Sharad Yadav loyalist Ramai Ram demands ‘Harijanistan’, separate country for Dalits

Ramai Ram, the expelled JDU leader and former minister in Bihar has said that Dalits can no longer live as second class citizens and therefore demanded a separate country named Harijanistan. Ramai Ram has been a known loyalist of Sharad Yadav.

“Constitutional rights of Dalits are being snatched and their dignity and honour hurt. Dalits cannot live in the country as a second-class citizen. We will demand Harijanistan,” News agency IANS quoted Ramai Ram as saying.

In addition to this, Ramai Ram demanded that the Dalits killed during the April 2 protests be declared as martyrs. He claimed that Ambedkar had also demanded a separate country for Dalits but had dropped it after assurances regarding special rights for Dalits. The former JDU leader reportedly said, “but then top leaders of the country provided special rights to Dalits in place of Harijanistan. Now special rights for Dalits in the constitution are under threat and Dalits are being discriminated everywhere. It will not work anymore.”

Ramai Ram’s comment comes in the wake of Supreme Court verdict which brought in safeguards under the SC/ST prevention of atrocities act and the widespread violence during protests against the verdict of the apex court.

SC stands by its judgement on SC/ST Act, says the rights of the innocent must be protected too

0

The Supreme Court of India has stated that its order on March 20, which provided safeguards against the misuse of the stringent SC/ST (prevention of atrocities) Act, is only meant to protect the innocent and prevent arbitrary arrests of innocents.

Pronouncing verdict in the case of Dr Subhash Kashinath Mahajan versus the State of Maharashtra & others, the Supreme Court had ruled that additional safeguards must be provided to civil servants before arresting them under the SC/ST (prevention of atrocities) Act. The Court has stated that the approval of an appointing authority or an S.S.P is required before arresting a public servant accused under the act.

The Supreme Court, in its order, has also mentioned that to avoid false implications, a preliminary enquiry by the DSP must be conducted to find out whether the charges are correct.

The central government had filed a review petition before the apex court for this ruling. According to reports, the Supreme Court, while on an urgent hearing on a plea by the central government for an interim stay on the order, refused to agree to the request.

The bench of Justices Adarsh Kumar Goel and Uday Umesh Lalit stated  “The judgment is not in conflict with the SC/ST Act. It does not dilute the law in any way. We only flagged one issue – can the liberty of an innocent be taken away without application of mind? We only said protect an innocent from being falsely implicated under the Act, which has stringent provisions. People agitating may not have read the judgment. They may have been misled,”

The bench also added that there should be no denial of the relief and compensation to people belonging to the SCs and STs and their rights. But an innocent person’s rights must also be protected.

Going further, the bench added that the March 20 judgement applies only to the complaints registered under the SC/ST Act and if any offences committed under the act also violates laws under the Indian Penal Code, then there is no ban on immediate registration of an FIR.

Justice Goel, who authored the verdict, said that the verdict is a ‘balance’ between the rights of a Dalit and the rights of an innocent person. Addressing to the Attorney General K K Venugopal, Justice Goel added that the preliminary inquiry which is mandated in the Supreme Court verdict before an arrest is not meant to delay the grant of compensation mandated under the SC/ST Act. Justice Goel added that grant of money from the public exchequer should be preceded by verification against false claims and this ‘preliminary enquiry’ serves that purpose.

According to reports, at one point Justice Goel even questioned KK Venugopal that how would the Attorney General function if he is accused falsely by a person under the SC/ST Act.

The bench had agreed to list the case for further hearing after all the parties involved have filed written submissions before the court.

Widespread violence had erupted across several states after Dalit groups called for a Bharat Bandh on April 2nd in protest of the Supreme Court order. The bench termed the protests as ‘ill-informed’ and ‘misled’. The Justices stated that the people agitating might not have read the judgement in detail.

TMC accused of using violence to stop candidates from filing nomination papers for Panchayat polls

The BJP on Tuesday accused the ruling TMC in West Bengal of using violence in order to prevent its candidates from filing nominations for the upcoming Panchayat polls in the state. These polls will be held in three phases across 20 districts of the state, with the dates being 1st, 3rd and 5th May.

BJP Bengal’s secretary Ritesh Tiwari took to Twitter to allege that BJP’s South Murshidabad District President Gowrishankar Ghosh, and 50 other party workers were brutally injured in an attack by the TMC while filing nominations for the Murshidabad Jiyaganj block.

BJP’s National General Joint Secretary Shivprakash too accused the TMC of assaulting BJP workers and not providing the nomination forms:

Ghosh as per reports was assaulted using sticks and was chased by TMC goons till the railway station, after which he somehow managed to escape. He alleged that the police were mute spectators while the attack was taking place.

As per reports, violence was reported from districts like Birbhum, Murshidabad, Hooghly and Bankura on Tuesday. BJP district general secretary Kalosona Mondal alleged that he was attacked with a knife by TMC workers when he and other party workers were coming out of DM’s office after submitting a deputation against the ruling party.

BJP leader Surajit Ghosh alleged that they were attacked in presence of the police and questioned as to how could TMC workers bring sharp weapons in a government building.

Incidentally, the Congress too has accused the TMC of not letting opposition candidates file their nomination papers. As per West Bengal Pradesh Congress Committee President Adhir Ranjan Chowdhury, the dates of the rural polls were announced suddenly, so that opposition parties could not file their nominations. Chowdhury has also alleged that the election has been reduced to a farce.

Another senior Congress leader of Bengal claimed that they won’t be able to field candidates in all the seats for polls, both in the Gram Panchayat and Zila Panchayat elections.

Punjab Police busts Pakistan plan to highlight pro-Khalistan campaign

Punjab Police on Monday arrested four people for allegedly trying to publicise pro-Khalistan campaign ‘Referendum 2020’ supported by Pakistan’s Inter-Services Intelligence (ISI), by setting buses and liquor shops on fire. Plans were also in place to stick posters in Mohali stadium in Punjab during the upcoming IPL games.

According to police, the men said that they wanted to light a fire in petrol pumps and other places to spread violence. The police said that the men came in touch with Pakistan-based ISI agent through a Malaysia based woman identified as Deep Kaur who lured them with lucrative job offers and convinced them to indulge in unlawful activities. They claim Kaur first lured them through social media and then through her network in Punjab arranged for Rs. 70,000 for them. They bought a bike from this money.

‘Referendum 2020’ is a campaign launched by radical Khalistani separatists group ‘Sikhs for Justice’ (SFJ) where the SFJ will hold an unofficial referendum in 2020 and if required, would take the UN’s intervention to help community conduct a referendum for a separate Sikh state. The referendum asks Sikhs across the world to build a consensus in favour of a separate state, Khalistan from “India occupied Punjab”. The referendum also asks Sikhs to reject article 25(b)(2) of Constitution that says Sikhs are a part of Hindu religion.

Last year in July, too, the Sikh Referendum posters appeared in several parts of Punjab and a sedition case was filed against five persons.

CAG finds untracked funds amounting to Rs. 7,270 crore in Delhi government, points out corruption

The CAG report tabled by Delhi’s deputy chief minister Manish Sisodia in the Assembly pointed out corruption in Delhi. The report included untracked funds of Rs. 7,270 crore and instances where ration shop owners allegedly cornered subsidised grains meant for the poor. The Delhi government has now sought a CBI probe in at least 50 instances where public funds are allegedly swindled off.

According to the CAG report, the Delhi government is sitting on Swachh Bharat funds amounting to Rs. 40 crore and no toilets are built in last two and a half years. There are about 3.5 lakh households in Delhi of which about 10.5% households do not have any toilet facility. The CAG report says that not a single toilet has been built by Delhi government since the inception of Swachh Bharat mission on 2nd October, 2014.

The report also points out the lax attitude of Rural Develpoment department of Delhi government regarding land lease allotment to the Municipal Corporation of Delhi resulted in non-recovery of around 67 crore. The compliance audit further mentioned that 88 units of the department of trade and taxes, state excise, transport and revenue conducted during the year 2016-17 revealed under-assessment, short levy, loss of revenue and other irregularities involving Rs 416 crore in 650 cases.

Over and above the financial irregularities, the CAG report also highlighted cases of administrative oversight and inaction that resulted in delayed projects and inefficient operations. As per the report, the government till 31st March last year failed to collect 3,105 utilisation certificates for Rs 7,269.69 crore released in grants, of which about 46% (Rs. 4,939 crore) were outstanding for two to 10 years. The report also said that 792 ration shop licence holders were enjoying the subsidised foodgrains that could otherwise have been given to the poor. Delhi’s quota of ration card holders has been full and no new beneficiaries are being added.

Meanwhile, Delhi chief minister Arvind Kejriwal has blamed the LG for stalling the doorstep delivery of subsidised foodgrains scheme which could have help Delhi government fight the ‘ration mafia’. However, the government has sought CBI probe and promised strict action if anyone, including minister, is found guilty.

PCI chairman issues a statement : Fake news a global menace, nothing wrong if govt wants to take remedial steps

The issue of fake news has been a matter of intense debate. The arrest of Postcard news founder which was celebrated by some journalists and parties had opened a pandora’s box. The guidelines which were issued by the ministry of information and broadcasting yesterday were withdrawn today.

In the light of these developments, the chairman of PCI (press council of India), Justice Chandramauli Kumar Prasad has issued a statement/response to the fake news. He has said that there is nothing wrong in government taking initiatives to curb fake news provided that the authority to examine complaints and punish is given to an independent body like PCI.

He has defined fake news as ‘ news, story, information, data and reports which is or are wholly or partly false’.

Chairman of Press Council of India on fake news

The PCI chairman has also highlighted that complaint of fake news can file by an individual, government or any aggrieved person. The complaint would be dealt as per the procedure laid down in Press Council Act and Press Council (Procedure of Inquiry) regulations as per the chairman. ‘However, it is only in gross cases of fake news or repeated involvement in fake news dissemination that power to suspend or cancellation of the journalists be resorted to’, says the chairman’s statement.

Rahul Gandhi rides The Wire’s fake news clown car all the way to a self goal

Rahul Gandhi just shared The Wire’s comprehensively debunked hit job on Piyush Goyal with some caustic comments without realising his self-goal perhaps. He is no stranger to self-goals. In fact, not so long ago he had done exactly the same when we at OpIndia has preemptively busted an imminent hitjob against the Finance Minister, Arun Jaitley. After our article, ‘The Wire’ had conceded that “there was not much of a story to pursue after all“, which is why they had dropped the story after receiving a response from Jaitley and his daughter’s firm. Mr Rahul Gandhi had then proceeded to plug the very article where ‘The Wire’ had admitted to no impropriety on the part of Arun Jaitley, in a bid to tarnish his image. We had then also speculated whether Rahul Gandhi actually knew of the imminent hitjob.

Of course, at that point in time, it was just a statement in jest. But the incident seems to have come a full circle. Today, ‘The Wire’ published a half-baked, shoddy hitjob against Piyush Goyal which we debunked comprehensively. But being the master of self-goals, Rahul Gandhi couldn’t resist himself, perhaps, and tweeted the article with his usual gibberish.

So to begin with, Rahul Gandhi mentioned the Jay Shah episode, which was debunked and The Wire faces a 100 crores defamation lawsuit for it. He mentioned Shaurya Doval article by The Wire which was again debunked by us. And then, he mentions the Nirav Modi scam which landed squarely on the Congress’, specifically, P Chidambaram’s doorstep.

He then proceeds to talk about the latest hit job in an attempt to tarnish the image of Piyush Goyal, who is not only an all-India second rank holder Chartered Accountant and second rank holder in Law in Mumbai University, participated in Leadership Programs at Yale University, Oxford University and Princeton University but has also been tackling the mess left behind by the Congress government in the power and railways sector.

There are certain allegations that the article makes which we must analyse to understand how Rahul Gandhi has made a self-goal.

Conflict of interest in SBI board membership and Directorship of Shirdi Industries

I start with this allegation because the lack of due diligence is so apparent in this charge, that it needs to be pointed out at the very onset. Piyush Goyal retired from the membership of the SBI Board on 25th February 2008. He accepted the Directorship of Shirdi Industry on 15th April 2008. There is almost a 2-month gap between the two dates. I wonder how Rohini Singh assumed or insinuated conflict of interest and how in the world did Rahul Gandhi further such preposterous lies.

In fact, if one takes a closer look at the financials of Shirdi Industry, one would realise there was no outstanding SBI loan in the books of Shirdi Enterprise when Piyush Goyal became the Director in 2008. How then is an insinuation of conflict of interest made? Or did Rahul Gandhi not read the article at all?

Why would Piyush Goyal be the Director of the company with 650 crores loan default

Now here is where the real self-goal surfaces. Piyush Goyal was the Director of the company from 2008 to 2010 (when he resigned post being elected to the Rajya Sabha).

Shirdi Industry was a profit-making company. In 2007-08, they made a profit after tax of Rs. 7.52 crores, followed by profit after tax of Rs 17.28 crores and Rs. 26 crores in 2008-09 and 2009-10 respectively. In fact, even after Piyush Goyal resigned in 2010, the company continued to make a profit of Rs. 33.15 crores in 2010-11. Hence, there is no conceivable reason why someone with the business background of Piyush Goyal wouldn’t want to be involved with the enterprise, that too when he was only a non-executive chairman which is not involved in the management of the company as a promoter.

So when did the trouble begin for Shirdi Industry, if throughout, the enterprise was profit-making?

The BusinessLine article plugged by The Wire itself states:

The company, which manufactures decorative laminates and MDF (medium density fibre) boards, was doing well till 2010 and filed for IPO to raise ₹120 crore for expansion. With clearance for IPO delayed by over 27 months, the company borrowed from a consortium of eight banks and dipped into reserve for funding expansion.

The thing to remember here is that Piyush Goyal resigned in 2010. After that, there was a delay of 27 months for clearance for IPO. Having not received the requisite funds on time through IPO, as Shirdi Enterprise had planned, they dipped into reserves and borrowed money from banks.

Throughout the 27 months of delay, it was the Congress which was in power. The policy paralysis, market gloom, stock exchange dips etc resulted in such a delay. Now, what Rohini Singh and The Wire wants to do, is hold Piyush Goyal retrospectively responsible for the Congress’ mess that drove a profitable company into running a debt, when Piyush Goyal wasn’t even associated with the said firm.

Insinuating that Shirdi Industry is a crooked organisation that wilfully defaulted on repayment of loans

It is The Wire’s intention to insinuate that Shirdi Industry is a shady firm that wilfully defaulted on repayment of loans. Perhaps Rohini Singh forgot to read the NCLT order in full and I can jog her memory.

The NCLT, which is a quasi-judicial and independent body with no government interference, appointed another independent body to conduct a forensic audit of the firm. The independent auditor said that there was no wrongdoing by the firm and that the debt was incurred in the natural course of business. In fact, the Resolution Plan that was submitted was approved by 99.43% of the creditors. Which is to say, 99.43% of the people/institutions that were owed money agreed to the repayment plan that was suggested.

Earlier with the SARFAESI Act, the entire company went into liquidation to pay off the creditors thereby resulting in job losses. The NCLT gives the opportunity to mutually decide on a valuation and pay the creditors over a period of time that is decided by the creditors. With this, the creditors recover their money, and the business also doesn’t cease to exist, saving jobs, promoting economic activity and in this case savings foreign exchange since these products were an import substitute.

Again, the article plugged by The Wire itself has this to say :

It is clear that there was a repayment and revival plan in place, sanctioned by the NCLT, an independent body and agreed upon by the creditors and the business entity. Let us reiterate here, that this is happening 8 years AFTER Piyush Goyal has resigned from the company in 2010.

This actually goes to show the effectiveness of the new insolvency and bankruptcy code that was introduced by the Modi Government.

Why were the promoters the only bidders even after an ordinance in place that forbids promoters from bidding for the company

This insinuation is actually hilarious. The ordinance introduced by the Modi Government that forbade promoters from bidding for their own company was introduced on 23rd November 2017. The NCLT admitted Shirdi Industry’s case in May 2017. Months before the ordinance came into play. And since the Ordinance was not applicable retrospectively, it didn’t change the course of NCLT order with respect to Shirdi Industry. In any case, as per NCLT order, Committee of Creditors approved the resolution plan on 25th October 2017. Which is to say, that before this ordinance was promulgated, the bid of the promoters was accepted by the NCLT.

In fact, an excerpt from the NCLT order mentions that advertisement was issued inviting expression of interesting seeking investment for which there was no response, owing to which, the NCLT allowed the promoters to bid.

If the ordinance came much after NCLT admitted the firm’s case and the promoters were allowed to bid before the ordinance barring promoters to bid and also because nobody else came forward, how Rohini Singh came to the conclusion of “special favours” is a mystery.

Perhaps Rohini Singh was upset about the streamlining of the Financial Sector that the Modi government has undertaken. From introducing the Insolvency code that enables creditors to get back their loan/ debt after years of failure of Bankers to recover their dues either through BIFR or SARFESI or ever CDR etc. and resulting in massive job loss and financial distress. But showing firm resolve the Modi government has introduced Insolvency and Banking Code and the NCLT process to clean up the stress in the Banking system caused due to indiscriminate lending particularly during 2008-14 under the Congress government.

Perhaps Rohini Singh can’t read dates right, which is why she didn’t realise that none of the gibberish she wrote happened while Piyush Goyal was still the director of the firm. Perhaps she also didn’t realise that the company she accuses of defaulting loans ran up massive debts during the Congress government for which Rahul Gandhi should be answerable.

Rahul Gandhi, by plugging that article, basically admitted to the effects of rampant policy paralysis during Congress regime that drove the business’ to the edge of bankruptcy.

Perhaps Rahul Gandhi trusts The Wire so much, that he is willing to plug gibberish without even reading the article, thereby making a fool of himself. Perhaps Rahul Gandhi is so used to embarrassing himself, that another embarrassment wouldn’t matter as long as the narrative goes in his favour, even if the narrative is based on falsehoods.

Perhaps it’s time Mr Rahul Gandhi gets himself ‘Re Wired’ because the current situation is doing him no favours. Cambridge Analytica anyone?

Congress leader tweets a sexist and misogynist tweet on Smriti Irani after fake news circular is withdrawn

Yesterday, the Information and Broadcasting Ministry issued directives to curb the fake news menace, which led to a major public meltdown of the celebrity journalists of India, who are otherwise vocally against fake news. However, in less than 24 hours, the directive was withdrawn by the ministry as the Prime Minister’s office directed that such decisions should be taken by bodies such as Press Council of India.

Amidst all this, Maharashtra Congress President, Sanjay Nirupam tweeted an extremely misogynist and condescending tweet referring to Smriti Irani as ‘Bahurani’ (daughter in law), which seems like a reference to very popular serial starring Irani, ‘Kyunki Saas Bhi Kabhi Bahu Thi.

Nirupam got called out by Twitterati for his sexist remark against Irani.

Usual Congress cheerleaders also called him out on his choice of words.

He even got reminded of the virtues of civility.

UP police files case of forgery against SP leader Azam Khan and his son, find out why

Senior Samajwadi Party leader Azam Khan and his son Abdulla Azam have landed in trouble after the Uttar Pradesh police has filed a case of forgery against them. As per reports, the police filed a case against the father son duo following the directive by a Rampur court.

The case pertains to Abdulla Azam allegedly submitting a fake affidavit during the 2017 UP Assembly Elections, in order to conceal his true age. The election was won by Abdulla from the Swaar Tanda seat in state’s Rampur.

Soon after the election, former BSP minister Kazim Ali Khan who is also known as Naved Mia, filed a case against Azam Khan and Abdullah, alleging their attempt to submit fake documents to prove that Abdulla was aged above 25 years. 25 is the minimum age required to contest either assembly or Lok Sabha elections. Abdulla’s father Azam Khan was dragged into this matter by the BSP leader by alleging that the latter too was involved in this matter.

The BSP leader to solidify his case, submitted Abdulla’s class 12 marksheet which supposedly showed his age to be a mere 24 years and five months, at the time of nomination paper’s filing.

Incidentally local reports had claimed that the controversy over Abdulla’s nomination papers had erupted even before the elections were conducted. But back then Abdulla had submitted a birth certificate from a Lucknow hospital which showed his age to be more than 25 years. Following this the Election Commission official had dismissed the case against him.

BJP leader Akash Saxena too got into the fray later and filed a similar complaint with the Election Commission in this regard. Here it was alleged that Abdulla had in his possession two different PAN cards, one for his bank accounts and one for his election affidavit.

While the inquiry was underway, reports claim that inquiry revealed that the charges against the father-son duo were found true which resulted in the court directing the police to file a case.

As a result of this matter, Abdulla risks losing his status as a MLA and they both may face action under section 420 and 120-B of the IPC which pertain to cheating and criminal conspiracy respectively.

Social Media abuzz with speculation of same person being Rajput Karni Sena activist and Dalit protester

Yesterday parts of Northern India were seeped in violence in lieu of Dalit protests against the recent Supreme Court order which sought to curb the possible misuse of Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act. This protest has resulted in at least nine deaths and saw protesters resorting to measures like firing gunshots, pelting stones and large scale arson.

While the protest was on full flow, social media became rife with speculation about the protests being a fixed match, with a picture claiming that the same person being part of both anti-Padmavaat protests by the Karni Sena and the current Dalit protests:

With both the aforementioned protests being across caste lines, it was assumed that Rajputs were part of the Karni Sena protests and Dalits were part of this pro SC/ST act protests. But the possibility of there being a common protester, gives rise to the possibility of “mercenaries” being brought in to fuel the said destabilising protests, which might also raise questions about the whole affair being politically motivated.

This angle was wholeheartedly taken up by various Twitter users:

A BJP MLA from Gujarat alleged that the protester was a plant by the Congress party:

Apart from Kanchan Gupta, another journalist too picked up this story and demanded that it be investigated:

Prima Facie the two facial identities do appear to be strikingly similar, but only a thorough forensic investigation would reveal the truth. If indeed future investigations reveal that the youths in question are the same person, then it might open up the possibility of the protests being being a political conspiracy, if indeed there is one.
