In the Pune Porsche hit-and-run case, the Bombay High Court on 16th December denied bail to eight accused, including the father of the minor boy who rammed his Porsche car into a two-wheeler killing two people in May last year.
The bench of Justice Shyam Chandak denied bail pleas of Vishal Agarwal, the father of the minor; Ashish Mittal; Aditya Sood; Arunkumar Singh; and Ashpak Makandar. In addition, the bail applications of Dr Ajay Taware and Dr Shrihari Halnor of Sassoon Hospital, who are accused of tampering with the minor accused’s blood sample to prevent detection of alcohol in his system, were also dismissed.
The court stated that the alleged conspiracy orchestrated by the minor accused’s father and others to tamper with the blood sample to shield the minor accused amounted to an erosion of justice for the man and woman who lost their lives due to the minor boy’s reckless driving.
The bench opined that the accused persons, if granted bail, can tamper with the prosecution’s evidence.
Some of the applicants are financially well placed. If bail is granted, even subject to stringent conditions, there is every possibility of their tampering with the prosecution evidence using their money power and superior dominance,” the Court stated.
It must be recalled that on 19th May 2024, two IT professionals, Aneesh Awadhia and Ashwini Koshta, were killed when a luxury Porsche Taycan car, allegedly driven by a minor under the influence of alcohol, struck them in Pune’s Kalyaninagar area. A massive row had erupted over the Juvenile Justice Board (JJB) issuing an unusual bail to the accused, requiring him to write a 300-word essay on road safety.
