SC appoints Nilekani to prepare Computer Network and AI based solution for medical college inspection

0

Supreme Court of India has appointed Nandan Nilekani for examining the possibility of deploying a computer technology including artificial intelligence based solution for inspection of medical colleges by Medical Council of India (MCI).

The court was hearing a petition has been filed before the apex court by a private medical college which has been denied to admit fresh students in MBBS course for the academic year 2017-18 by the central government. The contention of petitioner Azhar Medical College and Super Specialty Hospital is that they had no deficiencies or even if there are some deficiencies they are negligible.

Last year the court had noted that in fact most of the deficiencies of those colleges which are barred admission by the government are marginal and colleges were largely following the regulations. However, the court has expressed its displeasure over the fact that every year such litigations are filed in the court which results in high pressure and anxiety for students, colleges and everyone else concerned. Court had said that it is high time that some mechanism is evolved which does not cause such litigation. Court had noted that medical colleges contest almost every fact that is recorded in inspections by MCI, and there should be a way to eliminate this.

Advocate for petitioner Kapil Sibal suggested the court that “a computer network based technological solution which might include artificial intelligence” could be used for inspection of the medical colleges by MCI. For this purpose, Sibal requested that the court may appoint an expert in the field like Nandan Nilekani. Kapil Sibal has been appointed Amicus Curiae in the case by the court.

The bench of Justices S. A. Bobde and L Nageswara Rao accepted the suggestion of Sibal and requested Nilekani to study the problem and come up with concrete suggestions at the earliest. The court ordered that MCI will convene a meeting with Nandan Nilekani, Kapil Sibal, and any other interested counsel within 15 days, which is to be chaired by Sibal. Nilekani is expected to prepare an IT-based solution for inspection of medical colleges, which may involve the use of artificial intelligence also.

Court asked MCI’s counsel Gaurav Sharma to prepare a detail note for Nilekani detailing the issues that are needed to be taken up to come up with a technological solution. The order states that Nilekani is free to take any technical assistance from various IT companies like Wipro, Infosys, Accenture, etc. for preparing the suggestions.

In 2012 under the Congress government, Dassault preferred RIL over HAL

Former French President Hollande’s alleged revelation regarding the Modi government suggesting Reliance’s name for partnering in the Rafale deal has initiated yet another round of political slugfest. After the revelations by a French journalist, Rahul Gandhi latched on to the news and tweeted that the PM personally negotiated and change the Rafale deal behind closed doors. He alleged that PM Modi delivered a deal worth billions of dollars to a bankrupt Anil Ambani.

Essentially, Rahul Gandhi, piggybacking on Hollande’s alleged assertions, said that the PM had indulged in crony capitalism by mediating and awarding the deal to Reliance.

However, the truth might be different. In 2012 under the Congress-led UPA government, Reliance Industries and France’s Dassault Aviation had signed a pact for partnering in the defence and homeland security sector. Mukesh Ambani’s RIL had formed a new company named Reliance Aerospace Technologies Ltd (RATL) for this purpose. This was during the first round of bidding for 126 Medium Multi-Role Combat Aircraft (MMRCA) that India was seeking to buy, which was eventually cancelled.

The MOU was inked 2 weeks after Dassault’s Rafale emerged as the preferred bidder in a $15 billion contest to supply 126 multi-role fighter planes to India under the Congress regime. It was a necessity as a mandatory offset clause was prescribed by the Indian government.

In 2013, news emerged that France’s Dassault Aviation and Reliance Industries are planning to set up a facility to produce wings of Rafale combat aircraft selected by IAF for meeting its requirement of 126 fighter planes. It was reported that a Rs. 1,000-crore facility for producing the wings of the Rafale combat aircraft is most likely to come up in Bangalore.

It was reported that under the agreement, Dassault would help Reliance set up a facility that was similar to Dassault’s facility in France.

The clincher, however, is that the media reported in 2013 that the Defence Ministry and other agencies concerned have given a go-ahead to the two companies for creating the unit.

A 2013 report in NDTV quotes:

Dassault wanted Reliance to be the main partner in the production of the aircraft in India but the government made it clear that it was not possible as the tender for the procurement clearly stated that aerospace PSU Hindustan Aeronautics Limited (HAL) would be the lead integrator for the project.

The differences over the issue have been resolved and Dassault and HAL have started readying their teams for implementing the project after it is signed.

Although Dassault agreed that HAL will build the planes in India, they kept a significant condition for that. As per the agreement, Dassault was to supply 18 fighters from their plants in France and rest 108 planes were to be manufactured by HAL. And Dassault flatly refused to take any responsibility for the planes made by HAL. Dassault had serious reservations about the ability of HAL to accommodate the complex manufacturing and technology transfers of the aircraft. Dassault wanted that two separate contracts should be signed for the two batches of fighters, but the Indian government said at that stage the terms of the contract can’t be altered. It also wanted Dassault to take 100% responsibility of planes made by HAL. Both sides didn’t budge from its position and the deal remained stalled till the end of UPA government.

During this period, the agreement between Dassault and Reliance was allowed to lapse as there was no clarity about the future of the deal. With this, RATL decided not to go ahead with defence business. The NDA government officially withdrew the MMRCA tender in July 2015.

The original MMRCA deal didn’t go through even after finalisation of the deal because Dassault had such low confidence on HAL that they prefered to lose a multi-billion deal instead of depending on HAL. They were insisting on the RIL group company to be their partner.

Mayawati snubs Congress for Ajit Jogi, Mahagathbandhan dream over for the opposition?

0

The Congress party has suffered a critical blow ahead of the upcoming assembly elections in Chhattisgarh, Madhya Pradesh and Rajasthan. BSP supremo Mayawati has announced a coalition with ex-Chief Minister of Chhatisgarh and Congress rebel Ajit Jogi for the elections in Chhattisgarh.

Prospects for the party look bleak for the 2019 General elections as well now as the Mahagathbandhan appears to be crumbling. Mayawati’s inclusion in the grand alliance was essential to combat the BJP in Uttar Pradesh. Without BSP in the fold, it could very well turn out to be a sweep in Uttar Pradesh next year.

Meanwhile, the Congress party sees BJP hands behind Mayawati’s decision. State Congress chief Bhupesh Baghel said, “Pressure from the Central Bureau of Investigation and the Enforcement Directorate on the BSP has led to the creation of this alliance. This alliance had been formed with the BJP’s support and the people of the state had an understanding of it.” He went on to say that the alliance was formed with the BJP’s support.

The BJP is visibly pleased with the formation of the alliance. “Hopes of the Congress were dashed as it had been trying for an alliance with the BSP. The political scenario emerging after the alliance between the BSP and the JCC reflects that the state will see a triangular fight in the coming election,” state BJP president Dharamlal Kaushik said.

It could very well be that Mayawati is bargaining hard for a greater share of seats in the 2019 Lok Sabha elections. And if a respectable number of seats are offered to her, she may yet ally with the Congress-led Mahagathbandhan in the all-important elections. It is important to note that Mayawati had made it clear that an alliance for the General elections will be considered only if a seat-sharing arrangement is reached for the elections in the three states that go to polls this year. Clearly, the Congress will now be grasping at straws to bring Mayawati into its fold.

As an immediate effect, Chhattisgarh appears to be a lost cause for the Congress party. In Madhya Pradesh, which was always going to be difficult, reports suggest that the Congress is suffering from infighting in its ranks as a consequence of which it could suffer. Rajasthan appears to be much easier ground for Rajasthan as it has some popular leaders on the ground and reports suggest that BJP is suffering from anti-incumbency due to Vasundhara Raje’s unpopularity.

The Congress party understands very well that it will be clobbered by the BJP in 2019 if the Mahagathbandhan fails to materialize. Its supposed allies aren’t comfortable with Rahul Gandhi as the Prime Ministerial candidate for the grand alliance and its problems are exacerbated by the fact that there are multiple contradictions within the alliance itself.

The BJP, however, will know better than take it for certain that Mayawati will not be a part of the Mahagathbandhan in 2019. The Congress is still a cunning opposition and while Rahul Gandhi may be a little deficient on political acumen, Sonia Gandhi is not. Therefore, the Congress might yet succeed in coming up with offers that Mayawati cannot refuse. Only time will tell what 2019 holds for us but the BJP can surely breathe a sigh of relief after Mayawati snubbed the Congress for Ajit Jogi.

India cancels talks with Pakistan after murder of policemen in Shopian

0

The proposed talks between India MEA Sushma Swaraj and Pakistan foreign minister at the sidelines of the upcoming UNGA meeting in the United States is reportedly called off at the wake of today’s dastardly kidnapping and killing of three policemen in Jammu and Kashmir’s Shopian.

According to reports, an informal meeting of the SAARC foreign ministers was supposed to take place n New York at the sidelines of the UNGA meeting. It was confirmed yesterday that Indian MEA Sushma Swaraj will meet her Pakistani counterpart, Shah Mehmood Qureshi.

However, in a cowardly attack, terrorists in Shopian, Jammu and Kashmir had abducted and killed three police officers earlier today. Earlier this week, Hizbul Mujahideen terrorists had put videos warning police officers to resign from their jobs or prepare to be killed.

MEA spokesperson Raveesh Kumar has confirmed to media that at the wake of 2 major incidents, the abduction and killing of policemen and the release of 20 postage stamps by Pakistan that glorifying terrorists in Kashmir, India has decided to go forward with the scheduled meeting between the two foreign ministers. He added that the evil agenda of Pakistan has been exposed and behind the claims of peace, the true face of the newly elected prime minister has been revealed.

It is notable here that India had suspended all diplomatic dialogues with Pakistan after the Uri attacks in 2016. On September 14, Pakistan’s new PM Imran Khan had proposed the MEA level meeting at New York which India had accepted on Thursday.

Delhi bans Vat 69 and Smirnoff for two years

Popular liquor brands VAT 69 and Smirnoff will not be available in Delhi for two years, as the Delhi government’s financial commissioner has blacklisted the manufacturer United Spirits Limited (USL). It has been reported that the company had violated the Excise rules of Delhi as they used unauthorised and loose barcodes.

“I am of the view that the appellant violated provisions of the Delhi Excise Act, 2009, Delhi Excise Rules, 2010, the terms and conditions of the licence issued to it and the standard operating procedure framed by the Delhi Excise Department and that consequently the department has rightly imposed the penalty of blacklisting under Rule 70 of the Delhi Excise Rules, 2010 upon United Spirits LTD (USL), Aurangabad,” the financial commissioner said in his order.

USL is subsidiary of British multinational alcoholic beverages company Diageo, which makes the Scotch blended whisky Vat 69 and Smirnoff vodka.

To ensure safety and tax compliance, the Delhi government had directed all alcohol sellers to sell liquor through scanning only. And this requires that proper bar codes are affixed on the packages of the products.

Originally the ban was imposed for three years in May 2017, but USL had challenged the order in the court of Delhi financial commissioner. The court upheld the ban and said that the ban will continue for the remaining two years. The commissioner has said that it has been established that unauthorised barcodes were used and also the existence of loose barcodes has been established. The order also said that loose barcodes can be easily misused and that can cause danger to public health.

Delhi: ‘Chinese spy’ held for running for spy racket, Indian Passport and Aadhaar Card seized

A Chinese national has been arrested by Delhi Police’s special cell for allegedly running a spy ring. The 39-year old arrested man is identified as Charlie Peng from Majnu Ka Tilla in Delhi, who was arrested on September 13.

The top-secret intelligence operation was conducted against the Chinese National, as there were doubts that the arrested individual was running an ‘espionage network’. The police have recovered Indian Passport and also an Aadhaar card from him.

Reportedly, apart from the documents, the Delhi Police have recovered a Fortuner SUV, Rs 3.5 lakh in Indian currency and 2000 USD and over RS. 22000 in Thai currency belonging to him. According to the Special Cell of the Delhi Police, they have recovered several incriminating pieces of evidence from a house in Gurgaon, where he has also had an office and was also running a foreign currency business.

The Delhi Police produced Peng before the court of chief metropolitan magistrate Deepak Sehrawat on Thursday and obtained the custody of till Monday. The police said that Peng is involved in ‘anti-national’activities and need time to question him regarding his nature of work in India.

The police claim Peng travelled to India five years ago and married an Indian girl. He has been moving around mostly in the northeastern states and Himachal Pradesh and also got a passport from Manipur. His Aadhaar card mentions an address from a residential society in Dwarka in southeast Delhi. Police believe that he was running a currency exchange firm which was being used to carry out hawala transactions.

Police believe that Peng is a trained agent and the investigators are trying to ascertain if he has any connection with the People’s Liberation Army (PLA) of China.

Terrorists give ‘resign or die’ threats, abduct and kill three officers; MHA refutes media claims of police resignations

0

Three police officers were killed by terrorists and one another police officer managed to escape in Shopian in Jammu Kashmir. The terrorists had abducted three Special Police Officers after dragging them out from their houses in Kapran Village.

Earlier this week, Hizbul Mujahideen terrorists had put out videos in which they had threatened policemen to resign or prepare to be killed. Following which, it was reported that fearing brutal actions against themselves and their family by the terrorists, at least six police officers and a constable have resigned from the service.

A Special Police Officer reportedly resigned from service and said, “My name is Nawaz Ahmad Lone, a resident of Kulgam. I was working as an SPO. I am resigning of my own free will, not because of any compulsion.” While another officer, who has been an SPO for six years had resigned on the 17th and had “nothing to do with the police department”. A third cop in a video said, “My name is Shabir Ahmad Thokar, son of Ghulam Mohammad Thokar. I was working as an SPO for the last eight years. Through this video, l want to tell everybody that from today I have no relation with the police department.”

However, the Home Ministry officials have rejected these claims in the media and said that no SPO has resigned from the police service. The MHA said that the Jammu and Kashmir Police have confirmed that these reports are “untrue and motivated”.

The MHA clarified that those SPOs whose services were not renewed due to administrative reasons have resigned. Jammu and Kashmir DGP Dilbag Singh has asked people not to pay heed to such rumours.

Condemning the attack on the police officers, Singh said, “Our SPOs have been doing their duty very well. They are an important part of our security forces.”

The Home ministry had earlier expressed worry about consequences as the videos floated around in several villages. The Home ministry officials are of the view that the terrorists are resorting to increased kidnappings as terrorists were under tremendous pressure as the Armed forces have intensified their counter-terror operations.

India launches National sex offenders registry with 4.4 lakh names

0

The ministry of home affairs has launched India’s first national database on sex offenders yesterday. The National Database on Sexual Offenders (NDSO) has 4.4 lakh names in its nascent stage. According to reports, the registry has details like names, photographs, address and fingerprint details of the registered offenders. according to reports, India became the 9th country in the world to have such a database.

The database reportedly includes the names of offenders from 2005 onwards. A statement by the home ministry states that the database will not compromise an individual’s right to privacy. According to reports, the database will only be accessible to law enforcement agencies for investigations and monitoring. The database is to include persons charged with rape, gang rape, eve teasing and under the POCSO Act. The MHA also launched a national portal for cybercrimes, cybercrimes.gov.in for anonymous and instant reporting of issues related to child pornography and women’s safety.

Minister for women and child development Maneka Gandhi expressed concerns over cases of sexual exploitation in shelter homes and increasing cases of NRI grooms abandoning brides. Speaking at the event where the registry was launched by MHA Rajnath Singh, Gandhi stated that the DGPs are being instructed to keep close watch over shelter homes. She also pulled up representatives of the states that are yet to respond to a query by the ministry of WCD on the number of rape-kits procured by them. Rape-kits are specially designed medical kits to immediately determine if a sexual assault has taken place. PS Shrivastava, the joint secretary for MHA reportedly stated that 79 lakh rape-kits are in the process of procurement and distribution across the country.

It is notable here that the central government had in April promulgated an ordinance to amend the POCSO Act with provisions of the death penalty for rapists of children below 12-years of age.

JNU to celebrate ‘Surgical Strike Day’ on 29 September to mark 2nd anniversary of surgical strikes against Pakistan

0

Jawaharlal Nehru University VC has announced that the varsity will be celebrating the ‘Surgical Strike Day’ as per the circular issued by the University Grants Commission (UGC) which has suggested educational institutes to celebrate the 2 year anniversary of the historic surgical strike carried out against Pakistan on 29 September 2016.

“When our alumni go and fight for us at the borders, as a University, we must recognise their contribution,” said Jagadesh Kumar, JNU vice chancellor. Earlier, controversy had erupted when the circular was brought out by the UGC with the opposition accusing the government of trying to ‘politicize the army’. The UGC had released a circular to higher education institutions to hold programmes and activities to celebrate “Surgical Strike Day”. It had suggested organising special parades, written pledges of support for the armed forces and meetings with ex-servicemen.

The West Bengal education minister Partha Chatterjee had said that the state will not celebrate the ‘Surgical Strike Day’. He accused the Bharatiya Janata Party-led government at the Centre of trying to “malign and politicise” the Army. “This is an agenda of the BJP and it is trying to push this agenda by using the UGC ahead of elections. It is a matter of shame that they are using the UGC to achieve their political agenda,” Chatterjee said.

He further added that they have full respect for the soldier and their sacrifices and said that they would have understood and celebrated it if the UGC had asked to observe the day as a respect for sacrifices made by the soldiers. According to Chatterjee, the Indian Army has always been kept above politics and controversies and the party won’t support anything which maligns the Army.

While the HRD ministry clarified that the above circular is not mandatory, the Opposition was quick to take it as an opportunity to attack the government.

Kapil Sibal, a senior Congress party leader has also questioned the idea of celebrating Surgical Strike Day and called it as “another jumla”. “Is this meant to educate or to serve BJP’s political ends?” Kapil Sibal said in a tweet today. He accused the centre of interfering in the functioning of the UGC by issuing such circulars.

However, Union HRD Minister has cleared that the government has not made any compulsions on any institutions or students. He further added that the Ministry thought of this idea after receiving suggestions from many students & teachers that they need to commemorate the second anniversary of the surgical strike.

Indian Army Special Forces had conducted a surgical strike along Line of Control on September 29, 2016, was the first of its kind operation on Pakistani terror launch pads. While the figures of casualty vary between 35 to 50, Pakistan continues to reject the claims of surgical strike.

Demystifying Civil Society: Link emerges between ‘Urban Naxals’ and Separatists in Kashmir and Manipur

Our ‘Demystifying Civil Society’ series, thus far, has focused on a single umbrella organization, the Coordination of Democratic Rights Organizations (CDRO), which appears to be intricately linked to the ‘activists’ arrested recently over allegations of aiding the banned CPI (Maoists). We have mentioned how various organizations affiliated to it have a history of its members being arrested for links to Naxals and how an organization with clear separatist inclinations that was affiliated to CDRO published a report that demonized the Amarnath Yatra. In another article in the series, we elaborated the links between NOTA and CDRO.

Confusion at the very beginning

In this article, we shall focus on one certain organization COHR, Manipur. There appears to be certain confusion regarding the name of this organization as the acronym has two full forms. One is Coordination of Human Rights, Manipur and the other is Committee on Human Rights, Manipur. It could very well be that both these names stand for the very same organization. The CDRO bulletin for the month of March 2015, mentions both these full forms for the same acronym.

Thus, we can assume with relative certainty that they are either the same organization or fraternal organizations or intricately linked to each other as the chairman of Coordination of Human Rights, Manipur and Committee on Human Rights, Manipur is one and the same person, Phulindro Konsam. PUDR lists Coordination of Human Rights, Manipur as one of the coordinating organizations of the CDRO but Committee on Human Rights, Manipur is linked with the CDRO too as it hosted an event that was organized by the umbrella organization. Thus, for the purpose of simplicity, we will assume that COHR, Manipur represents a single entity going forward.

COHR, Manipur

The COHR has long been involved in a campaign against AFSPA. While opposition to AFSPA is not a red herring in itself, he recently said while speaking at an event that Manipur ‘lost its independence’ after it was merged to India and that AFSPA was imposed because India feared retaliation by Manipuris. Phulindro has also alleged that Army Chief Bipin Rawat’s statements indicate a genocide of the indigenous people of the northeast. In the same event, the organizers which included the COHR vowed to intensify their protests against AFSPA.

COHR, Manipur’s has a history of taking controversial stands on contentious issues. In June 2013, it had condemned the killing of six NSCN (Khaplang) cadres by the 10th Assam Riffles in an ‘alleged’ fake encounter, an extremist outfit that was designated as a terrorist organization by the Government of India only two years later.  It appeals in one of its reports, “Allow the indigenous people of Manipur to exercise their inalienable right to Self-Determination under Article 1 of the International Covenant on Civil and Political Rights, ICESCR and general international law.” It can be interpreted as the organization harbouring clear separatist inclinations.

In 2017, COHR, Manipur was one of the organizations which demanded a review of the 105MW Loktak power project and that the Ithai barrage constructed for the project be decommissioned while maintaining that the project does more harm than good for the state. In 2012, Phulindro Konsam along with Gautam Navlakha, the activist who was recently raided by the Pune Police for his alleged involvement in the Bhima Koregaon violence, were campaigning to stop the construction of mega dams in North East India. Konsam was himself reportedly arrested by Manipur Police in 2014. Konsam was also an attendee of an event which was organized to oppose the drilling of oil in Manipur. Konsam, reportedly, was one of the delegates who submitted their respective reports to the Special Rapporteur on Situation of Human Rights Defenders, United Nations, Margaret Sekaggya in 2011 who made a spirited argument for scrapping AFSPA at a session of the UN at Geneva.

COHR, Manipur is connected to the Human Rights Law through (HRLN) through the Manipur unit of the latter. They are both members of Manipur based Civil Society Coalition on Human Rights (CSCHR). We have reported earlier in a previous article in the series that the HRLN is a division of the Socio-Legal Information Centre (SLIC) which receives foreign funds from abroad and then engages in political activism in India. We have also reported that the HRLN is involved in a campaign for the abolition of Indian sedition with the CDRO. The CSCHR had claimed in 2015 that Manipur was on the brink of an inter-ethnic conflict. Considering that nothing of the sort has happened in the three years that have since passed, the claim can be disregarded as sheer fear mongering.

Conclusion

Thus, we have an organization, COHR, Manipur, which appears to be harbouring separatist sentiments that is a part of an umbrella organization, the CDRO, that has a history of members of its constituents being arrested for links to Naxals. It is also linked to a foreign-funded NGO, the HRLN, through the Manipur unit of the latter as they are both members of another umbrella organization, the CSCHR. Here is another evidence of the SLIC indulging in political activism after receiving funds from abroad. A connection also emerges between Naxals, Kashmiri separatists and separatists in Manipur through the CDRO.
