Delhi High Court orders four AAP leaders to remove defamatory content against BJP leader Shyam Jaju and his son, not to make further allegations

The Delhi High Court on Friday ordered AAP leaders Saurabh Bhardwaj, Sanjay Singh, Durgesh Pathak and Dilip Kumar Pandey to take down defamatory allegations made against former BJP vice president Shyam Jaju and his son Sandesh Jaju from social media platforms. In an interim order in a defamation case filed by Shyam Jaju and Sandesh Jaju, the court also restrained the AAP leaders from making any further allegations against the father-son duo.

Hearing the matter, the bench of Justice Navin Chawla said that there is a prima facie case for granting interim relief to the petitioners. The defamation suit was filed by Jaju and his son responding to allegations made against them by the AAP leaders at a press conference held on 22 January.

They had alleged that Delhi BJP leader Adesh Gupta and Shyam Jaju’s son Sandesh Jaju are earning illegal money through a company named Majboot Solutions Private Limited. Addressing the press conference, AAP leader Saurabh Bhardwaj had said that when Adesh Gupta was the mayor of MCD from April 2018 to 2019, he had formed this company, and he and Shyam Jaju’s sons were equal partners and directors in this company.

The AAP leader alleged that Adesh Gupta misused the power of the mayor to buy and sell a lot of property through the company. Delhi Lokayukta had launched a probe after a lawyer lodged a complaint, and several notices were issued to Gupta in this regard but he didn’t respond, they further alleged.

Apart from the press conference which was covered by media and streamed by AAP’s social media handles on various platforms including YouTube and Twitter, the AAP leaders had also posted tweets making the allegations.

Following this, Shyam Jaju and his son Sandesh Jaju, a Chartered Accountant, filed a plea against the AAP leaders seeking a permanent and mandatory injunction on the statements made by the AAP leaders. They contended that the statements are ex facie false and unsubstantiated, per se defamatory, slanderous and libellous.

According to the petition, while Sandesh Jaju was a director and shareholder of the company, he had resigned from the post of director in December 2018, within just three months of the incorporation of the Company. After that, he transferred his entire shareholding in the company to Adesh Gupta’s son Yash Gupta in November 2019. The plea said that till the time Jaju was involved with the company, no financial deals were done by the company. Therefore, he is not involved in the transactions done after his exit from the company.

The AAP leaders pointed out transactions done in dates 05.02.2021, 25.02.2021, 04.03.2021 and 16.06.2021 to allege misdeeds. Therefore, it is clear that these dates of the transactions mentioned by the AAP leaders are after Sandesh Jaju left the company.

The AAP leaders had also alleged that the address of the company was 11-A, Ashoka Road, New Delhi, which means the company was running from the BJP headquarters in Delhi. But the plea states that a bare perusal of the certificate of incorporation of the Company will show that the registered address of the Company as on the date of incorporation was 9918/5, 4th Floor, Multani Dhanda, Paharganj, Delhi – 110 055.

The plea further said that Shaym Jaju has not received any notice from the Lokayukta, as alleged by the AAP leaders.

The petitioners point out that the dates of financial dealings made by the company, and dates of Sandesh Jaju resigning from the board and then selling his shares are available in relevant records which are publicly available on the website of the Ministry of Corporate Affairs. These records show that he was not involved in any deals done by Majboot Solutions, but despite that, the AAP leaders dragged his and his father’s name into the issue.

The petition also said that the AAP leaders lied while claiming that the company’s office was in BJP headquarters. The company’s data shows that its office was in Paharganj when it was incorporated, and its current address is at West Patel Nagar in West Delhi.

“It is therefore a matter of record as per the public documents of the said company, the registered address of the said company is not at 11 A, Ashoka Road, New Delhi – 110 001, as falsely alleged by the Defendant No. 1 in his Press Conference,” the petition filed by the BJP leader and his son said.

Therefore, Shyam Jaju and his son Sandesh Jaju had filed the plea seeking a permanent and mandatory injunction against the AAP leaders permanently injuncting them from making or publishing or disseminating any further defamatory statements, in any form or manner, in relation to the allegations made in the defamatory press conferences. They further urged the court direct the for AAP leaders to issue or publish an unconditional apology for making the false and defamatory statements.

Moreover, the petitioners also sought that the AAP leaders should pay Rs 5 crore to the “Prime Minister’s Citizen Assistance and Relief in emergency Situations Fund”, and urged the court to award exemplary costs and costs of the suit.

The 403-page petition filed at the Delhi High Court included records of the company as supporting evidence.

In the latest financial development in our hostile neighbour, the country’s parliament has authorized the government to increase taxes on a number of high-end goods and services. The move is an attempt to secure the next instalment of an International Monetary Fund (IMF) loan, in order to help their dwindling economy.

The government has already stopped most imports, with the exception of food and medicine, due to critically low foreign exchange reserves. However, the cash-strapped nation intends to increase revenue with the sweeping tax increase.

Pakistan’s economy is on the verge of collapse as a result of years of corruption and fiscal mismanagement, as well as political unrest. Global oil shortages and catastrophic floods that enveloped a third of the country in 2022, added greatly to the country’s financial woes.

A supplementary budget law that raises the sales tax on imports of everything from automobiles and home appliances to chocolate and cosmetics from 17 to 25 per cent was adopted by the parliament on Monday. Other expenditures that people now have to pay more for include business-class airfare, wedding venues, cell phones, and sunglasses.

General sales tax witnessed an elevation from 17% to 18%.

However, the government is reluctant to be overly tough because an election is scheduled for the end of the year. It doesn’t want to deal with the fallout from making exceedingly tough decisions.

“We will have to make difficult decisions,” finance minister Muhammad Ishaq Dar said to the national assembly as the bill was enacted, adding, “the prime minister would also announce other austerity measures in the coming days.”

The country’s prime minister has recently asked its foreign office to reduce staff and cut expenses as part of the austerity drive.

Dar estimated that the luxury tax would bring in an additional 170 billion rupees (or $650 million) while presenting the bill to the legislature, this month. 

He said that it would “place the minimum burden on the common man” and said, “These are the products which are extensively used by the upper class.”

Pakistan is straining to meet the IMF’s stringent requirements, which it needs to fulfil in order to receive an instalment of a $6.5 billion financing facility.

Pakistan is under pressure from the IMF to increase its relatively small tax base, eliminate concessions for exporters, and increase artificially low energy prices that are designed to aid low-income families.

Although an IMF cash infusion won’t be sufficient to save Pakistan on its own, the nation sorely needs it to inspire trust in “friendly states” like Saudi Arabia, the United Arab Emirates, and China for additional financial aid.

‘The accused has tendered an apology’: Assam CM says police will follow case against Pawan Khera to its ‘logical end’

On Friday, February 24, Himanta Biswa Sarma, chief minister of Assam, said that Congress leader Pawan Khera had “tendered an unconditional apology” for his allegedly offensive remarks on Prime Minister Narendra Modi. Sarma also stated that Assam Police will pursue the case to its logical conclusion.

Taking to Twitter, the Assam CM shared a copy of the writ petition filed by Pawan Khera in the Supreme Court and wrote, “The majesty of law shall always prevail. The accused has tendered an unconditional apology (Para 7) We hope that keeping the sanctity of public spaces, no one will use uncivilized language in political discourse hereafter. @assampolice will follow the matter to its logical end.”

This comes after the Supreme Court bench presided by CJI DY Chandrachud granted interim bail to Pawan Khera. CJI Chandrachud said that Pawan Khera will be released on interim bail by the magistrate in order to protect him till the day he applied for regular bail before the jurisdictional court and the next hearing would be slated for February 28.

Defending party leader Pawan Khera, Singhvi said to the Supreme Court today that it was a word play and that he personally should have refrained from using it. Singhvi claimed it was a slip of the tongue adding that he has already apologized for his mistake.

“I genuinely got confused that whether it is Gautamdas or Damodardas”.. he also apologized and said this was a mistake… Please protect him from arrest,” Singhvi said. 

Notably, at 11:30 pm on Monday, Indian National Congress spokesperson Pawan Khera made the remarks against the Prime Minister at a press conference in Delhi. PM Modi’s full name is Narendra Damodardas Modi. Pawan Khera, while accusing Narendra Modi of favoring businessman Gautam Adani, called him Narendra Gautamdas Modi. He further said that his full name is Narendra Damodardas Modi but his actions are like Gautamdas (literally meaning a servant of Gautam). Cases were registered by BJP leaders against the Congress spokesperson in Lucknow and Varanasi of Uttar Pradesh.

The pro-Khalistani Sikh leader Amritpal Singh, who recently got into a violent altercation with the Punjab Police after the arrest of his close aid, Lovepreet Toofan has cleverly tried to avoid answering why his ilk never demand a separate Punjab inside Pakistan.

“Now,” he has claimed, that the Khalistan movement is not “limited to India alone,” his organization will take it “across the border” as well.

Talking to the news channel, India Today, Amritpal stated, “Britisher’s divided Punjab,” which according to the separatist leader was a country. “We chose India in 1947 and accepted ourselves as Indian citizens,” he added.

He complained of not getting a state on linguistic grounds. “We didn’t get Punjab until 1966. Then, it was divided into Haryana and Himachal Pradesh. Chandigarh is currently disputed.”

On being asked, why don’t they make any such demands for Khalistan in Lahore, which was the original capital of Maharaja Ranjit Singh, he replied, “We are demanding Khalistan in India, because this is our country.”

Amritpal asserted, that they will take their movement to Pakistan after they succeed in establishing Khalistan in India. “Once we make Khalistan here, we will go to Pakistan. Khalsa will rule every place it did before (during the time of Maharaja Ranjit Singh).”

He alleged that his real effort is to resurrect Sikhi (Sikh religion) which will in turn revive Khalsa Raj, which actually stands for Khalistan.

He did not clarify what does he mean by ‘resurrecting Sikhism’ because Sikhism as a religion has been flourishing and growing in India, in contrast to Pakistan where non-Muslims are persecuted and in Afghanistan where Sikhs had to be rescued by the Govt of India and brought to India in special planes to save their lives.

According to him, he is not breaking any law. “India is a democratic country. The Punjab Police will abide by the written commitment they have made. Otherwise, nobody will believe the police. We won’t have any more faith in them.”

He was questioned whether he will challenge them (the police) any more? “Why would I,” he asked, “if they won’t bring false accusations against me?”

Amritpal Singh is the current chief of ‘Waris Punjab De,’ founded by late actor-turned-separatist Deep Sidhu.

Yesterday, on February 23, a large group of his followers who were armed with lathis, swords and firearms stormed the police station to protest an FIR that had been filed against him and some of his cronies.

Amritpal had also issued a covert threat to home minister Amit shah, saying, “Amit Shah will have the same fate as Indira Gandhi,” on Deep Sidhu’s death anniversary.

Pakistan: Man kills his 24-year-old son with a hammer and a knife for not offering namaz despite repeated warnings

On Wednesday, February 22, a man named Haji Saeed Ahmed brutally murdered his own son Mohammed Sohail for not offering prayers. The incident took place in Block 11 of the Gulistan-i-Johar area in Karachi, Pakistan. 

According to Pakistani media reports, the accused was upset over his children not offering namaz in time even after he had been warning them about the same. Haji claimed that despite repeated warnings, Sohail did not listen.

On Wednesday, Haji Muhammad Saeed returned from fajr prayer, the prayer before sunrise, and found that Sohail was sleeping. Seeing this, an angry and frustrated Haji Saeed hit 24-year-old Mohammed Sohail with a hammer on his head while he was asleep leading to his death. 

Soon after this, other people informed the police, and they detained the accused after arriving at the scene. A knife and a hammer were recovered from the crime scene, believed to be used in the murder. 

Following this, the dead body of the victim was taken to Jinnah Post Graduate Medical Centre for postmortem. The accused has been arrested and a case against him has been registered at Shahrah-e-Faisal police station. The accused also said that his son was disobedient and used to fight often, another reason of his anger on his son.

According to a local media report,  SH Shahrah-e-Faisal, Ghulam Murtaza said that the deceased Sohail was stabbed to death by his father Saeed Ahmad. On the basis of information from the locals, the police arrived at the scene, detained the accused, and seized the murder weapon.

Both the deceased boy and the arrested father are from Khanpur Katora in South Punjab, and they were staying in a rented room. The victim worked as a tailor, and his father works at a factory.

Adani-Hindenburg row: SC rejects plea seeking to gag media from reporting on the issue

The Supreme Court made it clear on Friday, February 24, that it will not issue an injunction against the media in connection to the recent Hindenburg Research report on the Adani Group of firms and its market impact.

Pronouncing the decision Chief Justice of India (CJI) DY Chandrachud said there is no question of gagging the media till the court pronounces the order. “We are not going to issue any injunction to the media ever. We will pronounce orders shortly,” the CJI said.

The apex court was responding to a plea filed by Adv ML Sharma on February 3. The plea had sought a gag order to prevent media from carrying statements or allegations related to the Adani group firms unless they are filed with and verified by market regulator SEBI.

“Media hype has crashed the Indian share market by more than 50 per cent. Regular allegations /statements in the media are creating panic amongst the investors who are selling their stock under panic and suffering financial losses. Common investors are being butchered which must be stopped in the interest of justice,” the interim plea said.

Adani-Hindenburg row: SC rejects centre’s sealed cover suggestions over expert panel

On Friday, February 17, the Supreme Court turned down the Centre’s suggestion in a ‘sealed cover’ regarding a proposed panel of experts recommending steps to tighten regulatory measures in order to minimise any loss to Indian investors due to market volatility, as witnessed during the Adani-Hindenburg row.

A bench comprising of the Chief Justice of India (CJI), DY Chandrachud, and Justices PS Narasimha and JB Pardiwala decided against accepting the government’s sealed cover proposal stating that since the issue demands ‘full transparency’, doing so may give the impression that the committee was appointed by the government and the matter was kept away from the other side.

Four petitions regarding a report written by short-seller Hindenburg Research, alleging conglomerate fraud that cost the Adani Group losses of over $100 billion in market value, were being heard by the court.

Notably, on Monday, the Centre agreed to the top court’s recommendation to form a panel of experts to look into strengthening the regulatory procedures for the stock market in the wake of the share price drop in the Adani Group stocks, which was precipitated by a report by Hindenburg Group over claims of “stock manipulation”. Nonetheless, the Adani group has vehemently denied any wrongdoing.

‘Women are tortured here, it is not Dharma, it is Adharma’: Samajwadi Party leader Swami Prasad Maurya again rants against Hinduism

Swami Prasad Maurya, the controversial leader of the Samajwadi Party known for his anti-Hindu rants has once again spewed venom against Hinduism. On Wednesday, February 22, Swami Prasad Maurya stated that on one one hand Prime Minister Narendra Modi is running women empowerment programmes on the other why the so-called Hindus who worship women during the time of Navratri talk about insulting and tormenting women. 

“Under the garb of Dharma, why do they talk about humiliating, assaulting, and torturing the whole Shudra community? PM Modi runs women empowerment campaigns, the so-called Hindus who worship the woman-power in the form of Devis (Goddesses). Why is it said that women should be tortured while we worship women-power (nari shakti) and the government runs women empowerment campaigns? Half of the country’s population is comprised of women even then if women have to face all this, then it is not Dharma but ‘Adharma’, injustice and atrocity on women,” Maurya said while speaking at an event. 

Maurya went on to say assert that how can abuses be hurled at women when today they have been given equal rights. Maurya quoted a Chaupai (verse) from the Tulsidas authored Ramcharitmanas “Je varnadham teli kumhara swapach kirat kol kalwara.” 

“Have you ever seen a Dharma where its own followers are called low-castes, Adharm.” Maurya once again misinterpreted the Chaupais like ‘dhol gawar shudra…’ of the Ramcharitmanas. 

Furthermore, Maurya claimed that the Gita Press publication did a correction in the ‘dhol gawker shudra pashu nari sakal taadna ke adhikari’ chaupai and claimed that Gita Press which is not the author of the book but only a publisher has said that ‘taadna’ in this verse means ‘educating’ and not ‘assaulting’.

This is not the first time that the Samajwadi Party leader has expressed his Hindu-hate. In January this year, Maurya stirred a controversy after he insulted Hindu saints and seers by dubbing them ‘Aatanki’ and ‘Jallad’. Previously, the SP leader drew criticism for demanding a ban on Ramcharitmanas claiming that certain verses ‘insult’ a large section of society.

In a tweet posted on January 27 in Hindi, the SP leader wrote, “Recently, some religious contractors have declared a reward for those who cut my tongue and head; if someone else had said the same thing, the same contractor would have called him a terrorist, but now these saints, mahants, religious leaders, and caste-specific leaders have declared a reward for those who cut my tongue and head. What do you call such people aatanki, mahashaitan or jallads.”

On January 22, Maurya, while speaking to a news channel, said that Ramcharitamanas, written by Goswami Tulsidas in the 17th century, promoted social discrimination and spread hatred. “Religion is meant for the welfare of humanity and for strengthening it. If there is any insult to a section of society due to certain lines in the Ramcharitamanas on the basis of ‘jaati’, ‘varn’ and ‘varg’, then it is certainly not ‘dharma’, it is ‘adharma’. There are certain lines in which names of castes such as ‘teli’ and ‘kumhaar’ are mentioned,” said the SP leader. He added Tulsidas wrote the book for his own pleasure while demanding a ban on the “objectionable portions” of the Ramcharitmanas.

A case has been registered in Gwalior, Madhya Pradesh against Samajwadi Party leader Swami Prasad Maurya and eight others for hurting religious sentiments and disturbing social harmony over his controversial remarks against Ramcharitmanas. Acting on a complaint of Akhil Bhartiya Hindu Mahasabha office bearer Praveen Chaudhary, the case was registered at the Gwalior Crime Branch police station earlier this month. The case was registered under IPC sections 153A and 295 at the Gwalior Crime Branch police station.

‘Hijdo Ki Fauj’: RJD leader and Bihar minister Surendra Yadav hurls insult at armed forces recruits under Agniveer scheme

In a major controversy, Bihar Co-operative Minister and Rashtriya Janata Dal (RJD) leader Surendra Yadav on Thursday, said that the ‘Agniveer’ scheme will make a “Hijdon Ki Fauj”.

Talking to the media, he said, “Exactly 8.5 years from now, the country’s name will be included among ‘Hijdon Ki Fauj’ (Army of eunuchs), I am telling this. After 8.5 years, the current Army men will retire and the training of these Agniveers won’t even be complete,” he added.

“Why has this idea been brought up when our Army is the strongest in the world? What kind of Army will be prepared in 4.5 years?” he added.

He further claimed that no one will marry those who will retire as Agniveer at the age of 25-26 years.
“When they (Agniveers) will be 25-26 years old, people will come with marriage proposals. What will they say? I am a retired soldier? Who will marry them?” he said.

Surendra Yadav added saying, “Whoever gave this idea should be hanged, as he deserves no lesser punishment than that.”

Under the Agnipath scheme, announced on June 14 last year, the three services are recruiting youths between the age bracket of 17-and-half years and 21 years for four years with a provision to retain 25 per cent of them for 15 more years. For 2022, the upper age limit was extended to 23 years.

‘No country will ever come out of a difficult situation if its basic industry is terrorism’: EAM Dr Jaishankar on Pakistan’s crisis

As Pakistan’s economy continues to remain in crisis, External Affairs Minister S Jaishankar on Thursday said that no country can come out of the difficult situation “if its basic industry is terrorism.”

Speaking at the annual Asia Economic Dialogue organised by the external affairs ministry in Pune on Thursday, Jaishankar said, “The reality of this particular relationship (India-Pakistan) is that it has a fundamental issue which we cannot and we must not avoid. And that issue is that of terrorism because the moment you start doing this walk around that…” “And we mustn’t be in denial of what are very fundamental problems in that relationship. And just as a country has to fix its economic issues, a country has to fix its political issues, too. A country has to fix its social issues too. No country will ever come out of a difficult situation and become prosperous power if its basic industry is terrorism,” he added.

Notably, Pakistan’s economy is in shambles and the country is holding virtual talks on the Memorandum of Economic and Financial Policies (MEFP) in order to strike the staff-level agreement.

He also stated that it is in nobody’s interest that any country least of all a neighbouring country get into severe economic difficulties. But, if any country gets into severe economic problems that country has to make policy choices and governance decisions to get itself out of it.

“There’s no doubt role or salience of Asia will increase. Asia is growing because Asia has been global, what we shouldn’t fall for is ‘Asia for Asians’, that rhetoric is misleading, and appeals to primitive chauvinism. It actually has deep strategic intent behind it,” Jaishankar said while addressing the presser.

Meanwhile, Jaishankar also highlighted the ‘Neighbourhood First’ policy, the state of the world and India’s G20 Presidency at the event.

“If I were to pick three big issues in the forefront of my thoughts, one I would actually reflect on our neighbourhood, partly because we are in the neighbourhood, 3 of us,” said Jaishankar.

The Inaugural Session of the Dialogue was a conversation between Jaishankar, Lyonpo Namgay Tshering, Bhutan’s Finance Minister, and Ibrahim Ameer, Maldives’ Finance Minister.

The Asia Economic Dialogue (AED) is the Ministry’s annual flagship event on Geoeconomics, co-hosted in collaboration with Pune International Centre.

The 7th edition of the AED is being held from 23-25 February 2023 in Pune. The principal theme for the Dialogue is ‘Asia and the Emerging World Order’. The Dialogue will also discuss themes such as Global Growth Prospects; How the Global South Will Shape the G20 Agenda; the Metaverse: Understanding the Future; and Meeting Climate Targets: The Road Ahead, added the Ministry of External Affairs press release.

‘Indian society does not recognise live-in relationships, woman has no other option but to file FIR against boyfriend’: Allahabad HC

The Allahabad High Court has observed that it is difficult for an Indian woman to live alone after breaking up with her live-in partner. As per reports, while granting bail to a man accused of raping his live-in partner, who was already married to another man.

As per a report in Live law, justice Siddharth of Allahabad High Court remarked on 23 February that the Indian society, at large, does not accept live-in relationships, hence when such relationships break up, the woman is left with n other option but to file an FIR against the live-in partner.

In this case, a married woman had been in a live-in relationship with a man named Aditya. Aditya was arrested on November 24, 2022, on charges of rape under the pretext of marriage.

Aditya and the woman were in a live-in relationship for the past 1.5 years and the woman had reportedly become pregnant with his child. However, the woman alleged that Aditya refused to marry her and sent her intimate photographs to her husband. As a result, she got rejected by her husband too.

The accused Aditya had rejected the allegations and had submitted to the court that the complainant woman is an adult who had entered into a consensual relationship knowing the consequences of such a relationship. He had also rejected the allegation of the false promise of marriage saying he had never made any such promise.

While hearing both sides, the court observed that it is a case where disastrous consequences of a live-in relationship have come to the fore.

However, the court also noted down the ‘one-sided’ nature of the police investigation against the accused and granted bail to Aditya.

The woman in the case has 2 children with her husband.
