Supreme Court lawyer says criminalization of triple talaq goes against freedom of speech

The liberal brigade has clearly lost its mind over the passage of the Muslim Women Protection of Rights on Marriage Bill 2017, also known as the Triple Talaq Bill. The main arguments against the bill during the Lok Sabha discussion can be summarized as below.

  • The law will not act as a deterrence just like the dowry prohibition act failed to stop dowry
  • Imprisonment will make reconciliation between the husband and wife more difficult
  • The person who is imprisoned may not be able to pay the subsistence allowance
  • Proving that the instant triple talaq has been delivered in a court of law will be difficult for women.
  • The bill has not taken into consideration the opinions of Muslim women and AIPMLB

Though all these arguments make an attempt to derail the bill, they have a semblance of logic or common sense that can be understood and appreciated to some extent. Someone who is liberal and compassionate can understand the merit of the arguments made above. One can at least give it a second thought.

But, I heard something on the Bloomberg TV’s show that was so ridiculous in its merit, that it would be tragic, if it wasn’t so amusing. A Supreme Court advocate Karuna Nandy said that criminalizing instant Triple Talaq is against free speech.

Between 2:10 to 2:30  in the video, the lawyer says this :

Saying Talaq Talaq Talaq is same as saying – Mein apko divorce de raha hoon.  In such a situation, are you going to criminalize that?  How can that be criminal? Isn’t that against free speech ?

Well, if it was as simple as that, then there would be no need for court battles and legislative action from the Parliament. The Supreme court has outlawed the practice of instant Triple Talaq, but has not provided any means to prevent and punish those who are violating its order. Hence, the police were not able to do anything even after receiving complaints from Muslim women.

Instant Triple Talaq is not same as saying – I want to divorce you , as per Karuna Nandy’s claim. It is finalization of divorce in an instant. If there is no punishment for a crime, then there will be no need for people to desist from committing a crime. That is the basic logic for framing a law against any crime in the first place.

If one goes by Ms. Nandy’s logic, should one conclude that since marriage is valid only when adults are involved, and since that makes child marriages void ab initio, that child marriages shouldn’t be criminalized? The Supreme Court has said that Triple Talaq won’t be valid in the eyes of the law. But how many times can a regressive practice be stopped just by making it invalid and not making it punishable.

What Ms. Nandy is saying, holds water technically. Once the Supreme Court deems the phrase “Talaq Talaq Talaq” invalid, it becomes just another three words without any consequences and hence, does fall into FoE. But she naively and criminally ignores the realities on ground. “Talaq talaq talaq” isn’t just something said in rage which can be taken back and the matter reconciled. And that Karuna Nundy ignores this fact, points either towards ignorance, or maliciously misleading people.

The lawyer goes on to say that the government is not at all concerned about Hindu women as it is not taking action on marital rape. Though it is an important issue, that must not be a reason to not punish the practice of instant Triple Talaq. Also, one has to wonder if Ms. Nandy has some specific knowledge which can prove that Marital Rape is a “hindu woman” problem and that Muslim and Christian women don’t suffer from it? It is shameless of an advocate to turn a problem like Marital Rape, into a religion specific one, just so it can used while defending triple talaq. She then goes on to talk about the controversial comments of a minister on the constitution. It is quite evident that she has almost lost her mind after the bill was passed in Lok Sabha.

As MJ Akbar said in his speech during the discussion, the impact of instant triple talaq is not just momentary but a lifelong threat used by Muslim men to subjugate and threaten women. It is sad to see self-proclaimed feminists trying to deny justice to Muslim women , just because the law is being passed by a political party they have visceral hatred for.

Police raids UP Madarsa and rescues 51 girls being held hostage, manager arrested

The UP police on Friday, raided a Madarsa in Lucknow’s Shahadatganj area, where girls were allegedly held hostage and molested by the Madarsa’s manager. A total of 51 girls were rescued by the police during the raid and the manager was also arrested. More than 125 girls are believed to be studying in that Madarsa.

This raid was carried out by the police after a few girls had filed a complaint against the manager named Kari Tayyab Ziya for sexually harassing them.

As per Deepak Kumar, Senior Superintendent of Police (SSP), Lucknow, strict action was taken, soon after the complaint was received and claimed that during the raid, they found that 51 girls were being held hostage there. As per the SSP, the manager used to assault and molest the girl students.

A FIR has been lodged in this regard and West Uttar Pradesh’s Superintendent of Police, Vikas Tripathi has claimed that after an investigation was lodged in this matter, the complaints about the girls being held hostage were validated.

As per local reports, some girl students of this Madarsa named “Khadiztul Kubra Lilbanat”, decided to throw hand written letter and chits from the windows of their rooms on Friday afternoon. In these chits the girl alleged that they were being molested and held hosted, thereby imploring the passersby to help them by notifying the police.

The locals promptly informed the owner of the Madarsa named Syyed Mohammed Jilani Ashraf, and when he reached the spot, it was noticed that the main gate of the Madarsa was locked from the outside, thereby confining the girls. He later escalated the matter with the police.

As per the report, the owner of the Madarsa, when he came to know about the matter, was threatened by the manager to keep away from this matter. Now two cases have been filed against the manager and his associates. One has been filed by the girls alleging assault, harassment and being held hostage. The second case has been filed by the owner of the Madarsa, alleging fraud.

This isn’t the only time madarsas have been in the news for the wrong reasons.

In 2015 it was reported that a Madarsa teacher in Kozhikode, Kerala was arrested over charges of him sexually abusing a minor girl.

While responding to everyone like the gentleman he truly is, one social media user couldn’t help but notice the difference in the manner in which he chose to respond to Rahul Gandhi and Prime Minister Narendra Modi


While Rahul Gandhi got a mere ‘thank you’, the reserved champion expressed his deep sense of nationalism while hearing the national anthem and the Tri-colour being unfurled after taking the winner’s podium.

Perhaps the difference in response stems from how the Congress party has been denigrating the sentiment of nationalism at every opportunity it gets and how Prime Minister Narendra Modi proudly proclaims that the sense of nationalism is above all.

Viswanathan Anand has made the country proud on several occasions. He has held the flag high and brought glory to every citizen of this country with his championships. It is certain that a man of his stature would be a sworn nationalist, and dare we say, his responses are a testament to that fact.

Writer and lyricist Javed Akhtar, who has displayed his hypocrisy and bigotry multiple times, today tried to passive aggressively defend triple talaq by claiming how like triple talaq, even Hindu Succession Act is unfair to the daughters.


Soon, Twitter users gave him a quick lesson in law and updated his knowledge regarding the ‘anti women’ Hindu Succession Act.


Some resorted to sarcasm to prove a point.


This is not the first time the so-called liberals have brought up the Hindu Succession Act to prove a point against triple talaq. Earlier in August, when the Supreme Court had given the verdict declaring the instant triple talaq unconstitutional, many journalists and politicians had brought it up and were eventually taught a lesson in law by Twitter users. The abusive, foul mouthed troll Swati Chaturvedi had also showed off her complete ignorance about Hindu inheritance law along with controversial journalist Sagarika Ghose.


This just goes out to show how the ‘liberals’ of India cannot think beyond religion themselves.

Former NDTV journalist claims the channel is ‘communal’ and free speech is only for selected few

Since its launch in 1988, the media group NDTV has made a name for itself as one of the most controversial channels in the Indian news media sphere.

Earlier social media users and vigilant media observers used to be instrumental in exposing the ‘sins’ of NDTV 24/7, like it peddling blatant fake news. But in recent days, the media group has been hit by a new trend, which is, getting exposed by its own former employees.

Earlier we had reported how Sushant Sinha, a former colleague Ravish Kumar exposed his hypocrisy when the latter had written an open letter to PM Modi alleging that he received death threats on social media.

This, “I am an ex-employee and I will expose NDTV” template was further popularised by former employee Barkha Dutt who wrote a long Facebook post, to exposes censorship at NDTV. She also spilled the beans on how former corporate lobbyist Nira Radia could have helped the channel financially, and had also launched other attacks on the channel.

Now the latest ex-employee on the scene is Abhiranjan Kumar, who earlier was the senior output editor at NDTV India and is currently the director Neutral Media Pvt. Ltd, apart from being the founder and editor-in-chief of hindiwriters.com. 

In a no holds bar Facebook post in Hindi, Abhiranjan has alleged that the channel is ‘communal’ and values free speech only for a few select persons. In the post Abhiranjan claimed that even though the channel was more news and less noise, this news was frequently ‘adulterated’.

He recounted an old news where a youth was beaten up because he entered a military compartment. Incidentally the youth named Shafqat hailed form Kashmir, this as per Abhiranjan provided ammo for the channel’s senior decision makers, who spun the news as, “A Muslim and a Kashmiri. Possibly this was the crime of Shafqat“. 

Abhiranjan claims that he opposed the inclusion of this narrative by arguing that this line spread hate, communalism and was against journalistic ethics, because the version of military was not being taken into account.

But nobody paid heed to Abhiranjan and the reason he gives is that, the story was part of a high level level planning. As claimed, a senior editor of the channel had fixed Shafqat’s meeting with then Home Minister P Chidambaram, which indeed took place.

In another instance, Abhiranjan claims, he had written an article for NDTV Khabar, post the Mumbai terror attacks. Abhiranjan claimed that like countless other Indians, he was very angry and as a result factually criticised the the UPA government policies.

That article Abhiranjan claims, went viral and was invoking a positive response. But the then editor of NDTV India soon sent an email to NDTV Khabar’s editor (it was CCed to Abhiranjan), instructing him/her to take down the piece, and the editor promptly complied.

Abhiranjan later asked the editor regarding the objections for that piece and got a cryptic reply that, “The article was very good, but you know, don’t you“. As per Abhiranjan, rumour had spread that the PMO had objected to that article and had conveyed a message seeking its removal.

Abhiranjan claims, the channel though had no issue in running hate speeches of ‘Congress leaders’ who were calling the attacks as a RSS conspiracy.

He thus claims, how he finds it amusing when his ex-employees claim they are fighting against the government. Curry favour with one government and attack another, it won’t be difficult to understand as to on whose directions are they fighting this fight, claims Abhiranjan.

In conclusion, Abhiranjan claims that the channel always promoted a selective freedom of expression and reserved very limited space for neutral writers and journalists.

Interestingly these allegation of NDTV selectively censoring voices have also surfaced earlier, when it was reported that NDTV had deleted a blog post by rebel AAP leader Kapil Mishra which was critical of AAP supremo Arvind Kejriwal.

It remains to be seen whether any senior NDTV employee now comes out to rebut these serious charges, while revealing more than intended like they did, when the news about the channel potentially sacking 25% employees broke.

In 1986, Rajiv Gandhi’s government passed the so called “The Muslim Women (Protection of Rights on Divorce) Act“. The objective of this Act of “protecting the rights” of Muslim women?

To subvert the verdict of the Supreme Court of India and make sure that Shah Bano, a Muslim woman over 60 years of age at the time, was thrown out by her husband without a penny to her name.

At that time, the Congress Party had 404 Lok Sabha seats.

Knock out the zero in the middle and you get 44, around a tenth of that number. That’s what Congress got in the 2014 elections.

And what did the nation get in return for knocking the Congress down from 404 seats to 44 seats?

The nation got Narendra Modi, who has now passed in the Lok Sabha The Muslim Women (Protection of Rights on Marriage) Bill 2017.

Unlike Rajiv Gandhi’s “Protection of Rights” bill for Muslim women, the name of Narendra Modi’s bill is not Orwellian. Triple Talaq has been criminalized. That means goodbye to things like this.

Muslim women can sleep peacefully now. Meanwhile, the Islamist patriarchs across the nation are waking up to the new reality of women who can choose to sleep at night.

In an instant, Narendra Modi has become the liberator of 8 crore Muslim women of India. Just for comparison, if these 8 crore women formed a country, its population would be the same as Germany, the most populous nation in Europe.

And things have come to such a pass that Rajiv Gandhi’s son dare not oppose this bill to grant freedom to Muslim women. They employed some delaying tactics, made some demands to send the bill to a committee and some long time courtiers like Salman Khurshid made the mistake of publicly admitting the party’s real sympathies. But their bluff was called rather easily. The Bill still needs to go to the Rajya Sabha where the party of Rajiv Gandhi’s son is more capable of doing mischief, but chances are that he won’t dare.

That is what the people of this nation get for reducing the Congress from 404 to 44. This is not about Hindus or Muslims alone or about men or women. Bringing 8 crore Muslim women into the mainstream, empowering them is a bonanza for every Indian no matter what his/her identity. Like I said, 8 crore people is roughly the population of Germany. The liberation of 8 crore citizens is not only a moral imperative, but an economic blessing for us all. A rising tide lifts all boats.

If you look at the numbers, what India has achieved today is nothing short of the end of apartheid in South Africa.

The stakeholders in the 70 year old establishment have projected it as a war on Muslims. That’s okay because these stakeholders used to benefit from things as they were. And they were okay with apartheid against Muslim women as long as it kept their benefactors in power in Delhi.

But it was *not* a war on Muslims. It was a battle against Islamist patriarchy. 

We are all victims of this Islamist patriarchy in one way or the other. It is the Islamist patriarchy that teaches children in Palestine to hate Jews and children in Kashmir to hate Hindus. It is the Islamist patriarchy that ties suicide belts around children who have been raised with TV shows that glorify the murder of innocents.

This same Islamist patriarchy carries out things like the recent gangrape and murder of a woman in Jharkhand who refused to convert to the religion of her Muslim boyfriend, popularly called “love jihad”. The Islamist patriarchy carries out campaigns of subjugation against non-believers, particularly idol worshippers, such as the Sadhvi in Delhi who wants to sell her temple and run away. And yes, it was the same Islamist patriarchy that shot Malala Yousufzahi in the head.

And today, Islamist patriarchy has been shaken to the core by the passage of the Triple Talaq Bill. The Islamist patriarchy fuels paranoia in Muslim society about Jews, about non-believers, about America and what not. But, the real fear of the Islamist patriarchy is not one of these. Their real fear is liberated women.

For the Islamist patriarchy, this is the stuff nightmares are made off. The liberated women are coming!

Congress MLA from Dalhousie, Himachal Pradesh, Asha Kumari was caught on camera assaulting a female constable, who in turn, slapped Kumari back.


As per reports, Kumari was furious at being denied entry into a review meeting chaired by newly crowned Congress President Rahul Gandhi, who was in Shimla to assess what went wrong in the recently concluded Assembly elections where Congress won 21 out of 68 seats and BJP bagged 44. Kumari the Punjab in-charge of All India Congress Committee (AICC) and recently won the assembly elections in Dalhousie, Himachal Pradesh.

Soon, netizens came together to call out Asha Kumari’s arrogance at assaulting a public servant on duty.


Many even came out in support of the lady constable who slapped back Kumari.


With the common citizen getting exponentially aware, such arrogance of politicians is the one thing that political parties need to check. This seems to be just another incident where the Congress party has displayed its elitism.

Andhra Couple arrested for attempting to convert tribal kids to Christianity

The Rachakonda police in Hyderabad, Telangana has busted a religious conversion racket, by arresting a couple from Kadapa district in AP, over accusations of them converting tribal kids to Christianity.

As reported, the police have rescued nine kids aged below 14 years of age from the couple, who allegedly were teaching the kids about the Christian faith, under the guise of an orphanage and old age home. These kids are reported to hail from the backward communities living in Suryapet, Mahbubnagar, Warangal, Khammam and Kothagudem districts.

The accused couple was supposedly touring Hyderabad from the past three years. About three months ago the couple moved to the Parvathapur region, under the Medipally police station, to start a shelter house named Nazareth Orphan Children & Home for the Aged.

Here they admitted about 16 kids below the age of 14 by claiming that they would be provided education and shelter. The kids here were taught Christian prayers and Christian literature too was found in the house.

Based on a tip-off the police raided the shelter home and rescued four boys, five girls. It has been alleged that at one point a single room was housing 16 kids, which is a violation of juvenile justice act.

In recent days, reports have emerged about law enforcement authorities acting against attempts to forcibly convert people to Christianity.

We had reported how Madhya Pradesh police had arrested a Catholic priest and detained 40 others, over accusations of them forcibly converting Hindus to Christianity. The man who made the complaint alleged that he was converted to Christianity by being offered money. It was also alleged that one of the fathers present in the group also asked villagers to take holy dips in the pond and embrace Christianity.

It was also reported how the Mathura police had arrested 7 Christian preachers after they were accused of carrying out forced conversions in a UP village. These preachers were alleged to have distributed Bibles among the citizens and even allegedly started insulting other deities while praying at one of the villager’s house.

As per one of the villagers, these preachers turned aggressive and tried to forcibly convert the people after they became exasperated with their ‘lack of success’.

After Pakistan seized shoes of Kulbhushan Jadhav’s wife, BJP spokie decides to send them more shoes

Tajinder Bagga, the spokesperson of BJP Delhi has made a name for himself by successfully using social media to promote innovative campaigns.

In January it was reported that Bagga had announced on social media that he had brought a new kurta for Rahul Gandhi, after the latter had tried to generate sympathy for himself after showcasing his torn kurta at an Uttarakhand rally.

He later also put up Manmohan Singh’s ‘magical raincoat’ on sale, after PM Modi made a ‘raincoat remark’ about Manmohan Singh still being considered an honest man despite numerous scams taking place under his watch.

Bagga is in news again for similar reasons after he has taken to twitter to announce his decision to send shoes to the Pakistan High Commission in New Delhi:


Such a decision of Bagga comes after Pakistan decided to humiliate Kulbhushan Jadhav’s mother and wife, by forcing them to remove their Mangalsutra, bindi, and bangles. Pakistan also decided to heap further troubles on Jadhav’s wife by refusing to return her shoes after the meeting was over.

The Islamic nation decided to create further drama by sending these shoes for a forensic examination as some ‘metallic object’ was apparently found in them.

It seems that this ‘obsession’ of Pakistan with Indian shoes, caught the attention of Bagga, who has now successfully gifted a pair of slippers to Pakistani High Commission. He also requested others to join him on this campaign.

Incredibly, people paid heed to his call and started to truly send newly ordered slippers:


As per Bagga more than 10 twitter users have successfully sent shoes to the Pakistani High Commission and his #JutaBhejoPakistan hashtag too started trending in India.

It remains to be seen as to what the Pakistan High Commission does with all the brand new slippers, and whether they would send them for a forensic analysis to similarly search for presence of foreign objects.

Humans of Hindutva Facebook page: deactivated or suspended?

The hateful anti-Hindu Facebook page masquerading as a ‘parody’ account, has been removed by Facebook for violating community guidelines. Some of the posts on this page reeked of hate under the guise of satire.

However, the admin of the page, who chooses to remain anonymous, is claiming that he deactivated on his own accord as he ‘fears for his life’ and ‘does not want to end up like Gauri Lankesh or Afrazul Khan’.

This is not the first time the admins of this Facebook page, which is described as ‘satire on right-wingers and Hindu fundamentalists’ by left-leaning mainstream media, has pulled this stunt earlier when journalist Gauri Lankesh was killed outside her Bengaluru home in September this year. The admin had then said that he does not want to be killed like Lankesh even then.

Many also claimed to have talked to this admin who said he is getting death threats and he fears for his wife and children.


However, there seems to be a twist in the tale as it seems Facebook removed the page since the hate page was violating community guidelines. Many users who had mass reported the page for hate speech, claimed to have received an update from Facebook stating that the Humans of Hindutva page they had reported was found violating community guidelines and hence it has been removed.

Perhaps one of the self proclaimed hoax busting websites would like to come forward and get to the bottom of this mystery.
