Justice C Saravanan had accepted Suhail's petition and directed the Tamil Nadu government to file a counter to his petition.

The Court held that under Section 29 of the POCSO Act 2012, it is for the accused to defend himself once the prosecution proved the offence and the Court had drawn its presumption.

The HC also noted that Vijay, a successful actor, had not bothered to mention his occupation in his affidavit.
