The Telangana High Court ruled that a Muslim woman can end her marriage through khula without needing her husband's consent or a certificate from any religious authority, making it a legally valid and self-executing form of divorce.

"...offence was committed in such a way that the private part of the victim was torn and after committing the offence, the victim was thrown in the solitary place treating her that she had died,” the judges said.

The High Court stated that the present case does not involve a question of religious freedom but of obeying the lawful command of a superior.

The victim is a student at a popular university in Noida. The incident occurred in September 2024 where the victim had gone with her friends to a bar. At around 3 am, the victim was in an intoxicated state and upon insistence by the accused, she had agreed to go with him to his flat to rest.

The observation came as several hospitals from Punjab sought the release of funds from the state government under the Ayushman Bharat Yojana. It was noted that the state released Rs 26 crore to the tune of notwithstanding bills amounting to Rs 500 crore.

However, the Court has granted Tahir Hussain custody parole to allow him to file his nomination papers and participate in campaigning for the upcoming Assembly elections. Hussain, who is contesting from the Mustafabad constituency, has been fielded by the All India Majlis-e-Ittehadul Muslimeen (AIMIM), led by Asaduddin Owaisi.

Justice Moksha Khajuria Kazmi and Justice Rahul Bharti observed that the Bar Council of India (BCI) rules regarding the dress code for advocates restrict such attire and emphasised the significance of maintaining decorum and professional identification in courtrooms.
