On Wednesday (27th May), the Madhya Pradesh High Court quashed the anticipatory bail order of retired judge Girbala Singh in the Twisha Sharma death case.
The dead body of former model Twisha Sharma was recovered on 12th May, and an FIR was registered in the matter on 15th May. Within hours of the FIR registration, a trial court granted Twisha’s mother-in-law, Girbala Singh, an interim bail. Twisha’s husband, Samarth Singh, is currently in the CBI custody.
During the hearing by a single judge bench of Justice Devanarayan Mishra, it was found that there was consistency in allegations, non-cooperation, and the heinous nature of the offence, in addition to the trial court’s failure to consider evidence as key points to cancel the bail order given by the Bhopal district court.
“The anticipatory bail order by the 10th Additional Sessions Judge, Bhopal, for the offence punishable under sections 80(2), 85, 3(5) of BNS, 2023 and Sections 3 & 4 of the Dowry Prohibition Act, 1961, is hereby quashed,” Justice Mishra said.
“After getting anticipatory bail, Giribala Singh is not cooperating with the investigation agency, though several notices were issued to her for recording her statement and cooperating with the agency. It is also an admitted fact that the deceased got pregnant, and it was terminated within two months. The complainant party has alleged against the accused, whereas Giribala Singh has submitted that the deceased herself was interested in terminating the pregnancy. From the WhatsApp chats also, it cannot be said that the allegations are only against Samarth Singh, but the trial court did not consider all these facts,” the court said.
During the hearing, the Madhya Pradesh government informed the high court that the injuries found on Twisha Sharma’s body were pre-death. The government stated that these injuries could have been caused by a scuffle that occurred before her death. The government also stated in court that Twisha was harassed for dowry by her mother-in-law, former judge Giribala Singh, and her husband, Samarth Singh.
