The Kolkata Municipal Corporation (KMC) has issued a notice under Section 400(1) of the Kolkata Municipal Corporation Act, 1980, to Lata Banerjee, the mother of Trinamool Congress MP Abhishek Banerjee, over unauthorised construction at a property on Kalighat Road in Kolkata.
According to the notice issued by KMC’s Building Department under Borough IX, the matter pertains to premises No. 121, Kalighat Road, Ward 073, Borough IX. The civic body has alleged that certain portions of the building were constructed in deviation from the sanctioned or approved plan.
The notice, dated May 18, 2026, directs Lata Banerjee either to demolish the allegedly unauthorised or deviated portions within seven days from the date of service of the notice or submit an explanation stating why such action should not be taken.
The document states that the deviations violate provisions of the Kolkata Municipal Corporation Act, 1980.
“You are hereby required under Section 400(1) of the Kolkata Municipal Corporation Act, 1980 to demolish the deviated unauthorised parts of the building within seven days from the date of service of the notice … or to show cause within a week from the date of service of this notice,” the notice reads.

The civic body further warned that non-compliance could result in demolition proceedings being initiated by the Municipal Commissioner after the prescribed notice period.
The notice additionally states that if demolition action is carried out by KMC, the cost incurred for such proceedings may be recovered from the owner, occupier, or person deemed responsible for the construction.
Apart from seeking removal of the alleged deviations, KMC has also directed submission of an “as-built” drawing of the structure along with structural details, including installations such as lifts or escalators, if any, within seven days of receipt of the notice.
An enclosure detailing the alleged deviations and non-compliances is also mentioned in the document.
The issuance of the notice is a procedural step and allows the recipient an opportunity to submit an explanation before any further action is taken.
