Former judges said that the “we will rip you apart” comment verged on a street brawl threat and could never be part of the obiter dicta lexicon of a constitutional court judge, TOI reported.
On 15th January 2024, the Supreme Court of India received an anonymous letter addressed to the Chief Justice of India and Justice Anamullah stating that the false advertising by Patanjali Ayurved continued despite the court’s orders. Subsequently, a contempt notice was issued to Balkrishna and Patanjali on 27th February.
The court was dealing with an Indian Medical Association plea seeking to frame guidelines for prohibiting false and misleading advertisements in relation to allopathy and modern medicine.
In an affidavit, Patanjali Ayurved Managing Director Acharya Balkrishna said that he submits an unqualified apology before the top court for the breach of the statement recorded in the order copy of the top court dated November 21, 2023.
The Supreme Court ruled that Patanjali cannot advertise or market any of its medicinal products that claimed to heal conditions listed in the Drugs and Magic Remedies (Objectionable Advertisements) Act.
Pathai Khan, in whose name the FIR is filed, has stated that his lawyer, whom he was consulting in different case, took his signature on blank document which was eventually used for filing police complaint against Baba Ramdev.
