Exclusive story of Christian Michel’s extradition and how the grand plan was implemented by CBI and Ajit Doval

The middleman Christian Michel in the Agusta Westland Helicopter Scam was extradited by the Dubai Government and was brought to India by a special plane on December 5th. He is the witness and the accused alive in this Rs 3,600 Crore scam. It indeed is a great achievement of the Government to extradite and bring him to India. Calling it another Surgical Strike wouldn’t be an exaggeration.

The credit of this massive feat is due to the seamless coordination between NSA Ajit Doval and the CBI.

How did this action plan get in place? How did Ajit Doval plan it? What were the games Christian Michel played with CBI to dodge the imminent extradition?

CBI and other sources have revealed some startling details of the entire saga of how the plan unfolded and how, the unthinkable was achieved to extradite a man who possibly holds several secrets, Christian Michel.

Agusta Westland

This by no means is the first scam related to Agusta Westland. Its shenanigans extend up to South Korea, India and Panama. It had sold Westland Choppers to South Korean army by conniving with Army officials and those close to them by bribing them with amounts running into crores. Tenders were manipulated to make them eligible to supply Choppers of inferior quality. This scam got exposed and those Korean beneficiaries involved, including Army officials and middlemen, were punished.

It is common knowledge as to what happened in India. For VVIP transport, the specifications for the Choppers included its ability to fly at altitudes of 6000 meters. Agusta Westland choppers did not have required safety clearances to fly at those altitudes. In order to qualify and bag the tender, Agusta Westland attempted to exert influence to reduce this altitude to 4500 meters in the tender specification. Christian Michel is the middleman who allegedly bribed then ruling Congress family. To get flying clearances, he also allegedly bribed Air Chief Marshal SP Tyagi through his sister, Julie Tyagi.

In Panama, Agusta Westland had sold military equipment and choppers. Since the accusation of kickback was directly against their President, the agreement was cancelled. All this information is available in the UK based Corruption Watch report. This may not constitute official records, authorities have conducted anti-corruption operations based on these documents.

Entry of Christian Michel

Christain Michel was not part of this deal in the initial stages. Giuseppe Orsi and Bruno Spagnolini were allegedly in India much before him. In 2013, in Italy, they were charged with invoicing fraud and corruption charges and sent to jail.

After several stages of legal fights, Italian courts finally sentence them for 2 years in prison on charges of Invoicing fraud. In the interim, they had appointed 3 middlemen for India. Guido Haschke, Carlo Gerosa and Christian Michel. In the beginning, the deal was being managed by Haschke but since Christian Michel was a resident of Dubai and with excellent relationship with India and Congress family and also with good knowledge of Indian market, Haschke brought Michel to the forefront.

In October 2014, Italian Supreme Court overturned the verdicts of lower courts and ordered that it was not only an invoicing fraud but corruption was also involved. At this juncture, all 3 middlemen nominated by Orsi and Spagnolini were in different countries and thus escaped action.

The plan behind the arrest of Michel

In view of the charges against him in Italy, UK Citizen Michel became a resident of Dubai and used to surface off and on. On knowing that CBI and Indian Intelligence agencies were on the lookout, he used to disguise himself wearing long robes like Arab Muslims and vanish. It is said he escaped once, disguised as a woman.

But this game did not play out for long. On July 18th, he was arrested by Dubai police. How did this happen? It was based on information that NSA Ajit Doval and CBI had in their possession and with his knowledge. Dubai police were informed about the exact arrival time, the Emirate flight details including the country of embarkation. They were also informed that if he is not arrested from the airport, he has something else up his sleeve.

Had it been anyone else other than Michel, Dubai Police would have extradited from the airport itself, which is the actual law of UAE. Since the catch was among the top 10 defence company’s middleman, they arrested him and took him to a Jail. Thereafter he was produced before a court on August 26th. However, he was released on bail on September 2nd.

Christian Michel controlled misinformation campaign using Indian Media?

Michel is a big ticket player of these games and is not to be underestimated. The moment he got bail from Dubai court, Indian Media started spreading false information. The headlines screamed ‘setback to ED and CBI’. Some even asserted that everytime the Dubai court had asked India to produce necessary documents, India had failed to comply.

It is a well-known fact that Christian Michel had media personnel on his payrolls. However, the media is generally managed in a far more sophisticated manner. Sources believe that Michel fed misinformation through his trusted channels to send media on wild goose chases. Since the media is not inclined to confirm facts, the misinformation to tarnish CBI, ED and undermine the operation was spread far and wide.

Officials spent sleepless nights

A 12-year-old scam not only had to be solved within 4 years but also arrests had to be made. This was not an easy task. They had to study more than 2 Lakh files and records. Credit is due to the officials concerned for their diligent efforts in studying, understanding technicalities of Choppers, aircraft, Agusta Westland, Christian Michel, collating all evidence and then studying it in minute details to establish the links. A fact to be appreciated is that this was facilitated and supported completely by Ajit Doval.

Dubai-UK close relationship

The Operation to bring Christian Michel back to India was not limited to Dubai alone. This is precisely the reason why this can be considered as a second surgical strike. Dubai and United Kingdom share an extremely close bilateral relationship. UK is considered the architect of basic infrastructure in UAE. Most of the projects have been designed, executed by the UK. In other words, UK was a very important and much-needed ally of Dubai. It is in view of this special relationship that Michel despite being a UK Citizen established his residence, his business in Dubai for the past decade.

He was confident that India just a sea-hop away would not be able to touch him. The documentary evidence submitted by CBI/ED was so thorough and powerful that it could not be disregarded by Dubai courts and they had no options but to extradite Michel.

Michel-CBI dialogue and extradition

Michel lost his appeal in Dubai courts on November 20th. If the Law Minister had taken a view that since he is not a citizen of UK, he cannot be extradited would have been the entire exercise futile and there was nothing left for CBI to pursue. Despite getting clearance from the courts, Indian officials did not rejoice but waited patiently till December 4th.

Not sure if India was lucky or if Michel’s luck ran out, even the Law Minister took a stand that Court’s verdict is final. That very moment the team got the most awaited communication from Dubai police for extradition. Once this message was received, CBI had just a few (less than 4) hours to arrange for a special plane. Once again it was Ajit Doval who was the saviour. With his help even this was achieved well within time – a special aircraft was waiting in Dubai.

Christain Michel arrived and boarded the aircraft. He was extremely irritated and angry. It was also noticed by the CBI Officials. Sometime during his travel, he initiated a conversation on his own. He claimed “This extradition process is illegal and done by deception. I am being hijacked”. Not to be beaten down, the officials replied, “It was only a matter of time, if not today, tomorrow you would have to come. Even Dubai disowned and did not retain you realizing that you have been in illegal business, despite your persistent efforts. Do not pontificate to us about law and morality.” Shocked by this response, Michel kept quiet.

Upon arrival in Delhi, he was received by other CBI with a “Welcome to Delhi!” greeting.

Dubai’s hospitality

Dubai Police provided great hospitality to the Indian officials. Even the officials acknowledged that the reason for this is the political acumen and strategy of Prime Minister Narendra Modi. However, Indian officials did not accept any hospitality. Remaining extremely cordial to the hosts, they stayed and used facilities paid in full by them, as per Indian Government norms. Their objective was one: Get Christian Michel to India. Period

‘India police are morons’

We have an image of Indian police as people with a paunch, unfit, silly and converse on those lines about them. It was no different when Agusta Westland middlemen conversed amongst them – “Indian police are morons (They always used this as a code word to refer police). Even if we are caught, no one will know what it is about. They will not even find a sign of corruption because we have paid the Army man’s family only by cash. It thus will not be traceable. At the most, we may have some issues with Taxes. By the time these morons find documents and arrange evidence, it would be decades”.

However, the extradition took precisely 4 years since the Modi government came to power. As they say, the proof was in the pudding.

When I asked my source how this entire plan was made possible, his answer was rather simple. Prime Minister Modi left them to do their work without interference, and, of course, there is always Ajit Doval.

Kerala law minister calls IUML member ‘fake Muslims’ for supporting idol worshippers of Sabarimala: Reports

As per a report on The New Indian Express, Kerala Law Minister AK Balan has created a furore with his remarks on Islam and polytheism. Things got heated while discussing the Kerala Police (Amendment) Bill 2018 and Balan ended up telling IUML leaders to not be “Munafiqun”.

Balan told the IUML members, “You are the followers of Prophet Mohammed who opposed idol worship and polytheism. You should not become fake believers. Don’t be Munafiquns.” In Islam, Munafiq refers people who pretended to be Muslims outwardly while concealing disbelief and actively seek to undermine the Muslim community. Munafiqs are condemned as more dangerous to Islam than non-Muslim opponents of Islam.

As per a report by The Hindu, Balan made the remarks while admonishing the IUML for supporting the devotees of Lord Ayyappa at Sabarimala. He asked IMUL leaders how could they support the Congress on the matter. The Opposition dubbed his remarks “religiously alienating and socially schismatic”.

VD Satheesan from the Congress party condemned the law minister’s words. He stated, “Here everyone lives together – those who believe in one god and many gods. This comment is bad taste and would divide people. This should be expunged as per Rule 307.”

The controversial remarks by the Law Minister come at a time when the communist government in Kerala has been accused of committing severe atrocities on the devotees of Lord Ayyappa at Sabarimala.

NCW Chairperson Rekha Sharma has also asserted that Chief Minister Pinayari Vijayan and the Kerala government was turning a blind eye to the reality of forced religious conversions in the state.

Radical Islam has also been gaining ground at an alarming pace in Kerala, a concern that is raising eyebrows across the nation. The PFI, a radical Islamist organization whose members have been accused of committing a variety of violent crimes, has also established a vast network in Kerala right under the noses of the Kerala government.

Enforcement Directorate raids three locations connected to Robert Vadra

According to reports, today Enforcement Directorate raided the offices of Robert Vadra, the son in law of former Congress president Sonia Gandhi. The ED raided three locations related to close aids of Vadra and reportedly, his office.

The lawyer of Robert Vadra said that ED has locked the offices of Skylight hospitality, and did not allow anyone to go inside.

ED sources told media that the persons being raided had received money in their bank accounts from defence suppliers.

It is alleged Robert Vadra has close links with arms dealers. One of his close associate Sanjay Bhandari had tried to partner with Dassault Aviation. But Dassault had refused his offer after learning about Bhandari’s association with Vadra.

Robert Vadra is also under investigation in a money laundering case related to a land deal. It is alleged that Vadra had “fraudulently” acquiring land in Bikaner meant for rehabilitation of poor villagers through his company Sky Light Hospitality Pvt Ltd. ED had sent two summoned to Vadra to appear before them, but he had ignored both the summons. ED issued the third summons today which was also ignored by Robert Vadra.

Earlier Vadra had said that the summons of ED is‘ political witch-hunts’ and said that the investigation agencies have an agenda to tarnish his reputation.

BJP workers not afraid of Mamata Banerjee, Rath Yatras will be carried out: Amit Shah

Amit Shah on Friday convened a presser to raise strong objections on the undemocratic process followed by Mamata Banerjee and Trinamool Congress in West Bengal.

While addressing the media, Shah said that Mamata Banerjee is afraid of the meteoric rise of the BJP in West Bengal, which is why she has persistently disallowed the BJP from organising rallies in West Bengal.

Mounting a fierce attack on Mamata Banerjee, Amit Shah alleged that the Mamata Banerjee led TMC government in the West Bengal has resorted to undemocratic measures to obstruct BJP from conducting rallies in the state. He claimed that BJP has made several requests to West Bengal administration seeking permission for organising the rally in the state but none of them has been answered by them.

Shah contended that they made their first request on October 29, 2018, but got no response from the West Bengal administration. Since then, multiple requests have been made but none of them has elicited any response from the administration. He even stated that the BJP has written to the West Bengal police thrice but are still waiting for their response.

Claiming that the violence in West Bengal has reached alarming levels, Amit Shah asserted that the violent activities under Mamata’s governance have surpassed the violent communist regime. He also alleged that the administration is in cahoots with the TMC members in subjugating the people of Bengal.

Shah affirmed that the law and order situation is continuously deteriorating in West Bengal. Citing National Crime Bureau report, he said that West Bengal has seen a rise of 70% more crimes than Uttar Pradesh and 19% more than Bihar under the present regime. Shah inquired about the progress of the murder cases against Trinamool workers, insinuating that the police are working on the directions of TMC goons.

Highlighting the egregious violations of democratic norms in West Bengal, Shah also asserted that 36% of the total Panchayat election seats in West Bengal went uncontested. The electoral representatives were restrained from filling their nominations. 20 BJP workers were killed. Shah claimed West Bengal tops the list of states with highest political murders. In fact, the high court issued an order advising the representatives to file their nominations on Whatsapp.

However, he reassured the people of West Bengal that the BJP is not afraid of the political manoeuvres of the TMC. They will be conducting the rallies after seeking necessary approval from the judiciary in case the administration denies them permission yet again.

Madhya Pradesh High Court rejects Congress petition seeking EVM probe, says no action required

0

Giving a set back to the Congress party, the Madhya Pradesh High Court on Friday rejected a petition filed by the party in relation to Electronic Voting Machines (EVM). On Tuesday, Congress leader Naresh Saraf had filed a petition in the high court demanding constitution of a SIT to probe alleged irregularities in handling EVMs during the assembly elections. Madhya Pradesh voted on November 28.

The petition alleged that there was lack of adequate security in handling both used and unused EVMs and VVPATs in some areas in the state. It was also alleged that attempt to tamper with the machines were made in Bhopal, Shajaput, Sagar and Khandwa.

The petitioner had also alleged that no separate facility was created to keep the unused reserve EVMs after polling was held. These were kept within the vicinity of EVMs used in polling in all the assembly seats, the petitioner had said. The petition sought the court’s direction to the Election Commission to reveal the number of unused, reserved EVMs. It also sought punishment for authorities for alleged dereliction of election duty.

Responding the petition, the Election Commission refuted all the allegations and asserted that all the necessary steps have been taken for safe upkeeping of EVMs and VVPATs used in the elections, as well as unused and reserved EVMs and VVPATs. The Election Commission in its detailed response to the complaint of the Congress had clarified that the alleged ‘power cut’ in the Strong Room was due to disconnection of the power supply of the poll room after it was sealed as per the poll panel rules. The subsequent power cut was because of the local fault of the electricity arrangement and not because of the power cut of the electricity board as mistakenly informed by the District Election Officer. The report said that no one visited the strong room during the period of the power cut.

After examining the reports submitted by the poll commission, the bench of chief justice S K Seth and judge Vijay Kumar Shukla disposed of the petition saying no further action is needed to be taken. The bench in its order said “the strong rooms for storing polled EVMs/VVPATs and warehouses for unused/reserved EVMs/VVPATs are separate buildings with separate security arrangements. It was clear that the strong rooms with polled EVMs/VVPATs were sealed immediately after the poll to be opened on the day of counting. These strong rooms are under the security of Central Armed Paramilitary Forces with a triple cordon of security.’’

The bench observed that the Election Commission had conveyed all the alternative security measures to Congress. Therefore no separate action is required in relation to the EVMs and the strong rooms.

Like most recent elections, the Congress party has been trying to spread rumour of EVM tampering. Last week, Congress leader Ahmed Patel had posted a video of EVMs being transported in a school bus, and had alleged that EVMs were being carried to the strong room two days after the election. But it was revealed that those were unused EVMs being sent to EC warehouse and not to a strong room. The Election Commission had removed the returning officer of the assembly seat for delay in returning the unused machines.

Taking benefit of such rumours by top leaders of the party, some thugs are even trying to dupe local Congress leaders offering to hack EVMs. One such man was arrested 2 days ago when he had approached a Congress candidate in the state proposing to hack the machines in his favour for ₹2.5 lakh per unit.

Another petition filed by advocate Amitabh Gupta on the same day had sought counting of slips of VVPAT machines used in November 28 polling. The petition requested that the slips of VVPAT machines should be tallied with the votes polled in the EVMs for all the 230 Assembly constituencies in the state. The court has reserved its verdict on this petition.

The counting of votes will take place on December 11.

TMC Minister Siddiqullah who claimed Quran would prevail over Constitution accuses BJP of creating religious divide

West Bengal Minister Siddiqullah Chowdhury on Tuesday accused the BJP of trying to create religious division in society through its Rath Yatras. The TMC government in Bengal had denied permission to the BJP for the Rath Yatras which were scheduled to begin from Coochbehar on Friday.

Siddiqullah, who is also the president of the West Bengal Jamiat-e-Ulama, stated, “The BJP’s main target is to create a division among the people on religious line in Bengal. The rath yatra is being organised to serve that purpose. It should not be allowed in the state. They want to disturb the harmony in the state.”

The Minister for library and mass education also claimed that all the steps taken by the NDA government at the Center were anti-Muslim. He said, “All the steps taken by this government is against the Muslims. Under this regime, Muslims and Dalits have been lynched.” He added, “India is a secular country and every community has the right to perform his religious activities. The BJP does not have the right to dictate us on what we should do and what we should not.”

Amusingly enough, Siddiqullah is the same person who had stated earlier that the Quran will prevail over the Constitution. Expressing his displeasure towards the ordinance banning instant Triple Talaq, he had said, “For us, our holy scripture, the Quran Sharif, is supreme and if any constitutional provision or any law contradicts the Quran, then our scripture will prevail and not the law or Constitution. BJP is playing the religion card and is playing with the Constitution. The ordinance will have no effect on Muslims. No one will adhere to it, but will follow the religion and the holy book.”

Siddiqullah perfectly captures the essence of Indian liberalism and secularism. While the BJP, the party of Hindutva, can be accused of creating religious divide for holding Rath Yatras, ministers from the Muslim community can assert the supremacy of Quran over the Indian Constitution and yet preach the virtues of secularism without attracting any attention from liberals.

The TMC minority leader has a history of controversies. He had once courted controversy after it was found that he was using a Red Beacon even though he had questioned others for doing the same. Red Beacons were outlawed for VVIPs from 1st May and since then most have complied with the order. He had also deemed the Supreme Court’s verdict on Triple talaq ‘unconstitutional’.

Viral video: Fireball lands on a Pakistani news anchor’s lap during live television

In a video that has gone viral on social media, a Pakistani news channel anchor could be seen being hit with a fireball on live television. Moments earlier, the sound of an explosion was heard which rattled the composure of the anchor.

After the fireball fell on his lap, the anchor could be seen going helter-skelter to rid himself of it. Presumably, nothing untoward happened and the viral clip came across as extremely comical.

People on Twitter found the video hilarious and were quick to tweet witty responses.

While journalists across the world take extreme risks to cover war zones and other dangerous stories, it appears in Pakistan, news anchors aren’t safe even in their studious as well.

Chhattisgarh Congress files petition in High Court following ‘complaints of EVM tampering’

The Congress party has filed a writ petition in the Chhattisgarh High Court seeking directions to the Election Commission (EC) to maintain adequate security in the strongrooms housing the EVMs used in last month’s Assembly Polls in the state.

The party has also demanded that VVPAT paper slips used in EVMs during the elections also be counted. VVPAT is a printer system attached to EVMs that allows voters to verify whether their votes have been cast as intended.

The petition was filed by Chhattisgarh Congress general secretary Girish Dewangan. He filed it claiming there are complaints of EVM tampering in the state, his lawyer Satish Chandra Verma said. The High Court will hear the matter on the 10th of December, a day before the declaration of results.

Late in November, the Congress party had protested strongly with the Chief Electoral Officer alleging EVM tampering. Massive protests had erupted outside a strong room where EVMs were kept before the counting on December 11.

Not just in Chhattisgarh, the party has alleged EVM tampering even in Madhya Pradesh. Senior Congress leaders had started complaining about EVMs merely hours after voting began. In Chhattisgarh, a Congress worker was also reported to have died of cold while guarding the strong room where the EVMs were kept.

It has become fairly routine for opposition parties to claim EVM tampering after losing elections. On 11th March 2017, as the BJP alliance swept the Uttar Pradesh polls, Mayawati was the first politician who had come out and blamed the EVMs for BJP’s victory. Soon, other political parties too started raking up the EVM issue and AAP supremo Arvind Kejriwal took it to the next level after spreading an outright lie about the machines that were equipped with the VVPAT system.

Uttar Pradesh: 10 smugglers caught with 500 kg cow meat from Maneka Gandhi’s constituency, Pilibhit

0

It’s been only a few days since carcasses of cows were recovered in Bulandsheher leading to violence that claimed the lives of a police inspector Subodh Kumar Singh as well as a youth named Sumit. Uttar Pradesh Chief Minister Yogi Adityanath had ordered a thorough investigation and had issued directions for strict actions against those involved in the alleged cow slaughter.

After the Bulandsheher incident, a campaign was started by the police against cow smugglers in the entire State. In a major success under the campaign, the police caught 10 people slaughtering cows inside a closed house in Puranpur, Pilbhit as reported by Jagran. The police also seized 500 kgs of cow meat from the house along with knives and axes being used in slaughtering. Cases have been registered against all accused.

On Thursday, SI Keshav Kumar Tiwari reportedly received information that cows are being slaughtered and meat being sold in the house of one Haseeb, resident of Ahmednagar locality in Puranpur. The Police reached the spot immediately and caught the people slaughtering cows. The other accused have been identified as Shabbir Ahmed, Haneef, Basheer Ahmed, Rahees Ahmed, Mohammad Miyaan, Rafeeq, Akram, Habeeb, Babbu and Mohammad Islam. The police are on the lookout for the absconding suspects.

Upon interrogation, the arrested culprits revealed that they had escaped the two previous raids conducted by the police on August 22 in Mohalla Linepaar Sahukara and on Nov 6 in a house belonging to one Nafees Ahmed. All the accused caught by the police have admitted to having been involved in these previous two incidents as well.

It is ironical that the incident happened in the constituency of Union Minister Maneka Gandhi who is known to be a fierce animal rights activist. Maneka Gandhi was also appointed the Chairwoman of the Committee for the Purpose of Control and Supervision of Experiments on Animals (CPCSEA) in 1995. She had also started an organisation called People for Animals in 1992.

Supreme Court imposes Rs 50K fine on lawyer for frivolous PIL against Arun Jaitley

0

The apex court on Friday quashed a petition against Finance Minister Arun Jaitley levelling charges of “plundering” capital reserves of the Reserve Bank of India to waive off loans of certain companies. The court has imposed a fine of ₹ 50,000 on the lawyer Manohar Lal Sharma who had filed the PIL against Jaitley.

The bench comprising Chief Justice Ranjan Gogoi and Justice SK Kaul rejected the petition stating, “We do not find any credible reason to heed this PIL.” Reprimanding Manohar Lal Sharma for the frivolous PIL against Jaitley, he said “You have done great work in the past. You want us to rein in the finance minister. Why are you damaging your credibility.”

Gogoi also said that time has to ban Sharma from filing PILs. “Mr. Sharma, the day has come to ban you from filing PILs”, the CJI said.

Furthermore, the bench said, “What’s this PIL? We cannot allow you to go ahead with such misadventure. You are bringing disrepute to the institute. Why should we approve this PIL?” The Supreme Court also directed the registry to not accept any PILs from Sharma unless he pays a fine of ₹ 50,000.

Chief Justice Gogoi has kept the roster of the fresh PILs with him, thereby exercising a tight grip on the petitions filed. He has also made it amply clear that he is not going to waste the apex court’s time by allowing the registry of such frivolous petitions.

Advocate M L Sharma is known for filing frivolous PILs and he has faced the ire of the apex court earlier also for the same. He has been fined by the court multiple times for his petitions. In 2014, he was fined ₹50,000 and ₹25,000 by the court on two occasions. Numerous petitions filed by Sharma have been rejected by the court in the past, he was warned several times not to file such frivolous petitions.
