The ‘bone’ of contention behind the ‘Fine for Biryani at JNU’ story

0

Something is always cooking in JNU. Today, news broke that a JNU student had been fined for cooking Biryani. Business Standard used this headline:

A journalist further claimed that the student was fined for eating Biryani:

Just recently the JNU VC was subjected to a farcical kangaroo court by left leaning faculty. Today too, people did not lose the chance to attack the JNU VC. Reactions on social media too showed their outrage over this seemingly “sanskari” fine:

Congress leader Shehzad Poonawalla, who is not related to the other famous and respectful Poonawallas, and who is in a constant fight to set newer lows in political discourse, also chose to attack the BJP Government at the centre:

So was a JNU student victimized for merely cooking or eating Biryani as some have claimed? Not quite. The complete picture was revealed with a copy of the order which levied the fine:

The student was in fact fined for cooking food near the stairs of the Administrative Building. Subsequently, he along with other students ate the item there as well. The order makes clear, the problem was the fact that food was being cooked near the stairs of the Administrative Building, and not the Biryani.

Thankfully, most other media houses had at least reported the full facts in the headline, unlike the Business Standard which carried a click-bait, truncated headline, while mentioning the core issue in the article:

Even so, a Rs 6000 fine for some innocent students cooking Biryani could be a bit steep. But was this an innocuous act of cooking food or Biryani at a random place? Probably not.

The incident has got more to do with the hatred the JNU VC has been facing in recent times. A report claims that the JNUSU president Mohit Pandey and Satarupa  Chakraborty had gone to the V-C office to raise students’ issues. However, after the V-C allegedly did not meet them, they camped outside the Administrative Block overnight and made biryani. This was a form of protest, because prior to this, the JNU administration as well as the Delhi High Court had banned protests within 100 metres of the Administrative Block.

The report further claims that for the above, Chepal Sherpa, Amir Malik and Manish Kumar — were fined Rs 6,000 each, and former JNU Students’ Union general secretary Satarupa Chakraborty was been fined Rs 10,000. She was also punished under another clause for “leading the protest demonstration along with slogan shouting against Vice-Chancellor, administration and Professor Atul Johri, and sitting inside the V-C’s office… even after repeated requests from CSO (Chief Security Officer) and security personnel”.

Not an incident of merely cooking or eating Biryani then? Also the question arises, Why did the students choose only Biryani? It certainly isn’t the easiest to cook. Or was it because they wanted it to be Biryani so that the usual suspects could make it a BJP vs Biryani, or better yet, BJP vs Beef issue? Cooking Khichdi in protest doesn’t have the same ring now does it?

Supreme Court refuses to entertain petition which sought a minority status for Hindus in 8 states

0

The Supreme Court on Friday refused to entertain a petition which sought a minority status for Hindus in 8 states of the country.

This petition was recently filed in the apex court by Ashwini Kumar Upadhyay whose PIL sought that Hindus be given a minority status in, Lakshadweep, Mizoram, Nagaland, Meghalaya, Jammu and Kashmir, Arunachal Pradesh, Manipur and Punjab.

As per Upadhyay who is also a Delhi BJP leader, the Hindus were being treated as a majority in those states, despite being in the minority and as a result were being deprived of the resulting facilities.

A check of the demographics as per the 2011 census reveals that, there are a total of, 2.77% Hindus in Lakshadweep, 2.75% Hindus in Mizoram, 8.75% Hindus in Nagaland, 11.53% Hindus in Meghalaya, 28.44% Hindus in Jammu & Kashmir, 29.04% Hindus in Arunachal Pradesh, 38.49% Hindus in Punjab and 41.39% Hindus in Manipur.

Out of these 8 states, 4 states have a Christian majority, two have a Muslim majority, one has a Sikh majority. Manipur has a threadbare Hindu majority by only 0.10% since the Hindu population is 41.39% and the Christian population is 41.29%.

Advocate Upadhyay also stated that the Central government offered 20,000 scholarships to minority students, in the field of technical education. In Jammu & Kashmir even though there are 68.30% Muslims, 717 out of 753 scholarships still went to Muslims and none went to a Hindu as a 1993 notification declares Muslims as a minority and not Hindus.

The petition also alleged that the minority rights of Hindus in those 8 states are being siphoned off as neither the Centre or State governments have notified Hindus as minorities under Section 2(c) of National Commission for Minority Act. Which as per the petition deprived Hindus of their basic rights which are guaranteed under article 25 to 30.

Till date, 6 communities namely Muslims, Christians, Sikhs, Buddhists, Parsis and Jains are notified as minority communities.

The Supreme Court though didn’t entertain Upadhyay’s plea and in-turn asked him to approach the National Minorities Commission. As per the bench headed by Justice Ranjan Gogoi, they cannot issue such orders and the minority commission is the most competent body.

The appearing advocate though had argued that the Minority Commission only dealt with national level decisions and did not look into state level demands, hence the Supreme Court could decide. This, unfortunately, failed to cut ice with the court.

ShivpratapDin: Remembering first significant military victory against Adilshahi forces

0

On this day, back in 1659, Battle of Pratapgad was fought between the forces of the Maratha king Chhatrapati Shivaji Maharaj and Adilshahi general Afzal Khan, near the town of Satara, Maharashtra, where the Marathas emerged victorious despite the numbers not being in their favour. It led to the eventual establishment the glorious Maratha empire. In 1657, Aurangzeb, the Mughal leader with a heart of gold as described by so called liberals, decided to leave the Deccan and march northward. Shivaji, in his bid to expand his Maratha empire started winning over Konkan and other Adilshahi kingdoms.

Afzal Khan, the commander of the Adilshahi dynasty in Bijapur Sultanate, presently in Karnataka, took upon himself to stop the forces of Shivaji. He had earlier killed Shivaji’s brother, Sambhaji Shahaji Bhosale, through treachery when he was just 33. Khan started destroying temples (not surprising). Khan’s strategy was to bring Shivaji in open in the Deccan plains as against the rocky plateau where Shivaji had an advantage, and overpower him since they outnumbered the Marathas. Armed with over 20,000 Adilshahi cavalry and 15,000 infantry over 6,000 light cavalry and 3,000 light infantry of Marathas, Khan and Shivaji met on the foothills of Pratapgad. Shivaji sent out an emissary to Khan that he did not want to fight and wanted peace.

They had decided to meet unarmed with just 10 bodyguards each, who would stay within an arrow’s distance from the two men. A towering figure, Khan hugged Shivaji, but in a treacherous move, tried to kill him with a sword. However, Shivaji had come armed as well and the force was repelled by Shivaji’s armour which was underneath his clothes. Shivaji, who had concealed a bagh nakh (curved blades fixed to a crossbar) and disemboweled Khan when they embraced in the tent.

Bagh Nakh

A hand to hand combat ensued where the Marathas, though having been outnumbered by Adilshahi forces, emerged victorious. Shivaji was attacked by Sayyed Banda, Afzal’s body guard, but his trusted bodyguard Jiva Mahala came to the rescue, cutting him down, saving Shivaji’s life.

Such is the story of valour and courage of Shivaji that he is respected across India. Karnataka Chief Minister Siddaramaiah even said that Shivaji belonged to Karnataka since his ancestors were from Vijaypura in Karnataka and his father died in Davangere, again in Karnataka.

However, when it comes to honouring a great warrior like Shivaji, same Siddaramaiah shies away and chooses to glorify a bigoted ruler who plundered Hindu temples.

Not just that, a full page ad was published in papers by Karnataka Government led by Siddaramaiah to celebrate “Hazarath Tippu Sultan Jayanthi”

He is the same Tipu Sultan who hanged women and children.

He even indulged in forced religious conversion by forcing Hindus to eat beef.

He has left behind a legacy of destroyed temples in Kerala.

Despite the atrocities, Siddaramaiah government decides to celebrate Tipu Sultan, who looted and plundered instead of Shivaji Maharaj, whom he once hailed as son of his own soil.

Perhaps the demands of ‘secularism’ trump honouring men who fought for our right to breathe and live by defeating the forces of tyranny and oppression.

Twitter users start their own version of ‘KnowYourLegacy’ and it’s hilarious

0

The official Congress Twitter ID has been posting various polls under the “KnowYourLegacy” hashtag in a bid to get people talking again about the grand old party. While this idea itself has been plagiarised from BJP’s ‘KnowYourGovt’ polls, the gaffes Congress seems to make, are completely novel.

Earlier today the Congress IT Cell made a hilarious gaffe when they put up a poll asking “Named in the honour of Indira Gandhi, what is the northern most point of India called?” The northern most point of India is called “Indira Col”, named in 1912, 5 years before Indira Gandhi was even born.

Twitterverse wasted no time in coming up with their own hilarious version of “KnowYourLegacy”, mocking the Congress Party’s need to attribute everything, sometimes unrelated, to the Dynasty.

Here are some of the tweets that cracked us up

While this twitter user used a movie title to mock the ‘Indira Col’ gaffe

This Twitter user responded by saying that Lord Indira was perhaps named after Indira Gandhi

We certainly hope Congress doesn’t end up taking these twitter users seriously, considering they proudly assert “India is Indira, Indira is India”

While Congress party’s endless bloopers are a constant source of entertainment, Twitter’s creativity always leaves us laughing.

Breaking the back of terror : After Kashmir, NIA to now investigate funding received by Naxals

0

The National Investigative Agency (NIA) in recent months has been in the news for investigating the funding that Kashmiri separatists receive to promote terror activities in the valley.

We have chronologically reported the action taken by NIA in the valley which includes:

  • Raiding 23 locations related to the Pakistani funding which the Kashmiri separatists are believed to have received.
  • Detaining Syed Ali Shah Geelani’s son-in-law and about a month later, summoning Geelani’s sons in connection with its probe.
  • Bringing in journalists and retired judges under the radar of its investigation.
  • Arresting 7 Hurriyat leaders including the dreaded Bitta Karate.
  • Summoning a PhD student a trade body chief.
  • Arresting notorious stone pelters and also identifying 79 WhatsApp groups, 117 individuals who led stone pelting groups and gave instructions over WhatsApp. Some of the admins of these WhatsApp groups were based out of Pakistan.
  • The investigative agency has also created ripples in the political circles by questioning a sitting Jammu and Kashmir MLA named Rashid Engineer, over his possible links to businessman Zahoor Watali who was arrested by the agency in August and highly incriminating material was recovered from his home.

As per reports the NIA has now even started to focus on the possible funding received by Naxals.

The report claimed that a NIA team will be dispatched to investigate a Naxal funding case dating back to August. In this case, the brother of CPI (Maoist) leader Sudhakar, named B Narayan and his business partner Satyanarayan Reddy were arrested by Ranchi police while carrying about Rs 37 lakh worth of cash and gold.

The duo were in possession of Rs 25 lakh in cash and half a kilo of gold biscuits which was allegedly meant for Maoist leader Sudhakar’s family in living in Telangana.

The agency as a result will be investigating an inter-state module involving Jharkhand and Telangana while also actively probing the Maoist trail in Telangana. Maoist leader Sudhakar is believed to collect levies from his associates in Palamau, Garhwa, Latehar, Lohardaga, Gumla and Simdega districts. He is also known to extort money from businessmen involved in mining, road construction type activities in forested areas of Chhattisgarh, Maharashtra and Odisha.

Such a focus on the Naxal funding may not mean that the NIA has gone cold on the Kashmir terror funding front. On Tuesday the agency arrested 9 people and recovered a whopping Rs 36 crores in demonetised notes in connection with its Kashmir probe.

#KnowYourLegacy: this Twitter user tells Congress to #LearnYourHistory

0

Congress, which has copied its bloopers filled #KnowYourLegacy campaign from BJP’s #KnowYourGovt campaign, is time and again trolled on Twitter by users who remind Congress of the horrors inflicted by Congress leaders on Indians. The audacity Congress has in equating Nehru-Gandhi dynasty’s history to history of India is unfathomable. They are so blinded in the love for The Dynasty that they believe every other thing in India has been and named in honour of The Family.

Doesn’t quite come as a surprise that all three prime ministers from The Dynasty got a Bharat Ratna, of which Nehru recommended himself for the highest civilian award and while it is unclear who recommended Indira for the award, chances are she too recommended herself for the award.

The Family has been so self obsessed that they have covered the length and breadth of the country naming every other road, airport, educational institute, locality, metro station after them. But in the mad rush for naming things after them, Congress social media team forgot that not everything that is named Indira in India is named after Indira Gandhi. Yesterday, Congress Twitter account ran a quiz asking which northern most point in India is named after Indira Gandhi.

Most people answered Indira Point in Andaman and Nicobar Islands, which is the southern most point in India (not norther most as in the quiz), named after Indira Gandhi, the then Prime Minister of India, by a local MP.

A Twitter user took a jibe on Congress and said how they need to #LearnYourHistory to understand that not everything in India is named after The Family, thankfully.

The northern most point in India is named Indira Col, but it is not named after Indira Gandhi. It was named in 1912, 5 years before Indira Gandhi was born in 1917.

Perhaps Congress should hire a fact checker before posting lies and glorifying The Family.

People amused as Kejriwal praises himself using an article written by his own party’s website

0

Delhi and its surrounding areas in recent days have become riddled with hazardous levels of smog. This as per experts has been caused due to stubble burning by farmers in areas nearby Delhi-NCR. The smoke emanating due to this burning of stubble has been trapped in the Delhi-NCR region due to the westerly winds bringing it into the region and easterly winds reducing the temperature and trapping the fumes.

We had reported yesterday, how while this whole pollution situation was panning out in Delhi, its Chief Minister Arvind Kejriwal and Punjab’s Chief Minister Amarinder Singh were seen passing the buck when it came to taking action. Kejriwal via his tweets was seen urging Amarinder Singh to grant him a meeting to discuss the pollution woes, while the latter was not agreeing to it.

Amarinder then passed the buck on to the centre and Kejriwal decided to play on to again request Amarinder to grant him a meeting so that they both together could “urge” the centre.

Kejriwal was embarking on such an exercise even though his own party leader from Punjab was seen burning stubble in October in order to push the Amarinder government to agree to a few farmer related demands.

After this episode played out, AAP’s website came out with an article titled (translated to English), “Delhi CM Arvind Kejriwal is fighting a solitary battle against air pollution”.

This article began with claiming how the Delhi CM by executing all his responsibilities was appealing to the Centre, Haryana government and Punjab government to schedule a meeting for finding ways to alleviate the pollution.

Then in a tone favouring Kejriwal, detailed his episode with Amarinder Singh and embedded tweets of journalists who seem to have supported Kejriwal in this matter, before concluding the report by taking the moral high ground and bashing the centre in one of the sentences.

After this article went live, Kejriwal decided to tweet it with the commentary that, Kejriwal was fighting a solitary battle against air pollution in Delhi:

Such a tweet amused a lot of people who felt it was an exercise in self praise by Kejriwal, even as Delhi is far from cured of the said pollution:

One user even sarcastically praised Kejriwal for this act:

It is certainly amusing to note that a political leader is spending his time indulging in such self promotion on twitter instead of coming up with a long term plan for ridding the capital of such pollution woes in the future.

Read how Congress regularly plagiarises and steals content

0

In a major embarrassment for Congress, cartoonist Satish Acharya has accused Congress of using his cartoons without permission and removing his signature. Karnataka unit of Congress had put up posters in local language, which were Acharya’s cartoons with a caption in Kannada. However, not only did they not take his permission to use them commercially, they even removed his signature from the cartoons and used it as their own.

This is not the first time Congress has done this. Earlier, Manjul, another cartoonist had accused Congress of mutilating his cartoons, that too without his permission.

Congress media cell are serial plagiarists when it comes to lifting ideas and concepts. Congress tried to copy BJP’s #KnowYourGovt strategy to speak about the government and various initiatives by bringing about the #KnowYourLegacy campaign. However, it failed badly as Congress has been trolled multiple times for the goof up galore of the IT cell. We had also reported how the idea of “Indira canteen” in Karnataka may have been directly lifted from the food subsidisation programme run by Tamil Nadu Government, “Amma Canteen”, which Rahul Gandhi inadvertently ended up crediting.

In an even more hilarious copy-cat instance, Gujarat Congress, which is harbouring hopes of revival in Gujarat, seems to have borrowed their tagline, “Congress Aave Chhe” from a cooking oil brand, Pankaj, which had the tagline “Pankaj Aave Chhe”, months before Congress came up with the tagline. Earlier, too, Congress had ‘copied‘ the ‘Main Nahin, Hum’ tagline of Gujarat government chintan shivir during their 2014 campaign.

Not only media cell, even former ministers from the UPA have been accused of plagiarism. The Hindu had published an article ‘From welfare to paternalism’ by Veerappa Moily, on June 11, 2015, which they had to withdraw after charges of plagiarism were put on Moily. As reported, several paragraphs under a subheading were copied from another article by G Sampath which was published on 26th May, 2015, ironically in The Hindu itself. Also speaks volumes about the editorial standards of the publication.

Seems like Congress steals not just our money, but also our ideas.

Radicals issue fatwa, death threats against Muslim woman to stop her from teaching yoga

0

A Muslim woman from Jharkhand who is famous for teaching Yoga has now attracted the ire of few radicals who have issued a fatwa against her for this act. As per reports, the woman has also been at the receiving end of death threats, after which the administration has decided to tighten her security.

The woman named Rafia Naz, came into public focus after her photos of her doing yoga with Baba Ramdev went viral.

This seems to have angered a few members of her community who, as per reports, threatened her on Tuesday, not to teach yoga to anyone. Soon, this matter came to the attention of Jharkhand Chief Minister’s Principal Secretary Sanjay Kumar.

He as a result, directed the police to increase Rafia’s security. Ranchi’s senior superintendent of police, Kuldeep Diwedi subsequently dispatched a police force to meet Rafia. Later as per a report issued by Jharkhand police, she has been given two bodyguards.

Rafia is the eldest among her siblings and teaches yoga for a living. She is also pursuing her M. Com at a nearby college. As a result of her threats, her family members are now concerned for her well-being.

As per a statement given to the media she has expressed dissatisfaction with both Hindus and Muslims. As per her, on one hand she is being threatened not to teach yoga and on the other hand she is being asked to change her name so that people don’t hesitate before learning yoga from her.

She has put up a brave face during this whole episode and has asserted that she will continue teaching yoga for life.

Recent days have seen a sudden spurt in fatwas issued against various individuals and acts.

In October the Darul Uloom Deoband in Saharanpur, Uttar Pradesh, issued a fatwa banning Muslims from posting their pictures on social media. Darul Iftaa decreed that men and women should refrain from posting their or their family’s picture on social media as such an act is considered un-Islamic.

A few days later we had reported how the Deoband Ulema proclaimed that Muslim women who had famously performed Aartis in Uttar Pradesh, were no longer Muslims as if any Muslim prays to anyone except Allah, they have forsaken Islam.

Brother of Congress leader Ashok Gehlot in eye of ‘fertilizer scam’ as Rahul sings pro-farmer tunes

0

Rahul Gandhi has left nothing to chance in projecting himself as a pro-farmer messiah to reverse the sagging fortunes of Congress party, but a ‘fertilizer scam’ in Rajasthan, which features brother of Ashok Gehlot – the former Chief Minister of Rajasthan who was appointed in-charge of Gujarat Congress in April this year – could ruin the ambitious plans thrashed out by his spin masters.

It has emerged that Agrasain Gehlot, the brother of Ashok Gehlot was allegedly involved in a corruption scandal between 2007 and 2009 that involved diversion of a crucial ingredient used for making fertilizers – all of which were actually meant for farmers in distress. Essentially, government concessions available to pass benefits to the farmers were allegedly misused to create benefits for oneself and private companies.

According to documents available, this scam largely took place when Ashok Gehlot was leading the state government in Rajasthan and Manmohan Singh was leading the central government at Delhi. It is alleged that Agrasain Gehlot, during the period 2007 to 2009, was part of a conspiracy to export tonnes of Muriate of Potash (MOP) against shipping bills by falsely declaring it mostly as Feldspar Powder or industrial salt; the total value was also falsely declared against the then correct actual value. This resulted in diversion of items that were actually meant for the farmers.

The irregularities and the scam

The zonal unit at Ahmedabad of the Directorate of Revenue discovered that a firm was exporting MOP, which is a restricted commodity for exports, under the guise of feldspar powder or industrial salt to buyers in Malaysia and Taiwan. MOP, also known as or Potassium Chloride, is a soil nutrient used in manufacture of non-urea fertilizers.

There are no viable sources of MOP in India. Since India does not produce MOP, its demand is met by imports and the government provides subsidy on imports. Indian Potash Limited (IPL) is the company that imports bulk of MOP catering to domestic demand. The demand, however, always tends to exceed the availability. The soil nutrient is meant for domestic consumption by the farmers and its export is subject to severe restriction including prior permission of Department of Fertilizers and forfeiture of the custom duty exemptions.

A standard sack of imported MOP, which clearly shows that it has to be sold only to farmers and that it is subsidized. It is alleged that this packing was changed to hide the identity of the content, and MOP was illicitly exported by some firms.
A standard sack of imported MOP, which clearly shows that it has to be sold only to farmers and that it is subsidized. It is alleged that this packing was changed to hide the identity of the content, and MOP was illicitly exported by some firms.

Concessions and subsidies are granted on import of MOP so that fertilizers are available at low cost to the farmers. The dealers of IPL are mandated to sell MOP only to farmers. However, instead of selling them to farmers who can use it judiciously, some firms were found indulged in exporting them to foreign customers and making profits.

After investigating some firms and their activities, the Commissioner of Customs, Kandla concluded that the firms and the associated people were willingly involved in a syndicate that caused losses to the government exchequer in range of crores of rupees, and to the farmers by virtue of unauthorized sale of MOP.

The order by Commissioner of Customs, which is with OpIndia, bares the modus operandi employed by the firms and its associates, which involved manipulations and forgery to camouflage their chain of operations and quantum of business. The order goes onto further state that the syndicate clearly knew what they were doing, and that the sales documents were manipulated to show that the MOP was sold to farmers while it was never sold to them.

Commissioner of Customs order
A part of order by the commissioner of collector, Kandla. Anupam Krishi is the firm owned by Agrasain Gehlot. This part highlights one of the wrongdoings employed in the scam.

The Commissioner of Customs records statement by a person named Dineshchandra Agarwal, who founded the firm that exported the MOP in violation of rules. Agarwal accepted in his statement that he got involved in the whole syndicate as his financial condition was not good. He was paid a monthly remuneration for opening a firm and obtaining an Import Export Code.

Agarwal also admitted that the syndicate used fake bills to show having bought feldspar powder or salt, which was then used to wrongly label MOP as feldspar power or salt and export it. Firms supplying such fake bills (bills generated without any actual physical sales) were given commission in return. The syndicate used to change the original packaging of Indian Potash Limited to camouflage it as feldspar powder or salt, and export it.

The role of Agrasain Gehlot

In the entire supply chain of MOP being illicitly exported and sold, the crucial part of MOP being obtained relates to Agrasain Gehlot, which has been highlighted in the order by the commissioner of customs. Excerpts from the said order are hereunder:

  • Agrasain Gehlot, a dealer for Indian Potash Limited (IPL), was given MOP by IPL to sell it to farmers, but he sold it to people who subsequently exported it.
  • Agrasain Gehlot was made all payments in cash, account of which was not proper in the books.
  • The person acting as the middleman in this whole syndicate was known to Agrasain Gehlot.
  • Agrasain Gehlot was the custodian of subsidised imported MOP and he knew that it was an offence to sell it to anyone other than farmers, but he manipulated sales document of his firm to show that MOP was being sold to farmers while in reality it was being subsequently exported.

Agrasain Gehlot rejected these charges, and his version is recorded in the order by commissioner of customs. He instead claimed that the middleman used to buy from him in name of farmers and he did not know that MOP was subsequently being exported. He claimed to have not sold MOP directly to the middleman, whom he also accused of possibly having ‘lifted’ the MOP from the ‘buffer godown’ of IPL, entire stock of whose was being handled by Agarsain Gehlot.

However, the commissioner order concludes that Agrasain Gehlot was giving contradictory statements and that he has a habit of suppressing facts thereby misleading investigations. The order goes on to state that Gehlot connived with other persons and knowingly indulged himself in diversion of the MOP, playing a very vital role in the fraudulent activities. In fact, the order even claims that Gehlot accepted that he gained certain commission for his role.

Brother of Ashok Gehlot accused of being part of fertilizer scam
Accusations against Agrasain Gehlot

The order of Commissioner of Customs was based on the Customs Act, 1962, and it imposed penalties on various firms under Section 114.1 of the Act, which provisions for penalty for attempt to export goods improperly, and under Section 114AA, which provisions for penalty for use of false and incorrect material.

With various firms charged with aiding and abetting diversion or illegal transportation of MOP imported at concessional rate of duty in the guise of Feldspar Powder, the customs order imposed a penalty of Rupees 5.45 crores specifically on Gehlot’s firm “Anupam Krishi” for being part of the fraud.

Brother of Ashok Gehlot penalized for allegedly being part of the scam
Customs commissioner found Agrsain Gehlot complicit and imposed a penalty.

Others involved too had similar amounts imposed on them as penalty for their deeds.

The parties moved to the West Zonal bench of Customs, Excise And Service Tax Appellate Tribunal at Ahmedabad challenging the commissioner order and sought a stay order, especially seeking waiver of the pre-deposit of the amounts as penalties imposed by the adjudicating authority. The tribunal refused to grant complete waiver but reduced the amount for pre-deposit via an order in August 2014, though the overall matter is currently pending in the tribunal.

While Agrasain Gehlot and others have challenged the customs commissioner’s order imposing penalties, a close perusal of the seriousness of the allegations in the order suggests that the activities could as well attract application of Section 132, which provisions for imprisonment for false declaration, false documents, etc. or Section 135, which provisions for imprisonment for evasion of duty or prohibitions. In fact, even Prevention of Money Laundering Act, 2002 could also have been applied, which has even stricter punishments.

Prevention of Money Laundering Act, 2002
Money laundering charges are more serious and provision even for imprisonment.

One can only speculate the reasons for not invoking harsher sections or acts; whether it was due to involvement of brother of a Chief Minister, or if the commissioner had some other information that is not publicly available.

OpIndia.com reached out to Agrasain Gehlot for a response, and he confirmed that the said matter was pending in the appellate tribunal. He denied all the charges and claimed that the retail sales by his firm formed a small part of his overall business, for which he has been unfairly accused of wrongdoing. He further said that he is actually suffering because of being relative of Ashok Gehlot and that the probe findings against him were politically motivated.

This is not the first time a relative of Ashok Gehlot is in spotlight. Ashok Gehlot has earlier been accused of favouritism and giving benefits to his family members, including Agrasain Gehlot. In March 2013, media reports claimed that Ashok Gehlot had admitted that Agrasain Gehlot was one of the beneficiaries of allotment of sandstone mines near Jodhpur. It was alleged that allotment norms were changed to benefit Chief Minister’s relatives.

The farmer politics

Congress has been raising farmer issues in various parts of the country, and people associated with the party were suspected to be instigating violence in areas like Mandsaur in Madhya Pradesh earlier this year in name of farmer protests.

Earlier in the run up to Uttar Pradesh assembly elections, Rahul Gandhi had organized “Khat Sabhas” in order to attract support of farmers. The Congress Vice President, rather ridiculously, even claimed credit when BJP government in Maharashtra and Uttar Pradesh announced farm loan waivers. The same rhetoric is now being employed in Gujarat assembly elections too.

In his “Navsarjan Yatra” in Gujarat, Rahul has repeated his farmer rhetoric many times by spreading lies about how big industrialists get loan waiver but farmers don’t, and made wild charges about other issues concerning farmers such as land acquisition and farmer suicides.

However, this incident of farmers being cheated during Congress tenure in Rajasthan could prove to be an embarrassment for the Congress party and its Vice President Rahul Gandhi, especially because party’s General Secretary Ashok Gehlot has been appointed by the party as in-charge of Gujarat. The party could face questions over farmer welfare, when profits were made at farmer’s expense during Congress governments both in the state and at centre.

Ashok Gehlot with Rahul Gandhi during an election rally at Rajasthan in 2014
Rahul Gandhi with Ashok Gehlot

Ashok Gehlot has already come under fire last month from none other than Prime Minister Narendra Modi himself, who recalled that Gehlot, who was then the Chief Minister of Rajasthan, had tried to scuttle Sujalam Sufalam project to supply Narmada water to areas of North Gujarat. Modi said that the project was badly needed to save the farmers of North Gujarat, but Congress had tried to oppose it. A set of farmers from the region had later termed Gehlot “anti-farmer”.

Perhaps the “anti-farmer” jibe can come back to haunt Ashok Gehlot and Rahul Gandhi given the latest findings and election mood in Gujarat.
