Uttar Pradesh: Court declares mosque on Saharanpur DM office premises illegal, orders demolition in 30 days

The court of the City Magistrate in Saharanpur has ordered the demolition of an illegal mosque located within the premises of the District Magistrate (DM) office. City Magistrate Kuldeep Singh has also imposed a fine of ₹6.41 crore on the occupants for encroachment of government land. The court has given 30 days to the occupants for the demolition of the illegal structure.

As per reports, the illegal mosque has been standing on the premises for 70 years. The court action comes after a complaint was filed by Vikas Tyagi, former provincial coordinator of Bajrang Dal. In his complaint, Tyagi pointed out that an illegal mosque was constructed within the District Magistrate office complex, which is a sensitive zone housing confidential government operations. He said that religious as well as commercial activities had been taking place within the premises. He further said that a post office was operating from the site and several rooms were rented out to outsiders, and the mosque committee had been collecting the monthly rent.

Acting on the complaint, the local administration conducted an inquiry and filed a case in the City Magistrate’s Court based on the findings of the inquiry. After a prolonged hearing, the court found that the mosque is illegal and passed an order for its demolition. The court order stated that the mosque was constructed over an area of 315 square meters on government land registered under Khasra No. 539 in the name of the Collectorate.

The mosque’s representatives could not present any evidence in the court to prove the legal status of the mosque. After examining the available records, revenue records, and other evidence, the court deemed the construction illegal and passed an eviction and demolition order. The court ordered the illegal occupants to remove the encroachment themselves within 30 days, failing which the administration will carry out forceful eviction action.
