The court noted, "The parties are governed by Muslim Personal Law. It recognises the permissibility of plurality of marriages."

Citing Quranic principles and Muslim customary law, the Kerala HC said polygamy is not permitted if men cannot treat their wives equally. However, it asked the state to protect women who were victims of polygamy.

The court pointed out that polygamy is mentioned in the Quran only once and that too for a fair historical reason.

“He has not treated the first wife and the second wife equally as required under the provisions of Islamic Law. Under Islamic Law, the husband is entitled for Polygamous marriage, however, he has to treat all the wife equally," the court observed.
