Indian man faces unexpected racism in New Zealand: “I feel like an outsider even after two years”

A 29-year-old Reddit user from India has posted a heartfelt account of his experience with racism in New Zealand. The man moved to New Zealand two years ago, hoping to get a “fresh start.” In the post, he described his disillusioning experience with the country’s social fabric. When he went to New Zealand, he imagined the social fabric of the country would be welcoming. However, the multicultural society in the new country turned out to be a challenge to his identity and sense of belonging.

In the post, he wrote, “I had this ideal image of NZ being welcoming and multicultural, but my experience has been far from that, unfortunately.” While he acknowledged that there are “good people here,” he noted that his encounters with racism had been more frequent than he had expected, ranging from verbal harassment to a sense of exclusion in social settings and the workplace.

He described the different types of discrimination he faced during his time in New Zealand. He said he had faced “random strangers yelling stuff at me on the street,” as well as “weird looks or rude comments at work” due to his accent and appearance. In social interactions, he felt a sense of alienation and observed how people would “talk over me or exclude me from conversations.” The most painful moments were the blatant expressions of prejudice, as some people in New Zealand even told him to “go back to where I came from.”

He added that despite the problems he faced, he actively tried to integrate himself into the new country’s culture by learning Kiwi slang and understanding local customs. He wrote, “I’m trying my best to integrate.” He emphasised that he is committed to making New Zealand his home. Yet, he confessed, “there are moments when it gets exhausting.” He also reflected on his life in India and added, “I never felt like an outsider growing up in India, but here, even after two years, I feel like I don’t fully belong.”

In the end, he sought advice from others who might have experienced similar struggles. He wrote, “I guess I’m just looking for some advice or solidarity.” He hoped to hear from people on how they coped with “the feeling of being an outsider or dealing with racism, especially when it hits so unexpectedly.”

Replying to his post, a flight attendant wrote that subtle racism is everywhere, which she experienced while living in the UAE as well. “Make your circle. Focus on work. Once you get slightly financially well-off, you will feel the difference. With time, you will also get better at dealing with situations like these,” she advised.

Another user, Balram, wrote, “Faced the same overt and covert racism in Berlin. Left the place and came back home after a year.”

The experience of the Indian man on Reddit highlighted the tough reality that some immigrants face after moving to a new country. Despite his efforts to fit in, he encountered racism which left him feeling drained, and he felt like he did not truly belong in New Zealand. His experience shows how Indians face racism after moving to other countries, which often present themselves as welcoming and multicultural.

Indians often face racism while in foreign countries and on social media. In July this year, the official handle of the American TV show demonised Indians as ‘street-shitting ragheads’. In a tweet posted on the micro-blogging platform, the American TV series referred to Indians as ‘mother fuckers’ and ‘street-shitting ragheads.’ The caption wrote – ‘Motherfucking fucking–Street-shitting raghead Indian fucks.’ The official X handle of ‘The Sopranos’ tried to pass off the derogatory remark as ‘real dialogue’ from the TV series. However, one user was quick to point out that such remarks were not part of the show. An X user (@SaiyanWhoKills) stated that the character featured in the screenshot did not say anything about Indians. He had also uploaded a short video clip of the scene to substantiate his point.

In August 2023, an apology was sought from the Department of Education in Australia’s Sydney after a teacher was found guilty of hurling racist remarks against Indians. James Anderson, a teacher at Cronulla High School, was accused by an Indian-origin former student of describing Indians as “Uber drivers and Deliveroo people” during a business studies lecture in 2021.

Gujarat: Police detain over 50 Bangladeshis, living in Ahmedabad with Hindu names, had built encroachments on water body after dumping waste

On Friday (25th October), the police detained 51 illegal Bangladeshi immigrants from Ahmedabad city of Gujarat.

According to reports, the city crime branch carried out a 4-month-long investigation, interrogated 250 suspects and found that the infiltrators had filled the Chandola Lake in Ahmedabad with processed waste.

At the same time, they have set up illegal shanties on lake sites. The Ahmedabad crime branch informed that the illegal Bangladeshis had blocked the Narmada pipeline and filled it with processed waste from the Pirana dumping site.

The infiltrators cut off the water supply to Chandola Lake, which has now been confirmed through satellite images dating back to 1985, 2011 and 2024.

Chandola Lake currently has no natural source of water other than rainfall. The Gujarat government used to fill the water reservoir by pumping Narmada water via pipelines. Despite this, the lake was shrinking over a period of time.

Encroachment on Chandola Lake

During the investigation, it surfaced that the Bangladeshis blocked the entire pipeline through which Narmada water was being pumped into the lake.

In satellite images released by the crime branch, it could be seen that in just 15 years, a large part of the lake was encroached upon by illegal immigrants.

The local administration has taken action against the illegal encroachments and vacated 60-70% of the houses built on lake sites. Most of the infiltrators have been apprehended or managed to flee.

Some of them were reportedly using Hindu names. On being interrogated, the illegal immigrants claimed that they were from West Bengal.

Bangladeshis were operating using Hindu names

They had prepared forged documents such as Aadhar cards and PAN cards with the signature of a local corporator. The infiltrators had exploited government loopholes to avail welfare schemes

According to DCP Ajit Rajian and Joint Commissioner Sharad Singhal, Bangladeshi women were initially brought here through trafficking channels. Later, the area became a hub for prostitution and anti-national activities.

The detained Bangladeshis will be deported to their home country soon. The incident has created a state of panic among the residents of the area.

Lahore’s air quality reached alarming levels, with the city’s Air Quality Index (AQI) approaching 700 mark on Sunday, according to global monitoring sites, ARY News reported.

The city’s overall AQI has been recorded at 690, placing Lahore at the top of the world’s most polluted cities list.

The hazardous air quality has prompted health authorities to issue warnings, advising citizens to take immediate precautions. Residents are experiencing a surge in respiratory issues, including coughs, viral flu, and sore throats, due to the poor air quality, as per ARY News.

To mitigate the risks, health experts recommend wearing masks and goggles, avoiding unnecessary outdoor activities, and taking protective measures.

According to ARY News, the AQI index report, in its health recommendation, advised citizens of Lahore to avoid outdoor exercise, close windows to avoid dirty outdoor air, wear a mask outdoors, and run an air purifier for the fresh air.

The air becomes heavier in the winter as compared to the summer, causing poisonous particles in the atmosphere to move downwards and making the atmosphere polluted. As a result, a layer of polluted particles, including large amounts of carbon and smoke, covers an area.

The smoke produced by burning crop remnants, factories, and burning coal, garbage, oil or tyres enters the atmosphere, and the impact of this appears at the onset of winter and remains till the season’s end, experts added.

The situation has raised concerns about the long-term impact of air pollution on the city’s inhabitants.

Sanjay Manjrekar criticises Indian top order after series defeat against New Zealand: Says 3 out of top 4 short of confidence against spin

Former Indian cricketer Sanjay Manjrekar expressed disappointment with Team India’s batting during their shambolic loss to New Zealand in the second Test at Pune, which led to the hosts’ first-ever series loss at home in 12 years.

Indian batters got the taste of their own medicine as the Kiwi spin attack led by Mitchell Santner, who took 13 wickets in the match, trapped the hosts in their own spin trap and defeated India by 113 runs to secure the series 2-0 with a game to go.

Speaking on ESPNCricinfo, Manjrekar said that he felt India could pull off a surprise when Yashasvi Jaiswal and Shubman Gill had a partnership going on but remarked that the latter does not have a “feel for spinners” and feels pressure while playing them on turning pitches.

“When Yashasvi and Shubman were going together, I thought that there would be a surprise around the corner. Shubman Gill clearly does not have the feel for spinners. You know batters, who can work with their footwork instinctively, he clearly is under pressure when he is playing spinners on turning pitches,” Manjrekar said.

Manjrekar also said that star batter Virat Kohli once again misread the length of Santner’s delivery and skipper Rohit Sharma felt underconfident on the crease against spin. He feels that the top three of India’s top four are short of confidence against spin. He feels India should have backed their defence more and not lost early wickets.

“Virat Kohli once again misread the length. The ball was much fuller than he anticipated and came back into him sharply. Rohit Sharma was not confident at the crease. There are a lot of guys, top 3 out of 4 who are short of confidence against spin. On pitches like these, you see that it is difficult to bat vs spin in first session and a half. I think that if India backed their defence a little more, things could have gotten easier. If India had not lost too many wickets earlier, this game could have been much closer with Rishabh Pant, Washington Sundar and Ravindra Jadeja being around,” he said.

Coming to the match, New Zealand won the toss and elected to bat first. Half-centuries from Devon Conway (76 in 141 balls, with 11 fours) and Rachin Ravindra (65 in 105 balls, with five fours and a six) placed Kiwis in a strong position at 197/3, with Ravichandran Ashwin (3/41) being the only one to have made some dents into the batting. Floodgates opened for wickets after Conway’s dismissal, with comeback man Washington Sundar (7/59) getting the remaining wickets to get NZ to 259 all out.

India was tasked to overcome this rather modest total and gain a sizeable lead. After skipper Rohit Sharma’s dismissal for a duck, youngsters Shubman Gill (30 in 72 balls, with two fours and a six) and Yashasvi Jaiswal (30 in 60 balls, with four boundaries) tried forming a partnership. However, their effort was cut short at 49 runs. Just like the first innings, dismissal of a set Gill paved way for Mitchell Santner to run through the Indian line up. Santner (7/53) and Glenn Phillips (2/26) made Indian batters dance to their tunes on their own pitches, skittling them out for just 156 runs. Ravindra Jadeja top-scored with 38 in 46 balls, with three fours and two sixes.

Kiwis got themselves in a commanding position in their second innings. Led by skipper Tom Latham’s 86 in 133 balls, with 10 fours and some important contributions from Phillips (48 in 82 balls, with four boundaries and two sixes) and Tom Blundell (41 in 83 balls, with three fours), Kiwis increased their 103-run first inning lead to a lead of 358 runs, being skittled out for 255 after some fine bowling on first session of day three by spinners.

Sundar (4/56) once again lead the bowling from the front, with Jadeja (3/72) and Ravichandran Ashwin (2/97) wiping the lower-middle order and tail.

In the chase of 359, India got a fine start from opener Yashasvi Jaiswal, who stitched a valuable 62-run stand with Shubman Gill (23 in 31 balls, with four boundaries). However, after Jaiswal’s dismissal for 77 in 65 balls, with nine fours and three sixes, India never recovered, falling a prey to Kiwi spinners and bundled out for 245, losing the test by 113 runs. With this India also registered its first home series loss in 12 years.

Santner (6/104) was once again the star, taking 13 wickets in the match, with Phillips (two wickets) and Ajaz (one wicket) also offering some support to end the Test two days early.

Mumbai: Stampede at Bandra train terminus – 9 injured, 2 critical; incident occurred due to heavy Diwali rush

On the intervening night of 27th and 28th October, at least nine people were injured following a stampede at the Bandra Terminus station in Mumbai. The incident occurred at around 2 AM on Platform number 1 before the departure of the Bandra-Gorakhpur Express. Reports suggest that the stampede took place due to a heavy rush at the terminus. When the train arrived, passengers hurried to board the train, leading to the stampede. The injured passengers have been shifted to Bhabha Hospital for treatment.

According to reports, the train was scheduled to depart at 5:10 AM but arrived at the station at 2:55 AM. Passengers panicked and rushed to board the train, leading to the incident.

News agency PTI quoted officials and identified the injured passengers of the Mumbai Bandra Railway Station Terminus stampede. They have been identified as 40-year-old Shabhir Abdul Rehman, 28-year-old Parmeshwar Sukhdar Gupta, 30-year-old Ravindra Harihar Chuma, 29-year-old Ramsevak Ravindra Prasad Prajapati, 27-year-old Sanjay Tilakram Kangay, 18-year-old Divyanshu Yogendra Yadav, 25-year-old Mohammad Shareef Shaikh, 19-year-old Indrajith Sahani, and 18-year-old Noor Mohammad Shaikh.

Mumbai has a history of stampedes at railway stations. In September 2017, 22 people were killed and 35 reportedly injured following a stampede that broke out on the pedestrian bridge connecting two stations in Mumbai. As per reports, sudden rains caused water accumulation at the stations leading to people taking foot over bridge to commute which led to chaos.

IIT Bombay invites Mahmood Farooqui, once accused of rape, to perform ‘Mahabharata’ on Diwali: Know about the case against him

Mahmood Farooqui, a film director who was previously accused of rape by an American researcher, was invited by the prestigious Indian Institute of Technology-Bombay (IIT-B) to perform Mahabharata on the occasion of Diwali.

The event titled ‘Dastan-e-Karn – AZ Mahabharat’ was scheduled for Saturday (26th October) evening. A body of volunteers named ‘IIT B for Bharat’ was one of the first to raise their objections.

“Hosting Mr. Farooqui at IIT Bombay risks conveying a message that undermines our institution’s stance on the safety, respect, and dignity of all students. For survivors of sexual assault and those who support them, his presence could create a campus environment that feels uncomfortable, triggering, and dismissive of survivors’ experiences,” it emphasised.

“On the behalf of the existing students, staff and alumni of the prestigious institution, ‘IIT B for Bharat’ stated, “Furthermore, as a premier educational institution, IIT Bombay has a responsibility to lead by example, fostering a culture that respects personal boundaries, consent, and ethical behaviour.”

“Allowing Mr. Farooqui to engage in a public performance on campus-particularly given his association with a high-profile sexual assault case-not only compromises this commitment but also risks damaging the institute’s reputation as a progressive and inclusive institution. We strongly urge the administration to take a stand for campus safety and inclusiveness by cancelling Mr. Farooqui’s scheduled performance,” it added.

The volunteer group called for the cancellation of the event, keeping in mind the accusations of rape against Mahmood Farooqui. Interestingly, he was also invited as a ‘chief guest’ at the IIT campus school and junior college.

Mahmood Farooqui holds the distinction of signing a mercy petition for Islamic terrorist Ajmal Kasab, who carried out the deadly 26/11 attacks.

Following social media upheaval over his invitation, the administration of IIT-Bombay was forced to cancel the event.

The rape case against Mahmood Farooqui

Mahmood Farooqui, the co-director of the movie ‘Peepli Live’, was accused of raping an American researcher at his residence on 28th March 2015.

The victim went to Farooqui’s house on his invite and found the accused in a drunken state. According to the woman, he kissed her against her will and forcibly performed oral sex on her.

The victim had narrated

“At   that   time   accused   kissed   me.   I   said   no.   I   pushed him away. He tried kissing me again and he said “I want to suck you”. (the witness started   weeping). I said no. He started putting his hand up my dress and pulling down my underwear from one side. I was trying to pull my underwear up from the other side. He held my arms and pinned my   arms   and   body   on   the  diwan. I   said   no.   I struggled to push him away but he was stronger   than I was. I did not understand how he could be that much strong. I was very scared. (The witness   continued   weeping   and   restless).  

I   thought   two   things. The first thing I thought “I had seen a clip from documentary of Nirbhaya case where rapist had said that if she (victim) did   not   fight, she would still be alive”. I thought I am getting out of this and going to survive. Accused forced oral sex on me. I faked an orgasm because I wanted to end it”.

The ordeal ended after the doorbell rang and the victim could escape from the scene. On reaching her home, she dialled her friend and narrated the incident. The victim had also sent an email to Farooqui, highlighting the heinous nature of the crime.

He responded with the message, “My sincerest apologies.” Farooqui was sentenced to a 7-year imprisonment by a trial court on 4th August 2016. A year later on 25th November 2017, the Delhi High Court set aside the judgment and gave the accused ‘benefit of the doubt’.

A single-judge Bench acquitted the film director of all charges, claiming that Farooqui did not understand that there was ‘no consent’ on the part of the victim.

The verdict drew a narrow interpretation of what constituted ‘consent’ and relied on the film director’s background to suggest that he was somehow ‘incapable’ of such a crime.

Coincidentally, the Supreme Court upheld the verdict in January 2018, adding that the judgment by the Delhi High Court was ‘well reasoned.’

Instagram ‘influencer’ harasses foreign tourists at India Gate for reels, leaves public outraged

On Saturday, 26th October, videos of an “influencer”, identified as Sachin Kumar, who goes by the handle “Sachin Raj Viral” on Instagram and Facebook, went viral. In the videos, Sachin was seen harassing tourists at New Delhi’s India Gate.

The videos have caused widespread outrage since yesterday. The clips showed Sachin repeatedly attempting to film dance reels with tourists who were visibly trying to avoid him. Such videos have raised serious concerns about the treatment and safety of foreign visitors in India among the online community, who have called for immediate police action.

Instagram Reels by the ‘influencer’

The video captured tourists visiting India Gate with their families and enjoying their day out. Suddenly, Sachin appears in the video and starts dancing to Bhojpuri songs, attempting to involve the tourists for his social media content. The tourists are visibly uncomfortable in the videos and are seen trying to walk away while he continues to follow them, repeatedly attempting to make them participate in the reels. In one of the videos, which was among the first to go viral on social media, the father of a foreign tourist intervened, after which Sachin retreated.

After learning about the account, OpIndia reviewed his profile and found several problematic videos. Notably, Sachin has 1.6 lakh followers on Instagram and 68,000 followers on Facebook, indicating his content is being “loved” by several social media users. Here are some of the videos from India Gate fiasco where he was seen harassing different tourist groups.

In this video, he suddenly tried to touch feet of a tourist and the man accompanying them was visibly angry.

In this video, he kept pushing a Russian group to join him in dancing.

In the following video, he danced around a foreign tourist couple who was already being harassed by another vlogger.

Netizens demand action against the influencer

The viral videos of Sachin harassing tourists has triggered a wave of anger on the social media platform X. Several netizens have expressed shame and frustration at his behaviour. Netizens tagged the Delhi Police and the Tourism Ministry, demanding immediate action against Sachin and stricter enforcement of regulations at tourist sites. The reaction from netizens indicates growing frustration over the trend of creating viral “reels” at the expense of others’ privacy and comfort, especially when tourists become targets.

The video was initially shared by social media influencer Maxtern. He wrote, “Dear Delhi Police this guy Sachin Raj is harassing foreign girls just to go viral and is degrading the name of India. Please take immediate action.”

Replying to him, popular X handle ThePlacardGuy wrote, “This dude’s entire feed is filled with him harassing people in the name of content creation. When can we expect an action on him and his ilks.”

X user Kumar Rao wrote, “Dear Delhi Police, this guy Sachin Raj is harassing foreign girls just to go viral and is degrading the name of India.

Another X user Shri Krishna Sena wrote, “Dear Bihar Police, this guy Sachin Raj is harassing foreign girls just to go viral and is degrading the name of India.”

Reel culture and India’s tourism image

India has a long history of the ethos of “Atithi Devo Bhavah,” which means the guest is like a God. Millions of tourists visit India every year to experience its culture, heritage, and renowned hospitality. For most, the experience is warm and welcoming. However, the unchecked rise of “reel culture” and the desire to go viral with “cringe content” has escalated over the past few years. Social media users have increasingly sought fame by creating sensational content, often disregarding personal boundaries, and it has become a troubling issue. Plea for additional survey at Gyanvapi complex which was rejected by court was not filed by us, clarifies advocate of the main petitioners in the case

A day after a Varanasi Court dismissed a plea for an additional survey at the Gyanvapi complex, it has been revealed that the petition was filed by a different party, not the devotees who were successful in getting a survey of the site done by ASI. Vishnu Shankar Jain, the advocate in the petition said on X that the application which was rejected yesterday was not filed by them.

Advocate Jain further said that a similar plea from their side for additional archaeological survey is already pending with the Supreme Court of India. He further added, “The proper forum for filing this application is SC. Order passed by civil judge Varanasi does not impact our case at all.”

Notably, the application rejected by the Varanasi court was filed by Advocate Vijay Shankar Rastogi, acting as the next friend of Lord Vishweshwar in the case. He had filed the plea in the Fast Track court seeking an order for ASI to conduct an extensive survey of the entire Gyanvapi complex.

The Archaeological Survey of India (ASI) conducted a survey of the Gyanvapi complex last year, the report of which was published in January this year. The report said that the study and survey of the structure strongly suggests the existence of a substantial Hindu temple structure at the Gyanvapi mosque complex.

The ASI survey was the result of a petition filed by five women, who petitioned to be allowed to pray at the ‘Shringar Gauri Sthal’ inside the Gyanvapi complex. After the publication of the survey report, they have already applied for Archaeological Survey of India (ASI) survey of the rest of the basements in the mosque premises, which were not included in the first survey.

FIR registered against Jharkhand Congress leader Irfan Ansari for derogatory remarks against BJP’s Sita Soren

Jharkhand Additional Chief Electoral Officer, Neha Arora on Saturday said that an FIR has been registered against Jharkhand Minister Irfan Ansari for allegedly making derogatory remarks about BJP leader Sita Soren in Jamtara district.

“A case of MCC violation has been registered. An FIR has been registered in Jamtara district for violating MCC provisions. Strict advisory has also been issued to all the political parties in this regard,” Neha Arora said.

Union Minister Annapurna Devi said the statement made by Irfan Ansari exposes the mentality of the Congress party.

“He (Irfan Ansari) has given a very wrong statement on Sita Soren. This exposes the mentality of the Congress party. The Congress party is anti-women and anti-youth…I condemn this statement…Will Rahul Gandhi take back the tickets given to people with such a low level of thinking?… The Congress party should remove such people from the cabinet,” Annapurna Devi said.

Meanwhile, BJP leader Sita Soren said that she is unable to understand where he gets the courage to make such statements.

“I am unable to understand where he gets the courage to make such statements. Who is giving him the courage to make such statements, because no one has ever made such statements against me in Jharkhand…The party has informed the Election Commission about his statement. We will not forgive him…The entire tribal population is angry,” Sita Soren said.

BJP leader Ragini Singh said that insulting women is the policy of the Congress party.

“This is his mentality. It is the policy of Congress to comment on a woman but BJP policy is to respect all the women whether they are of Congress or of BJP,” Ragini Singh said.

Irfan Ansari, the Congress candidate from the Jamtara constituency, stirred controversy with his remarks about Sita Soren, the Bharatiya Janata Party (BJP) candidate from the same constituency, calling her “rejected” and a “borrowed player.”

On Friday, Sita Soren posted a video on X, claiming that the Congress leader referred to her as “rejected” and a “borrowed player” while responding to a journalist’s question about competing against her in the upcoming election.

The BJP leader also demanded an apology from Ansari for using “indecent language” against her, stating that the public would respond to him.

“Congress @INCIndia candidate Irfan Ansari must apologise for the indecent language he used against me in front of the media immediately after filing his nomination. He has previously made personal comments about me, but this time he has crossed all limits. Irfan ji @IrfanAnsariMLA, apologise, or be prepared for fierce opposition,” she posted on X.

“The indecent words you used while holding such a respected position have alarmed women across society. If you can use such words for me, what must poor and vulnerable women face? As long as such leaders remain in power, women will remain unsafe. The time has come to remove them from power. The way you look at women is now before the public, and the public will respond,” the BJP leader added.

The BJP will contest the upcoming Jharkhand assembly elections in alliance with the All Jharkhand Students Union (AJSU), Janata Dal (United), and Lok Janshakti Party (LJP). BJP will contest 68 seats, AJSU 10 seats, JD-U two seats, and LJP one seat.

Union govt issues advisory to curb hoax bomb threats on social media, directs platforms to remove and report threats, cooperate with authorities

Amid the relentless hoax bomb threat calls to flights in the country, the union govt on Saturday issued detailed guidelines to tackle the issue. The Ministry of Electronics and Information Technology (MeitY) has issued an advisory emphasizing the responsibility of intermediaries, including social media platforms, to curb the spread of hoax bomb threats to the various airlines operating in India.

MeitY has stressed that social media intermediaries must adhere to the IT Act, 2000, the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Bharatiya Nyaya Sanhita (BNS), 2023 and these platforms are required to promptly remove unlawful content to maintain public order and security.

The ministry said that the instances of malicious acts in the form of hoax bomb threats to such airlines lead to potential threats to the public order & security of the state. Such hoax bomb threats while affecting a large number of citizens also destabilises the economic security of the country.

Further, the scale of spread of such hoax bomb threats has been observed to be dangerously unrestrained due to the availability of the option of “forwarding/re-sharing/re-posting/re-tweeting” on social media platforms. Such hoax bomb threats are mostly misinformation that is massively disrupting the public order, operations of airlines and security of the airline travellers, said the guideline.

Due diligence obligation under the IT Act and Rules

In this regard, the ministry reiterated that that intermediaries including social media intermediaries have a due diligence obligation under the Information Technology Act, 2000 (“IT Act”) and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (“IT Rules, 2021”) to promptly remove such misinformation that affects public order and security of the state.

The notification states that as part of such due diligence obligations, it is the responsibility of concerned intermediaries including social media intermediaries to promptly take necessary action under the IT Rules, 2021 by not allowing any user to host, display, upload, modify, publish, transmit, store, update or share any unlawful or false information.

Further, the exemption from liability for any third-party information, data, or communication link made available or hosted by social media intermediaries as provided under section 79 of the IT Act shall not apply if such intermediaries do not follow the due diligence obligations as prescribed under the IT Act read with IT Rules, 2021 or abetted or aided, in the commission of the unlawful act.

In case of failure of the intermediaries to observe the due diligence obligations as provided in the IT Rules, 2021, the provision of section 79 of the IT Act shall not be applicable to such intermediary and they shall be liable for consequential action as provided under any law including the IT Act and the Bharatiya Nyaya Sanhita 2023 (“BNS”).

The Ministry has reiterated the following key responsibilities for intermediaries including the social media intermediaries:

  1. Prompt Removal of Misinformation: Intermediaries including social media intermediaries must observe their due diligence obligations and disable or remove access to unlawful information, including hoax bomb threats, within strict timelines.
  2. Reporting of Offenses under Bharatiya Nagarik Suraksha Sanhita, 2023: Intermediaries must report activities or act that threaten or are likely to threaten the unity, integrity, sovereignty, security, or economic security of India
  3. Cooperation with Government Agencies: Social media intermediaries are required to provide relevant information and assistance to authorised government agencies within stipulated time frames (as soon as possible but not later than 72 hours) to aid in investigations or cybersecurity efforts.
