Maharashtra: Hindu minor girl abducted, raped, assaulted by one Javed Sheikh and his family, victim rescued after 4 years and accused arrested

“I was beaten. His mother, aunt and other family members tortured me. They kept me hostage for months and also assaulted me with lit cigarettes,” disclosed a 21-year-old recently rescued victim of Love Jihad from Manchar in the state of Maharashtra.

In a dreadful case of Love Jihad, on May 20, Maharashtra Police filed an FIR and arrested one Muslim person named Javed Sheikh (22) for abducting a minor Hindu girl, sexually assaulting her and then forcefully marrying her in the Manchar city of Pune, Maharashtra. The accused has been booked under sections 363 (kidnapping) and 376 (rape) of the Indian Penal Code and sections 4, 6, 8, 10 of the POCSO Act. The victim was 16-years-old when she was abducted and raped.

The case dates back to the year 2019, when the victim had just finished her last examination for 10th standard under SSC Board. She returned home after her exam but later in the afternoon could not be found anywhere by her parents and her elder sister. The father of the girl then immediately filed a missing person complaint against an ‘unidentified person’ and claimed that his daughter was kidnapped. He also asked the Taluka police to find the girl.

Years passed but the administration failed at searching for the girl. The family members of the girl meanwhile were also conducting search for the missing Hindu girl and the boy who abducted her. The father of the girl also wrote several letters to the administration to seek an investigation into the case but to no avail. During this, they discovered that their daughter was kidnapped by a Muslim person identified as Javed Sheikh. He had trapped the girl in a love affair and then abducted her.

The parents and other family members of the Hindu victim girl were scared and didn’t want society to know that their daughter was missing, so they decided to keep shut. But they were secretly making efforts to search for the girl.

As per the information provided by the sources to OpIndia, the brother of the victim girl recently discussed the matter with his friends who apparently helped the family to find the girl. They further discovered that Javed was a resident of their town, Manchar and that it would be easy to locate him within the locality.

The boys (brother of the victim and his friends) began looking for Javed. They notably located the premises in which he stays and observed the house for weeks. They also inquired the neighbours of the suspected house to know whether they had seen a new girl in the area. The neighbours happened to agree that they had seen a new girl in their neighbour’s house (Javed’s house) but they claimed that she was their newly added family member, the sources said.

It is then that the family members of the victim knew that their daughter was forcefully married and tortured by the family members of the accused. The girl was finally rescued earlier this month (May 16) by her brother and his friends and was brought home. She said that she was brutally treated and assaulted by Javed and his family members. She also said that she was raped and was kept hostage for months in an apartment.

The girl has been diagnosed with severe depression and is scared even to be around people including her family members. The complaint filed by the family members on May 20 this year clearly states that the girl confessed to have been kidnapped by Javed in the year 2019. The girl also said that the accused promised to marry her and then established sexual relations with her against her will.

However, the boy married the girl in December 2020 as per Islamic rituals and the legal document (Nikahnama) of the event has been accessed by OpIndia. The age of the girl in the document was reported to be 18 and that of Javed 21.

Notably, as per the Aadhaar card copies obtained, the Hindu victim girl is 2002 born and the accused Javed is 2001 born. Considering that, the age of the girl though was 18 during the marriage, the age of the accused was falsely shown as 21, when in fact he was just 19 years old. In India, a boy must be 21 years old to legally marry.

Further the ‘Nikahnama’ also states that the duo getting married are ‘adults’ and Muslims by religion. This indicates that the girl was also forced to convert her religion to Islam before marriage. In the videos obtained by OpIndia, the girl could also be seen wearing a burqa. However, no confirmation regarding this could be obtained.

Some videos of the girl talking to local activists were made available to OpIndia. The girl in the video confessed that she was tortured and beaten by the family members of the victim. She also could be seen fearing to be around people, even her family members, which is one of the crucial symptoms of depression.

“They tortured me. Hit me. Abused me with lit cigarettes. His family members assaulted me. They kept me hostage for months. They established sexual relations with me without my will. Asma, Javed, his mother, grandmother thrashed me,” the girl reiterated.

Sources also claimed that the girl was thrown into the racket of prostitution for around 6 months and was given bruises from lit cigarettes. The images of the marks on the woman’s entire body have been obtained by OpIndia (attached above).

It is important to note that the victim girl’s father had filed a police complaint in the year 2019. The case then was filed under section 363 (kidnapping) of the Indian Penal Code. The father of the girl had also written several letters to the Pune Police demanding investigation into the case.

Police confirm arrest of the accused to OpIndia

OpIndia talked to the API Bhalekar of the Manchar Police Station who confirmed that the case was long pending from the year 2019. He also said that the accused had been arrested on May 17 this year.

“The recent FIR in the case was filed on May 20. But the accused has been arrested on May 17. This is an old case from the year 2019 and that the girl has been rescued. We request to please not make public the identity of the victim. Further investigations are underway,” he said.

Team OpIndia meanwhile also talked to brother of the victim, Avinash. He confirmed the incident and said that he along with his friends, mother and wife rescued the victim on May 16. “She is now at home and she is safe,” he said. Sources meanwhile say that the family members of the victim girl want all the members of Javed’s family arrested as they all have tortured the victim together. “They have ruined her life”, they say.

The Police have arrested the accused and booked him under sections 363 (kidnapping) and 376 (rape) of the Indian Penal Code and sections 4, 6, 8, 10 of the POCSO Act. Further investigations are underway.

Delhi CM Arvind Kejriwal says he will boycott NITI Aayog meeting, writes to PM saying “cooperative federalism is a joke”

On 26th May 2023, Delhi’s chief minister Aravind Kejriwal announced that he will boycott the NITI Aayog meeting scheduled on 27th May 2023. The Aam Aadmi Party convenor also wrote a letter to Prime Minister Narendra Modi in this regard.

In his letter, Arvind Kejriwal said, “The objectives of NITI Aayog are to prepare India’s vision and promote cooperative federalism. However, in recent years, there has been an attack on democracy and non-BJP governments have been destabilized, toppled, or prevented from functioning. This is neither in line with the vision of our nation nor with the principles of cooperative federalism. Over the past few years, a message has been sent across the country that if people elect a non-BJP government in a state, it will not be tolerated.”

Arvind Kejriwal further alleged in his letter, “Either non-BJP governments are destabilized by buying off legislators, or they are brought down by instilling fear through agencies like the Enforcement Directorate (ED) or the Central Bureau of Investigation (CBI). And if a party’s legislators cannot be bought or broken, then the government is prevented from functioning either by implementing ordinances or through the intervention of the Governor.”

AAP chief further said in his letter, “After an eight-year-long struggle, the people of Delhi emerged victorious in the Supreme Court, obtaining justice. However, within just eight days, you overturned the Supreme Court’s order by passing an ordinance. Consequently, if any officer of the Delhi government refuses to work, the elected government chosen by the people cannot take any action in that regard. How can such a government function effectively? It seems like the government is being rendered completely powerless. Why do you want to render the Delhi government powerless? Is this the vision of our nation? Is this cooperative federalism?”

Proclaiming his boycott of the NITI Aayog’s meeting, he said in his letter, “When there is such a blatant disregard for the constitution and democracy, and when cooperative federalism is being mocked, then there seems to be no purpose in attending NITI Aayog meetings. Hence, people are saying that we should not attend tomorrow’s NITI Aayog meeting. Therefore, it will not be possible for me to attend the meeting tomorrow.”

The upcoming NITI Aayog meeting, slated for May 27, will address various important matters such as healthcare, skill development, women empowerment, and infrastructure development. The objective behind these discussions is to propel India towards becoming a developed nation by 2047. The council, which comprises chief ministers, lieutenant governors of Union Territories, and several Union ministers, serves as the highest governing body of NITI Aayog.

‘Family first parties have come together to boycott all that represents India’: 270 eminent personalities write open letter condemning boycott of new parliament building inauguration

The controversy surrounding the opening of the new Parliament building, which is scheduled for May 28, appears to have no end in sight. Now, 270 distinguished individuals have penned an open letter denouncing the opposition’s call to boycott the opening ceremony of the new Parliament building. Former officials, diplomats, military officers, and academicians are among those who authored the letter.

The letter highlighted that the inauguration of the new Parliament building is a moment of pride for the entire country as well as all Indians and accused the opposition of having “skeletal arguments, immature, whimsy and hollow reasoning and, most importantly, non-democratic posturing.”

The letter referred to Narendra Modi as “the democratically elected Prime Minister of India, who has inspired a billion Indians with his authenticity, inclusive policies, strategic vision, commitment to deliver and most of all, his Indianness is unpalatable to the Congress and other opposition parties with a similar worldview.”

It said that the reason for this is because the parties driven by the ideology of family-first cannot reconcile with an India-first strategy brand of politics. “So naturally all the family first parties either structurally or in thought have come together to boycott all that represents India.”

It charged, “Those that are boycotting the inauguration of the Parliament by Prime Minister Narendra Modi just don’t get how they are the ones that are sucking the soul of democracy. They are following their own formulaic undemocratic, routine and baseless boycotts.”

The staggering number of recent non-partisan events of the Parliament that the opposition has boycotted was also mentioned. “In 2017, the Congress party decided to boycott the Parliament’s midnight session to launch GST, a truly federal innovation and the only of its kind in post-Independence India. In 2020, the opposition parties boycotted Lok Sabha to support eight Rajya Sabha members who were suspended for despicable unruly behaviour.”

The incident that occurred in 2021 when the Congress party and the opposition boycotted ‘Samvidhan Divas’ was also brought up. “This being the second time in a row that the Opposition Parties had boycotted the President’s Parliamentary Address.”

It pointed out that Congress conjured up yet another fictitious concern of inflation during the 2022 Monsoon Session and added the superfluous subject of GST to it. “One cannot forget the same very gang boycotting the joint session of Parliament on Constitution Day, honouring Baba Saheb Ambedkar.”

According to the letter, the opposition does not comprehend that engaging in its routine behaviour of brandishing placards and yelling slogans, disrespecting the country’s most important institutions, and even using commonplace objects like milk packets to illustrate its disapproval is what is “authoritarian” and is “a grave insult and direct assault on our democracy.”

“They just don’t get that they are the ones side-lining the Hon’ble President Draupadi Murmu. In 2023, they boycotted her customary speech to the joint session of the parliament ahead of the Union Budget, 13 opposition parties, who took part in the march, also boycotted the Speaker’s customary tea gathering,” it proclaimed.

It also brought up the disrespectful remarks of Congress leader and Berhampore MP Adhir Ranjan Chowdhury, who insulted the President by calling her “Rashtrapatni.”

It further read, “They don’t get how abysmally they demean their own political stature. The inauguration of the Parliament building is a proud moment for the entire country. And, it is a matter of extreme despondency in the context of Indian democracy that the Congress Party, which calls itself the oldest political party has decided to needlessly cry foul.”

“In 2012, the then Speaker Meira Kumar observed that the Parliament, with its cracks and absence of emergency measures, was ‘silently weeping.’ Now, do they think that the old building is bulging with efficient opulence,” it questioned and added, “Maybe they do because they just don’t get it.”

In a scathing attack on Congress, it commented that the party’s arrogance and anti-democratic attitude have consistently impeded the advancement of the country. “Of course, to expect any largesse of heart or soul or to be imbued simply by the pride of being an India is expecting too much of the Congress party. They, as has been belaboured, just don’t get it.”

It observed, “But what the Congress party also does not get, along with its allies, is that the Indian people get it. If only the Congress and its allies would ponder deeper, would they get that it is not the soul of democracy that has been lost but that the opposition’s popularity which has been lost.”

They alluded to themselves as “the concerned citizens of India” who “condemn the non-democratic and posturing of the opposition parties”  and committed to support the nation and Prime Minister Narendra Modi as Indians.

The coordinator, Ms Bhaswati Mukherjee, a former ambassador, signed off the letter at the end.

On May 28, a seven-hour programme will be held to honour Prime Minister Narendra Modi’s inauguration of the new Parliament building. A puja and a havan will commence the ritual, and PM Modi will deliver an address at its conclusion.

The new structure, which is a part of Central Vista‘s revivification as the country’s power corridor, has drawn criticism, and 21 opposition parties have chosen to boycott the event. They contend that by discrediting the president, the PM’s inauguration constituted a serious insult and an outright attack on democracy.

Maharashtra: ASI Bhaginath Wagh, who booked youth Sagar Wankhede for a social media post against Aurangzeb, suspended for dereliction of duty

On 25th May 2023, Assistant Sub Inspector Bhaginath Wagh of the Sillod (Rural) police station was suspended for booking a case against a youth named Sagar Wankhede under section 295A of the IPC for sharing a social media post. The Superintendent of Police (Rural) of the Chhatrapati Sambhajinagar district in Maharashtra issued an order in this regard on Thursday, May 25.

The suspension order mentions, “It is found that you committed dereliction of duty.” The list of apparently questionable and contentious FIRs filed by this police officer is then given in the order which includes FIR number 107/2023 registered against Sagar Wankhede – a 23-year-old Hindu youth from the Borgaon Bazar village in the Sillod taluka.

It is notable that on May 19, Sagar Wankhede shared a social media post depicting Chhatrapati Sambhaji Maharaj crushing the head of Mughal tyrant Aurangzeb. Local Muslim youth Amir Shaukat Shaha had then filed a complaint of hurting religious sentiments against Sagar Wankhede in the Sillod (Rural) police station on May 20. Sagar Wankhede was produced before the session court in Sillod on the same day and was sent to 14-day magistrate custody remand.

There was a demand in social media about suspending the investigating officer API Sitaram Mehetre in this case for needlessly invoking serious sections against the Hindu youth just over a social media post. But it was later found that ASI Bhaginath Wagh who received the complaint and filed the FIR in the first place was suspended by the SP (Rural) of the Chhatrapati Sambhajinagar district.

The suspension order states that disciplinary action is being taken against the police officer, and a final decision will be taken based on the inquiry report. Bhaginath Wagh will be attached to the Aurangabad Rural Police Headquarters during his suspension period.

OpIndia spoke to Appasaheb Paradhe – the joint secretary of the RSS for the Chhatrapati Sambhajinagar district. Providing more information on this matter, he told, “Bhaginath Wagh is just the primary police personnel involved in this case. There are two-three more officers who need to be suspended in this case. Hindu youths in the locality are not completely content with the suspension. Many social media users posted that video yesterday and challenged that let there be a case booked against them if anyone can dare to file one. Similarly, one Hindu youth in the same village had posted the status of the same visuals on his social media account. Again 40-50 Muslims gathered at the police station and demanded a similar case but the local police did not entertain them.”

He further informed, “The court did not hear the bail plea of Sagar Wankhede today. There were so many cases and the court ran out of time. We expect that tomorrow the court will hear the bail plea.”

According to sources, the local Hindu youths are alleging that the API Sitaram Mehetre should be suspended but the police department has suspended a junior beat officer instead because of the political pressure of Abdul Sattar. It is being asked by them that if API Sitaram Mehetre was on leave on that day, then how come he reached to sign the FIR in the first place?

Japan: Muslim migrant damages a Shinto shrine and threatens Japanese local not to pray there because ‘Allah is the only god’, arrested

A video has been going viral on social media wherein a man in yellow attire can be seen vandalising a worship place. The video is reportedly from the Tarumi Ward in Japan’s Kobe City where the accused identified as Mamadou Balde had vandalised the Mizuoka Hachiman shrine in the area.

Balde is a Muslim native of the Republic of Gambia in West Africa, who migrated to Japan and now lives in Tarumi Ward, where the incident took place.

The accused, who was later arrested by the Japanese police, reportedly broke an offering box kept in the shrine. He also, reportedly, threatened a local worshipper against offering prayers at the shrine claiming Allah to be the only God. The incident occurred on May 3, 2023.

The CCTV footage revealed that the Muslim man, dressed in yellow attire appeared in the precincts of the Japanese Shinto shrine at around 9:30 am on May 3. He kicked the offering box kept in the shrine.

Shinto Shrines are places of worship as well as the dwellings of the Shinto gods- kami. Sacred articles of devotion representing the kami are kept in the shrine’s innermost chamber, where they cannot usually be seen by anyone. In some cases, a mountain, waterfall, or rock behind the shrine building can be the object of veneration.

Another security camera also showed the bamboo pipes in the chozuya, where the worshippers wash their hands before offering prayers in the shrine, and a wooden box kept on top of another offertory box being slammed to the ground.

The accused also reportedly told a woman devotee who was visiting the shrine at the time, “There is only Allah (the god) of Islam, so there is no God here, so don’t pray here.”

Reacting to the incident, Mizuoka Hachiman Shrine, chief priest, said: “It’s really disappointing, I can only say that.” 

Rise of Islam in Japan

It is pertinent to note here that as per available data, Islam has become the fastest-growing religion in Japan in terms of percentage increase, with its followers growing by 110%, from 110,000 in 2010 to 230,000 at the end of 2019, out of the total population of Japan of around 126 million. According to some sources, there were 30,000 Muslims in Japan in 1982.

One of the primary reasons for this demographic change is the sharp rise in marriages between Muslims and Japanese citizens and Japanese converts over two decades. This has caused a seven-fold increase in the number of mosques that have mushroomed in the country. A study by Hirofumi Tanada, professor emeritus of sociology at Waseda University in Tokyo showed there were 113 mosques across Japan in March 2021, up from only 15 in 1999.

Notably, the first contact between Japan and the Muslim world can be traced back to the 16th century when Japanese traders began establishing trade routes with the Middle East and Southeast Asia. These interactions introduced some Japanese to Islamic customs and practices.

In the late 19th century, Japan experienced a wave of migration due to industrialization and economic development. This resulted in the arrival of a small number of Muslim migrants, primarily from India, Turkey, and other parts of the Middle East. These migrants played a significant role in laying the foundation for Islam in Japan.

Islamic organizations began to emerge in Japan during the mid-20th century. Some Japanese individuals began converting to Islam, either through personal study or interactions with the Muslim community in Japan.

In the 1960s hundreds of Pakistani and Bangladeshi Muslims migrated to work in Japan and became settled. Additionally, Muslims from Pakistan and Bangladesh increased in the late 1980s as visa waiver programs were introduced by the Japanese government. According to data provided by the International Organization for Migration (IOM), the population of migrant Muslim workers in Japan doubled to reach more than 2 million at the end of 2011.

Thiruvavaduthurai Adheenam, the math that gave the Sengol to Nehru, slams Congress and media for claiming that govt is lying about the sceptre, says it has records

On 24 May, Union Home Minister Amit Shah announced that a Chola Dynasty Sceptre named Sengol will be placed at the new parliament building on 28 May after its inauguration. The Sengol was specially commissioned in 1947 and was handed over to Jawaharlal Nehru as a symbolic transfer of power from the British. After that, some media houses, including the Hindu and The News Minute, claimed that there is no evidence that the sceptre was used as a symbol of the transfer of power. They claimed it was just a gift from Hindu seers in Tamil Nadu, and didn’t have any symbolic value.

Thiruvavaduthurai Adheenam in Tamil Nadu, one of the oldest Saivaite Maths in India, has strongly refuted these claims, saying that the sceptre was indeed used as a symbol of the transfer of power. It is notable that it was seers of Thiruvavaduthurai Adheenam who had commissioned the sceptre, travelled to it with Delhi, and handed it over to Nehru after symbolically receiving it from Lord Mountbatten.

While narrating the use of the Sengol at the time of India’s independence from the British in 1947, the government said that the seers of Adheenam, led by Sri La Sri Kumaraswamy Thambiran, had first handed over the sceptre to the then viceroy Mountbatten, and he had then given it back. After that, a purification ceremony of the Sengol was carried out by Sri La Sri Kumaraswamy Thambiran. The Sengol was then taken to the Constituent Assembly Hall in a procession accompanied by the ‘nadaswaram’ of Adinam Vidwan TN Rajaratnam Pillai. It was then handed over to Nehru at his residence.

The Hindu and The News Minute had claimed that there is no evidence of the Sengol being presented to Mountbatten and he giving it back as a symbolic gesture, saying it was directly ‘gifted’ to Nehru by the seers.

These reports were then used by Congress leaders and others in the opposition to mock the government over the issue. Jairam Ramesh said that the claim that the sceptre was used as symbol of transfer of power is bogus, calling it “Wholly and completely manufactured in the minds of a few and dispersed into WhatsApp.” He also said, “The sceptre is now being used by the PM & his drum-beaters for their political ends in Tamil Nadu. This is typical of this brigade that embroiders facts to suit its twisted objectives.”

Responding to these claims, Thiruvavaduthurai Adheenam posted an official release on its Facebook page strongly, saying that Adheenam’s records support the govt version. They said that it has been documented in multiple sources that the Adheenam was invited to conduct a ritual to symbolise the transfer of power.

The official release by the Adheenam says, “Our Adheenam honoured the invite of Rajaji and we got a Sengol made, gave it to Lord Mountbatten, got it back from him and presented it to Pandit Jawaharlal Nehru in an elaborate ritual. The Swami who presented it to Nehru also made it clear that this Sengol is a symbol of self-rule”.

The Adheenam said, “saying that such events are bogus or false, trying to raise question marks about our credibility, and trying to reduce the importance of the use of the Sengol as a symbol of the transfer of power for the sake of politics is very sad and unfortunate.” They added that they will provide detailed information on the same in a press conference.

S Gurumurthy, thought leader and editor of the Thuglak Magazine, who was behind rediscovering the Sengol, also slammed The Hindu calling its report recklessl. He Tweeted, “The Hindu report is reckless and the congress relying on the reckless report shows that due to old age its institutional memory is failing.”

Countering ‘no evidence’ claim of The Hindu, he said that the govt docket distributed to journalists contain quotes from the Adheenam, saying “Sadaiyapa swami gave the sengol [Sengol] to Mountbatten and got it back from him and sprinkled holy water on it, invoked the divine name and gave it to Pundit Nehru blessing him to assume power.” He provided the Tamil quote by Adheenam and its English translation.

“This Annex is available in the govt docket but the Hindu has been blind,” he said. S Gurumurthy later also posted the response by Thiruvavaduthurai Adheenam.

After he asked, “Will The Hindu persist with the wrong,” The Hindu director Malini Parthasarathy said that his comments are indeed concerning. “If the report is factually incorrect, we will correct it,” she added.

Allahabad high court takes over all the cases related to the Shri Krishna Janmabhoomi in Mathura

The Allahabad High Court has taken over the jurisdiction of all the cases pertaining to the Shri Krishna Janmabhoomi in Mathura. The High Court has transferred the ongoing cases from the lower court in Mathura to be heard before itself on Friday, 26th May 2023.

On May 3, the Allahabad High Court reserved its judgment regarding a petition that sought the transfer of a case from the Mathura district court to the high court. The case involves Hindu devotees who claim the right to the land where the so-called Shahi Masjid Idgah is situated.

The petition highlighted the national significance of the Krishna Janmabhoomi case in Mathura and emphasized that it should be heard in the Allahabad High Court. The petition was filed by Bhagwan Shri Krishna Virajman at Katra Keshav Dev Khewat Mathura, represented by Ranjana Agnihotri and seven others, along with the counsel for the respondents.

The respondents in the case include the Management Committee of the Shahi Masjid Idgah, located next to the Krishna Janmabhoomi temple, the Shree Krishna Janmabhoomi Trust, Katra Keshav Dev, Deeg Gate, Mathura, and the Shri Krishna Janma Sthan Sewa Sansthan, Katra Keshav Dev, Deeg Gate, Mathura.

The applicants filed a civil suit with the civil judge (senior division) seeking a declaration and injunction, asserting the rights of the Hindu community over the Idgah mosque. They argued that the mosque was built by demolishing Hindu temples and contended that it cannot be considered a mosque as no Waqf (endowment) was ever established. The plea further stated that the land was never specifically dedicated to the construction of the mosque.

Advocate Vishnu Shankar Jain representing the Hindu side in this case tweeted, “Krishnajanabhoomi case transferred to Allahabad high court for original trial. Jai Shri Krishna. Finally, our transfer petition has been allowed. All cases will be tried by Hon’ble Allahabad high court.”

Advocate Hari Shankar Jain leading the team of counsels for the Hindu side shared a video from his Twitter handle in which he said, “Today, the honourable high court has given a very important order. According to that order, all the cases related to Mathura’s Shri Krishnajanmabhoomi will be heard in the high court. In fact, we filed a civil suit on 25th September 2020. In that case, we pleaded that the disputed structure on the Shri Krishnajanmabhoomi should be removed. It was first rejected. Later it was taken up for hearing, and now the high court will hear it.”

He further said, “In between, we pleaded that this case and all other cases related to it should be transferred to the high court. Because the Ayodhya case took 70 years. So if the cases remain in the lower court for a long time, it will be too late. so the honourable high court accepted our request and ordered the transfer of all the cases. The court has also ordered the district magistrate to collect all the cases and send them to the high court.”

Meerut: Scuffle breaks out during swearing-in ceremony as AIMIM councillors refuse to stand up during ‘Vande Mataram’

On Friday, May 26, councillors of Asaduddin Owaisi’s All India Majlis-e-Ittehadul Muslimeen (AIMIM) party and BJP traded blows at the Meerut Municipal Corporation Mayor and Councillors’ swearing-in ceremony. The scuffle allegedly broke out after AIMIM party councillors raised an objection to India’s national song ‘Vande Mataram’.

Reportedly, the AIMIM councillors refused to sing and stand up while India’s National song ‘Vande Mataram’ was being played during the ceremony.

The dispute escalated from a verbal skirmish to a full-fledged physical brawl, with members of both parties throwing punches and blows at each other.

BJP leader and Rajya Sabha member Laxmikant Vajpayee who was present during the ceremony alleged that the matter escalated after the AIMIM councillors made some objectionable comments.

Meerut police, meanwhile, have taken to Twitter to inform about the incident. “When Vande Mataram was played during the swearing-in ceremony, some AIMIM councillors remained seated and protested.” Other councillors were outraged. This resulted in sloganeering and a commotion. The police officers on the scene intervened and separated the councillors from each other,” the police tweeted in Hindi.

The incident occurred on Friday at the Subhash Chandra Bose Auditorium of Chaudhary Charan Singh University in Meerut, Uttar Pradesh, when the newly elected mayor and councillors were being sworn in. During the ceremony, the BJP councillors started singing the national song (Vande Mataram).

The AIMIM councillors objected to the singing of the National Song. They neither sang the national song nor stand up in reverence, which irritated the BJP members. The BJP members objected to this behaviour. Members of both parties got into a verbal spat, thereafter. Within no time, the verbal altercation devolved into an all-out physical altercation.

The police intervened and requested the AIMIM councillors to leave the auditorium. AIMIM councillors got even more agitated as a result of this. Collector Deepak Meena rushed to the venue to pacify the AIMIM members. The AIMIM councillors were, however, so angry that they boycotted the swearing-in ceremony and walked away without taking the oath.

The commissioner, meanwhile, administered the oath to the mayor and somehow completed the formalities of the ceremony in the midst of the ensuing ruckus.

It may be recalled that in 2021, AIMIM MLA Akhtarul Iman, who had raised objections to ‘Hindustan’ written in his affidavit during the oath-taking ceremony of the 17th state assembly of Bihar, had once again courted controversy after he raised an objection to India’s national song ‘Vande Mataram’. Iman, who was also the Bihar State president of the All India Majlis-e-Ittehadul Muslimeen party then, had refused to sing the National song ‘Vande Mataram’ during the last day of the Bihar assembly winter session, calling it ‘against his faith and religion’.

Speaking to the media, the AIMIM Bihar president questioned why it was important to sing the national song and said that while he had nothing against singing the national song, saying ‘Vande Mataram’ was against his religion.

A Public Interest Litigation (PIL) that asked the Supreme Court to rule that President Droupadi Murmu, and not Prime Minister Narendra Modi, should preside at the inauguration of the new Parliament building was denied by the apex court on Friday. After a vacation bench consisting of Justices JK Maheshwari and PS Narasimha declined to consider the petitioner’s plea, attorney CR Jaya Sukin, who was appearing as a party-in-person, withdrew from the case.

Justices JK Maheshwari and PS Narasimha stated that the applicant lacks locus standi to bring such a plea and mentioned that he should be grateful that the court is not fining him.

“What is your interest,” the bench asked and commented, “We don’t understand why you come with such petitions. We’re not interested in entertaining it under Article 32.” The petitioner cited Article 79 of the Indian Constitution to which Justice Maheshwari inquired, “How is Article 79 related to the inauguration?”

The President, per him, should open the building since she is the head of the executive. The President’s Special Address is what formally begins each Parliamentary session, according to Article 87, which he emphasised.

The petition was dismissed by the bench because it was not persuaded by the applicant’s arguments as he requested permission to withdraw the case. In the opinion of Tushar Mehta, the Solicitor General, CR Jaya Sukin shouldn’t be permitted to withdraw it since he would make a similar argument in the High Court. The SG argued that these issues should be categorically rejected as not justiciable by the court.

However, the petitioner asserted that he is withdrawing because he does not intend to appear before the High Court and that he does not want the rejection to serve as a “certificate to the executive.” He decided to abandon the lawsuit after much deliberation because, as the bench noted in the decision, the Court was not inclined to hear the matter.

The PIL which said, “Lok Sabha Secretariat violated the Constitution by not inviting the President for the inauguration,” was filed in the highest court on Thursday seeking a direction that the new Parliament building should be inaugurated by President Droupadi Murmu.

According to the petition, the announcement made by the Lok Sabha Secretariat on May 18, 2023, and the invitation sent out by its Secretary General for the opening of the new Parliament building, violate the Indian Constitution. It alleged that the President is an essential member of the Parliament and quoted Article 79 of the Constitution to support this claim. Therefore, she shouldn’t be kept away from the inauguration ceremony.

There will be a seven-hour programme on May 28 to commemorate Prime Minister Narendra Modi’s inauguration of the new Parliament house. The ceremony will begin with a havan and a puja, and it will end with a speech by PM Modi.

However, the opening of the new structure, which is a part of the revitalization of Central Vista, the country’s power corridor, has been met with opposition, and 21 opposition parties have decided to boycott the occasion. The inauguration by the PM, they claim, represented a grave insult and direct assault on democracy by sidelining the president.

Former Jammu and Kashmir Chief Minister Omar Abdullah on Thursday praised the new Parliament building terming it “pretty damn impressive”. 

In a tweet, Omar Abdullah said, “Setting aside the brouhaha about the inauguration for a moment, this building is a welcome addition. The old Parliament House has served us well but as someone who has worked there for a few years, a lot of us often spoke amongst ourselves about the need for a new & improved parliament building. Better late than never is all I’ll say & this one looks pretty damn impressive.” PM Modi will dedicate the new Parliament building to the country on May 28. 

Meanwhile, slamming the opposition parties’ call for boycotting the inauguration of the new Parliament building by Prime Minister Narendra Modi, several leaders and activists from Jammu and Kashmir on Friday extended support to the inauguration while also describing the opposition’s decision as “childish and trivial”. 

Speaking to ANI, socio-political activist Adil Hussain said, “The new parliament building is the temple of democracy. It is a very proud thing for all of us, for all Indians including the Opposition. In the last 70 years, we did not have such leadership. If you see the ratings worldwide, Prime Minister Modi’s rating is 78 whereas US President Joe Bidden’s rating is only 43. The Opposition has expressed issues but we do not think that this is such a big issue. Politics should not happen on this.” 

Meanwhile, Ghulam Nabi Azad’s party Democratic Progressive Asad Party (DPAP) spokesperson, Firdous, said, “This is not such a big issue as the Opposition has been portraying. This is simply childish behaviour by the opposition parties. This new Parliament building has a vision. It is a great move by PM Modi to inaugrate the Parliament. An agenda should not be made out of this.” 

He said that the inauguration should be welcomed with “open arms” and disrespecting the Prime Minister by boycotting the event is not right. “As a spokesperson of the party, I believe the inauguration should be welcomed with open arms. After all, he is our Prime Minister. Disrespecting the Prime

Minister is not right. We must respect the move. Earlier Prime Ministers including Rajiv Gandhi also inaugurated the building in the Parliament. This is not new,” the DPAP spokesperson added. 

Notably, at least 21 opposition parties have decided to boycott the PM’s decision to preside over the inauguration ceremony instead of President Droupadi Murmu. 

The opposition said that the inauguration of the building without President Droupadi Murmu “insults the high office of the President, and violates the letter and spirit of the Constitution”. 

Meanwhile, amid the boycott call by the opposition, the Centre has received a confirmed list of 25 political parties, including some which are not a part of the

National Democratic Alliance (NDA), that will participate in the inauguration ceremony. 

Apart from the Bharatiya Janata Party (BJP), several parties in the NDA including AIADMK, Apna Dal, the Republican Party of India, the Shinde faction of Shiv Sena, NPP, and NPF have confirmed their attendance for the function on Sunday. 

Several neutral parties, including Biju Janata Dal, TDP, and YSRCP will also be present for the inauguration. Amongst the opposition parties, Shiromani Akali Dal and Bahujan Samajwadi Party and JDS will attend the function on Sunday.
