Lucknow: Special Court sentences woman to 3.5 years in prison for misusing SC/ST Act, filing fake rape case against former boyfriend

A SC/ST Special Court has sentenced a woman named Rinki to three and a half years of imprisonment, along with a fine of Rs 30,000. The court mandated that any assistance she obtained from the state government must be returned. This development occurred after the convict lodged a false rape and SC/ST case against her former boyfriend as an act of revenge. Special Judge Vivekananda Sharan Tripathi pronounced the verdict.

The court observed that the incidence of extramarital affairs, live-in relationships and illicit relationships has risen within Indian society. These situations have created a new challenge for authorities and organisations. A woman who has engaged in such relationships for an extended period may suddenly approach the police and courts to claim rape. Hence, the legal process is exploited in numerous instances. Likewise, both the SC/ST Act and the rape allegation were misused in the present matter.

The court emphasised that a case does not materialise solely upon the submission of a charge sheet against an accused individual, while directing the District Magistrate. A case is established only when the police submit a charge sheet following their investigation. It remarked that the immediate distribution of relief funds upon the filing of an FIR contributes to the growing trend of false accusations.

On 3rd June, Rinki submitted a report at the Mohanlalganj police station alleging that she had been in a romantic relationship with Deepak Gupta from the village for five years. She accused him of engaging in physical relations with her under the false pretense of marriage. She even charged that his family members even assaulted her after calling her to his residence on 30th May.

During the investigation, the woman declined to undergo an internal medical examination. The authorities then submitted a charge sheet against Deepak in court. However, when the court reviewed the case, it determined that the accused had not engaged in sexual relations with the her, on the day of the incident.

Deepak had wed another woman in February. As a result, the complainant aimed to punish him and lodged this bogus case. The court concluded that the case did not constitute rape. Her intention was to invade the man’s home and jeopardize his marital life, purposefully making allegations that would adversely affect him.
