The Supreme Court deemed the observations by the Calcutta High Court as 'problematic' and also questioned the legal principles involved in the judgment.

The court said that the prosecution failed to prove the case against the accused and was based solely on circumstantial evidence which could not be established to prove the accused guilty.

The incident took place in sector 57 of Gurugram. the case is booked in the women's police station in sector 51. The 3 accused have been booked under Section 10 of the POCSO Act and Section 75 of the Juvenile Justice Act

While pronouncing the judgment, the judge said that due to such crimes, society will never be able to send girls to such institutions for education.

The body of the minor victim was found dumped in a sack in a marshy area behind a local market in the nearby Aluva area on 29th July. It was found a day after the minor was abducted, brutally raped, and killed by Alam, the victim's neighbour.

When the 5-year-old girl was playing outside her home, she was lured by the accused Sher Mohammad to his residence.

The young Hindu girl lived in a village which is under the jurisdiction of Pingla Police Station in the Paschim Medinipur region. She went missing on June 18 in Namchi, Sikkim.

Principal Rizwan Ahmed then forced the minor victim to take off her clothes and started checking her private parts. He also threatened the minor schoolgirl not to tell anyone about his act.

The incident took place on September 9 this year. The men happened to be the neighbours of the 16-year-old victim.
