Goa court issues notice to Arvind Kejriwal for his ‘take bribe but vote for AAP’ comment during Goa elections

0

A local court in Goa has issued a notice to Delhi Chief Minister and Aam Aadmi Party leader Arvind Kejriwal regarding his bribery remarks during Goa assembly elections. Yesterday the Judicial Magistrate First Class of Mapusa town near Panaji has issued the notice and fixed the next hearing on February 8th, 2018.

According to reports, his statement was,“If Congress or BJP candidates offer money, do not refuse it. Accept it as it is your own money and there is nothing wrong in getting it back. If they do not offer money, go to their offices and ask for it. But, when it comes to voting, press the button against the name of the AAP candidate.” The statement had sparked a row during the elections. After his statements were made, the Election commission had ordered the police to file an FIR against Kejriwal.

In December 2017, the returning officer had approached the Judicial Magistrate First Class in Mapusa with a plea that an offence under section 171 (B) (inducement to voters) and 171 E (bribery) of the Indian Penal Code (IPC) be registered against Kejriwal.

During the assembly elections in Goa last year, AAP had fielded Elvis Gomes as the chief ministerial candidate and had contested in 39 out of 40 seats.

This was not the first time the Delhi CM had made such remarks. In January 2015, speaking at a rally at West Delhi’s Nawada area, he had made similar statements to the public. There he was speaking support of AAP’s Uttam Nagar Assembly candidate Naresh Balyan. At that time both BJP and Congress had severely condemned his statements saying it was an insult to voters and also to the authority of the Election Commission.

Modi walks the talk on VVIP racism, PM convoy moves without affecting traffic

0

The  union cabinet took a decision to end VIP culture in the country on April 19 2017. This decision made red beacons history as it withdrew special privileges to all public servants. The rule 108 of the Central Motor Vehicle Rules, 1989, which deals with beacons had enabled the use of these devices that sought to differentiate between the high and mighty from common people. The decision had implemented a Supreme court order of December 2013 to reduce use of red beacons.

The new rules had come into effect from May 1, 2017.  After May 1, beacons were allowed only on vehicles concerned with emergency and relief services (ambulance and fire service).

A video of the PM’s convoy moving in normal traffic emerged from @EconomicTimes which showed that the PM has been walking the talk on ending VIP culture. The video showed that common man had not been troubled by the PM’s movement.

Bangalore man Syed Shamshuddin confesses that he, along with his two sons, beheaded the landlord

0

A barbaric crime of beheading has been reported from Nelamangala in Karnataka. The beheading of a landlord named Manjunath (40) has come to public notice on February 2, a week after the crime had been committed.

The CCB (central crime branch) had picked up the accused, Syed Shamshuddin alias Syed Altaf (45) in a case of theft. This murder has come to the notice of the police during the course of the investigation. According to reports, the accused has confessed to the police that he had committed the crime along with his minor sons who were aged 14 and 15.

According to reports, Altaf and his sons were residents of Haleguddadahalli on Mysuru Road. They had  opened a wood factory in a shed belonging to Manjunath, in Kempalinganahalli. Reported location of the crime is just 31 kilometres from the state capital.

According to the confession, reason for this crime has been attributed to the abusive language used by the landlord over non – payment of rent.

On 24th January, Altaf allegedly called Manjunath saying that he wanted to pay the rent. As per his confession, when the landlord arrived at his place, he murdered his landlord with the assistance of his sons. The accused confessed that he slit the throat of his landlord, chopped his head and buried it in his land. The body was thrown away into a stormwater drain as per reports. The water body is also identified as Vrushabhavati river by one of the reports.

The head of Manjunath has been recovered by police. The police are searching for the torso in the waterbody mentioned by the accused. Sons of the accused have been sent to a juvenile home.

Job creation and MSME seem to be the key focus of Budget 2018

0

Micro, Small and Medium Enterprises (MSMEs), play an important role in the economic fabric of our country yet decades after Independence they continue to face constraints in obtaining adequate finance or necessary focus from our policy makers. This isn’t a pretty sight for the biggest job creators in our country. However this government has given a special focus to MSME’s and has taken some bold and important steps to spur their business activity.

Whats is TReDS?

Liquidity, particularly ability to convert trade receivables into liquid funds has been a major issue for MSME’s meanwhile this being easily available for large corporate. In order to address this issue, RBI had allowed setting up of an institutional mechanism for financing trade receivables. TReDS stands for “Trade Receivables Discounting System (TReDS) — a digital platform where small businesses (MSMEs) can get access to capital by auctioning their trade receivables.”

Budget 2018 and TReDS

We have already seen how GST data is helping the government track tax evaders and expand base. On the flip, side this same data can be used by honest persons to access cheaper, faster and reliable financing. In this Budget the Finance Minister has laid out a plan to introduce online loan sanctioning facility for MSMEs via TReDS. Current system would be revamped for prompt decision-making by banks. He has also proposed to on-board public sector banks and corporates on Trade Electronic Receivable Discounting System (TReDS) platform and link it to Goods and Services Tax Network (GSTN).

With abundance of data available on GSTN, Financial Institution will be in a better position to gauge viability and reliability of a business entity. Further availability of all records in electronic format shall mean easy and quick transmissibility. This simple tweak might seem innocuous but shall be a game changer for capital starved MSME sector.

Other Important proposals for MSME’s

The Centre has allocated INR 3,794 crore for MSME’s as a credit support, capital and interest subsidy as well as to spur innovation in this budget. Mudra Yojana launched in April, 2015 has led to sanction of Rs.4.6 lakh crore in credit from 10.38 crore MUDRA loans. 76% of loan accounts are of women and more than 50% belong to SCs, STs and OBCs. It is proposed to set a target of Rs.3 lakh crore for lending under MUDRA for 2018-19 after having successfully exceeded the targets in all previous years the Finance Minister stated in his Budget speech.

For reducing tax burden on MSMEs and to help generate more employment, Finance Bill has proposed to extend the benefit of reduced corporate tax rate of 25% to companies which had reported turnover up to INR 250 crore during the financial year 2016-17. “This will benefit the entire class of MSMEs, which accounts for almost 99% of companies filing their tax returns. The estimate of revenue forgone due to this measure is INR 7,000 crore during 2018-19,” Finance Minister stated.

Surely these little tweaks shall go a long way in boosting the MSME sector.

Shia Wakf board chief asks Muslims opposing Ram Mandir to go to Pakistan

0

Wasim Rizvi the Shia Wakf Board chief on Friday stated that the Muslims who are opposed to Ram Mandir should go to Pakistan. He made this statement while offering Friday prayers at the disputed Babri Masjid-Ram Janmabhoomi site in Ayodhya. Apart from offering prayers, he also met Ram Janambhoomi’s head priest Acharya Satyendra Das.

While speaking to media persons at the occasion, he claimed that secularists have never been opposed to the Ram Temple in Ayodhya. He further stated that those opposed to the temple and want a Babri Masjid built should go to either Bangladesh or Pakistan. As per him, such fundamentalist Muslims have no place in India.

He said that Ayodhya is a sacred place for Hindus hence a Masjid should not be built there. To take things a step further, he stated that those wanting a Masjid there should join the forces of ISIS chief Abu Baqar Baghdadi.

This pro-Ram Manidr stance of Rizvi is in line with the Shia Wakf Board’s stance that Ram Mandir be constructed at the Janambhoomi area, while a Mosque be built in a Muslim dominated area that is at a reasonable distance from Lord Ram’s birth place.

This isn’t the only time Wasim Rizvi is in the news for his statements. It was reported how he implored PM Modi to shut down Madrasas by claiming that they are a breeding ground for terrorists. This angered a few radical Muslims who then proceeded to put a Rs 10 lakh bounty on his head for his statement.

Rizvi incidentally isn’t the only person batting for the Ram Mandir in recent days.

Yesterday media reported how Surya Kumar Shukla, Director General Homeguard, Uttar Pradesh, had publicly vowed to build the Ram Mandir in Ayodhya along with a few other. The senior IAS officer was quoted taking a pledge that, “We Ram-bhakts, today, as part of this programme, take this pledge that at the earliest, the Ram Mandir be constructed. Jai Shri Ram”.

This incident happened at an event on Ram Mandir organised at the Lucknow university. Apart from taking pledge to construct Ram Mandir, the attendees also raised slogans of “Jai Shri Ram”.

Karnataka elections : 5 broad themes that the Congress seems to relying on to retain power

0

The state of Karnataka is heading towards an election for its Legislative Assembly in the coming months. While the reigns of the state are obviously at stake, what is causing this election to be even more critical is the current political dynamics in the country. The ruling party in the state – Congress – has become a virtual non-entity in the country. Apart from a few smaller sized states in the north-east, Karnataka is the only large state in the country where it is in power. To harbor any ambitions of a political comeback, it absolutely has to do well here. On the other hand, the state is equally critical for the BJP in its quest to win a second term at the center in 2019. BJP had broken the southern citadel in 2008 by winning power in Karnataka during the state assembly elections but then it lost the same due to massive in-fighting and factionalism in the 2013 elections. If it wants to realize its ambition of increasing its seat share in New Delhi in 2019, winning back this state in the south is vital for the BJP.

With so much at stake, it is natural that both the Congress and the BJP have started early preparations for the elections. In fact for more than 6 months now, both parties have been raising the stakes and increasing their campaign pitch. In any election, it is natural to expect the opposition party to focus on the shortcomings of the government and appeal to the voters for a change. On the other hand, the incumbent government is expected to talk to the people on its “achievements” and consequently its continued plans for the state if voted back again.

However, the campaign preparation from the ruling Congress side in Karnataka has taken a very different route this time. The focus is not on the achievements of the Siddaramaiah government. Of course, there is a constant, if only notional, mention of the numerous social justice “bhagya” schemes launched and run by the government, and their consequences. However, the main focus of the ruling party has been on a few totally different issues. The goal of the preparation seems to be more towards disrupting the apple cart of the BJP and thereby hoping to come back to power, than going in for a campaign seeking a vote on the performance of the past 5 years.

We can categorise the approach of the ruling party on 5 broad “themes”.

Campaign of division

Since the past several months, the state government has been an active participant in the renewed demand for declaring the Lingayat community as a minority religion. Lingayats constitute nearly 20% of the electorate in Karnataka and undoubtedly have an overwhelming say in deciding the ruling party in every election. The leader of the Karnataka BJP, B S Yedyurappa, belongs to this community and is increasingly seen as consolidating the community vote for BJP. By stoking the fire of alleged discrimination and subjugation under the Hindu fold, the goal is to ensure that the community’s votes are split. Read this excellent piece to understand the role played by some senior political leaders of the Congress in this whole controversy. This movement is already showing some “results” for the incumbent with the Lingayat and Veershaiva (sub)community split on the demand. While the actual outcome of this movement can only be gauged in the coming months, it is quite clear that the re-ignition of this long standing demand this time is purely for political reasons.

Another potential fault-line being exploited by the ruling party in the past few months has been on the issue of Hindi vs Kannada. The trigger for this topic was the usage of Hindi messages in the Bengaluru Metro stations and coaches. The same was exploited to the hilt to project some sort of “imposition” of Hindi by the central BJP government with the Congress playing the role of the Kannada flag bearer.

Campaign of provocation

Recently, BJP leader B S Yedyurappa had some discussions with the Chief Minister of Goa regarding the sharing of the Mahadayi river water. As a result of the discussions, the CM of Goa sent a response to BSY agreeing in principle to provide drinking water to Karnataka on humanitarian grounds, while the core issues may take longer to resolve. Instead of latching on to this opportunity, the ruling government did everything to ensure the initiative died a quiet death. Not just this, it then tacitly supported a Karnataka bandh to protest the attitude of Goa in this dispute. The only reason for the complete non-action on the part of the government was the inevitable credit that BJP and its Karnataka leader was bound to get, if any kind of a settlement (even an interim one) happened. The bandh, and associated protests, ended up agitating a lot of the genuinely affected farmers and villagers of North Karnataka and the diplomatic steps initiated were naturally forgotten.

Over the past few years, a number of Hindu activists in the coastal Karnataka region have been murdered brutally. The reasons for these murders are both political and social. However, the state government has gone completely slow in the investigation of these cases. Whether it is the murder of Prashanth Poojary in 2015 or the recent murder of Deepak Rao in 2017, the near static progress of investigation has emboldened those who are committing these political murders. The net result of such inaction is the widening the religious fault-lines in an already communally sensitive region of Karnataka. Politically this is expected to create stark polarization of votes based on religion, which again could help the establishment.

Campaign of appeasement

A third approach that is distinctly visible in the run up to the elections has been that of appeasement of minorities. The most recent, and most blatant, attempt at such appeasement was the circular by the government to the police department to look into the possibility of withdrawal of cases against those accused belonging to the minority communities who have been held in cases of communal riots. Subsequently, due to sustained protests of many, the circular was withdrawn and a modified communication dropping the word “minorities” was issued. However the purpose of communicating the intent of appeasement was successfully achieved through this exercise.

The allocation of budgetary resources for minority-only schemes has increased manifold in the past 5 years in Karnataka. From a sum of around 770 crores in 2013-14, this budget has increased to more than 2200 crores in the year 2017-18, indicating a three-fold increase in just 4 years. There is no doubt doling out of exclusive schemes based solely on the religion of the target recipients is a blatant exercise at minority appeasement.

One of the state ministers recently declared, very proudly, that he was being elected continuously from his constituency due to the benevolence of the minority community.

All these clearly indicate at a planned effort to garner the votes of the minorities based on a regime of appeasement.

Campaign of carping

Recently, as part of the Parivartana yatra being held by the Karnataka BJP, the Chief Minister of UP – Sri Yogi Adityanath – visited Hubballi and gave stirring speech to the crowd gathered there. He reminded the people that Karnataka was the land of Hanuman and therefore he must be a guiding spirit for the people of this land. The ruling Congress party was however quick to term him an outsider and took exception to a North Indian talking to Kannadigas about their culture and tradition.

Similarly, whenever the BJP President Amit Shah has visited Karnataka, the ruling establishment has been relentlessly hitting back at him raking up the issues of the false cases and accusations that were hurled against him by the UPA government.

In addition, from every issue starting from funding of states for schemes to the budget for Swacch Bharat campaign, the Congress party in the state has made it a point to blame the central government for every ill affecting the performance of the state.

On another occasion when Prime Minister Modi visited Dharmasthala and later a railway inauguration event in Bidar, the Chief Minister excused himself from the event citing lack of proper invitation.

If one were to believe all this complaining, then the BJP government at the center is solely responsible for all the failures of the state government in Karnataka.

Campaign of silence

According to a recent report, Karnataka is one of the 5 states in India that is expected to have an urbanization ratio of more than 50% by 2030. Naturally, the capital city of Bengaluru will play a significant role, and bear a big burden, in this fructifying. However, the attitude of the state government towards this fast-growing city has been one of complete apathy and disregard.

The degeneration of Bengaluru city in the past 5 years is most evident in the stoic silence that the ruling establishment maintains when it talks about its “achievements”. From worsening traffic problems to increasing pollution to lack of civic amenities – the city has only seen its problems increasing. Not a single flyover or under-bridge has been completed on time. A new scheme – named TenderSURE – was launched and was touted as the panacea for all road-quality issues in the city. However, even after spending many tens of crores on some of the best roads of the city, the roads developed serious quality issues immediately after the first showers hit the city. The state government came up with an unpopular idea to build a steel bridge in the city and tried to push it through much against the wishes of the residents. In the end, it had to give in to the genuine concerns of the citizens and drop the plan.

The crowning jewel in this impressive list of non-achievements in Bengaluru was the fire display on Bellandur and Agara lakes. This ghastly incident only highlighted the utter contempt the civic authorities have for the once beautiful capital of Karnataka.

In its desperate attempt to cling on to power in Karnataka, and in the face of the obvious reality of non-achievement on the development front, the ruling party is resorting to every political, communal and social trick in the book to dent the electoral prospects of the opposition parties. More than a positive vote for itself, it seems to be banking on a division of votes amongst the opposition to retain power.

Whether it succeeds with this approach or not remains to be seen but one thing is certain – the road to power in May 2018 will be paved with a lot of dirty and unclean politics.

Bundelkhand to be modelled using Israeli techniques in agriculture

0

On his maiden visit to India, Israeli Prime Minister Benjamin Netanyahu discussed how to optimally utilise groundwater to fullest in Bundelkhand, Uttar Pradesh, with Uttar Pradesh Chief Minister Yogi Adityanath. Uttar Pradesh Chief Secretary Rajiv Kumar has said that Bundelkhand will now utilise Israeli techniques for irrigation, for which a team from Israel is expected to visit Bundelkhand soon.

He said, to bring a solution to drinking water scarcity, hand pumps will be installed by MLAs in their constituencies. Meanwhile, in order to fight drought like situation, irrigation facilities modelled on Israeli techniques since the climate situation there is similar to that of Israel. Funds from Bundelkhand Development Fund has been allocated for various projects. Rs. 83 crore are allocated for piped drinking water, Rs. 36 crore for electricity and Rs. 19.50 crore for tubewell for irrigation.

Earlier, we had reported how technology from Israel is helping Indian farmers. There is great expectation on this front as far as the Indo -Israel cooperation is concerned. The progress of this partnership, is crucial for the future of Indian agriculture and to the Prime Minister’s dream of doubling farmer’s income.

The Indo-Israeli Agricultural Project started in 2008 following the signing of a three-year action plan between the two governments. The plan was later on extended to include the 2012-2015 period. On the occasion of Prime Minister Benjamin Netanyahu’s 5-day visit to India, Indians should know about the phenomenal success stories that have emerged from this partnership.

The Indo- Israel partnership in agriculture is implemented by MASHAV,  Israel’s Agency for International Development Cooperation which shares the best of Isreal’s experience in development and planning. MASHAV is running centres of excellence in Bihar, Gujarat, Haryana, Karnataka, Uttar Pradesh, Maharashtra, Punjab, Rajasthan, Tamil Nadu and West Bengal. These centres demonstrate the best of Israel’s technology in growing fruits and vegetables.

NHAI instructs officials to properly maintain highways, failing which toll would be halved

The National Highways Authority of India (NHAI) in a stern warning to its officials, has instructed them to ensure proper maintenance of toll roads across the country, failing which the toll charges levied would be halved.

This comes in the backdrop of a Madras High Court ruling which asked the NHAI to reduce its toll by 50% on the Madurai-Virudhunagar highway due to poor maintenance. The Madurai bench in its interim order stated that 100% toll can only be charged at the Kappalur toll plaza after the stretch is repaired and a report regarding the same is submitted to the court.

As per the Union road transport and highways secretary – Yudhvir Singh Malik, he has asked the NHAI to not challenge the High Court order, and take it in the right spirit. Further he claimed that they are proposing to establish a protocol to assess maintenance of roads, which will bring in accountability.

This order issued as a result, has asked for a preventive maintenance of roads to avoid incurring a reduction in toll charge.

As per an official, this effort of the NHAI strives to drive home the point with concessionaires and highway operators that, toll is paid by the people for good service, who then have the right to relief, owing to service deficiency.

Even though various stretches of Indian road network boast of a four lane highway network, many of them over the years have been marred by bad maintenance, even though commuters continued to pay premium toll charges.

The condition has been so pitiful in the sense that the Bihar government had slammed the NHAI in 2015 for a poor maintenance of its 2,560 KM roads in the state. The Bihar government also claimed that the NHAI had decided to allocate a mere Rs 68 crores for the maintenance and repair of National Highways in the state.

In 2015, the Supreme Court had come up with a landmark judgement in this regard by observing that, the NHAI and concessionaires cannot collect toll from commuters if the road was in a bad shape. The bench of Justice T S Thakur and Justice Kurian Joseph while hearing the case about a poorly maintained 26 KM stretch on Raipur – Durg stretch of NH-53, observed that the public cannot be made to suffer both bad roads and heft toll. It thus ordered the refund of Rs 11 crore in collected toll to the Central government, which had taken over the road from a private contractor.

Incidentally the troubles of the commuters aren’t limited to the bad condition of roads and also extend to toll operators.

As per a 2013 report, Delhi was at the third place when it came to the list of complaints against the toll users. One of the main culprits being the Delhi-Gurgaon expressway, which accounted for the majority of complaints. The complaints included overcrowding and a lack of proper infrastructure.

Incidentally, going by a DNA report, there are also checks and balances in this regard which are, being able to refuse toll payment, if you are stranded at a NHAI toll plaza for more than three minutes. Besides this you can also refuse toll payment if there are six vehicles or more ahead of you.

This issue though might be eliminated in the near future via a proper implementation of the FASTag technology. In this technology a device operating on Radio Frequency Identification (RFID) technology is fixed on the windscreens of a vehicle. Using this toll payments are automatically deducted from an account linked to it, while one passes through a toll plaza.

Such a fixture of FASTag has been made mandatory for all new four-wheelers post December 1st.

Congress MLA booked for rape of journalism student

0

Hemant Katare, Congress MLA from Madhya Pradesh has been booked on charges of rape and abduction of a 21-year-old student of the Makhanlal Chaturvedi National University of Journalism. As per reports, the student has filed a written complaint against the MLA.

The girl had accused that Katare had raped her at Juna, a gym owned by him. The girl’s mother had lodged a complaint about her daughter’s abduction by Katare. The police acted on the complaint and registered a case against Katare.

Earlier last week, the student was taken into custody after Hemant Katare had filed a complaint against her. He had alleged that the girl had threatened to circulate intimate videos of the two of them and wanted Rs 2 crore to be paid to her if he did not want the videos to be leaked. The MLA admitted that he knew her but had denied any relationships with her. He had alleged that he had finalised a deal for Rs 5 lakh and informed the police. The police had then arrested the girl from the parking lot of a hotel in Bhopal’s M P Nagar locality.

After the girl was arrested by the police, a video had surfaced in media where the girl was seen alleging that the MLA has been exploiting her and she has evidence of the same. The Congress MLA too had released a video where he alleged that the girl’s allegations were false.

The girl student’s bail plea was to be heard in court on Friday. But she filed a written complaint through jail superintendent in which she accused the MLA of rape. DIG Dharmendra Choudhry of Bhopal had stated that the student had accused Katare of rape and abduction. He said the police has sought permission from the court on Friday to record the complainant’s statement in jail.

The case has now given rise to political arguments and counter-allegations. The Congress party’s leader Ajay Singh had stated that the rape and abduction charges against Katare are a political conspiracy. Katare is said to be a close aide of Jyotiraditya Scindia. Hemant is the son of former opposition leader Satyadev Katare. Congress has said that the girl had an accomplice named Vikramjit Singh who had associations with BJP. They alleged that the girl bringing rape charges nine days after her own arrest means it is a political conspiracy to tarnish the image of Katare.

Bandh tacitly supported by Siddaramaiah to undermine Modi rally called ‘unconstitutional’ by Karnataka HC

0

The Karnataka bandh called by Kannada outfits on Sunday was struck down by the Karnataka High Court. The Bandh was called to target PM Narendra Modi’s rally to be held in Bangalore tomorrow. However the reason cited by Kannada outfits had been the centre’s alleged inaction over resolution of Mahadayi river water dispute between Goa and Karnataka. The protestors have now decided to observe a black day.

Another bandh for the same reason called by Kannada outfits during Amit Shah’s visit to Mysore had received tacit support of the Congress government lead by Siddaramaiah. The Bandh had failed to thwart the BJP rally in Mysore on January 25. The chief minister often endorses these Kannada ‘activists’ on Twitter.

Karnataka High Court calls the proposed Sunday bandh as unconstitutional

The Karnataka High Court head a petition by Sri A.S.Ponnanna on the proposed bandh and passed the following order [pdf] . The High Court, in its order said that such bandh’s were unconstitutional. It asked the law enforcement authorities to abide by its order and restrain those who have called the bandh.

The Hon’ble Supreme Court in All India Anna Dravida Munnetra Kazhagam v. Govt. of T.N. [2009 (5) SCC 452] and in Communist Party of India (M) v. Bharat Kumar [1998 (1) SCC 201] has declared that calling of a bandh or the holding of it is unconstitutional. Therefore, we direct the State Government and its officials including the Law Enforcement Agencies to do all that is necessary to give effect to the aforesaid declaration. Further, the organizations who have called for the bandh are restrained from proceeding with the call for bandh in the State on 04.02.2018.

The court also appreciated the petitioner for bringing the matter to its attention.

It is high time that CM Siddaramaiah learns to prioritise his responsibilities as a Chief Minister rather than encourage forced bandhs called by people who seem to be his cronies, disguised as ‘activists’.
