Arun Jaitley slams Congress and its cohorts, writes about the saga of disruption, weapon of impeachment and fake news

0

The Supreme Court yesterday dismissed the petition demanding fresh probe into the Judge Loya Death case. The petition, which was backed by Congress party and some other political and media personalities was called frivolous and a full frontal attack on the judiciary. The amount of media hype and political posturing the case generated was enormous. The lawyers, political leaders and media persons kept pushing the fake, baseless allegations into limelight even after the deceased judges’ family made clear that they have no doubts the manner of his death.

The Supreme Court, in the 114-page judgement, has made very potent and scathing remarks on the intent and attempts to malign the judiciary and law enforcement of the country. Today Finance Minister and prominent lawyer Arun Jaitley have shared a post on his Facebook page titled ‘Judge Loya Death Case- The one that almost created a judicial mutiny” where he has discussed the SC’s judgement and made some every thought-provoking remarks.

The Finance Minister, who is currently undergoing treatment for a kidney ailment has stated that he read the judgement and a reading of the judgement exposes every facet of the conspiracy to generate falsehood as propaganda in the public and political space.

The FM states that never ever so blatantly in the past have national political parties, a few retired judges and some senior lawyers so closely identified themselves with the generation of falsehood that they almost came out as conspirators. He adds that a detailed analysis of the facts and the role played by some groups is necessary since he suspects such attempts will also be made in the future.

Arun Jaitley then goes on to discuss the alleged role of Amit Shah in the Sohrabuddin case. He states that Amit Shah had no role in it and it was an alleged encounter executed by some central agencies through the State Police. He adds that on September 27, 2013, he had written a detailed letter to then PM Manmohan Singh with details of the case. He added that the alleged linkage to Amit Shah was based entirely on the statements of two persons, Ramanbhai Patel and Dasrathbhai Patel who were both noted landgrabbers, had given evidence that on a meeting regarding the cancellation of PASA orders against them, Amit Shah allegedly demanded Rs 75 lakhs from them and during their conversation, mentioned in some casual statements that why Sohrabuddin had to be killed. FM Jaitley adds that the evidence was false as there neither was any PASA order against the two persons, nor the visitor’s register in Amit Shah’soffice had any mention of him meeting them. Thirdly, the persons had claimed that they had paid Rs 75 lakhs to Amit Shah through some Ajay Patel but on the dates mentioned by them, Ajay Patel was not in the country.

Arun Jaitley states that on this flimsy evidence, Amit Shah could have got bail from any court in the country and that in fact, the Gujrat High Court had even commented that this was a case of ‘no prosecutable evidence’. Jaitley further asserts that it did not matter to Amit Shah that which judge would hear the flimsy case against him and he was discharged in the case. He adds that some individuals went ahead to challenge the discharge order in the Mumbai HC and the SC but the challenge was again rejected. Jaitley states that many of the people behind the Judge Loya case are in fact the people behind the Sohrabuddin case against Amit Shah.

Arun Jaitley then discusses the fake news peddled by the Caravan magazine which raked up the Judge Loya case. He states that as the Supreme Court judgement establishes, Judge Loya complained of chest pain in Ravi Bhawan, Nagpur on Dec 1, 2014. He was accompanied by four of his colleagues to a hospital where an ECG was conducted, preliminary treatment was given and Judge Loya was further referred to a specialised cardiology hospital but he passed away. He adds that though attempts were made to revive him, they were unsuccessful and he was declared dead. Jaitley adds that as per the investigations reports, during the period of his cardiac problems, only the four colleagues (who are all district level officers), the doctors and the medical staff of the two hospitals had access to h due him. He further adds that, after Judge Loya was declared dead, four High Court judges arrived at the second hospital and a post-mortem, which was conducted at a third hospital indicated death due to cardiac issues. The FM states that judge Loya’s body was accompanied to his hometown by two Magistrates. He further states that after perusing the statement of all concerned persons and Judge Loya’s family members, who accepted the natural causes of the death, the Supreme Court came to a finding that this conclusively was a death because of natural reasons and there was no suspicious circumstance.

The FM then states, “The Caravan Magazine stories and investigations are a textbook example of fake news. It was not gossip or rumour mongering but a deliberately generated fake news where falsehood was manufactured to generate a massive public controversy.”

The FM then goes ahead to discuss the ‘Institution Disruptors’. He states that most courts in India have a set of crusading lawyers who pick-up causes in public interest and pursue them and that is perfectly acceptable but in the last few years some of the public interest crusaders have evolved into ‘Institution Disruptors’ who pick up even false causes and pursue them with deep commitment. He adds that these people are shrill, rude and often indulge in intimidating advocacy. He asserts that these people are disrespectful to judges and believe that their falsehoods must be accepted as gospel truths. Jaitley adds that a section of media gives these people publicity. He further goes ahead to add that from a national party, the Congress has reduced to the fringe and the party, through its lawyers and otherwise is ‘too willing to identify’ these disruptors and together they have made intimidation and rudeness as the new form of advocacy.

The FM then goes ahead to discuss the impeachment motion the Congress party is mulling and explains that impeachment is sought for an SC judge only in the case of ‘incapacity’ or ‘proven misconduct’ but the Congress is trying to make it as a political tool. He asserts the judicial, constitutional and moral profoundness of the power of impeachment vested upon the houses of Parliament and adds that each member has to act as judge irrespective of party’s intentions. He adds that collecting some signatures and attempting to make impeachment a political tool is a dangerous precedent and a serious threat to the independence of the judiciary. He affirms that the current suggested impeachment motion against CJI Deepak Mishra is nothing but Congress’ revenge petition after its falsehoods have been exposed. He further adds that it is nothing but a threat to the CJI and a message to other judges.

Arun Jaitley goes further to add that apart from impeachment motion and intimidation tactics, the single greatest threat to the judicial independence is the ‘divided court’. He ponders that when the four judges of the SC held a press conference, had they even checked up on the basic facts of the Judge Loya case before commenting on it and whether anyone should be commenting on pending cases at all. He even wonders if the impeachment motion is the direct result of that press conference itself and whether this will set a trend that political parties of the country will use impeachment as an instrument to intimidate judges.

The Finance Minister concludes by stating that what has happened today is a price the Indian judiciary has to pay for misadventures of many and there is no better time for judicial statesmanship and political foresight.

Omar Abdullah heckled at University of Berkeley

0

Omar Abdullah, the former Chief Minister of Jammu and Kashmir was reportedly heckled in the United States by Kashmiri Americans. He was there to deliver a speech at the University of Berkeley when a group that also consisted of Kashmiri Pandits protested against him.

Omar Abdullah had tweeted about his engagement at Berkeley earlier.

The group interrupted Omar Abdullah’s speech and cornered him on his silence over Pakistan sponsored terrorism. Interestingly, in the war of words that ensued, Abdullah ended up revealing his true thought process regarding the Kashmiri Pandit exodus that took place in 1990.

One of them, a Kashmiri Pandit, said, “You Talk to me in Kashmiri, I speak better Kashmiri.” To which Omar Abdullah replied, “You all ran away.”

The youth didn’t back down at this horrifying response by Abdullah. He shot back with, “You forced us out.”

A woman who was a part of the protesting group called Omar Abdullah and his father “war criminals”. She is reported to have said :

“I will take you to International Court. You are a war criminal. You, your father, your grandfather. You will see.”

A video of the same has been uploaded by a channel called “Jammu Updates” on Youtube.

[youtube https://www.youtube.com/watch?v=bcf5DLSlXmE]

Addendum :

After this report got published, we were contacted by a student from the University of Berkeley. We were informed that Republic TV, on whose report we relied, might have got some facts wrong.

The student, who identified himself as Dhrushil said that the people heckling Omar Abdullah were not Kashmiri Pandits but actually, Kashmiri separatists and radicals. Dhrushil said that the lady questioning him is Huma Dar – a known rabid provocateur from the azaadi bandwagon, who had a problem with someone as left as Ramchandra Guha.

Dhrushil said that Omar Abdullah was indeed taking on the pro-azaadi gang at Berkeley. In fact, there was a petition that was doing the rounds that identified India as “Indian occupied Kashmir” and asserted that Omar Abdullah doesn’t represent the people of Kashmir.

Gowhar Geelani, who identifies himself as a journalist also tweeted and confirmed that it was indeed Huma Dar who had heckled Omar Abdullah. He also asserted that pro-azaadi slogans were raised.

Omar Abdullah also tweeted and clarified his stand.

He also clarified that his speech was not cut short, in fact, the session extended beyond the scheduled time.

Editor’s note : Some portions of the report that were written owing to the incorrect information that the group consisted of Kashmiri Pandits has been deleted. An Addendum has been added to reflect facts that later emerged to the fore. The headline has also been changed accordingly.

Sports ministry shoots down a TOI report and accuses it of being misused by vested interests

0

The Sports Ministry on Friday shot down a Times of India report and accused the media house of being misused by vested interests. The contentious issue seems to have arisen with regards to a Times of India report which claimed that the International Olympic Committee (IOC) had offered to mediate between the Sports Ministry and the Indian Olympic Association (IOA) over the “contentious sports code”.

As per the supposed report in question, IOC President Thomas Bach who is currently on a visit to India had proposed this mediation via the formation of a four-member working group, during a meeting with union sports minister Rajyavardhan Singh Rathore on Thursday. The report also quoted the IOC President as saying that IOA had even agreed to this proposed mediation.

These claims by the TOI though didn’t sit well with the sports ministry which issued a tweet claiming that no mediation was required, discussed, offered or accepted during their meeting. After calling the news inaccurate the ministry also accused TOI of allowing its platform to be misused by vested interests:

This was also echoed by Sports Minister Rajyavardhan Rathore:

The draft of the said sports code in question has been prepared by the Sports Ministry and if implemented would have to be adhered to by the IOA and other India sports federations. Some of the contentious issues include a 12 year limit for every official holding his/her post, barring bureaucrats and politicians from holding the federation posts and a CEO being appointed by the government.

An agreement though has been formed over the proposal that office-bearers should be below 70 years of age.

British officials apologise for despicable protest where Khalistanis and Pakistanis burnt Indian flag

0

According to reports, a repugnant incident took place on April 18, where a group of Pakistan backed pro-Khalistani and Kashmiri protestors, in the presence of London Metropolitan Police, pulled down the tricolour from a pole at London’s Parliament Square and replaced it with a flag representing Pakistan-occupied-Kashmir (PoK) and Khalistan.

The incident took place when Prime Minister Narendra Modi was addressing the Indian community at Westminster Central Hall. Earlier, the British foreign office had apologised for the incident. “While people have the right to hold peaceful protests, we are disappointed with the action taken by a small minority in Parliament Square and contacted High Commissioner Yashvardhan Kumar Sinha as soon as we were made aware,” according to Foreign and Commonwealth Office’s statement.

The Ministry of External Affairs (MEA) on Thursday expressed annoyance over India’s national flag-burning incident at London’s Parliament Square and said, “We’re deeply anguished with the incident involving our national flag. The matter was taken up strongly with the United Kingdom side. They have regretted the incident. The flag was immediately replaced. We expect legal action against the people who were involved in this,” said MEA’s official spokesperson Raveesh Kumar.

On a related note, addressing the Indian community at ‘Bharat ki Baat, Sabke Saath’ event at Westminster, Prime Minister Modi described Pakistan as a “terror export factory”. He said, “We believe in peace, but we will not tolerate those who like to export terror. We will give strong answers and in the language they understand. Terrorism will never be accepted”.

The foreign office also mentioned that Prime Minister Modi’s visit “has strengthened our relationship with India and we look forward to working even more closely together on a number of important areas.”

The protests that the British officials have apologised for, was hailed by the self-proclaimed “seculars”.

Prakash Raj who regularly peddles lies had supported the protests, though with old images.

Sanjay, National spokesperson of the Congress party had also fanned these protests held by Khalistanis and Pakistanis.

Opindia had earlier reported on how Pakistan’s Inter-Services Intelligence (ISI), was shielding miscreant for allegedly trying to publicise pro-Khalistan campaign. Gradually the world is realising that the militant Khalistanis are not just dissenters against the Indian states but terrorists fuelled evidently by cross-border funds.

For centuries, this Odisha temple has allowed only Dalit women to touch the idols

0

The Panchubarahi temple in the coastal village of Odisha’s Satabhaya has a unique tradition. Only married women of the local sabar community can enter the sanctum sanctorum and touch the five idols. The daily rituals of the temple deities are also exclusively performed by these women. Male members are allowed darshan but not entry into the sanctum sanctorum.

For almost 400 years the temple has followed the traditions. The tradition was broken for the first time today, only to save the temple from nature’s wrath. The Satabhaya village has been under threat of erosion due to rising sea levels and for last several years, the state government has been relocating the families to another village about 12 km inland. According to reports, as many as 571 families of the fishing village has been shifted to the Bagapatia rehabilitation colony.

Shifting the temple idols, however, is no easy task. The idols are made of stone and have heavy pedestals attached too. For the first time in 400 years, the priestesses had to agree to allow men to help relocate the idols to the new rehabilitation colony.

The district administration had earlier proposed the state government to allocate funds to shift the idols. Finally today, the idols were lifted and placed on transport vehicles so they can be shifted to Bagapatia colony.

The priestess performed the rituals and adorned the idols with clothes and garlands. The men who were allowed entry for a day lifted the idols up amidst loud chants of prayers and the traditional sounds of ‘hula-huli’, sound women make while performing any auspicious ritual. The hula-huli is a common feature in eastern India.

According to the Times of India report, once the idols have been shifted to their new address, the priestesses will perform a purification ritual to ‘cleanse’ the idols and resume their daily puja in the new temple.

While a temple with only women as priests is indeed unique, temples with Dalit priests are common in Odisha. There are several ‘shakti peeth’ or goddess temples in the state where the worshipping rights have been exclusively held by Dalits. In western Odisha, it is often the priests from the Dalit ‘Majhi’ community who perform the rituals in many goddess temples. People of all castes bow to these priests while performing rituals.

Even in the legends of the Jagannath Temple in Puri, it is mentioned that the Lord Nilamadhab was being worshipped by a tribal chief Viswavasu and after King Indradyumna built the Jagannath temple, the King had decreed that the descendants of Viswavasu will perform the decorating rituals during Rathyatra and Anavasara. The descendants of Lalita, Viswavasu’s daughter who married the King’s Bramhin priest, are known as Supakars who cook the Mahaprasad in the Jagannath temple.

Recently the priest in a Telangana temple carried a Dalit youth on his shoulders in a reenactment of 2700-year-old ritual. In times when vested interests are trying hard to malign India’s culture and instigate caste-based violence, these stories not only bring out our nation’s rich culture to attention but also signify that ours have always been an inclusive society of harmony and equality.

Amazon India deletes tweet featuring Swara Bhasker’s endorsement after massive twitter outrage

Actor Swara Bhasker has in recent days generated massive backlash for her Hinduphobic campaign in light of the Kathua rape case, where she like a few other actors was seen holding a placard highlighting an allegation of the rape taking place in a ‘devi’-sthaan temple (with the term devi written in single quotes). This was considered by many as a classic case of selective outrage, with such a stance not being replicated in case of worship places of other religions.

She later aggravated matters when she got into a spat with one of her critics, whom she described as a “rape apologist” while hurling slurs based on her political affiliation. This was considered by many as a bit rich coming from Bhasker, considering she herself had in the past glorified stalking, by calling it an ‘unapologetic celebration of crazy love’.

Many of her social media critics on Thursday received a rude shock after she appeared to have been signed up by Amazon India for one of their campaigns:

This tweet of Bhasker lamenting about her failure to buy a decent music system was later featured by Amazon India in one of their campaign tweets thanking Bhasker for sharing her experience:

In the resulting outrage, social media users vehemently demanded that Bhasker be removed from the campaign while threatening a boycott of the brand, if their demands were not heeded to:

The anger of Indian twitter users was so visible that #BoycottAmazon was one of the top trends in the country:

Such sustained pressure by Indians seems to have got to Amazon India who have now deleted their tweet featuring Swara Bhasker’s endorsement, with it no more being visible on their timeline. It though isn’t clear whether the e-commerce giant has chosen to end its association with Bhasker.

This might be a second successful instance of social media media users compelling big brands to review their celebrity endorsements. Earlier in 2016 Snapdeal had decided not to renew its endorsement contract with actor Aamir Khan, which was largely attributed to the negative publicity he brought in via his statement insinuating an “atmosphere of fear” since Modi came to power.

Rahul Gandhi trusted the Judiciary when it acquitted him of rape, why undermine it now?

We live in exciting times. The political potboiler is at its zenith with the BJP sweeping elections after elections and the Congress party trying every trick in the book to come back to power. Frankly, there can’t possibly be a more exciting time for any political observer and writer. But, as a citizen, the recent developments can be rather distressing.

The Congress party and its allies have decided to launch a ‘full frontal assault’ on the Judiciary. And this is not a first. Every time verdicts have gone against the Congress party or the Dynasty, they have undermined the Judiciary and abused the system. Who can forget what Indira Gandhi did when the Court barred her from contesting elections? She ushered in the Emergency period which is by far, the darkest period that the Indian democracy has suffered.

Who can forget “State of Uttar Pradesh vs. Raj Narain” case which was fought in the High Court? After Indira Gandhi’s 1971 electoral win, Narain filed a petition alleging that Indira Gandhi has used bribery, government machinery and other resources to gain an unfair advantage in the elections.

Owing to this petition, Justice Jagmohanlal Sinha found Indira Gandhi guilty of electoral malpractice, declared Indira’s win from Rae Bareilly null and void and having found her guilty of gross malpractice, barred her from contesting elections for 6 years. At that time, the court gave Congress 20 days to replace Indira Gandhi. Indira then got a stay order on 24th June 1975.

Indira Gandhi got the stay order on 24th June, the Emergency was declared on 25th June. Indira Gandhi imposed the emergency a day after she got the stay order in order to postpone impending elections and pass a bill that amended the law under the provisions of which she was held guilty by Justice Jagmohanlal.

Perhaps coming up with novel ways to undermine the Judiciary runs in the Dynasty blood.

But today, some questions must be asked of the Congress party and its President Rahul Gandhi. These questions must be asked because it is time someone breaks the silence, considering the Media, which seems to be bound by the ‘omerta’ never will.

The hypothesis for this article is fairly simple. If the Judiciary as an institution is compromised and has the potential to sell its soul to the Government in power now, it must have been so always, because institutions don’t change overnight.

In the early 2000s, Rahul Gandhi was accused of a heinous crime. Of raping a girl called Sukanya Devi in Amethi. He was accused of gang-raping the girl during a visit to his constituency. The High Court had then had tossed the case, acquitted him of all charges and calling the case malicious. The Court had also slapped costs of 10 lacs, including Rs. 5 Lacs on the SP MLA, Kishor Samrite, who had filed that case.

A Court bench had said,

“The allegation is without substance and without an iota of evidence, the reputation of respondent no 6 (Rahul Gandhi) has been damaged by the undesirable act of the petitioner (Samrite).”

The appeal against this verdict in the Supreme Court had also been dismissed. In fact, the Supreme Court had awarded Rahul Gandhi a compensation of Rs. 5 Lacs for “damage of reputation”.

In 2018, a similar verdict was passed. A rag of a magazine tried to create a fantasy tale to brand the natural death of Judge Loya as a murder. The insinuation was that since Loya presided over the Sohrabbudin case, Amit Shah had something to do with his death and that, it should be probed. Supreme Court passed a verdict and all hell broke loose. The Court observed :

There is no reason to disbelieve the sequence of events leading to the death as narrated by the four judicial officers namely Shrikant Kulkarni, Shriram Modak, R. Rathi and Vijay Kumar Barde and the assertions of Bombay High Court Justices Bhushan Gawai and Sunil Shukre.

The court said that the petition was a “full frontal attack on the independence of the Judiciary”. The bench also said that “there exists a case for initiating contempt proceedings against the petitioners and the lawyers representing the petition but is refraining from doing so”.

Congress’ official press release called it a “sad letter day in India’s history” and went on to reiterate the motivated, factually inaccurate points that the Supreme Court had already tossed out.

Rahul Gandhi tweeted :

Indians are deeply intelligent. Most Indians, including those in the BJP, instinctively understand the truth about Mr Amit Shah. The truth has its own way of catching up with people like him.

He insinuated that the court was incorrect and that Justice had been denied. That Amit Shah was responsible for the death of Judge Loya, even though the court had called the entire case false and motivated.

One can’t really miss the parallels in the judgements delivered. The 2012 verdict exonerated Rahul Gandhi of abduction and gang rape and the judgement that denied an investigation into the death of Judge Loya.

1. Political motivation

In both cases, the petitioners were severely politically motivated. In the 2012 rape case against Rahul Gandhi and his friends, the petitioner was a Samajwadi Party MLA. In 2012, SP and Congress were political rivals especially as far as Uttar Pradesh was concerned.

In the Judge Loya case, Indira Jaising is a known Congress loyalist. She represented Navy Admiral L. Ramdas. Ramdas was the ‘internal lokpal of AAP’. He was also a part of the group that had filed a PIL in Supreme Court against the appointment of Lt. Gen. Bikram Singh as COAS. Interestingly, his daughter Kavita Ramdas is a former member of the Global Development Program Advisory Panel to the Bill & Melinda Gates Foundation. She was also appointed as a representative to New Delhi by the Ford Foundation.

Tehseen Poonawalla is Nehruvian Congressman apart from being related to Robert Vadra. Bombay Lawyers’ Association is a repeat offender as far as intervening in such cases is concerned. They had also intervened in the Sohrabuddin encounter case. Prashant Bhushan is the former AAP member and lifelong “activist” who had sought clemency for Yakub Memon”.

2. Both cases hinged on published articles

In the gang-rape case against Rahul Gandhi, it was said that the website that originally posted these allegations against Rahul Gandhi received a legal notice after which the article was taken down. There was also news that the website that originally posted these allegations had some foreign connection.

In the Judge Loya case, the allegations also appeared on a website first and the glaring loopholes in the entire story were severely criticised by the Court. It is, of course, a different matter that the magazine hasn’t received any legal notice to the best of my knowledge. It is, however, telling that both stories were slammed as factually inaccurate by the courts themselves.

3. In both cases, the Court slammed the petitioners

As explained above, the Court slammed the petitioners in both the cases. The only difference? In the Rahul Gandhi rape case, the petitioner was fined and investigated. In the Judge Loya case, they appeared on television to malign the Supreme Court and the judgement delivered. Perhaps there can be no greater indicator of the famed ‘Congress ecosystem’.

Given the similarities between the two cases, it is intriguing that Congress seemed to have accepted the verdict of the 2012 case, but not the 2018 case. If it is the Congress’ and Rahul Gandhi’s assertion that the Judiciary as an institution bows to the Government in power and hence the Loya case was tossed out, it must also concede that something similar could have happened back in 2012? Which would mean the Judiciary declared Rahul Gandhi innocent owing to political pressure from the government in power, which was Congress?

Many believed that Rahul Gandhi was indeed guilty of the rape charges that were hurled against him. Just as some today believe that there was foul play involved in Judge Loya’s death. If Congress professes to represent the “people’s voice”, owing to which is it even bringing an impeachment motion against the Chief Justice of India, why did it not then represent the same “people’s voice” who thought Rahul Gandhi raped Sukanya Devi?

The dichotomy is glaring and painful. Congress has often undermined the Judiciary when it didn’t suit their narrative, and a game of narrative this all is. In both cases, the Court did its job. Pronounced a verdict based on lack of evidence and the political motivation of petitioners. How then does one judgement hold water and the other doesn’t? How then does one case deem hailing of the Judiciary and the other inspires a malign campaign extending to bringing an impeachment motion?

Everytime someone brings up the Sukanya rape case, the standard defence of the Congress is that it is defamatory since the Apex Court pronounced Rahul innocent. They can’t possibly decry detractors in one case because they believed in the Judicial process and become the detractor in another case because the Judiciary’s decision doesn’t help their agenda.

The sacrosanct truth is this – If Congress is hell-bent on proving Judge Loya’s death was a murder because the story appeared on some digital portal and “the people” are asking questions, they must also rally for Rahul Gandhi to be proven guilty of abducting and raping Sukanya. On the flip side, if they accepted the verdict in 2012 with grace, it is time they do the same now.

It is said that hypocrisy, the lie, is the true sister of evil, intolerance and cruelty and while the truth often offends the hypocrite, Rahul Gandhi and his party can’t escape it. Not for too long, anyway.

The Congress ecosystem retaliates against the Judiciary

0

In the press conference held by Congress leaders Ghulam Nabi Azad and Kapil Sibal, there was a very active attempt to indicate that their impeachment motion had nothing to do with the verdict in Judge Loya case. In all probability, it had everything to do with the Loya case. It is no coincidence or a matter of surprise to see the Congress mount a frontal attack on CJI Dipak Misra, who seems to be so aloof and unsympathetic to the causes for which the Congress stands for.

When Kapil Sibal asked for a postponement of the Ramjanmabhoomi case till 2019 Lok Sabha elections, the Chief justice had summarily rejected the proposal. In the recent judgement related to a demand for another investigation into the death of Judge Loya, the bench headed by the CJI had made scathing remarks on the political nature of the petition. The tipping point had been reached for the Congress party.

When Ghulam Nabi Azad explicitly stressed on the fact that he had asked for an appointment ten days ago, but VP was on a tour to North-east, I chuckled. When Kapil Sibal explicitly mentioned that the impeachment motion had nothing to do with Judge Loya case, it failed to convince me. In fact, I was convinced that this act of Congress and its allies were triggered by yesterday’s judgement.

The Congress party is least bothered about the constitution or the integrity of judges. In fact, Congress had saved a judge found guilty of corruption in 1993. At that time, Kapil Sibal himself had defended the judge as a lawyer. Kapil Sibal talking about “highest standards of integrity” is a perhaps, one of the best examples of shameless hypocrisy.

The Congress and its allies don’t have the numbers to impeach the CJI. This motion is not about defending the democracy or the institution of judiciary. This act of the Congress party and its allies is an act of retaliation against the judiciary. It is also a warning for future judges who dare to anger the Congress party in future.

Another pillar of ‘saffron terror’ collapses as High Court acquits Maya Kodnani

0

A division bench of the Gujarat High Court has acquitted former minister of Gujarat Maya Kodnani who was sentenced to life imprisonment by a trial court in 2012 for 2002 riots case.

Bajrang Dal leader Babu Bajrangi’s conviction has been upheld. Other accused Suresh Langado alias Richard Chhara has also been found guilty. Kodnani’s personal assistant, Kirpal Singh Chabda, who was convicted by the trial court was also acquitted.

For Kodnani’s acquittal, the court did not find any criminal conspiracy in the riots and observed that none of the witnesses was reliable. In August 2012, a special court for SIT cases had sentenced 32 people, including Kodnani and Bajrangi to life imprisonment. While Kodnani was sentenced to 28 years of imprisonment, Bajrangi was awarded life imprisonment till death. The trial court had also acquitted 29 other accused, for want of evidence.

Last year, in September, BJP President Amit Shah recorded his statement in the sessions court in Ahmedabad as we witness for Maya Kodnani. He told the court that Kodnani was inside the state Assembly at 8:30 am on 28th February as against in Naroda as she is accused of. A television footage available corroborated the claims.

There have been glaring loopholes in her conviction by Judge Yagnik. Despite video footage of her presence at Gujarat Assembly between 8:30 am to 8:40 am, witnesses for the prosecution had claimed Kodnani was leading a mob in Naroda at 8:30 am as well. As per another witness, Kodnani was distributing swords and other weapons, though at a later time that day.

In fact, in 2012, right after Kodnani’s conviction by a trial court, a Congress leaning journalist had even talked about Maya Kodnani’s helpful attitude towards Muslims. She claims her discussions with Kodnani prior to 2002 riots where she had no qualms in helping Muslims and even helped a distressed Muslim woman get a job.

Interestingly, all these witnesses have named Kodnani for the first time in 2008, six years after the riots took place. Some of the witnesses are also allegedly close to Teesta Setalvad, who has been accused of illegal exhumation of victim bodies and embezzling funds of trust created for helping the riot victims.

Kathua rape victim’s family never received the funds collected for them, claims leaked audio

0

The family of the Kathua rape victim never received the funds which were collected in their name, if reports are to be believed. The reports have attributed this allegation to an audio tape where two people are supposedly heard discussing how “huge funds” were collected in the rape victim’s name, which never made its way to the family. The individuals in the clip are also reportedly heard suggesting that a dispute has arisen between the people who helped raised the said funds.

In light of the clip’s emergence, the Jammu and Kashmir government has forwarded it to investigative agencies for a probe. J&K’s Deputy Chief Minister Nirmal Singh acknowledged hearing the audio clip following which he decided to forward it.

Besides this, Singh also touched on the point of a long-standing demand for a CBI probe into the rape case, by claiming that the government will oblige in this regard if the court orders so.

This controversy over Kathua funds comes a few days after a Zee News report alleged that the victim’s lawyer Deepika Singh Rajawat had spent days in JNU “collecting vast sums of money” for legal representation in the case.

The allegation in question was aired by a certain Vakar Bhatti on a Zee News show. Bhatti supposedly had also speculated whether the large sums of money collected in the victim’s name had actually reached her family.

Following this, Rajawat had come out to slam what she called a “false statement” made by Bhatti. She claimed that she had never set foot in JNU and alleged that it was a calculated tactic by Bhatti to malign her.

With regards to the legal expenses, she claimed that her entire legal team including senior counsel, advocate-on-record and lawyers collective in Delhi were providing pro bono legal services.
