An FIR was filed on Friday (15th May) at Bidhannagar North Cyber Crime Police Station against Trinamool Congress MP Abhishek Banerjee for making inflammatory statements during the recently held assembly elections in the state, as confirmed. The FIR was filed based on a complaint submitted by a social activist, Rajib Sarkar, at Baguiati Police Station in the North 24 Parganas district.
“Following due procedure after the filing of the complaint, an FIR was formally registered at the Cyber Crime Police Station under the Bidhannagar Police Commissionerate on May 15,” the police said.

According to the complaint, Banerjee, the national general secretary of the TMC, made provocative remarks on post-poll violence and the vote-counting process during political events held between April 27 and May 3. Sarkar stated that Banerjee’s remarks were linked to Union Home Minister Amit Shah. The complaint mentioned Banerjee’s speeches delivered at rallies in Maheshtala, Arambagh, Haringhata, and Nandigram. Sarkar said that Banerjee used aggressive language against opposition workers, which could disturb public peace and create political tension.
The complaint quoted the TMC MP as saying, “I will see who comes to save them on May 4. I will see which godfather from Delhi comes to their rescue.”
“The complainant alleged that certain remarks made during public meetings were provocative in nature and had the potential to disturb public order and communal harmony. The contents are being examined as part of the investigation,’ the police added.
“The brief facts of the case are that on 15.05.2026, a written complaint was received from Shri Rajib Sarkar, son of Late Mrinal Kanti Sarkar, residing at Arunila Apartment, FA 6/2 Deshbandhu Nagar, Baguiati, Kolkata-700059. In the complaint, he alleged that Shri Abhishek Banerjee, MP from the Diamond Harbour constituency, delivered provocative, threatening, and inflammatory speeches during different political rallies and election campaigns for the West Bengal Legislative Assembly Election 2026. The speeches allegedly incited violence, promoted enmity, and disturbed public tranquillity,” the FIR stated.
The FIR was lodged under Sections 192, 196, 351(2), and 353(1)(C) of the Bharatiya Nyaya Sanhita (BNS). The case also includes Sections 123(2) and 125 of the Representation of the People Act, 1951.
