Gujarat Samachar creates panic by spreading lies about Unregulated Deposit Schemes Ordinance

Gujarat Samachar, widely read Gujarati daily, was caught lying about the new norms about Unregulated Deposits. The government had issued the ‘The Banning of Unregulated Deposit Schemes Ordinance, 2019’ last week. The ordinance was issued as the bill could not be passed in Rajya Sabha. It contains a clause which bans deposit takers from promoting, operating, issuing advertisements or accepting deposits in any unregulated deposit scheme.

In an article in Gujarati titled “Aniyantrit deposit leva upar pratibandh thi vepario-udyogo ni haalat kharab (following the restriction on unregulated deposits, traders face tough time)”, author Vivek Mehta claims that after February 21, traders and small businessmen are facing problems after a ban on taking the deposit from private investors. However, the owner or promoter or any relative of the partner could advance such loans to the businesses. Other than relatives, all private deposits are prohibited.

The article claims that when companies take an advance against the supply of goods and if such goods are not delivered, then such advance taken would be considered unregulated deposit and the same will be considered ultra vires the law. The report further states that a separate authority will be created to monitor those businesses which carry business by taking such deposits which will collect periodic information with respect to such deposits. The list will then be checked by the competent authority who will then decide whether the deposit is an authorised one or unregulated. Those found flouting the norms can face imprisonment from 1 to 7 years. Over and above this, the defaulter may be fined Rs 2 lakh to Rs 10 lakh.

However, the truth of the matter is, the law prohibits only schemes or arrangements of money deposit and loans and not the isolated cases of loans or deposits from friends or acquaintances. Any law or any section is never to be read and interpreted in isolation but harmoniously. A careful reading of the section reveals that the ordinance only bars “schemes or arrangements” of unregulated loans/deposits. Reference is drawn to section 2(17), section 3, Section 21, Section 33 to substantiate.

The Ordinance makes it clear it is applicable only to schemes of deposits, an isolated transaction of the advance turned into deposit due to non-delivery of goods without any scheme or arrangement can’t attract the Ordinance.

Reacting to misinformation being spread about the ordinance, today the government clarified that it has brought to control the menace of Ponzi schemes. The department of financial services clarified on Twitter that Individual, Firm, Companies & LLP etc are exempt from the ordinance for taking loans for their businesses.


The ordinance states that if a business takes an advance against supply of goods, and such supplies are not made hence the amount becomes refundable, it will be considered as deposits if the amount is not returned fifteen days after it becomes due to be refunded. The ordinance does not say such deposits are prohibited, but only says that advances against delivery of goods will be considered as deposits if such delivery is not made.

The government also clarified that Chit fund is regulated by Chit Fund Act, 1982 and it is treated as Regulated Deposit as per Schedule 1 of Banning of Unregulated Deposit Ordinance, 2019. Which means, Chit funds are not banned, but they are treated as regulated deposits.

In a recently organized event by Leftist Propaganda outlet, The Wire, ‘Eminent Intellectual’ Ravish Kumar spouted numerous inanities that only goes on to highlight the extent to which ‘liberals’ have a delusional sense of their own selves.

The Wire Dialogues was a manifestation of the cocoon that the Liberal intelligentsia has engulfed itself in. Journalists appear to believe that they ought to be accorded special rights by virtue of the profession they are in.


Without going into the veracity of the allegations or whether the UPA regime used to indulge in similar tactics or not, journalists need to realize that they are subject to the same laws that govern everyone else. If an ordinary citizen can be sued for defamation, then it’s not clear why journalists should not be.

The sheer entitlement of Ravish Kumar reeks of petulance and a deluded sense of grandeur. People have their own priorities, they have their own lives to deal with. Why should they be bothered if some politician takes the legal action against some journalist? Moreover, it is a right that is granted to politicians, just like any other citizen, by the Indian Constitution. Why is Ravish so threatened by an Indian citizen exercising his constitutional right?

In a bitter case of irony, Ravish goes on to praise The Wire, Scroll and Caravan, outlets who have time and again epitomized everything that is wrong with modern-day journalism.

In the same breath, Ravish also warns the Army that ‘news anchors’ are attempting to divide them on the basis of their religion.


It’s hard to find any news anchor who has attempted to divide the Army on the basis of religion. But Ravish praises The Caravan right after it committed the most atrocious sin of dividing martyrs on the basis of caste. Thus, it appears, according to Ravish, dividing the Army on the basis of religion is wrong but asking the families of martyrs “Kaun Jaat Ho?” while they are grieving is an example of path-breaking journalism. One runs out of words to describe the depth of moral depravity such people have sunk to.

It is a traditional liberal trope. They continuously express their desire for Hindus and Muslims to live peacefully, which we all want, but simultaneously, they do everything in their power to divide Hindus along the lines of caste. They won’t even spare the Army in their efforts to keep Hindus divided.

Another liberal trope is that they accuse their adversaries of the crimes they are guilty of themselves.


Was the ‘idea of information’ not compromised when liberal media ran a fictional narrative of rising intolerance based on the biased perception of Darbaris? Was it not compromised when liberal media ran a fictional narrative of ‘minorities under attack‘? If we are to believe Ravish, then of course not, because according to him, liberals have a monopoly over truth. Whatever they say and perceive must be regarded as objective truth. If you don’t take their word for it, then it’s only because you are morally inferior to them.


Hasn’t the media which publishes more lies than people on social media can counter legitimized falsehood? Hasn’t the entire Indian media which blamed ‘nationalism’ for Fake News on the basis of the Fake BBC research legitimized falsehood? The irony of it all was the fact that Ravish was accusing the Prime Minister of legitimizing falsehood at the event of a media outlet that is widely known to peddle the worst kind of Fake News.

As I have said before, in the world of liberalism, respect and credibility are not earned by hard work, honest research and an objective quest for truth. It’s earned by toeing the ‘party line’. It doesn’t matter if your conclusions are wildly off target and spread misinformation, if you toe the liberal line, liberals will fall at your feet and sing paeans to your credibility

The EU asks Pakistan to take stern action against the terrorists

The European Union has asked Pakistan to take ‘clear and sustained’ action to rein in the terrorists operating from its land. The statement comes on the heels of the ghastly attack in Pulwama on February 14 that claimed 40 lives of Indian soldiers. The terror outfit Jaish-e-Muhammad, which is based out of Pakistan, took the responsibility of the attack.

The High Representative of the EU for Foreign Affairs and Security Policy and Vice President of the EU Commission, Federica Mogherini has urged Pakistan and India to urgently “de-escalate” the saber-rattling that is on the rise after the attack in Pulwama. Stressing the need to “continue addressing terrorism including clear and sustained actions” Federica urged Pakistan to target not only all United Nations-listed transnational terrorist groups but also individuals carrying out such attacks.

In the wake of the attack, India had launched an all-encompassing diplomatic offense to corner Pakistan and isolate it internationally. PM Modi has also granted full freedom to the forces to avenge the attack as per their choice of time, place and format. India has also stripped Pakistan of the MFN status and levied 200% customs duty on the imported goods from Pakistan.

Union Minister Nitin Gadkari had also announced that the 3 rivers of water assigned to India as per IWT, whose water hitherto was generously allowed to flow to Pakistan, will be diverted to be used for developmental projects in the Yamuna. A few days back, FATF condemned the Pulwama attack and continued to keep Pakistan in the ‘Grey list’ for failing to stop terror financing.

Senior Congress leader Digvijaya Singh has again found himself in controversy as another video has now surfaced where he has been caught on camera saying ‘Murdabad’ to his own party’s workers who did not support their Bairagarh candidate in the recently concluded Madhya Pradesh elections, reported Republic TV.

According to the reports, Digvijaya Singh, a former Chief Minister of Madhya Pradesh was addressing his party workers at an event at Bairagarh, where he vented out his anger against those Congress party workers who did not support Naresh Gyanchandani, the Congress’ candidate from the Bairagarh constituency in the 2018 state elections.

“I would like to thank all those who worked for Naresh during the elections and ‘Murdabad’ to those Congress workers who did not support,” said Digvijaya Singh. Digvijaya Singh further welcomed people who had quit BJP to join Congress.

Congress candidate Naresh Gyanchandani had lost the Bairagarh constituency to the BJP’s Rameshwar Sharma. Rameshwar Sharma had secured 1,05,000 votes while Naresh Gyanchandani got just over 91,000 votes.

The Congress party has recently come back to power after 15 years of BJP rule under the leadership of Shivraj Singh Chouhan. It had secured 114 seats while BJP won in 109 seats out of 230 constituencies. Falling one seat short of a majority, Congress had to obtain the support of Samajwadi Party, Bahujan Samaj Party and few independents to form the government.

Digvijaya Singh had also caused controversy during the Madhya Pradesh state elections after a video featuring him had gone viral where he was seen claiming that Congress will lose votes in the upcoming election if he campaigns or gives any speeches. In the past, he had also been in the limelight for spreading fake news.

The terrorist attack on 14th February 2019 in Pulwama that left 44 CRPF soldiers dead, has led to Pakistan indulging in grandstanding and war-hysteria. The terrorist attack that was sponsored by Pakistan was one of the most dastardly attacks on security forces that Kashmir has ever seen. Following the attack, the Pakistan Army spokesperson had delivered a press conference in which he denied Pakistan’s role and cast aspersions on India. Now, 2 Indian TV channels, ABP Tiranga TV backed by Congress leader Kapil Sibal, that broadcasted that press conference have been sent showcause notices by the Government of India. Sources in MIB confirmed that 11 others are being examined for the same.

OpIndia has learnt from reliable sources that the 11 channels that are being examined for the violation. ABP and Kapil Sibal’s Tiranga TV have already received showcause notice.

As per information, EMMC has sent transcription reports of these TV Channels to MIB for Pakistan Army Spokesperson, Major General Asif Ghafoor’s media briefing. MIB has already issued showcause notice to Tiranga TV and ABP news.

Following is the showcause notice sent to Kapil Sibal backed Tiranga TV, that is backed by senior Congress leader Kapil Sibal.

The notice says that in the light of Pulwama attack, the Ministry had issued a notification on 14th February 2019 (the day of the terror attack) to be particularly careful about publishing and broadcasting content that:

  1. Likely to encourage or incite violence
  2. Contains anything against maintenance of law and order
  3. Promotes anti-national attitude
  4. Contains anything that affects the integrity of the nation

The notice says that the Ministry of Information and Broadcasting has learnt that Tiranga TV broadcasted the Pakistan Army spokesperson’s press conference between 15:41 and 16:02 on 22nd February 2019 and that was in violation of the rules and regulations.

The showcause notice says that the broadcast of the press conference violated the following rules:

  1. Likely to encourage or incite violence
  2. Contains anything against maintenance of law and order
  3. Promotes anti-national attitude
  4. Contains anything that affects the integrity of the nation

The showcause notice also mentions that the channel did not attempt to intervene to present the correct picture of the situation when the Pakistan Army spokesperson was presenting incorrect facts.

The notice deemed the broadcast in contravention to the notice issued by MIB on 14th February 2019 and asked the channel to respond, without 7 days of the issue of the notice with a reason as to why the government should not initiate action against them.

The National Investigative agency which is close to unraveling the dastardly Pulwama carnage said that several leads point out to the direct involvement of Pakistan in executing the ghastly act.

The evidence collected by the agency points out that four to five Jaish-e-Mohammed (JeM) militants, including suicide bomber Adil Ahmad Dar and a local handler, were involved in the planning and execution of the Pulwama carnage. While it has been ascertained now that the vehicle used in the attack was a red Maruti Eeco, investigators have also learned that it was the Pakistan military that provided the RDX.

An officer with the National Investigation Agency, while speaking with OneIndia revealed that the RDX was moved into Kashmir from across the border weeks before the attack. The RDX was smuggled into India by touts of the Jaish-e-Mohammad. Since it was a large quantity, it was moved in batches, the NIA officer also confirmed.

According to the officer, the RDX was supplied to the militants by the Pakistan army since they freely supply such explosives to the terrorists. The agency was sure that it has been smuggled from across the border, the officer also said.

According to NIS investigators, the owner of the Maruti Eeco vehicle used in the February 14 attack on a Central Reserve Police Force (CRPF) convoy that killed over 40 soldiers has also been identified. The vehicle was registered in Kashmir some eight years ago and was being used by the group with the knowledge of the owner, who has gone missing, investigating officers added.

“We have the full details about the vehicle, which was sighted with the same group at least a couple of times,” said an NIA investigator.

The officers investigating the matter also concluded that there were rare possibilities of the bomb fitted in the car being triggered remotely. It was Adil Ahmed Dar, the suicide bomber who triggered the explosives.

A car bomb is also known as a vehicle-borne improvised explosive device (VBIED).  Car bombs are more common with Talibanis and Palestinian terror groups. This mode is one of the most lethal modes of attack, as it creates a huge impact and parts of the vehicle which explode act as shrapnel causing further damage and the fuel in the vehicle also adds to the damage.

This has not been used in Kashmir so far. The NIA’s probe revealed that since the mastermind, Mohammad Umair had been trained in Afghanistan, he could have picked up the concept from there, where the car bombs are used by the Taliban extensively.

As per the OneIndia report, Security experts explain that countering a car bomb is very difficult. For instance in Pulwama, the car bomber used the highway to target the CRPF bus. The highway was not closed for the public as a result of which the bomber was able to access the target. Even if the car bomb were to be intercepted, the bomber would have anyway detonated it, thus causing damage, the official explained.

Although the NIA declined to reveal the identities of people involved in the attack at this stage, a senior official said that the full details of the case should be known over the next two weeks.

“We have pieces of evidence; the job of joining of dots to unravel the entire conspiracy is on. Someone brought the RDX from across the border, while another person rigged the device. The vehicle was perhaps repainted with someone doing the reconnaissance of the spot and selection of the target. We have the full picture of the attack,” the senior official added.

Though Pakistan has been in a constant denial mode, reports have mentioned officials admitting under the conditions of anonymity that there were clear Pakistani footprints in the Pulwama attack.

Speculations that something bad has happened to Jammu Kashmir Democratic Freedom Party (JKDF) chairman Shabir Ahmad Shah were doing the rounds after the Kashmiri separatist leaders were shifted to Tihar prison as the security agencies initiated crackdown against the Pak sympathisers and separatist leaders. The rumour snowballed, leading many to believe that Shah has been assaulted in the jail.

According to the sources, Hurriyat leader Altaf Shah was injured when a loose roof-tile in the washroom fell on his head causing an injury to him. As the news of Shah being injured broke out, rumours of Shabir Shah being assaulted spread like a wildfire, creating panic among the imprisoned Kashmiris in Tihar jail. The rumour subsequently reached Kashmir leaving the Valley in the state of worried.

Disconcerted by the rumours, Shabir Shah’s wife, Dr Bilquees Shah went to Tihar Jail to see her husband but wasn’t allowed to meet him. She alleged that the officials didn’t allow her to meet him since it was a Saturday, a holiday in the jail. She contacted her lawyer to determine her husband’s wellbeing who denied anything untoward to have happened to him but couldn’t provide confirmation.

However, the DIG Tihar prison has rubbished the rumours of assault on Shah. Urging people to be cautious against ‘fake news’, he has stated that Shah is absolutely ‘fit and fine’, as well as the other J&K and Pakistani prisoners.


Altaf Shah’s daughter Ruwa Shah took to Twitter to scotch the rumours about the assault on Shabir Shah.


She stated that her father Altaf Shah was injured in an accident but because of the similar surnames, the rumours of Shabir Shah picked up steam.

The issue of ‘Dalit Chief Minister’ has come to haunt the Congress party in Karnataka as Deputy Chief Minister Dr G Parameshwara has once again raised the issue after he revealed that he was thrice denied CM post by the party as he was a ‘Dalit’.

Addressing a gathering of the Chalavadi community in Davangere, Deputy CM Parameshwara said that he lost the opportunity of being the Chief Minister of the state three times as he had belonged to the ‘Dalit’ community and added that he had to reluctantly accept the Deputy Cheif Minister’s post, leaving the Congress party red-faced.

Expressing his disappointment over the reluctance of the Congress party to accommodate Dalits into higher posts, Parameshwara said that Dalit leaders are not being given a chance to be the Chief Minister. Dalits are being discriminated at the government level and even though reservation is facilitated, there has been injustice in promotions, said G Parameshwara.

He further said that Dalit leaders of the Congress party PK Basavalingappa, KH Ranganath and the current Leader of Opposition Mallikarjun Kharge were also not made the Chief Minister as they had belonged to the Dalit Community. “All of them could have become CMs, but were victims of Dalit suppression,” he said.

Highlighting the untouchability prevailing the society, Deputy CM Parameshwara said that the evil practice is rampant in rural Karnataka and till now Dalits were being prevented from entering temples, hotels and barbershops despite the fact that constitution has guaranteed them their rights. He further added that seven government officials, who were demoted, had committed suicide. “Our government will come out with rules next week to implement reservation in promotions, he added.

The statements of Deputy Chief Minister G Parameshwara indicates the increasing friction within the party over the issue of Dalit politics. The unholy alliance of the Congress-JDS in the state and ceding the post of Chief Minister to a junior partner in the coalition has added more fuel to the fire. G Parameshwara, one of the influential Dalit leaders in the state has now exposed the anti-Dalit stand of the Congress party, which otherwise claims to be the champions of inclusive politics.

The Supreme Court ruled today that it would be hearing petitions on the validity of Article 35A that gives special rights to the citizens of Jammu and Kashmir and precludes non-Kashmiris from buying land and property in the valley from 26th to 28th February. Following the decision, senior Congress leader Saifuddin Soz made a controversial statement asserting that he will join hands with Omar Abdullah, Mehbooba Mufti and even separatist Geelani to protest if Article 35A is scrapped or altered.


Congress leader Saifuddin Soz said, “People like us, whether that is Abdullah, Membooba Mufti or even Geelani, on 35A we will unite at Lal Chowk if the article is touched. Ours and kids’ future depends on this. Our future depends on what the central government plans to do about Kashmir”.

Article 35A has been a contentious provision which precludes non-Kashmiris from buying land and property in Kashmir. Congress leader, after rumours of extra paramilitary forces being brought in the valley by the central government anticipating the striking down of article 35A, made the controversial statement where he asserted that he was even willing to join hands with Geelani, a known pro-Pakistan separatist and rabble-rouser to protest against the move.

Interestingly, Pakistan too has made such statements regarding Article 35A. The Pakistanis have claimed that any proposed changes to the Article were an attempt to impose demographic changes on the state. “Pakistan condemns any such attempts as these are clearly aimed at bringing about demographic changes in Jammu and Kashmir,” it said in a statement.

Speculations have been rife in the state as well after the Central government has organized a massive crackdown on Jamaat-e-Islami and arrested numerous leaders of the separatist outfit. JKLF leader Yasin Malik was arrested as well after the Pulwama terrorist attack.

Politicians of Kashmir have been stoking the separatist fire after the Pulwama terror attack. Mehbooba Mufti had recently said, after the crackdown on separatists that one can imprison the person but not his ideas.

Congress too has been at the forefront of playing politics after the Pulwama attack. Congress leader Haroon Yusuf had recently made a controversial statement. Referring to the RDX which was used by the terrorist to carry out the attack on the CRPF soldiers, Yusuf tauntingly said that the Prime Minister could trace 3 kg of beef but could not trace 350 kg of RDX which was allegedly used in the Pulwama terrorist attack.

Randeep Singh Surjewala had also attacked the Modi government by holding it responsible for the Pulwama terrorist attack and called the JeM terrorist a “home-grown so-called terrorist”.

The National Investigation Agency (NIA) is close to cracking the Pulwama terror attack case. As per reports, the agency has found a clear link of Jaish‑e‑Mohammed (JeM) terrorists with the attack. The terror attack was the result of an elaborate operation by four or five JeM terrorists, including the suicide bomber Adil Ahmad Dar.

The sources from the police has informed that a Maruti Eeco vehicle was used in the horrific terror attack on a bus in a CRPF convoy on 14th February, and the owner of the vehicle has been identified from its records. The car was registered in Kashmir eight years ago, and the owner knew that it was being used by the JeM operatives. The owner of the vehicle has gone missing after the attacks, sources added.

An NIA officer said that they have the full detail of the vehicle, and it was seen with the same group of people several times before the attack.

The NIA investigators have said that there is clear evidence of the involvement of Pakistan in the attack. The agency believes that the 25 kg of RDX used in the attack came from Pakistan, although they are still probing how the terrorists procured the explosives.

According to NIA, the suicide bomber Adil Ahmad Dar, who had shot a video talking about the attack before blowing himself in the attack, was actively involved with JeM since he went missing in March last year. The other members of the group involved in the attack were from Pakistan, investigators have found.

It is believed that Dar was radicalised after his house was allegedly ransacked by CRPF in May 2018, and he particularly hated the force for this reason. The JeM in a statement issued after a grenade attack in Srinagar in June had said that “government forces made a vain and shameful attempt of setting ablaze the house of one of our colleagues Adil Ahmad Dar alias Waqas of Kakapora Gundibagh, Pulwama, during the dead of night”. The JeM had warned that every army camp in the state was a target, and would be burned.

One NIA official said that they have full information about how someone RDX was brought from across the border, another person made the device, the car was repainted, and someone did the job of reconnaissance of the spot and selection of the target.
