Granting bail to the accused PFI Islamist Abdul Sathar, the Supreme Court bench comprising justices Abhay S. Oka and Ujjal Bhuyan said that a person cannot be put in jail for their ideology.
President Droupadi Murmu under Article 143 (1) of the Constitution of India has sent a reference to the Supreme Court following its recent ruling that set timelines for Governors and the President to grant assent to bills passed by legislatures.
The plea was filed by one Satish Kumar Agarwal, who flagged the failure of state authorities in discharging their duties/responsibilities to protect the life and property of Murshidabad residents.
‘Court of Kazi’, ‘Court of (Darul Kaja) Kajiyat’, ‘Sharia Court’, etcetera, by whatever name styled, have no recognition in law,” the Supreme Court ruled.
The top court noted that the use of spyware by the country for national security purposes is not inherently problematic, but its use against private individuals must be carefully examined.
The tenant did not provide any proof to indicate that during the pendency of the legal battle that went on for over six decades, he made any attempt to seek an alternative accommodation and failed to get it.
