldeep Sengar, who was suspended from BJP has been charged under several sections of the IPC in cases unrelated to the accident.

Interestingly, it was reported earlier that the truck that had hit the Unnao rape victim and caused grievous hurt apart from killing her two aunts, belonged to a Samajwadi Party leader, Nandkishor Pal aka Nandu Pal. Lal. Lal is a Samajwadi Party leader from Fatehpur district and his wife Ramashree Pal is also a Samajwadi Party leader.

The rumours of a conspiracy against the Unnao victim gained even more ground after it was found that the number plate of the truck was blackened. Samajwadi Party leader had claimed that the number plate was blackened out to evade the financiers. Pal has three other brothers, Devendra Kishore Pal, Munna Pal and Dilip Pal, who own 27 trucks amongst themselves. Nandu Pal has reportedly informed that the truck which was involved in the accident was in the name of Devendra Kishore Pal. The truck was returning from Rae Bareli to Fatehpur. However, though it was claimed that the number plate was blackened to evade financiers, the Finance Company had denied this version and said that no payments were due on the truck at all.

Kuldeep Sengar was a BJP MLA from Bangarmau. He had joined BJP in 2017 after a ten-year stint with Samajwadi Party. He had first become an MLA from Unnao Sadar on a BSP ticket. He had joined SP later and had won the Bangarmau seat in 2007 and Bhagwant Nagar seat in 2012. He had joined BJP in 2017 and won the Bangermau seat.

The accident had taken placed in June this year. The vehicle had collided with a truck going in the opposite direction towards Lalganj in UP. The truck had reportedly hit the vehicle near the turning at Sultanpur Kheda village in the Lalganj-Raebareli highway. The victim, her lawyer and others were reportedly travelling to Raebareli to meet the victim’s uncle who is imprisoned in Raebereli jail in charges for assaulting Kuldeep Sengar’s brother Atul Sengar.
