While dismissing the case, a bench comprising justices JB Pardiwala and Sandeep Mehta on Wednesday (10th September), said that there is a “clear distinction between rape and consensual sex”.
This problematic mindset entrenched in judiciary perpetuates a culture of impunity for sexual violence in India where rape cases have only increased, with over 30,000 cases reported in 2023 alone.
"The appellant, being a caring father, did not accept the proposal of marriage of the boy with his daughter. In my view, it seems to be the cause for the prosecution against the appellant, "the Bombay High Court Judge noted.
