SC rejects interim bail for Tahir Hussain, accused in Delhi anti-Hindu riots under UAPA, agrees with HC, grants custody parole for campaigning

The Supreme Court of India on Tuesday granted custody parole to Tahir Hussain, a former Aam Aadmi Party (AAP) councillor currently facing charges related to the 2020 Delhi riots.

This allows him to campaign for the elections daily from sunrise to sunset between January 29 and February 3. He will be released each morning and returned to Tihar Jail in the evening. Tahir Hussain is required to pay ₹2 lakh per day in advance to cover the costs of security arrangements during his parole.

Hussain, who has been in judicial custody, was permitted to campaign for the upcoming Delhi Assembly elections. The decision followed a plea from Hussain’s legal team, which argued for his participation in electioneering activities due to his political and public responsibilities.

It is worth noting that Hussain has approached the top court seeking interim relief after the Delhi HC had granted him custody parole in the Ankit Sharma murder case. The three-judge bench constituted days after the split verdict by an earlier bench agreed with the Delhi HC and maintained Hussain’s custody parole, allowing him to campaign for the elections for the forthcoming Delhi assembly elections.

Hussain is a key accused in the February 2020 Delhi riots and faces charges of inciting violence, rioting, and other offences. Despite his ongoing trial, the court allowed parole with conditions, including his return to custody after the campaign period concludes.
