‘There is no absolute concept of a man or a woman…It’s not the question of what your genitals are’: CJI Chandrachud in same-sex marriage hearing

During the hearing on the recognition of same-sex marriage, the Chief Justice of India, DY Chandrachud (CJI), pondered on the current gender spectrums, asserting that there is no absolute concept of a man or a woman and the question of gender is not determined by one’s genitals.

“There is no absolute concept of a man or an absolute concept of a woman at all,” CJI Chandrachud noted.

“It’s not the question of what your genitals are. It’s far more complex, that’s the point. So even when Special Marriage Act says man and woman, the very notion of a man and a woman is not an absolute based on genitals,” he further added.

The observations came at a time when the Supreme Court is considering a set of petitions that are based on constitutional principles and seek to establish the recognition of same-sex marriage. While hearing these petitions, the Chief Justice of India engaged in a discussion with the Solicitor General of India, Tushar Mehta, about the current scope of the institution of marriage in India.

During the hearing, the Constitution bench, which included Justice SK Kaul, Justice S. Ravindra Bhat, Justice Hima Kohli, and Justice PS Narasimha, indicated that the Special Marriages Act would be examined at a later time. In response, the Solicitor General pointed out that, at present, the idea of marriage was limited to a union between a biological male and a biological female. However, the Chief Justice of India countered by stating that the notion of a man was not an absolute one and was far more intricate than just the physical characteristics of one’s genitalia.

At the outset of the hearing, the court announced that it would listen to the petitioner(s) to gain an understanding of the basic claims that were to be presented. This decision was made after the Solicitor General pointed out that the Centre’s initial objection, regarding the issue falling under the purview of the legislature, needed to be addressed first.

“In that case, the government will have to decide whether it will participate in the hearing,” he added.

Subsequently, a light-hearted exchange took place, and currently, the hearing is ongoing, with Senior Advocate Mukul Rohatgi presenting the lead arguments in the case.

In November of last year, the Supreme Court issued a notice in response to a petition filed by a homosexual couple seeking legal recognition of their same-sex marriage under the Special Marriage Act of 1954.

During the hearing, Senior Advocate Mukul Rohatgi, representing the petitioner-couple, had stated to a bench consisting of Chief Justice Chandrachud and Justice Hima Kohli that the matter was a continuation of the judgment passed in the case of Navtej Singh Johar.

The current petition highlighted the lack of a legal framework that permits individuals belonging to the LGBTQ+ community to marry a partner of their choice.

The petition filed to seek recognition of same-sex marriage contended that the Special Marriage Act was unconstitutional as it discriminated against same-sex couples by denying them legal rights and social recognition that are enjoyed by opposite-sex couples in a marital union. The petitioners argued that this discrimination violated the fundamental principles enshrined in the Indian Constitution.

‘Not leaving NCP, no truth in allying with BJP’: Ajit Pawar refutes claims of joining BJP, says reports of NCP breaking are rumours

The Leader of Opposition from Maharashtra and senior NCP leader Ajit Pawar on Tuesday put a full stop on the speculations about his shift from the National Congress Party (NCP) to the Bharatiya Janata Party (BJP). He affirmed that he is not leaving the NCP and that no signatures of any MLAs have been obtained to support the speculated shift.

“I am with NCP, not going anywhere. Nobody took the signatures of any MLAs. These are all baseless speculations,” said Ajit Pawar while addressing the press conference in Mumbai. The leader turned furious and stated that several rumours are being spread about his shift from the NCP to the BJP. “I don’t know why people are speculating about my shift from the party. All these are sheer rumours,” he said.

He also added that several media channels said that he would be joining the BJP. “I don’t understand who spread this. I never said this. These rumours do nothing but affect the working of the party members. I request people to stop spreading the rumours,” Pawar said.

Earlier today, a report was published by the New Indian Express claiming that Senior NCP leader Ajit Pawar had attained the consent of his party’s 40 MLAs for his decision to join hands with BJP. “The signatures of these MLAs are also taken as voluntary consent,” tweeted NIE reporter Sudhir Suryavanshi.

The same was lauded by Nikhil Wagle, a journalist and Maha Vikas Aghadi government sympathiser. The journalist congratulated NIE reporter Sudhir Suryavanshi for breaking the Ajit Pawar news which mentioned that the leader had attained the consent of about 40 of the 53 NCP MLAs. The report also speculated that Ajit Pawar would step into CM Shinde’s shoes assuming that the Supreme Court would disqualify the Sena lawmakers who had rebelled against Uddhav Thackeray.

Pawar dismissed all the speculations and said, “You all are spreading much news of me. There is no truth to it. I want to clarify that there are no facts about 40 MLAs in support of me and have issued a letter of support this is untrue. There is no truth in my taking the signatures of 40 MLAs. Under the leadership of Sharad Pawar, NCP was established and we will continue to work under his leadership. This is an attempt to mislead the people and divert the issue from the core.”

He also blamed the Maharashtra government over the death of 13 people due to sunstroke at the Maharashtra Bhushan ceremony organised at Kharghar in Navi Mumbai on Sunday. “This was not a natural but man-made calamity. The government is responsible for the incident”, he said in a statement. He has demanded that the persons responsible should be booked and the incident should be probed by a retired judge.

Notably, Ajit Pawar’s statement came hours after NCP supremo Sharad Pawar dismissed speculations about Ajit Pawar’s political move. He said that no meeting of the party MLAs had been called in the matter. Earlier, when asked whether NCP would form an alliance with BJP, the NCP supremo had said that it was difficult to predict the future. “Nothing can be said about what will happen in the future,” he was quoted.

Shraddha murder case: Delhi court restricts Aaj Tak from airing details of Aftab’s narco test, allows Delhi Police to approach HC

A Delhi court on Monday gave the Delhi police permission to petition the high court to prevent TV news channel AajTak from broadcasting the details of the FIR, including the digital evidence related to the murder of Shraddha Walker.

The Delhi police requested that orders be issued to Aaj Tak and other media outlets not to air content related to the FIR filed in the matter. Additional Sessions Judge (ASJ) Manisha Khurana Kakkar of Saket Court was hearing the application.

The accused in the Shraddha murder case, Aaftab Amin Poonawala, underwent a narcoanalysis and psychological evaluation; the ASJ granted a three-day order preventing Aaj Tak from airing the findings.

“…Instructions to state on behalf of news channel Aaj Tak that the said channel shall not telecast/publish/disseminate the contents of the psychological assessment and voice layer test, narco analysis test, and conversation recorded on Practo App for the next three days, i.e, till April 20,” the court said.

It should be noted that on April 10, Additional Sessions Judge (ASJ) Ramesh Kumar Singh prohibited Aajtak and other news outlets from reporting on the chargesheet’s details, including the digital evidence, in connection with the murder of Shraddha Walker, declaring that “It is already a settled law that Chargesheet is not a Public Document.”

The court was considering Inspector Ram Singh’s request for an injunction telling AajTak and other media outlets “not to telecast” the documents related to the inquiry into the murder of Shraddha. He had stated that nothing relating to a court record could be used by any party or person without the court’s approval. The Delhi High Court Rules, which forbid third parties from obtaining copies of the case’s court records unless a compelling reason is provided to the court, were also cited by the judge.

“Article 21 of the Constitution of India protects the Life and Liberty of a person, it also contemplates a Protection of the psychological state of mind of such a person. Any dissemination of “sensitive info” pertaining to a Murder case will definitely result in psychological repercussions on the accused (Aaftab Amin Poonawala) and also on the victim’s family”, the court had observed.

Aftab Poonawala was taken into custody on November 12 after Shraddha’s family filed a missing person’s case. Aftab and Shraddha shared a home in Delhi’s Mehrauli neighbourhood. Six months before his arrest, Aftab had murdered Shraddha. Aftab reportedly cut Shraddha’s body into 35 pieces and threw each piece in a different location throughout Delhi.

Atiq Ahmed’s brother Ashraf abducted minor Muslim girls from a madarsa and raped them at gunpoint, UP Police shares criminal history of the mafia dons

On Monday, April 17, the Uttar Pradesh police, revealed that Atiq Ahmed‘s brother Ashraf Ahmed, who like his brother, had a long criminal history of murders, kidnappings, and land grabbing, was allegedly involved in the abduction of two minor Muslim girls from a madarsa and their repeated rape at gunpoint overnight.

The list of their victims is a very long one with members of the minority community at the receiving end in most cases, the UP Police records said.

“Out of 20 top criminal cases against the duo, the Ahmed brothers targeted members of the minority community in 13. Atiq’s brother Ashraf was allegedly involved even in the abduction of two minor Muslim girls from a madarsa and their repeated rape at gunpoint overnight. The victims were later thrown in front of the madarsa gate the next morning,” as per the police.

“A living example of Atiq’s atrocity in this regard is Zeeshan alias Janu, a resident of Kasari Masari in Prayagraj and Atiq’s brother-in-law Imran Zai’s younger brother. Atiq had got Zeeshan’s home demolished with a JCB to capture his land. In addition to this, according to Zeeshan, he was attacked by Atiq’s goons and got an extortion threat to pay Rs 5 crores,” the police added.

Another name that came to the fore from the UP police records was that of Ashfaq Kunnu, a Municipal Corporation ward councilor. Kunnu was allegedly killed by Atiq Ahmed.

Atiq was also accused of shooting ward councilor Nasson, who was once close to the gangster. According to the police records, the rift between Nasson and Atiq started after the former began raising his voice against Atiq’s high-handedness. According to the authorities, Atiq shot Naasan in Chakia in 2001, leaving his body riddled with bullets.

“BJP leader Ashraf was shot dead reportedly by Atiq in the year 2003. Ashraf’s house was located in front of Atiq’s house in Chakia. Atiq said that the names of the BJP leader and his brother were the same and the BJP leader, in this case, teased him by working for the opposition party. The most shocking thing in this was that after killing Ashraf, Atiq’s henchmen ran away with his dead body,” they added.

Notably, Atiq Ahmed was the first person who was booked under the ‘Gangster Act’ in Uttar Pradesh. His criminal history ran very deep. He was accused of murder at the young age of 17. After that, he became so well-known in the underworld that his popularity even overshadowed that of the dons of Mumbai. 102 cases were lodged against him, including those of threats, murder attempts, and kidnapping. The gangster act was also invoked three times.

Atiq Ahmed and brother Ashraf Ahmed killed

Atiq Ahmed and his brother Ashraf Ahmed were shot dead while being taken for a medical checkup on 15th April 2023 at around 10:40 pm. The incident was carried out by three youths, who came near the police convoy posing as journalists and opened fire.

The court has sent the three killers of Atiq Ahmed and Ashraf Ahmed to judicial custody for 14 days. The police had arrested the three from the spot at the time of the incident. Many cases were already registered against the trio.

Apple CEO Tim Cook inaugurates first Apple Store in India: Read what makes their maiden outlet in BKC so special

Apple’s CEO Tim Cook is in India to inaugurate the first ever Apple Stores in India. Apple has been present in India for over 25 years but the company never had dedicated stores in the country. The first-ever store was inaugurated by Cook in Mukesh Ambani-owned Jio World Drive Mall located in the Bandra Kurla Complex on April 18 at 11 AM. The second store is scheduled for opening in Saket, Delhi, on April 20.

The store opening event was attended by over 5,000 Apple fans. The store features the iconic black-and-yellow cab (kaali-peeli) colour combination-based design that is unique to Mumbai city. Apple has claimed that the BKC store is the most sustainable store the company has introduced so far. It has a dedicated solar array and zero reliance on fossil fuels for store operations making it completely carbon neutral.

In a statement, Tim Cook said, “At Apple, our mission is to enrich lives and empower people around the world. India has such a beautiful culture and incredible energy, and we’re excited to build on our long-standing history — supporting our customers, investing in local communities, and working together to build a better future with innovations that serve humanity.”

Notably, the company has had an iOS App Design and Development Accelerator in Bengaluru since 2017 that has hosted sessions for more than 15,000 developers so far. Apple started manufacturing iPhones in India in 2017.  Since then, Apple has not only assembled iPhone models in the country but also produced an array of components.

How Apple Store is different from existing Apple Premium resellers?

Though Apple has been operating in India for over a decade, its presence in the country was limited to selling its products through resellers and online sales. The existing stores where Apple products are available like Aptronix, Unicorn, Inspire, Maple, etc., are Apple-authorised resellers, meaning they procure products from Apple to resell them to the consumers, and are not managed by Apple itself.

However, the Apple BKC store in Mumbai is a dedicated outlet entirely managed and operated by the company itself, providing an altogether different experience to the consumers. Earlier, social media was rife with speculations surrounding the father of the child of actress Nusrat Jahan. Debashish Dasgupta, which is the formal name of actor Yash Dasgupta, was mentioned as the child’s father on the birth certificate (a copy of which went viral on social media).

Bihar: Vulgar message flashes on LED screen outside Bhagalpur Railway Station, probe underway

In a shocking incident, a vulgar message was shown on the LED screen close to the Ambedkar statue outside the Bhagalpur Railway Station in the state of Bihar. The encounter was documented on video and shared on social media, where it instantly went viralv. The vulgur message is said to have appeared for around 10 minutes on the screen before it 111¹1¹ taken down.

According to the reports, SDO Dhananjay Kumar and DSP Ajay Kumar Chaudhary reached the spot immediately after they received the information about the screen message. The police ordered removal of the screen and cancellation of its connection and launched investigation in the case. The Police has also lodged an FIR in the case.

Ajay Chaudhary, the city’s DSP, asserted that similar incidents frequently make the news for technical reasons. As the police investigated further, a technician was contacted.

The security guard stationed there was reportedly informed of the message by an individual who was on the station premises. According to reports, this message flashed on the screen for around ten minutes.

Investigation revealed that the Municipal Corporation has given the responsibility of beautification of Ambedkar Chowk to Jeevan Jagruti Society. The society had put up a display board at the crossroads. Along with following the traffic rules, other awareness messages were being displayed by the organization.

Someone is believed to have removed the chip on the board and put a chip with obscene information. Later, the police confiscated the board and took it to the police station with them. The President of the organization Dr. Ajay Kumar Singh also reached the spot.

He told the police that the work of beautification of the intersection has been done by the organization. He alleged that someone has deliberately done this kind of act. The Police is also checking the CCTV footages installed in the chowk to identify the accused.

A similar incident had happened in Patna, Bihar. Last month, a pornographic film unexpectedly started playing on the television used for ads at Patna Railway Station. The pornographic film continued to play on dozens of televisions for over three minutes. The GRP and RPF were promptly made aware of the situation by several passengers at the train station who contacted the company airing the television advertisement. The company had aired the adult film.

The railway authorities reported the incident to the police, who then charged the responsible enterprise, Datta Communication. The agency has also been punished and added on a blacklist by the Railways.

California Gurudwara shooting: 17 people arrested, machine gun and AK-47 recovered

In connection with a string of shootings at Gurdwaras in Stockton, Sacramento County, and other sites in the state, the California Police have made 17 arrests. The police have also recovered weapons like an AK-47, pistols, and at least one machine gun after conducting several searches at more than 20 locations.

According to reports, four of them have Indian passports, while the remaining are said to be born and raised in the United States. Those arrested include Armandeep Singh, Gurvinder Singh, Nitish Kaushal, Harmandeep Singh, Gurminder Singh Kang, Devender Singh, Gursharan Singh, Grucharan Singh, and more.

On March 26, a shooting took place during the Nagar Kirtan on the occasion of the opening ceremony for the Gurdwara Sacramento Sikh Society. Two men were reported to be in serious condition. The event happened on Bradshaw Road in Sacramento County’s Vineyard neighbourhood, where a large crowd had assembled.

As a result, officials began Operation Broken Sword, a probe that focused on two rival factions of a criminal organisation that participated in a variety of illegal operations, such as the sale of guns and violent crimes. Investigators carried out search warrants on Sunday as part of a planned “takedown,” seizing 41 unlawfully held guns.

According to a statement made by California attorney general Rob Bonta, Yuba City Police Chief Brian Baker, and Sutter County District Attorney Jennifer Dupré, the 17 felony arrests, mostly of members of the local Sikh community, were made on Sunday during a massive operation that involved agents executing search warrants at 20 locations in Northern California.

Dupré states that two mafia members “wanted for several murders” in India have also been apprehended. These people, who are alleged members of competing criminal organisations, are charged with several violent crimes, including five attempted murders.

Both the mass shooting at a Sikh temple in Stockton, California, on August 27, 2022, and the shooting at a Sikh temple in Sacramento, California, on March 23, 2023, are thought to have been carried out by these groups. According to a press statement, the investigation also showed that law enforcement was able to stop two other shootings from happening.

“Today, California is safer thanks to collaboration, determination, and swift action by DOJ agents and our law enforcement partners in Sutter County,” said California Attorney General Rob Bonta. “No family should ever have to worry about drive-by shootings or other forms of gun violence in the neighbourhoods where their children live and play. As a result of this joint law enforcement effort, we’re taking guns off the street and putting suspected gang members and their associates behind bars,” he said.

Dupré added, “An investigation of this magnitude requires a tremendous amount of time and effort, and especially a lot of personnel.” Authorities have detained 7 persons after discovering ammunition magazines with high capacities for two assault rifles and four pistols in those cars close to the parade route. The suspects planned to set up shop along the route and open fire on rivals.

Dupre said that members of the AK-47 Group and Minta, two criminal organisations responsible for the rising violence, were formerly affiliated with a single organization before splitting off into competing groups. The district attorney stated that although the reasons for the violence are still a little murky, they essentially just show up and try to shoot each other.

In relation to the incident in Woodland, five guys have been taken into custody. They are Husandeep Singh, Harkirat Singh, Pavittar Singh, Tirath Ram, and Sahajpreet Singh. According to Dupre, Husandeep Singh and Pavittar Singh are sought in India on allegations of murder.

Italy: Over 2 tons of cocaine with a market value of more than 400 million euros found floating in the sea

Over the weekend, using a regular surveillance aircraft, Italian police off the coast of Sicily recovered over two tonnes of cocaine floating in the Mediterranean Sea. The Guardia di Finanza, Italy’s financial police, said in a statement on Monday that they confiscated cocaine valued at more than 400 million euros (USD 440 million) that they discovered in 70 waterproof bundles floating in the open sea.

According to the police, the meticulous packing of the narcotics was probably done to prevent water intrusion and damage to the cocaine. Authorities also discovered a signalling device that lit up in the water that looked to be using many nets to keep the parcels together.

The narcotics were allegedly dropped at sea by a cargo ship, to be picked up by traffickers and transported to the mainland, where they might be sold for hundreds of millions of dollars. According to authorities, the signalling gadget was probably used to monitor the parcels’ contents.

The Sicilian municipality of Catania’s air and marine authorities gave responding officers cover to recover the narcotics, and officials claimed they are still searching the region for any other shipments. “After bringing the drugs to land, authorities tested the contents of the packages and determined that the white powder inside was indeed cocaine,” Italy’s financial police said.

Terming it to be one of the largest seizures the nation has ever seen, the police added, “The identification and subsequent seizure of a similar quantity of drugs, one of the largest ever carried out in the national territory, prevented the drug from being likely to be recovered by criminal subjects for subsequent illegal marketing in the national territory, which would have yielded very high earnings, in the order of approximately over 400 million euros at retail.”

The discovery comes only a few weeks after New Zealand police in February seized ample cocaine floating in the Pacific Ocean to supply the whole domestic market for 30 years.

Also in 2017, seven crew members were detained by Spanish authorities after they detained more than two tonnes of cocaine from a ship travelling through the Atlantic Ocean.

Income Tax notice issued to Shri Ram Temple in Orchha: Can the deity be subject to income tax? Here is what the law says

On April 18, Sudarshan News shared an Income Tax notice issued to Shri Ram Temple in Orchha where the IT department sought an explanation of cash deposits of Rs 1,22,55,572 during the Financial Year 2015-16. The notice read that despite carrying out significant financial transactions, the IT Return for the AY 2016-17 was not filed by the Temple.

While there are discussions if the temple should be asked to pay tax or not, the law is clear on the matter. First of all, it is necessary to understand how Gods or deities are represented in the law. As per the law, Gods and deities are litigants, just like a normal person. They are called juristic entities. The law recognizes two types of persons that are natural persons (human beings) or artificially created persons (juristic persons), also called legal persons.

In the case of an artificially created person, the identity is used for companies, trusts, societies, private businesses, and companies. It is notable that the courts have distinguished animal kingdoms as juristic entities as well. If we look at the July 2018 judgment of the Uttarakhand High Court, it has declared the entire animal kingdom as a juristic entity based on the fact that all of them have a distinct persona with corresponding rights, duties, and liabilities of a living person.

Speaking of the deity, especially when it comes to the Hindu deities or Gods, the recognition as a person goes back to the time of the Britishers. Back in 1887, deities were recognized as persons through a friend/shebait/manager and it was mentioned that they have rights. The Privy Council of that time ruled in the Dakor Temple case that the “Hindu idol is a juridical subject and the pious idea that it embodies is given the status of a legal person”.

Not only deities, but rivers have also been treated as persons with rights. In the 2000 case of Shiromani Gurdwara Parbandhak Committee vs Som Nath Dass and Others in the Supreme Court, it was said, “The very words Juristic Person connote recognition of an entity to be in law a person which otherwise it is not. In other words, it is not an individual natural person but an artificially created person which is to be recognised to be in law as such. Gods, corporations, rivers, and animals, have all been treated as juristic persons by courts.”

In the cases related to Lord Krishna, Lord Ayyappa, and Ram Lalla, the deity was recognised as a person represented by a manager/shebait/guardian in the court. However, it does not mean that all idols can be described as a person. Only the idols that have been publicly consecrated or pran prathishta has been done, enjoys the right as a juristic entity. The distinction between non-entity and entity was described by the Supreme Court in its 1969 verdict where it said, “Not all idols will qualify for being ‘juristic person’ but only when it is consecrated and installed at a public place for the public at large.”

The definition changes with the religion.

While the Hindu deity has been recognised as a person who can own properties and have rights or obligations, the case is not the same with other religions. In Sikhism, Shri Guru Granth Sahib Ji is considered a living Guru, and thus, the law sees Granth Sahib as a juristic entity. However, every Granth Sahib cannot be a juristic person unless it takes a juristic role through its installation in a Gurudwara, the Supreme Court observed in a 2000 verdict. In the case of Christianity or Islam, there is no provision for deities. Thus, these two religions do not have a juristic entity per se. In the case of Islam, caretakers operate the place of worship and in the case of Churches, organisations that are registered as trusts or societies take care of the buildings.

It is pertinent to note that most of the temples in India file yearly Income Tax Returns and pay taxes if required. The notice issued by the IT Department seeking an explanation about cash deposits can be a regular notice that the department sends to individuals from time to time. There was no mention in the notice that the department sought tax on the amount mentioned. As the temple administration allegedly did not include the transactions in the IT Return, the notice simply sought an explanation on why it should be considered as income.
