Pakistan: Triple Talaq ban ineffective, Islamic Council recommends it to be made a punishable crime

0

Pakistan’s Council for Islamic Ideology has recommended that the practice of Triple Talaq should be made a punishable crime.

As per a report in The Tribune, Pakistan’s CII has recently replied to a question by Member of National Assembly Bashir Virk, stating that under certain practices in Islamic societies, a divorce takes place when the word ‘Talaq’ is uttered thrice in ‘one breath’, even in jest.

Pakistan’s federal law minister Faroq Naseem had interjected that there have been instances in Islamic history where such acts of instant Talaq have been punished by Islamic Law. The present law minister of present-day Pakistan, then, cited that the second caliph of Islam, Hazrat Umar(584 AD -644 AD), had punished those who had practised instant Talaq. He then stated that the NA should make Triple Talaq a punishable crime.

Supporting the law minister the chairman of the CII, Dr Qibla Ayaz then stated that the practice of instant Talaq should be made punishable under ‘Fiqah Hanafi’. Ayaz also added that the CII is yet to decide what should be the punishment for Triple Talaq.

The Council of Islamic Ideology is a constitutional body in Pakistan which gives legal advice to the government on issues of Islam and religious practices.

It is notable here that the practice of Triple Talaq is banned in several Islamic countries, including Pakistan. In Pakistan, it was banned in 1961, under the Muslim Family Law Ordinance.

Recently, the Indian government had, in a bold and decisive move, banned Triple Talaq and made it a punishable offence after passing the Muslim Women (Protection of Rights on Marriage) Bill, 2019 earlier this year.

However, a significant section of opposition parties, many ’eminent intellectuals’ and so-called ‘secular liberals’ had opposed the government’s move, stating that the ‘Hindu Nationalist’ government is planning to punish Muslim men through this legislation. Their hollow argument was, sending the Muslim husband to jail will make it difficult for the divorced woman and her children to get maintenance. They had no explanation on how a Muslim woman is supposed to maintain herself and her children when her husband had the power to throw her away from her house after just uttering ‘Talaq’ thrice.

The fact that even an Islamic country like Pakistan is considering making the practice of Triple Talaq a punishable offence shows that just ‘banning’ does not end regressive practices. Most often, strong legislation and the fear of punishment under the law is needed for a practice to be shunned by people.

Tukde Tukde slogans: AAP govt refuses to sanction prosecution of Kanhaiya Kumar and gang, says they were not against country

Aam Aadmi Party-led Delhi government has rejected Delhi Police’s request for sanction to prosecute former Jawaharlal Nehru University Students’ Union (JNUSU) President Kanhaiya Kumar and others who have been accused of raising anti-India slogans on JNU campus on February 9, 2016. As per reports, Delhi Home Minister Satyendar Jain is of the opinion that no case of sedition can be made against Kanhaiya on the basis of the evidence put up by Delhi Police.

Delhi Home Minister Satyendar Jain is of the view that the accused had ‘no intention’ of inciting violence and did not raise such slogans during the march. He further said that the sloganeering started between two groups to ‘mock each other’. That the slogans such as ‘Bharat tere tukde honge’ were ‘aimed at other group and not to the State and its sovereignty’ as per Jain.

The Delhi government found the evidence provided by Delhi Police ‘flimsy’ and ‘riddled with gaps’.

In January this year, the Delhi police special Cell had submitted 1200-page charge-sheet in the JNU sedition case. The JNU sedition case has seen no proceeding so far due to the Arvind Kejriwal government’s refusal to give nod for prosecution. Accused in the case are Kanhaiya Kumar, Umar Khalid, Anirban Bhattacharya and several others.

In February this year, the Patiala House Court had asked Delhi police to speed up the proceedings by receiving Arvind Kejriwal-led Delhi Government’s sanction for prosecution. It had also added that state government cannot delay the case by withholding nod for prosecution.

But it was revealed before the court that the Delhi government did not respond to the charge sheet after receiving it. According to Delhi police, first request to sanction prosecution was sent in 2016, and another request was sent in January this year, without any results.

In cases like JNU sedition row, Police has to solicit a sanction to prosecute from Delhi state’s law ministry. Then the file has to go to Lt. General. The court cannot take cognisance of charge sheet without state government’s nod. Now the Delhi Government has refused to sanction the prosecution.

In February 2016, the students of JNU had organized an event to mark the anniversary of terrorist Afzal Guru who had attacked the Indian Parliament. Many slogans challenging the Indian State’s sovereignty and calling for its balkanization were raised. At the event, slogans like ‘Bharat Tere Tukde Honge’ and Afzal hum sharminda hain, tere katil jinda hain’ were captured in news reports.

Just days before Ravish Kumar receives his Ramon Magsaysay award, social media users expose his hypocrisy

On the day NDTV journalist Ravish Kumar was in the Philippines to receive the Ramon Magsaysay award, users on Twitter were digging out his old tweets. Not to congratulate him, but to show his hypocrisy.

Recently the GDP numbers for the first quarter of the financial year 2019-2020 were released, which had showed that GDP growth rate had come down to 5%. Talking about the state economy on NDTV India on 20th August, Ravish Kumar had said that such a low growth rate of GDP means that the Indian economy is in recession. He had noted that this is the lowest growth rate in 6 years. According to Ravish Kumar, 5% GDP growth news is very bad news for the economy.

[youtube https://www.youtube.com/watch?v=2Ct709LdeTk]

But it seems Ravish Kumar’s analysis on the economy has changed with change with government at the centre, because in 2013, he had said that there is nothing to worry about a GDP growth of 5%. He had asked whether people were worrying too much, as several only few countries were growing at even 5% rate, and growth rate most countries were below this.

A composite video of both comments of the NDTV journalist, showing his opposite comments on GDP during UPA and NDA government, has gone viral on Social media.

While Ravish Kumar of 2019 thinks 5% GDP growth means economic slowdown, Ravish Kumar of 2012 disagrees with him. In October 2012, when one social media user had pointed out to him that GDP growth rate of Madhya Pradesh was in negative during Congress regime, it was growing at 12%+ during Shivraj Chauhan led BJP government, Ravish Kumar had said that ‘journalism is not to propagate GDP rate only’. He had said that there are many realities which GDO does not bring.

During Modi government, Ravish Kumar worries about job loss, but during Manmohan Singh government had a different take on people leaving jobs. According to him, people were quitting jobs in the private sector to start businesses, as India was turning into a business society. But now suddenly we have reverted to a job-based society.

It is not that Ravish Kumar’s views on only economy change with time, people found some other such dynamic views also. For example, sometimes he says that TV should be thrown way, people should not watch TV either on Television or on phones. He had claimed that TV is trying hard to destroy the Indian democracy. But in other times he complaints that when his show comes on TV, people switch off the TV. He said that people switching off TV when his show starts is dictatorship.

Ravish Kumar’s view on economy changes during the Modi government too, based on the circumstance. On August 20, he had claimed that although the number of people filing Income Tax Return had gone up, tax collection amount had not increased much. The number of returns has increased, but its effect on revenue is negligible, he had claimed. But when the government increased the slab for income tax this year, he complained that this will lead to loss of revenue. In this year’s budget, the government announced that upto an income of ₹5 lakhs, no income tax will have to be paid. He complained that this will reduce the number of income taxpayers by 3 crores, and the government’s revenue will go down by ₹18,500 crore.

Ravish Kumar’s dislike for BJP is well documented, so such examples of his hypocrisy do not come as surprise. When the exit polls before the counting of 2019 Lok Sabha polls had projected a win for NDA, he went on a prolonged meltdown, and rejected the exit poll numbers. He has floated various conspiracy theories, like he was under surveillance, or that NDTV transmission was willingly disrupted, which were results of pure imagination.

Uttar Pradesh: FIR filed against 43 Muslims for serving buffalo meat to Hindus at a religious event

0

The police in Mahoba town of Uttar Pradesh on Thursday filed a first information report (FIR) against 43 Muslims for allegedly serving ‘non-vegetarian biryani’ to Hindus at the community feast organised at a religious event in Salat village in Charkhari area, Uttar Pradesh, reports PTI.

However, according to the report by Indian Express, the number to Muslims against whom the FIR was registered stood at 23.

The Hindu’s have alleged that they were served ‘beef mutton’ on purpose to hurt their religious sentiments.

The FIR has been registered under sections 153A (promoting enmity between different groups on grounds of religion, race, place of birth, residence, language, etc., and doing acts prejudicial to maintenance of harmony), 295A (deliberate and malicious acts, intended to outrage religious feelings of any class by insulting its religion or religious beliefs), 420 (cheating and dishonestly inducing delivery of property) and 506 (criminal intimidation) of the Indian Penal Code.

The case was registered following the intervention by local Bharatiya Janata Party MLA Brijbhushan Rajpoot who visited the Salat village on Tuesday where some villagers raised the matter with him.

The alleged incident took place on August 31 in the Charkhari police station area of Mahoba during Urs of Sheikh Peer Baba, a religious congregation that the Muslim community of that area had organised. According to the FIR registered, ‘buffalo meat’ along with rice was served to the Hindu’s without their knowledge.

“On Saturday, there was a Urs organised at Salat village,” Rajpoot said, adding that, “Hindus, who are in majority here, also participate and even give donations for the same. As part of the event, every year there is a huge feast where vegetarian food is served.”

“This year, when the feast started, several Hindus were served rice on the pretext of it being baba ka prasad,” Rajpoot added. “When a few people started eating it, they found meat pieces and bones. When the matter escalated, a panchayat was called in which the main accused accepted that buffalo meat was served by mistake. He apologised and offered to pay Rs 50,000 to arrange a shuddhikaran (cleansing). While some people agreed to it, others came to me. I went to the village and asked for an FIR to be registered against those responsible as they did this to knowingly hurt our religious feelings.”

One of the complainants in the FIR, Rajkumar Raikwar had claimed that only one amongst all who have been named in the FIR was guilty of serving non-vegetarian food while the rest were innocent.

Meanwhile, Charkhari Police Station House Officer Anoop Kumar Pandey said the main accused, Ansari, had promised a ‘biryani feast’ if his nephew recovered from an illness and as a result, non-vegetarian biryani was served at the event.

“While puri-sabzi was served at one stall, biryani was served at another. While those who eat non-vegetarian food ate the biryani, others did not. Later, there were rumours that there was buffalo meat in the biryani. I reached there and brought the situation under control. However, the MLA later intervened and the matter was again raised. I told the MLA to give a complaint if something wrong has happened. Now, we have registered an FIR based on the complaint,” said the SHO.

DIG, Chitrakoot range, Deepak Kumar, meanwhile, said that though he has heard about the alleged incident, was not aware of an FIR been filed.

After university, Azam Khan’s resort ‘Humsafar’ raided, power supply cut over electricity theft

There seems to be no end to Samajwadi Party leader Azam Khan’s legal worries. It was first land-grabbing, then lion statues, followed by books and valuable manuscripts, then buffaloes and now electricity.

The Samajwadi Party leader and Rampur MP Azam Khan has now been booked for electricity theft. According to a Times Now report, the power supply to Azam Khan’s resort ‘Humsafar’ in Uttar Pradesh was cut after raids were conducted in the resort by the Uttar Pradesh electricity department. The SP leader, who is already in neck-deep trouble has been now accused of electricity theft.

Azam Khan’s luxury resort where raids were conducted has already been under fire as the district administration had recently razed down the boundary of this resort as it was allegedly built on a nullah owned by the Irrigation department. A notice had already been served to Azam Khan in the matter.

Prior to this, Khan’s Mohammad Ali Jauhar University was raided by Rampur police following a complaint by the principal of Madrasa Aliya, wherein he stated that 9000 books and rare manuscripts from the Madrasa have been stolen.

Azam Khan was then booked for the alleged theft of these books and valuable manuscripts. Khan had applied for anticipatory bail before the court in the case related to the theft of books and ancient Islamic manuscripts from the Aaliya Madarsa, which was rejected.

Azam Khan’s bail application in as many as 34 cases has already been rejected which mostly includes land grabbing cases and also the case registered against him for his sexist jibe against BJP leader Jaya Prada.

Recently, Samajwadi Party leader and ‘land mafia’ Azam Khan was booked for ‘dacoity’ and stealing buffalo. Two people have filed an FIR against him in Rampur for allegedly stealing buffalo for which his anticipatory bail plea was also rejected.

A day before, the Samajwadi Party MP’ name had appeared in the FIR for a dacoity case. In this fresh case, it was alleged that he and his allies forcefully acquired land from a farmer for a school he had built.

Samajwadi Party senior leader Azam Khan is embroiled in over 80 criminal cases slapped on him under various offences.

UAE tells Pakistan Kashmir is a bilateral issue and has nothing to do with ‘Muslim Ummah’: Reports

UAE Minister for Foreign Affairs and International Cooperation Sheikh Abdullah Bin Zayed Bin Sultan Al Nahyan has told Pakistan that Kashmir is not an issue of the Muslim Ummah and is a dispute between India and Pakistan, Pakistani media has reported. He added that it is a bilateral issue that should be resolved through dialogue between the two countries.

The Pakistani establishment was under the impression that the UAE Minister as travelling to Pakistan to express solidarity with its stance on Kashmir. However, it has been left again with eggs on its faces as the UAE again refused to intervene on the matter.

Journalist Hamid Mir, anchor of the Geo News ‘Capital Talk’ said that Pakistan must convince the world that Narendra Modi’s ‘atrocities’ against Muslims is not limited to Kashmir alone but he wants to convert all of India’s Muslims to Hindus through a reign of terror. According to him, in this context, Kashmir is an issue that concerns the Muslim world and this is what Pakistan ought to tell the world.

Meanwhile, Arab countries don’t appear to take Pakistanis seriously. Narendra Modi was conferred with the Order of Zayed, the highest Civilian honour of UAE after the abrogation of Article 370 in August. Bahrain, another Islamic country, awarded Narendra Modi The King Hamad Order of the Renaissance the same month.

Accused in INX Media case, UPA-era finance minister P Chidambaram sent to Tihar Jail till September 19

In a major development, former Union Minister P Chidambaram has been sent to judicial custody at Tihar Jail till September 19, 2019.

However, Chidambaram’s counsels, in a desperate bid to save their client from going to Tihar, had moved an application in Court stating that Chidambaram wants to surrender in Enforcement Directorate case. It is pertinent to note that Chidambaram had refused it earlier.

Earlier today, in a huge setback to former finance minister P Chidambaram, the Supreme Court had refused him anticipatory bail in the INX Media case.

A couple of days back the Central Bureau of Investigation had said that it no longer wants Senior Congress leader P Chidambaram’s custody and that the veteran Congressman should be sent to Tihar till September 5. Chidambaram had then pleaded that he willing to remain in the CBI custody till 5th.

Chidambaram was arrested on August 21 by the CBI after a prolonged drama where he had gone into hiding for over 24 hours after his anticipatory bail plea was rejected by the Delhi High Court.

Author Ashi Kalim, accused of making derogatory comments on Hindu gods, gets bail from High Court, lawyer Chandni to file intervention application

0

The Bombay High Court on Thursday granted bail to author Ashi Kalim, after her anticipatory bail plea was rejected by a sessions court on 27th August. The court has decided 1st October as the next date of the hearing in the case.

A sessions court in Goregaon, Mumbai had rejected an anticipatory bail plea filed by writer, poet and activist Ashi Kalim Ullah in a case filed against her for making derogatory remarks against Hindus and Hindu gods on social media. Justice S U Baghele agreed with the petitioner that the writer has hurt religious sentiments of Hindus by her remarks, and denied the anticipatory bail plea, saying custodial interrogation of the applicant appears to be necessary to probe the case. The order was issued by the court on 27th August.

In July this year, screenshots of several tweets of the author went viral on Twitter where she had abused various Hindu gods. She had called Krishna a rapist, said that Brahma had raped own daughter, called Durga a prostitute, and made many such highly objectionable remarks.

Objecting to the tweets, advocate Chandni Shah had filed an FIR against Kalim. Initially Shah had filed a cyber complaint at the Bandra Cyber Police, and on the next day she visited the Bangur Nagar Police station in Malad to file an FIR. But the police didn’t register immediately, and after one month of relentless effort by advocate Chandni Shah, the FIR was finally registered on 21st August.

Talking about the delay of one month in getting the FIR registered, Chandni said, “Richa Bharti of Jharkhand had been arrested and jailed for 3 days within 24 hours of her tweet for ‘Hurting religious sentiments of the minority’, Sunny Gupta of Ghatkopar, Mumbai, had been arrested within 24 hours after his tweet for again ‘Hurting religious sentiments’, but it took 30 days to finally file an FIR”.

Following the filing of the FIR, Ashi Kalim filed for an Anticipatory Bail in the Dindoshi Sessions Court. The date of first hearing in the case was 25th August, and on 27th August the court rejected her application for anticipatory bail.

Along with Chandni Shah as the intervener, Public Prosecutor Usha Jadhav appeared in the court for the State of Maharashtra, while advocate Sunny Waskar argued on behalf of the accused. Ashi Kalim offered an apology for her comments but it was rejected by the court. Her advocate Sunny Vaskar requested the court to consider sympathy for her as she is a woman. He also argued that twitter account of Ashi Kalim was tampered with. Her advocate also claimed that she didn’t have any intention to hurt religious feelings of anyone, but she was provoked to do so.

Chandni Shah argued that such a sensitive case can’t be decided on the basis of the gender of the accused, but instead the seriousness of the offence should be considered. The argument was accepted by the Hon’ble Court. Sharing such controversial text on the social media platform not only hurts people’s religious sentiments but also can cause unrest in society, the court said while rejecting the pre-arrest bail application.

Talking about the claim of provocation made by the accused, the court said that the instigation or provocation for the same is a different aspect, which has to be dealt with separately. Whoever hurts the religious feelings of another community is liable to be dealt with in accordance with law, even it was done on provocation. The court added that the alleged derogatory remarks which allegedly provoked Ashi Kalim to made her derogatory comments can be dealt with in a separate case, but that can’t be the defence of making derogatory remarks on any social media.

Rejecting the bail application, the court said, “looking to the gravity of the crime, and as it has to be ascertained as to what were the twits or the comments originally posted by the applicant and for the purpose of the recovery of the device used in relation thereto, the custodial interrogation of the applicant appears to be necessary. Hence, she is not entitled to anticipatory bail.”

Talking to OpIndia about the case, advocate Chandni Shah said, “It’s a shame, that in the name of secularity, we are being taught to not to raise voice against the wrong doers and keep tolerating. But the limit of tolerance has a saturation point. This is the time that an example is to be set, that whoever is the wrong doer, be it from any community, religion, caste, creed or gender, will be punished and legal actions would be taken against him/her, without any bias.”

Following rejected of the anticipatory bail plea, author Ashi Kalim was likely to be arrested anytime soon, but now she will not be arrested as the high court granted her bail. She is facing charges under section 153 (A), 295 (A), 504 and 506 of the Indian Penal Code. Chandni Shah has said that she will be filing an intervention application at the Bombay High Court. She will be representing the state along with the public prosecutor in the case.

Rampur District Court rejects Azam Khan’s anticipatory bail plea in 5 more cases

Trouble seems to be mounting for the Samajwadi Party leader Azam Khan, who is embroiled in over 80 criminal cases slapped on him by the Uttar Pradesh government. The district court in Rampur on Thursday rejected Azam Khan’s anticipatory bail plea in 5 more cases. The cases are related to the land grabbing accusations levelled on him by farmers of Aliyaganj area.

Last week, the court of district and sessions judge, Alka Srivastava, had rejected the Samajwadi Party leader’s anticipatory bail plea in 29 cases, mainly related to land grab, moved by his counsel.

In the FIRs, Azam has been accused of forcibly grabbing the land of farmers when the Samajwadi Party government was in power in Uttar Pradesh. Interestingly, the land is now a part of the Mohammad Ali Jauhar University, which was constructed by the senior SP leader.

Azam had applied for anticipatory bail before the court in the case related to the theft of books and ancient Islamic manuscripts from the Aaliya Madarsa, amongst other cases.

Notably, the court had also rejected the anticipatory bail sought by the sexist SP leader for his ‘underwear jibe’ against BJP leader and film actor Jaya Prada. An FIR was then registered against Azam under section 509 of the IPC (word, gesture or act intended to insult the modesty of a woman) and under section 125 of Representation of People’s Act.

Recently, Samajwadi Party leader and UP’s ‘land mafia’ Azam Khan was booked for ‘dacoity’ and stealing buffaloes. Two people have filed an FIR against him in Rampur for allegedly stealing buffaloes for which his anticipatory bail plea was also rejected.

A day before, the Samajwadi Party MP’ name had appeared in the FIR for a dacoity case. In this fresh case, it was alleged that he and his allies forcefully acquired land from a farmer for a school he had built.

A complaint had been filed against Azam Khan, former circle officer Aalay Hasan, Fasahat Shanu and Veerendra Goyal by a person named Nanhe. The complainant had alleged that his land along with other’s was taken for construction of Rampur Public School. He was offered a different plot of land in place of his original plot, but that never happened. Rampur SP Ajay Pal Sharma confirmed that Nanhe’s land was grabbed and his house was demolished for the construction of the school.

Recently, Azm Khan was also declared as a ‘Land Mafia’ by the UP government.
