‘You cannot call Nikita guilty, this is not a media trial’: Supreme Court rejects child custody claim by Atul Subhash’ mother

The Supreme Court has rejected the plea by the mother of Atul Subhash seeking the custody of the deceased techie’s 4-year-old child. Upholding the mother’s right to have custody of the child, the apex court stated that the child’s mother (Nikita Singhania) is alive and the petitioner is virtually a stranger to the child.

Observing that the mother of Atul Subhash is ‘virtually a stranger’ to the child, the Supreme Court added that the child has one parent alive and putting him with the parents of Atul Subhash may not be in the child’s best interests as he is not familiar with them.

Justice B Nagarathna also warned the mother of Atul Subhash not to call Nikita ‘guilty’ till her crime is proven in a court. “This is not a media trial. This is court. Only a court trial can pronounce a person guilty.

The SC however, advised the parents of Atul Subhash that if they want the custody of their grandchild, there is a separate procedure for that, but they do not have ‘familiarity’ with the child and are basically strangers for the little boy.

Nikita Singhania, the wife of deceased techie Atul Subhash who is facing charges in Karnataka for his suicide, has informed the Supreme Court that her 4-year-old son is under her care and she was granted bail by the Karnataka High Court on January 4.

Atul Subhash had committed suicide on December 9, after making a video accusing his estranged wife and in-laws of mental and financial harassment.
