Bhavnagar has registered its first case of the Disturbed Area Act, with the police registering a complaint regarding the sale of a house without the permission of the government. This is also the second such case of the Disturbed Area Act in Gujarat, after Ahmedabad.
The case deals with a property situated in the Crescent area of Bhavnagar, which comes under the Disturbed Area zone. As per this law, any transfer of property in the notified area has to be done after taking prior written permission from the Collector or SDM. Despite this legislation, the property has been sold, and possession has been handed over without taking permission.
According to the officials, the property, which is situated in Ward No. 5, Sheet No. 135, City Survey No. 4463, Plot No. 567-A/1, was sold by Darsraj Singh Dharmendra Singh Gohil to Allahrakhbhai Kadarbhai Gigani.
The sale agreement was signed on August 26, 2025, for ₹93 lakh, and the full payment was made. The possession of the house was also handed over to the buyer.
Later, the seller applied for permission on September 11, 2025. After due verification and hearing, the permission was rejected on February 17, 2026. By that time, the transaction had already been completed, leading to a violation of Sections 4 and 5 of the Act.
Police action and investigation
The crime came to light during a document inspection by City Mamlatdar K.B. Chandlia, who then filed a complaint at Ghogha Road police station. The Police have registered a case against both the seller and the buyer, as well as against the other parties involved in the deal.
Bhavnagar City DYSP R.R. Singhal has confirmed that the property was sold and transferred illegally, even though the law was in effect in this area.
The police are also investigating the financial dealings of ₹93 lakh, which were part of this deal. The parties involved in this crime have been called in for questioning, and the local crime branch is investigating the case.
