Congress Manifesto: Declaration of disastrous legal reforms and a tale of contradictions

Congress being the oldest national party in this country has come up with its national manifesto and had raised a wide variety of controversial topics to cater to a particular vote-bank and ideology. Congress has claimed to be a centric party but how pretentious centric party claim can actually leave you in abeyance, this manifesto is a perfect example of that. Here, I have presented a brief analysis of the self-contradictory view of Congress towards legislation and laws which it aims to reform and revamp:

Establishment of Court of Appeals

Supreme Court is a constitutional court and only determines the constitutional questions of law. The court of appeal beneath the Supreme Court and above High Court will make the procedure excessively cumbersome and litigants will face harassment and end up paying unnecessarily in one more forum. In the times, when we have specialised and niche tribunals for a variety of matters ranging from Company Disputes, Environment, Civil and Criminal matters, this suggestion comes as an excessively chaotic interpretation of judicial system. It is imperative that there is absolutely no need for an extrajudicial system to create more pressure on litigants as it is clearly a retrogressive development which Congress is aiming at.

Another grey area where this is going to be creating complexity is by creating conflict of jurisdictions. We have come a long way from the colonial system of justice and it will definitely be a step backwards.

Women’s Reservation Bill

Commonly known as the Women’s Reservation Bill, it seeks to reserve one-third of all seats for women in the Lok Sabha and the state legislative assemblies. Introduced by the UPA-I government in May 2008, it also provides that one-third of the total number of seats reserved for Scheduled Castes and Scheduled Tribes shall be reserved for women of those groups.

The Bill showcased the political will and intent of Congress regime back then but eventually bill was not passed despite the fact that Congress got 206 seats in 2009 Lok Sabha elections. Women were involved in the early establishment of the BJP. The BJP has encouraged greater representation of women by developing women’s leadership programs, financial assistance for women candidates, and implementing a 33% reservation for women in party leadership positions. BJP has received women’s support by focusing on issues such as the Uniform Civil Code to extend equal rights to women and men regardless of religion. They have also spoken out against violence against Indian women.

Congress has over the years contradicted its own stand and has backtracked on its electoral promise and now bringing this in the manifesto is a mere eyewash.

Repeal of Sedition and Criminal Defamation

Section 124 A of the IPC deals with the Sedition. Now, Congress has ruled India over 60 years since Independence and shall be credited for misusing the law more than anyone.

Congress misused Sedition Law during its tenure. Thousands of sedition cases were filed against citizens during the 10-year UPA rule alone. Take the case of agitation against the nuclear power plant at Kudankulam in Tamil Nadu. A fact-finding team comprising journalists and civil society members had found that FIRs were registered against 55,795 people and around 23,000 agitators were arrested, while sedition charges were slapped against around 9,000 of them for “waging war against the Government of India”. UPA Government holds a record of filing highest number of cases.

Whether it was Aseem Trivedi (Cartoonist), Binayak Sen(Professor) or Raj Thackeray (Politician), everybody from different facets of public life faced the wrath of Macaulay’s colonial legislation. Congress has received this legislation as a legacy but now because of political compulsions and cater to a particular vote-bank, Congress has again taken policy U-turn.

Congress leader Rahul Gandhi and his media associates like The Wire have been prosecuted under Criminal Defamation case due to their allegations in bringing disrepute to RSS and Modi Government. The Supreme Court has upheld the constitutional validity of the country’s colonial-era criminal defamation laws, ruling that they are not in conflict with the right to free speech.

The judgement will put politicians and media figures, some of whom are already facing charges of criminal defamation, on the defensive. Some expressed concern that it could muzzle freedom of speech.

The apex court concluded there will be “no chilling” effect on the latter because of criminal sanctions.

Dissent is required, but it does not grant an unfettered right to damage a reputation, said a bench comprising justices Dipak Misra and Prafulla C. Pant.

Rahul Gandhi also filed a writ challenging criminal defamation which was disposed of by Supreme Court. The manifesto shows disrespect of Congress towards apex constitutional court.

Amendment of AFSPA

AFSPA has to be credited as the reason why Kashmir and insurgency-affected areas of North-east are still an integral part of India. Supreme Court has upheld the constitutional validity of AFSPA in Extra-Judicial Execution Families Association v/s. Union of India. It was held by both Honorable Judges that We are aware that this decision does not make it easier to deal with that reality. This is the fate of democracy, as not all means are acceptable to it, and not all methods employed by its enemies are open to it. Sometimes democracy must fight with one hand tied behind its back. Nonetheless, it has the upper hand. Preserving the rule of law and recognition of individual liberties constitute an important component of its understanding of security. At the end of the day, they strengthen its spirit and strength and allow it to overcome its difficulties.”

Supreme Court in its tone is loud and clear on upholding the constitutionality of the Act. However, the Interlocutory Committee Report presented by the Home Ministry in UPA Government had echoed the same views under the presidentship of Dilip Pedgaonkar. The then Home Minister Chidambaram also subscribe to the same views and this is definitely a threat to Indian Nationalism and unity and integrity.

The Congress manifesto is misleading the nation on issues where the Supreme Court has already upheld the constitutional validity of legal issues. There is no new finding and innovation in the manifesto and it looks like old wine in a new bottle.

From Pulwama terrorist Ahmed Dar to Maoists who killed BJP MLA: Here is how they speak the same language as ‘Liberals’ demonising Hindus and RSS

On April 9, 2019, the last day of the election campaign for the first phase of Lok Sabha elections, the sitting BJP MLA from Dantewada, Bhima Mandavi was returning from campaigning for his party in his convoy, unaware of the terrible fate about to befall. In an Improvised Explosive Device (IED) blast, Naxals blew up Mandavi’s convoy, killing him and 4 security personnel accompanying him. The blast took place at Shyamagiri hills when the MLA’s convoy was heading towards Kuwakonda from Bacheli area, about 450 km from state capital Raipur.

Yesterday, the Maoists claimed the responsibility of the attack alleging that the attack on Mandavi was in ‘retaliation’ to the killing of Maoist cadres in encounters by security forces and the grant of iron mining permission to Adani group in Dantewada. Defending the horrifying killing of the BJP legislator, the secretary for the Dankarnaya Special Zone and Darbha Division Committee of the banned Communist Party of India-Maoist, Sainath, claimed that the gruesome killing was in response to the aggressive Hindutva agenda pursued by the BJP and the RSS which seeks to divide people into the lines of caste, community and religion.

This is exactly what the Liberals have been bellowing against the BJP government ever since it came to power in 2014. From the last 5 years, Liberals across the country have fanned fear among the minorities by raising a bugbear of BJP-RSS attempting to turn this country into a Hindu Rashtra. For any untoward incident happened against persons belonging to minority communities, the Liberals have jumped the gun to hold ‘Hinduism’ pursued by BJP-RSS responsible for it. This, when the RSS has made it amply clear that

Juxtapose the reasons given by Sainath for carrying out an attack on BJP MLA with the assertions made by the Pulwama terrorist Adil Ahmad Dar in the video released by the Jaish-e-Muhammad terror outfit following the attack on the CRPF convoy that killed 40 CRPF personnel. Expressing his unmitigated hatred from Hindus, Dar justifies their killings by calling them ‘infidels’ and ‘cow piss drinkers‘. For many Liberals, Ahmed Dar was a manifestation of the growing resentment among the Kashmiri Muslims against the BJP’s pro-Hindu policies.

The Liberals masquerading as terror apologists then, instead of issuing an unconditional condemnation for the attack carried out by Dar blamed the perceived excesses by the security forces for pushing him towards extremism and held the central government’s supposedly anti-Muslim stance and pro-Hindu policies responsible for the Pulwama tragedy.

In fact, one of them went a step ahead and did a caste-based analysis of the soldiers killed in the attack. In an apparent reference to Modi and Shah, the journalist contended that lower caste soldiers had to pay with their lives for the bravado displayed by upper caste Hindus. Liberals also conjured up imagined Kashmiri victims and started a rumour that Kashmiri students were being attacked in various colleges and universities across India by the hostile RSS-BJP supporters in the aftermath of the Pulwama attack.

In 2015, a 15-year old Junaid Khan lost his life in a scuffle over the seat in a train compartment. However, in no time the Liberals spun the story and presented it as an attack on a Muslim by Hindutva sympathisers and castigated the BJP government for empowering such mobs to operate with impunity. However, it was later observed by the courts that the attack on Junaid Khan was because of the dispute over the berth in a train compartment and not a coordinated mob attack against a citizen belonging to a minority as the Liberals would have us believe.

There’s a stark similarity in the explanation tendered by Sainath while reasoning the murder of BJP MLA Bhima Mandavi and that of the terror apologists who defended the atrocity committed by Ahmed Dar and twisted it to pin the blame on RSS-BJP. The Maoist and terrorists are now co-opting the arguments peddled by Liberals to justify their vile acts against their adversaries. This link between the Naxals, terrorists and the Liberals was well-explain in the film-director Vivek Agnihotri’s book ‘The Urban Naxals’. The book exposed the vile nexus of Liberals with the Naxals and terrorists and all their shenanigans which until then had been meticulously hidden from the world were exposed in the book.

The Liberal-favoured Congress governments in the past have denied Hindus their rights, appeased Muslims and other minorities and have also concocted the term Hindu Terrorism taking Hindus on a guilt-ride. The BJP government, on the other hand, had abandoned appeasement politics, debunked the Hindu Terror bogey raised by Congress and restored the Hindu glory back which seems to be unpalatable to the Liberal cabal.

The Hindus who were conditioned to remain oppressed by the previous governments and their allies from the ‘Liberal’ community have finally awakened to the injustices meted out to them. Perhaps, this awakening which manifested itself into a thumping majority to the Modi government has spooked the Liberal community which is using every incident to ridicule the BJP government and demonise the Hindus.

The perpetrators across the length and breadth of the country, from Kashmir to Dantewada are now echoing what the Liberals have been saying since Modi came to power. Every egregious act is being vociferously justified and defended by blaming the surging Hinduism and holding the BJP-RSS governments liable for them.

Liberals have, perhaps, realised that the only way to get a government at the centre who is sympathetic to their world view is by demonising the Hindus and excoriating the BJP government’s pro-Hindu policies responsible for any unfortunate incident in the country. Such is the deep-seated hatred for Hindus and Hinduism amongst Liberals that they have no qualms if the terrorists and Maoist co-opt their contentions.

Had told Mulayam Singh that my morphed, lewd pictures were being circulated by Azam Khan : Jaya Prada

BJP Lok Sabha candidate from Rampur constituency and former Samajwadi Party leader Jaya Prada, while addressing a public rally, called sitting MLA of SP from Rampur, Azam Khan as the reason behind her leaving Rampur. She said that she used to call Azam khan her brother but he cursed and insulted her instead.

“Do my brothers here ever see me as a mere dancer?” she questioned. Prada said that she had even brought this behaviour of Khan to SP patriarch Mulayam Singh Yadav’s notice.

The veteran actor-turned-politician said that she had even complained to Mulayam Singh that her morphed pictures were being circulated in Rampur and had asked for his help but no leader came out in her support to save her. And therefore she had to leave Rampur.

Jayaprada, who had earlier said that the character of Khilji in the movie Padmavat reminded her of Azam Khan because of the way Khan has tried to take revenge on her, had also accused Azam Khan of attempting an acid attack on her and harassing her. She said that she had no certainty whether she would be alive the next day.

Last month, Azam Khan‘s close aide and SP Sambhal District President Firoz Khan using a highly condemnable language for Prada had remarked that the residents of Rampur would remain entertained and their evenings would be colorful because Jyada Prada would be visiting the district frequently for campaigning for the Lok Sabha elections.

Newslaundry columnist demands that BJP be banned from 2019 elections based on a debunked lie

The election season is upon us and with it, the lies and propaganda that ‘journalists’ spread from behind the veil of neutrality also seem to be peaking. Columnist of the leftist portal Newslaundry was found spreading fake news and demanding that BJP be banned from contesting in the 2019 elections on the basis of that fake news, that has already been debunked.

Jas Oberoi, a columnist with Newslaundry tweeted that Uttar Pradesh police was openly distributing food packets with NaMo and BJP written on them in Noida. He followed that with the assertion that had this happened in any other sane part of the world, the political party involved would have been banned from the election. But that would not happen in India.

Motivated propagandists like Jas Oberoi have never been too keen on checking their facts before making wild allegations and that is exactly what happened here. Incidentally, hours before Oberoi tweeted, this lie had already been debunked summarily.

While the first phase of polling was on its way, at about 10:45 AM on 11th April a journalist associated with Times Now tweeted that ‘NaMo’ (instead of Namo) food packets are at play in Noida, implying that the food was ‘branded’ on the name of Prime Minister Narendra Modi who is often referred to as NaMo. He claimed that he himself had not clicked the picture, but his friend had clicked and sent it to him. This lie was picked up by several Congress politicians, journalists and even “Fact-checkers” associated with international news agencies like AFP.

As it turned out, Namo Food (which was mischievously written as ‘NaMo Food’ by propagandists) has nothing to do with Prime Minister Narendra Modi and is an actual restaurant based in Noida. In fact, Namo Foods has not one but 4 food outlets in Noida as per the food search website ‘Zomato’. Senior Superintendent of Police, Gautam Buddh Nagar also took to Twitter to clarify that the food packets were procured at the local level for the police officers on election duty.

The clarification had already come in by 12:12 PM on 11th April 2019. However, the columnist with the NewsLaundry decided to further peddle this on 11th evening even after the issue had been put to rest.

Incidentally, this is not the first time that Jas Oberoi who works with Newslaundry had peddled lies and bigotry on Social Media. Earlier, Jas Oberoi had asked a Sikh man to give up Sikhism when he had challenged Mamata Banerjee to stop Durga visarjan during Durga Puja. Tajinder Bagga’s support for a Hindu festival had offended the NewsLaundry columnist so much that he deemed Bagga unfit to be called a Sikh. In 2017, he had displayed his bigotry in all its glory, by trying to pass off a 2016 video of Prime Minister Narendra Modi meeting Sayed Fakhar Kazmi Chisty of Ajmer Sharif, as a new video. Not only that, he had said this was Modi’s attempt to appease the Muslim minority in Gujarat which was about to go to polls at that time.

Jas Oberoi had also lied blatantly when he had asserted that the press conference held by Judge Loya’s son to implore journalists and activists to leave his family alone, was organised by Amit Shah, the President of BJP. In fact, when the abusive Newslaundry columnist, whose propaganda was re-tweeted by AAP chief and Delhi’s Chief Minister Arvind Kejriwal, was presented with facts, he showed his arrogance by refusing to accept correction. In reality, the son of Judge Loya had thanked his lawyer Ameet for the support, and propagandists like Oberoi had twisted that to insinuate that it was Amit Shah who had organised the press conference.

Congress, communists and Muslim League have attacked the root of our faith in Sabarimala: PM Modi in Tamil Nadu

PM Narendra Modi is addressing a massive public rally in Tamil Nadu’s Ramanathapuram. PM Modi has highlighted many local issues concerning the people of Tamil Nadu and has reiterated his party’s commitment towards the progress and socio-economic development of the region.

PM Modi started his speech by stating that he is an MP from Varanasi, a place that is connected to Ramanathapuram by bonds of spirituality.

Discussing the water scarcity issues faced by the people in regions of Tamil Nadu, PM Modi repeated the promise made in the BJP’s manifesto that there will be a separate ministry ‘Jal Shakti’ for the optimum utilisation of water resources.

During the release of BJP’s manifesto, PM Modi had mentioned that the states like Rajasthan and Gujarat have been facing water problems for decades and they have managed to find alternatives to battle the issue. However, there are several states, like Tamil Nadu, which have been exposed to the problem in recent past and thus need a better, effective water resource utilisation roadmap.

Repeating his promise today, PM Modi assured the people of Ramanathapuram that there will be separate ministry called ‘Jal Shakti’ in the new Modi government. He stated that the new ministry will be dedicated to water conservation and resource utilisation.

The BJP manifesto promises that the new government will also focus on getting pipe water to every household in the country.

Addressing the public in Tamil Nadu, PM Modi stated that thousands of people in Tamil Nadu depend on the sea for their livelihoods. He mentioned the fishing communities and stated that their hardworking Chowkidar is dedicated to their development and has been able to take several path-breaking decisions for their welfare.

PM Modi also mentioned that his government has seen to it that over 1900  fishermen have been released by Sri Lanka after the Modi government’s intervention. He added that some of those brought back were even facing death sentences. He added that a new ministry of fisheries will also be formed. The facilities of the Kisan Credit Card has already been extended to fishermen under the Modi government.

PM Modi stated that fishermen are benefitting from technology. The NAVIK technology developed by ISRO provides navigation and safety information to fishermen in their own language. Work on the Mukkayyur fishing harbor and Pampuhar harbor at Nagapattinam is underway at a record pace.

PM Modi also highlighted the infrastructure and tourism development projects undertaken in the area. He stated that his government is working on the doubling of the railway tracks between Rameshwaram and Dhanushkodi. He added that the 100-year-old iconic Pamban bridge will soon be transformed into a state of the art modern bridge.

Speaking to the people of Ramanathapuram, PM Modi reminisced about former president Dr. APJ Abdul Kalam. PM Modi stated that Dr. Kalam had many dreams for India and it is our duty to fulfill those dreams so we can take India to new heights of glory.

PM Modi also stated that the Congress, leftists and the Muslim League have been playing a very dangerous game regarding the Sabarimala Temple. They have used brute force to strike at the root of faith and expression. He assured the people that till BJP is there, no one will be able to destroy our faith and culture.

PM Modi also attacked Congress for its years of abusing power and corruption. He told people that if they go to Delhi, they will see that prime real estate has been used for building memorials for the members of one family. It is as if no other person has ever contributed to India except that one family. PM Modi stated that his government believes every Indian has contributed to the building of our nation in his/her own way.

Modern Secularism: While Mayawati stands by her appeal to Muslims, she “slams” Yogi Adityanath for appealing to Hindus

It wasn’t too long ago that BSP supremo Mayawati appealed to the Muslim community to vote as a bloc. She urged Muslims to not divide their votes between the Congress candidate and the SP-BSP candidate, but abandon the Congress candidate and vote en masse for the gathbandhan candidate.

One would imagine that this would shake the very core of the torchbearers of secularism. But it didn’t. There was an eerie silence where not a word was spoken against Mayawati’s appeal.

Now a video has been tweeted by a senior correspondent of CNN News 18 where Mayawati is heard being unapologetic about her remark.

In the video, Mayawati can be heard clarifying that she has not apologised to the Election Commission over her remarks and appeal to the Muslim community. She ensures that she clarified to the Muslim community that she stands by her comment and has no regret over it.

While Mayawati has stuck to her appeal to the Muslim community, she took to Twitter today to slam Uttar Pradesh Chief Minister Yogi Adityanath for saying that he is dividing the electorate between ‘Ali’ and ‘Bajrangbali’. She was alluding to the comment where CM Yogi Adityanath slammed the ones asking for a consolidation of Muslim votes and essentially meant that if they want only Muslims to vote for them, BJP would want to Hindus to consolidate.

Interestingly, the media lapped up the comment by Yogi Adityanath while giving a free pass to Mayawati’s comment. One can also bet that majority of the Lutyens’ media that has been tacitly campaigning to defeat PM Modi won’t ask Mayawati how her comment appealing to Muslims becomes inclusive while Yogi Adityanath’s statement which was an offshoot of Mayawati’s comment becomes divisive.

When Arvind Kejriwal attempted horse-trading to form the government in Delhi and was caught on tape

There have been talks and reports about an alliance between the AAP and the Congress in Delhi for the 2019 Lok Sabha polls. Arvind Kejriwal openly said that “He is tired of asking the Congress for an alliance.” Naturally, for a man who said in 2013 that ‘Sab mile hue hein ji’ (Meaning “All politicians are hand-in-glove with each other”) and that AAP will not ally with any party, allying with a party like Congress and claiming to be anti-corruption is the height of hypocrisy.

The real reason for that alliance is simple- to win some seats in Delhi, else AAP is likely to draw a blank there as well as elsewhere in the country. However, this alliance (whether it materializes or not) is not the only example of Kejriwal’s misdeeds. A major, but sadly forgotten chapter of Kejriwal’s political career is his attempted horse-trading in July 2014 to form a Government in Delhi.

Arvind Kejriwal is the national convenor of AAP. His party won 28 seats in Delhi out of 70 in the December 2013 Delhi Assembly polls, with 28% of the vote, finishing 2nd behind the BJP which won around 33% vote and 31 seats and 1 by its ally SAD to make it 32 for the BJP alliance. The Congress won 8 seats with 24% vote in Delhi. The AAP then formed a 49-day Government in Delhi with Congress support and resigned on 14 February 2014. The reason for the resignation was cited as the inability to get the Jan Lokpal Bill passed in the Delhi Assembly, which the AAP could not pass as it did not have a majority in the Assembly. The real reason, of course, was to focus on the 2014 Lok Sabha elections and try to become Prime Minister of the country.

AAP contested 443 Lok Sabha seats in the 2014 Lok Sabha polls but drew a blank everywhere in the country including Delhi except Punjab, where it won 4 Lok Sabha seats. The BJP won a clear majority in the 2014 Lok Sabha polls, with the Prime Minister Narendra Modi defeating Arvind Kejriwal in Varanasi by more than 3.71 lakh votes.

In Goa, while campaigning for AAP for the February 2017 Assembly polls, Arvind Kejriwal said that AAP will cancel ticket of any AAP candidate found in any wrongdoing even 24 hours before polls-AAP will leave a seat uncontested but not field tainted candidates!

This claim is extremely hollow and unsound, and by that claim, Kejriwal himself would be unable to contest an election on an AAP ticket on his own issue of horse-trading. Arvind Kejriwal has made allegation after allegation on the BJP leaders, accused the PM Narendra Modi of taking a bribe of Rs 25 crores, in a matter dismissed by the Supreme Court. Kejriwal continues to slander against the PM on his degree, AAP continues to lie that the PM’s suit cost Rs 10 lakh while it cost much less, and was also a gift given to him by an individual, not out of taxpayers’ money. It is revealed that the suit was a gift from a Mr Rameshkumar Bhikabhai Virani, who also rubbished the claims that it could have cost Rs 10 lakhs saying “My son does not have the guts to spend that kind of money or that amount.

Kejriwal continues to claim ‘honesty’ and claims to be ‘an anti-corruption crusader who risked his own life for it by going on a fast unto death’.The reason for his attacks on BJP and the PM is his desperation to become the PM of India and inability to digest the rout of 2014 Lok Sabha in general and his own rout in Varanasi by 3.71 lakh votes to Modi.

In 2013, before the Delhi Assembly polls, he swore on his children that he will not take support from Congress or BJP to form Government in Delhi, which he violated. After that, he resigned in February 2014 from Delhi Govt to try to become the PM of India but gave the excuse that the reason was the inability to pass the Jan Lokpal Bill.

After the AAPs rout in the May 2014 LS polls, he wanted to become the CM of Delhi AGAIN with Congress support. On 20 May 2014, AAP wrote to the Delhi LG asking him not to dissolve the Delhi Assembly and was open to forming Government AGAIN with Congress support (ignoring its reason of not passing Jan Lokpal cited in February 2014). Arvind Kejriwal asked Lt Governor Najeeb Jung not to dissolve the Delhi Assembly anytime soon. In a meeting, Kejriwal told Jung that the party was deliberating on whether it should form the government. Kejriwal also handed over a letter to Jung in which he said AAP would hold a series of public meetings to ascertain people’s views on the issue.

Yogendra Yadav, who later was expelled from AAP also claimed that Kejriwal said on 16 May 2014, the day of the 2014 Lok Sabha results, that he ‘wants to become Delhi CM again’. Open Magazine reported: “…Against the wishes of some AAP leaders, the next day (17 May 2014), even before Prime Minister-elect Narendra Modi would perform his Ganga Aarti on the ghats of Varanasi, Kejriwal met Delhi’s Lieutenant Governor to express his readiness to form Delhi’s state government, retreating from the very values he had cited barely six months earlier when he stepped down after 49 days of being in power and realised that he was more at home on the street. He now wanted to be Delhi’s Chief Minister at any cost—moral or otherwise. He also called a Political Affairs Committee (PAC) meeting, and then the fledgeling party’s National Executive and both rejected his proposal. The author of Swaraj, a book-length pamphlet in which he had set forth lofty goals of participatory leadership, imperiously shrugged off the party’s majority line. He was a man possessed, a dictatorial aspirant drawn single-mindedly to the trampling of all dissent…In defeat, this time, he showed no grace and tried vainly to apportion blame on others.”

At this time, in the Delhi Assembly, the BJP had 31 MLAs plus 1 of SAD to make it 32, Congress had 8 and AAP 27 (not including expelled MLA Binny). But at that time in July 2014, Arvind Kejriwal tried to form the Government by poaching Congress MLAs. He himself had tweeted that Congress MLAs were being sold for crores and BJP would pay Rs 20 crore for each Congress MLA. But later it emerged that in July 2014 Arvind Kejriwal himself tried to form the Government in Delhi with the help of Congress MLAs, by trying to break them away from the Congress when the party refused to support AAP.

Kejriwal had sworn on his children not to take Congress support to form the government. Not only did it violate it in December 2013 to February 2014 by running a 49-day government with Congress support, here in July 2014 when the Congress party was not ready, he tried to break it and get MLAs to support him and become the CM. He himself had tweeted that the cost of one MLAs support was 20 crores.

An audiotape purportedly showing the Aam Aadmi Party national convener and Delhi Chief Minister Arvind Kejriwal discussing his plans to break the Congress and buy its MLAs during the Delhi elections created fresh problems for the party in March 2015. Former AAP MLA Rajesh Garg released the tape, which shows Kejriwal in conversation with him and planning the horse-trading in the run-up to the Delhi Assembly elections (of Feb 2015). This conversation was of July 2014, one and a half months after the 2014 LS polls result, though the tape was out only in March 2015. It is obvious that ex-AAP leaders Prashant Bhushan and Yogendra Yadav were aware of this attempt of Kejriwal in July 2014, but kept quiet until they were expelled from the party in March 2015. After they were expelled, they exposed Kejriwal’s attempted horse-trading.

The audio tape of this is available here: https://www.youtube.com/watch?v=JlTN0E5Ksn8
Here is the explosive conversation between Kejriwal and Garg:
“Kejriwal: We are ready, but they are not agreeing. Manish & all are in touch with them.
Garg: The 8 MLAs are ready, but Ajay Maken and Surjewala are creating hurdles, saying that they will be finished in Haryana.
Kejriwal: So then what to do? This is not their final decision, what can we do?I have tried many times.
Garg: We can appeal in the mohalla sabhas, to the people of Delhi. We can say that if they offer support, we will form the government.
Kejriwal: No don’t say that. Say the opposite.
Garg: No, I’m just asking you.
Kejriwal: No, we should not say anything. If they are ready, we are ready. But if we say this now, it will seem that we are getting desperate.
——————————-
Kejriwal: You try and break these 6 MLAs away. They should form their own party and support us from outside.
Garg: Yes, okay.
Kejriwal: Congress won’t support us, it has been one and a half months.
Garg: Okay, I will plan something.
Kejriwal: These 6 people were going towards the BJP. They can’t go to the BJP because 3 among them are Muslims. So these 6 might as well support us.
Garg: Okay, I will try and do something.”

There was no question of the authenticity of the tape, the AAP accepted it and the AAP shamelessly justified it as ‘political realignment’! But some people with conscience in the AAP resigned from the party, for e.g. Anjali Damania.

This was also corroborated by the Congress MLAs after the tape became public in March 2015. Former Congress MLA Mateen Ahmed Khan says that he was approached by Garg sometime in July 2014. Another former Congress MLA Hari Shankar Gupta does not confirm if he was asked but says that AAP was desperately looking for Congress support. Asif Mohammad Khan, former Congress MLA says that late in 2014 he had many meetings with Manish Sisodia and Sanjay Singh who asked him to get their word to the Congress high command. However, Khan says that Rahul and Sonia were dead set against any tie-up with AAP.

Sadly, this tape has been almost completely forgotten. After this expose, the AAP suspended Rajesh Garg, the man who simply released the tape- punishment for exposing Kejriwal.

This tape dismantles Kejriwal’s claim of being an anti-corruption crusader once and for all and shows his greed for power. Even with AAP in power in Delhi, he is desperate to become PM and cannot digest his 2014 rout, and has leveled lies against the PM without apologizing (E.g. in Nov 2014 he tweeted a lie that Varanasi had 3 lakh + bogus voters but did not apologize when the administration clarified that this news was false, and how could BJP have anyway done anything in Varanasi when Samajwadi Party was ruling in UP and UPA at the Centre). If AAP was without power in any state, it would collapse within 2 years, unlike the Jana Sangh/ BJP which sat in Opposition for 50 years.

The name of the late Bangaru Laxman has become synonymous with the 2001 Tehelka sting, but this tape of Kejriwal has been totally forgotten. Kejriwal himself has never been grilled about it when he has given interviews.  Kejriwal’s name should become synonymous with this tape of horse-trading which shows his reality- say something & do something else, and desperation to be in power somehow.

The AAP’s desperate defence of this calling it as ‘political realignment’ when the Congress refused to support it will not convince anyone, and anyone will see that it tried to break Congress MLAs away to form the government despite the Congress not agreeing to support. That tape also carries Kejriwal’s statement “I have tried many times” (to get Congress support) after swearing on his children that he will never take the support of BJP or Congress to form a government.

The outrage over Amit Shah’s statement on infiltrators shows how ‘liberals’ simply can’t treat Hindus as victims

India for Indians. How did that become so controversial when discussing NRC?

Recently, BJP President Amit Shah set the proverbial cat among the pigeons by promising that if voted to power, the BJP government would send every illegal immigrant (except Hindus, Sikhs and Buddhists) out of the borders of our country.

Wait, that’s the wrong analogy. This is not about setting the cat among the pigeons. The National Register of Citizens is about the pigeons hoping to keep the cats away from their nest. Otherwise, there will only be cats left and no pigeons. Get it?

Indian ‘liberals’ have jumped in to compare such measures to the Holocaust, to apartheid and what not. Their case is based on both a denial of well established Indian history and Hinduphobia.

The Partition of India happened in 1947. The Partition was based on religion and was done with the explicit purpose of carving out a separate Muslim homeland. Those Muslims who wished to move to this separate homeland did so in 1947. They named the new country ‘Pakistan’ or land of the pure, presumably to distinguish itself from the ‘impure’ Hindus of India. Literally lakhs of Hindus were forcibly expelled from Pakistan to make space for the ‘pure’. Of course, any Indian of any faith was most welcome to stay back here in our secular state.

That was 1947. We Hindus had to take refuge in the only country that would allow us to live.

That’s history and it cannot be changed now. The deal was made. You keep your side and we keep ours.

Some seventy years later, if the lands of the ‘pure’ have not been successful in developing economic opportunities nor upgrading to the twenty-first century, then it is not really our economic burden to bear, is it? We wish them well, we wish to trade peacefully with them. But if they cannot build their nation, it is not our job to pay for them, is it?

We owe them nothing. Zero. We are happy to give them our best wishes, but nothing more.

We are the victims of Partition, not Pakistan or Bangladesh. How can it be our duty to bear the economic burden of our tormentors?

No, there is no comparison here to Nazism or apartheid. Jewish people faced persecution in Europe for centuries. Black people numerous injustices in South Africa. Nazism or apartheid was about reinforcing these injustices and making them even more severe.

The NRC is about making sure that we the victims of Partition get to keep whatever little of India we were still left with post 1947 after the oppressors had grabbed as much as they could.

Asking India to accommodate Muslim illegal immigrants from Bangladesh would be like asking Israel to pay an annual tribute to Germany. Or asking India to pay reparations to Britain. Or asking some African country to pay reparations to its former colonial oppressor in Europe. Or putting an extra tax on African Americans and using the money to pay for building ‘white only’ neighbourhoods in America. It would be the exact opposite of justice.

‘Liberals’ ask why only send Muslim illegal immigrants back? How can the law ‘discriminate’ on the basis of religion?

Well, that’s because the intent is to make reparations for a targeted injustice that was committed only against Hindus (and Sikhs, Jains, Buddhists, etc). Only the victims will get reparations. How could it be otherwise?

You tell me, liberals. Suppose there is a terrible fire in a cinema hall somewhere and a lot of people die because the theatre owner did not take adequate safety measures. Who should get the compensation? The families of the victims or every single Indian citizen irrespective of whether they suffered any losses in the fire? Of course, the compensation is paid only to the families of the victims and nobody else. That’s not discrimination. That’s just common sense.

Today a Hindu, a Buddhist or a Sikh trapped on the wrong side of the border is a victim of Partition done on the basis of religion in 1947. Naturally, we owe any such person our sympathy, protection, a warm welcome and Indian citizenship.

A Muslim who infiltrates across the border from Bangladesh is simply an economic migrant. We should only offer them compassion, best wishes for a pleasant journey back to Bangladesh as well as best wishes for a happy prosperous life in their home country. Beyond that nothing. Certainly nothing in economic terms.

Let me remind you that India still has the world’s second largest population of poor people. This is not the time for charity. The only thing we can fulfil is our obligations. And we have an obligation to protect any Hindu, Sikh or Buddhist victim of Partition, who may be stuck today in Pakistan or Bangladesh.

Here is another reason in the Indian context why ‘liberals’ who object to special treatment for Hindus are acting in obvious bad faith. Because provisions giving explicit privileges to disadvantaged groups is baked into the definition of ‘Right to Equality’ as per the Indian Constitution.

The Indian state is not supposed to discriminate on the basis of gender, caste, religion, etc.  This has *always* been interpreted to mean that the state will make special provisions for addressing specific problems of disadvantaged groups. That is why we have a Minority Affairs Ministry, which gives special scholarships and loans to members of minority religions. Our laws on rape and sexual harassment are clearly not gender neutral. The Women’s Reservation Bill, which enjoys widespread support across the political spectrum, if passed, would literally bar men from representing their local area in Parliament across 1/3rd of the entire country! We already have Parliamentary and Assembly constituencies that are reserved for backward castes and for tribals.  And of course, we have reservations for certain groups in government jobs and government colleges.

These special privileges have *never* been interpreted in Indian law as violations of the Right to Equality under Article 14. In fact, such privileges for disadvantaged groups have always been seen as tools for achieving the goals of equality and justice.

It is only natural, therefore, that when crafting an asylum policy, Indian law would give special privileges to Hindus, who are marginalized and persecuted in the Islamic Republics that around us.

How did this well-established principle in Indian law suddenly become controversial when it came to asylum law? I know why. Because this time it was Hindus as a group who received a benefit. And the Hindu hating Indian liberal cannot tolerate that. It would mean acknowledging the fact that Hindus were the victims of Partition and that Hindus have human rights too. To the liberal who has made a living out of telling the West that Hindus are sinister and evil, with their sarees, rasam, holy cows and Hanuman shirts, this would be a career destroying move.

The protection of Hindus who are persecuted in Pakistan and Bangladesh is a fundamental obligation that the Indian state cannot shy away from. Of course, in doing so, the Indian state should be careful to make sure that the burden does not fall unduly on the states in the North East. What we need is a systematic plan to make sure of the following:

(1) To secure the borders and ensure zero illegal infiltration of economic migrants.

(2) To provide a legal framework for granting asylum and a quick path to Indian citizenship for Hindu, Sikh, Jain and Buddhist refugees from Pakistan or Bangladesh.

(3) To resettle such refugees across the country in such a way that no particular state has to take too much of a burden.

(4) To identify illegal economic migrants by means of NRC and other initiatives and cut them and their children off immediately from all of the following:

(a) Any form of government welfare,

(b) Voting,

(c) Holding bank accounts, gas, electricity, water or phone connections,

(d) Admission in schools, colleges whether public or private

(e) Working whether in government or private sector

(f) Securing government documents and permits such as birth certificates, school certificates, Aadhar cards, PAN cards and drivers licenses.

(5) Eventually, deport all illegal migrants.

Can India get its act together before there is no India left? We’ll see.

No wrong in media publishing Augusta chargesheet: ED tells court

The Enforcement Directorate has informed the Patiala House Court in Delhi that there is nothing wrong in media outlets publishing or broadcasting the contents of the supplementary charge sheet in the AgustaWestland chopper deal case.

The ED has made the submission in response to the allegation made by Christian Michel’s lawyer that the ED is attempting to politicise the case by leaking the contents to the media.

As per reports, the ED has submitted that the charge sheet was a public document submitted in court and there is nothing wrong if someone has accessed it. “It is not that nobody was entitled to get a copy. The cognisance of it has already been taken”, the ED has informed to the court denying the allegation that the agency has leaked the document.

The ED has also sought dismissal of the petition filed by Michel, saying that the media obtaining the contents of the charge sheet has not affected anyone’s rights. Christian Michel’s lawyer had last week requested special judge Arvind Kumar to order an inquiry into the ED ‘leaking’ the charge sheet to the media.

The court has posted the case for further hearing after Michel’s lawyer sought time to respond to the ED’s submission. The court has also directed the court staff to file a report with information regarding the charge sheet, including how many copies were submitted by the agency.

In the charge sheet submitted by the ED on April 4 had several explosive revelations about the case. It had mentioned communications between Michel and the CEO of AgustaWestland and referred to ‘The Italian lady’ whose son was to become the ‘next Prime Minister’ and whose ‘power was growing in the party day by day’.

It has also mentioned the former finance minister Pranab Mukherjee had initially objected to the deal and later was left out of the decision-making process. The charge sheet had also mentioned that Michel had attempted to influence some powerful media persons in his attempt to seal the deal. The charge sheet had named Shekhar Gupta, Manu Pubby. It had mentioned payment of Euros 205860.40 to Ashwin Santhanam, the son of jounalist Raju Santhanam and booking of tickets for Ashwin and his family worth Rs 26 lakhs.

The charge sheet had revealed that Christian Michel and Agusta had access to the ministers in the government of India at the highest level. It had stated that Michel, through several middlemen and on behalf of Agusta, had made payments of kickbacks worth millions of Euros to air force officials, journalists, and top Congress politicians, including AP, which the ED stated that stands for Ahmed Patel, as per Michel’s statement.

Mahesh Bhatt’s wife peddles fake news about Junaid being lynched for being a Muslim, urges people to remember this when they vote

The first phase of polling for the 2019 Lok Sabha Elections have just concluded. With 6 phases to go, several people have come out of the woodworks to campaign for their favourite politicians and political parties. The Left has put all its might to defeat PM Narendra Modi, even if it means spreading fake news. Has-been actress Soni Razdan, wife of Mahesh Bhatt and mother of actress Alia Bhatt took to Twitter today to fear-monger and lie to campaign against PM Modi.

She tweeted a poster that had the face of Junaid Khan. The poster read, “I am Junaid Khan, Muslim boy, age 15. I was killed by a mob on a train for being Muslim. #RememberMeWhenYouVote”.

Peddling the Muslim victimhood card is the favourite ploy of the self-proclaimed “liberals” of India to fear-monger against Narendra Modi. They have long tried to convince people that PM Modi is a divisive figure who is out to get Muslims. Invoking Junaid Khan and claiming that he was lynched for being a Muslim is a part of that narrative.

However, is it true? Was Junaid Khan lynched by a fanatic Hindu mob just because he was a Muslim boy?

The answer is no. No less than the courts of India have held that his death had nothing to do with his religion.

In 2017, an unfortunate crime took place. A young man called Junaid was murdered in a moving train. The unfortunate murder was given an interesting turn by the usual suspects. Many media houses reported how Junaid was killed because of the suspicion that he was ‘carrying beef’. The country’s “liberal” elite had taken to social media and the streets to claim “not in my name” when the beef theory peaked.

However, while the politics of the case peaked and the Muslim victimhood was peddled lock, stock and barrel, on 28th March 2018, the High Court nailed the lies of these elements. The judgement makes it amply clear that the fight started over seats and “caste” slurs. The High Court observation too doesn’t mention beef or religious slurs to be a part of the reason for violence.

The High Court had observed:

Extract of High Court Judgement

The High Court in its judgement observed categorically that, “The incident seems to have taken place over the issue of seat sharing etc. in the train and there is neither any evidence of any preplanning to cause incident deliberately or intentionally or the create disharmony”.

It is essential to note here that nowhere in the FIR as well was the word “beef” mentioned anywhere.

The High Court makes 3 interesting observations in the portion attached above :

  1. The incident seems to have taken place over the issue of seat sharing
  2. There is no evidence of preplanning
  3. There was no intention to create disharmony

This judgement was passed during the bail hearing of one of the accused, Rameshwar Dass.

Despite the facts of the incident being clarified by the Punjab and Haryana High Court in March 2018 itself, the lies surrounding this case and the motivated narrative refuses to die down. The reason for drumming up this incident is extremely simple: Without the Muslim victimhood card, the assorted Leftists and “Liberals” won’t have much to go after Modi for. Since his days as the Chief Minister of Gujarat, the ecosystem has hounded Modi and concocted a story of sectarianism around him. Their hate is so acute, that in the process of demonising Modi, they started demonising Hindus.

Even in the Junaid case, Hindus ended up being branded as communal and violent. Some even went on to ask what was the difference between Islamic terror and ISIS and “Hindu terrorists”. It was all a lie.

At the time this High Court order was pronounced, some other prominent lies were busted in the same week. The concocted bogey of “Hindu Terror” by Congress was shattered when on April 16th 2018, all accused were acquitted of all charges by a special NIA court. The saffron terror bogey was demolished. Interestingly, Soni Razdan who is peddling lies today is the wife of Mahesh Bhatt who was present at the launch of a book called “26/11 RSS Ki Saazish”.

There was another lie that had gathered steam at the time that Hindus had filled balloons with their semen and were throwing it at girls. This ridiculous lie was busted when the forensic reports confirmed that the balloons were not filled with semen but perhaps only with shameless Hinduphobia. The latter is my deduction, I must confess.

So, when Soni Razdan says Junaid should be remembered while voting, she is not wrong. Every single citizen of this country should remember how a murder over seats was turned into one over beef and how Hindus were demonised over a lie.
