Summons issued to Nirav Modi and Mehul Choksi, passports revoked

0

The Enforcement Directorate has issued a summons for appearance to Nirav Modi and his business partner, Mehul Choksi, for their involvement in the Rs. 11,400 crore PNB fraud. The summons was issued under the Prevention of Money Laundering Act (PMLA) and the said persons have been asked to depose within a week’s time.

Meanwhile, the ED has raided several offices and showrooms of Nirav Modi and Choksi and recovered Rs. 5100 crore in gems, jewellery and gold. The case was registered against them after the Punjab National Bank had registered complaints with Law Enforcement authorities alleging fraud.

On January the 31st, CBI had booked Nirav Modi and others in a separate case of cheating worth Rs. 280 crore after a complaint by PNB. It is being probed whether the proceeds of the crime were converted into black money and used to create illegal assets. Mehul Choksi has been involved in shady dealings in the past. After an investigation by SEBI, Mehul Choksi and a set of firms were suspected of market manipulation and subsequently barred from trading for a period of six months.

Acting on the advice of the ED, the Ministry of External Affairs has suspended the passports of Nirav Modi and Mehul Choksi for four weeks with immediate effect. They have been asked to submit their replies within a week as to why their passports should not be revoked or impounded. The MEA shall go ahead with the revocation if the replies are not submitted within the stipulated time.

NDTV founder planning to run away from India, Subramanian Swamy alleges

0

The fight between BJP MP Subramanian Swamy and NDTV founder-promoter Prannoy Roy seems to be heating up. Prannoy Roy had earlier written a letter to the Prime Minister Narendra Modi asking him to drop the CBI investigations into financial frauds of NDTV ‘to promote press freedom’. Roy suggested that investigations were prejudiced by Swamy’s allegations. CBI had earlier raided the NDTV promoters’ residences earlier in June 2017.

Now the fight has gone a step further with Swamy asking for a lookout notice against Prannoy Roy, because Swamy believes that Roy could escape to South Africa. This explosive claim by Swamy comes after India has seen defaulters like Vijay Mallya and now Nirav Modi being outside India while being accused of financial fraud.

Swamy made this allegation on Twitter, which was interestingly re-tweeted by Prannoy Roy himself within minutes. Not only Roy re-tweeted Swamy, he even called him a liar in a subsequent tweet:

Snapshot of Prannoy Roy’s Twitter timeline

Interestingly, this is for the first time Prannoy Roy has directly responded on Twitter to any message by Subramanian Swamy about himself or NDTV.

The allegations of Prannoy Roy having properties in South Africa are not new. An income tax officer S K Srivastav, whom NDTV had branded as ‘biased‘, had claimed that Roy had a ranch in South Africa. The same can be heard in the video clip below [between 0:45 and 0:55 minutes]:

Social activist Madhu Kishwar too had earlier – weeks before Narendra Modi became the Prime Minister – suggested that Prannoy Roy could escape to South Africa if Sonia Gandhi’s family goes out of power i.e. if Congress loses the 2014 elections and Modi wins (which did happen):

Whether Roy has a ranch in South Africa or any plans to escape to South Africa is just a matter of speculation and allegation right now, but Swamy surely has brought the issue back in focus. We will have to wait and watch as to how this fight and case will progress in coming days.

Robert Vadra loses petition in Delhi HC, to be questioned by Income Tax Department

0

The Delhi High Court on Thursday quashed a writ petition filed by Sky Light Hospitality while hearing a case on the DLF-Sky Light Hospitality land deal. Robert Vadra is a partner in Sky Light Hospitality. According to reports, his company had filed the petition challenging the re-assessment notice by the Income Tax Department.

After the Delhi High court’s decision, Robert Vadra will now be questioned by the I-T department along with other stakeholders in Sky Light Hospitality.

A division bench by Justices Sanjiv Khanna and Chandra Shekhar had heard the petition. According to reports, the division did not find any merits in the company’s plea. The court has ordered the representatives of the company to appear before the assessing officers of the I-T department on February 19.

Sky Light Hospitality had challenged the I-T department’s assessment notice for 2010-2011. The case is related to the matter of Sky Light Hospitality (Which was converted to Sky Light Hospitality LLP from Pvt Limited) allegedly taking a 5 crore loan from DLF and using the money to buy a piece of land and then selling the same land to DLF for 50 crores.

The petitioners had claimed that as the I-T department had issued the reassessment notice to Sky Light Hospitality Pvt Ltd, it was invalid and void because the company was taken over by Sky Light Hospitality LLP by acquiring its rights and liabilities in May 2016.

To this petition, the HC concluded that the conversion was noticed and mentioned in the tax evasion report filed by I-T department and only the mere ‘human error’ of addressing the notice cannot nullify judicial proceedings which are otherwise valid.

Robert Vadra is now expected to be questioned by the I-T department regarding irregularities of the land deal made by his company.

Facing a woeful shortage of money, Congress withdraws 5 candidates from Nagaland

0

A few days ago the Congress party folded its hand in the upcoming assembly election in Nagaland when it was reported that the party was struggling to find candidates for the state elections.

The party workers’ lack of enthusiasm, shortage of resources and organisational weakness was blamed for such a muted response. Further as per a Congress functionary overseeing the party’s preparations for the state’s polls, owing to the lack of candidates the party was planning on contesting just 20-25 seats out of a total 60. In the end, the party fielded 23 candidates.

The embarrassment for the party though doesn’t end here and it has now been reported that a severe cash crunch has forced the party to withdraw 5 candidates leaving a mere 18 in the fray. Those who withdrew are Limawati Jamir from Aonglenden constituency, Hobeto Kiba from Zunheboto, Shami Angh of Longleng, Choakpa Konyak fielded from Tobu and Aimong Lam who stood from Noklak.

As claimed in the report, this was done due to a lack of financial resources in the party, and as per an unnamed Congress leader, it (Congress party) has realised that not a lot can be done (in the state), rendering them reluctant to spend the cash.

Kewe Khape Therie, the Nagaland Congress president, has claimed that the All India Congress Committee cannot fund them and this was conveyed via the party’s general secretary in-charge of the northeast, CP Joshi, who has been accused of a lack of interest in his role.

Reports have also alleged that the Congress has been starved of cash for long and it was admitted to by the party leaders during 2014 general elections.

This raises the question as to why is the Congress now being so careful with its finances even though the so called cash crunch has been visible from 2014?

Has the ascension of Rahul Gandhi as a party president, ushered in a new era of fiscal prudence or is the party penny pinching owing to these lack of funds, to be in contention for a strong push in 2019 Lok Sabha polls.

If the former is true, then the question might be asked as to why hasn’t Rahul Gandhi inculcated the same fiscal prudence in his personal life, brought into question when he was recently accused of flaunting his “riches”, by wearing an approximately Rs 63,000 Burberry jacket while campaigning in Meghalaya.

If the latter is true, then does it mean that the nation is witnessing the shrinkage of the Congress party in terms of its national presence and if its misfortune continues, might end up reducing itself to specific pockets of the country.

Kejriwal and his band of conspiracy theorists spread canards about the ED raids on Nirav Modi properties

0

The Nirav Modi fraud has rocked the country and people who have deposited their savings in banks. The saving grace for all depositors has been the fact that Punjab National Bank is a public sector bank and it is fully backed by the government. The swift action against the fraudster’s assets has also been a positive sign for the public.

Though political parties criticised Modi government for the Nirav Modi’s escape, the government has raided and seized gold and diamond worth 5100 crores from 17 locations associated with the businessman. We had reported about the details of the raid and the PNB fraud yesterday.

Conspiracy theorists spread doubts and misinformation about the raids

However popular YouTuber Dhruv Rathee, who has been a vocal critic of Modi government felt that the ‘5100 crores’ figure that emerged from the raid was ‘fishy.’ He is under the false impression that valuing gold and diamonds is same as counting currency that was collected during demonetisation.

Delhi Chief Minister Arvind Kejriwal spread this illogical tweet in order to spread doubts in the minds of people.

Another journalist with ‘Moneylife‘ claimed that the assets were valued at just 100 crores.

Twitter users slam conspiracy theorists propaganda

However, such claims were slammed by Twitterati as they were illogical and politically motivated. One of the Twitter users remarked that these conspiracy theorists did not figure out things that were obvious to second-year finance students.

Another user remarked as to how the comparison between demonetisation and ED raids was absurd.

Ankit Jain, Twitter user who is in the jewels and diamonds business explained that it is easy it value the items that were raided yesterday.

Several others debunked ‘conspiracy’ theories and ‘doubts’ of propagandists.

Thus, conspiracy theorists are not able to accept the action taken by the government in Nirav Modi episode. Instead, they continue to work on their propaganda which aims to blame the government for a fraud that has its origins under the UPA regime and not even concede, when swift action is taken and property immediately seized after such frauds surface.

UP criminals move around town holding placards, vow to stay away from criminal activities

0

Two longtime criminals in UP, Salim Ali and Irshad Ahmed carried placards and marched around town with vows to stay away from crimes.

According to a report in Times of India, the two criminals, who have a long list of crimes in Kairana town carried placards that said, “I will never get involved in any crime and earn money by fair and honest means. Please forgive us.”

The criminals are afraid that they might get shot by the UP police in one of the encounters. The criminals said that they want to turn away from crime for good and they want to live life peacefully with their families. Amidst the ongoing crackdown on the criminals by UP police, they are scared of being hunted down like others.

Both Salim and Arshad also met Shamli SP Ajay Pal Sharma and handed over to him an affidavit with the same pledge. Bhagwat Singh, the station officer in Kairana said that both criminals have several cases of loot and murder against them and are currently out on bail. SP Sharma also acknowledged the criminals meeting him and said that it is good that they want to turn away from crime and the main goal of the police is to ensure that criminals leave a life of crime. He also added that their pledge reflects the fear of police among criminals and that is essential to maintain law and order. He asserted that the police will continue to keep a watch over them anyway.

Shamli SP Ajay Pal Sharma in the past months has earned the tag of ‘encounter specialist’ in UP. He has gunned down at least six dreaded criminals and injured several others.

After Yogi Adityanath took over as CM in UP, the state has seen a severe crackdown on criminals by the police. Law and Order was one of the main focus of Yogi Adityanath’s poll campaign and his government has taken it seriously. UP has seen several encounters in the recent months where many dreaded criminals were eliminated and hundreds have been arrested. Despite repeated notices from the National Human Rights Commission, Yogi Adityanath’s government has maintained its stance on encounters.

Yesterday, speaking in the UP state Legislative Council, Yogi Adityanath announced that the police encounters in UP won’t stop. Hinting towards the opposition and its failure to maintain Law and Order in past tenures, he added that everyone knows who has been giving patronage to criminals and his government will continue its crackdown. UP has seen over 1200 encounters in the recent months.

Recently, UP police also have called out a fake news circulated by Amnesty India regarding the number of criminals shot in encounters and asserted its commitment to put a stop to criminal activities.

Amnesty India had deleted their tweet after UP police’s reply. As a result of the continuous encounters, many UP criminals have also been surrendering in fear and crime rates are on a significant decline in the state.

Artist accuses Rahul Gandhi of ‘stealing’ her art work on social media

0

An artist named Sania Dsilva has accused the Congress President Rahul Gandhi of ‘stealing’ her art work of Lord Shiva and posting it on his Facebook page without her permission and even without giving credit to her. She shared her disappointment and frustration in a Facebook post.

Rahul Gandhi steals Shiva poster
The Facebook posts where the artist accused Rahul Gandhi of ‘stealing’ her work

The artwork appears to be the intellectual property of Sania Dsilva as she has been selling her work under the brand ‘A little more whirl’. The poster that was used without permission by Rahul Gandhi is available for sale at this link. The poster costs $12.50 (around 800 rupees).

Rahul Gandhi had shared the same art work on Twitter as well on the eve of Maha Shivratri.

Twitter post by Rahul Gandhi showing the same ‘stolen’ image

While Rahul Gandhi’s official Facebook page appears to have removed the image after Sania’s objection, the art work is still there on his official Twitter profile by the time this report was published.

Appears that in a rush to prove himself a ‘Shiv Bhakt’, Rahul Gandhi is not even caring about copyright issues or basic courtesies about asking artists for permission to use their work or crediting them. Or will Rahul Gandhi say that he is so poor that he can not afford 800 rupees to buy a poster?

Factcheck: Did a whistle-blower really alert the PMO about the PNB-Nirav Modi scam in 2016?

0

While the modus operandi of the scam itself has been well talked about, the game has now shifted to the political angle. Congress and BJP are trading allegations over the responsibility of the scam. Now some sections of the media have also joined in.

Yesterday, some media houses and other social sites made a claim that a whistle-blower had alerted the PMO about the PNB-Nirav Modi scam and that the PMO ignored the same. A site called AsiaTimes in an article written by Saikat Datta makes the below claim:

Similarly, TheLogicalIndian has this post:

The reports are exactly in line with what the Congress has alleged and are based on the statements of a businessman, Hari Prasad who had entered into a business with Nirav Modi and Mehul Chokshi as a franchisee of their jewellery business in 2012. He claims that he had written to the PMO warning them in 2016 about a “scam and fraud done by the person/company based in Mumbai involving loss of Rs 1000s of crores of Indian public money”.

Hari Prasad did indeed write such letters, which have been put out by an official Congress handle itself. The letters speak of various alleged financial irregularities. They say that a scam which can cause “losses of Rs 1000s of crores” is being orchestrated by Mehul Chowksi of Gitanjali Gems. They claim that various franchisees have lodged complains against his companies. They claim the Chowksi and his companies have syphoned off 1000s of crores via subsidiaries.

Then, the letters speak of various “deficiencies” in the balance sheet of the accused. Hari Prasad states that 31 banks have extended loans of almost Rs 9872.0 crores against assets of merely Rs 25-30 crores, Tax liabilities are increasing and are remaining unpaid and that Tangible assets are “very very small”.

Hari Prasad also claims that a large number of inventories and receivables are “manipulated and inflated” figures and that there is something “fishy” about the company. He also states that while Indian companies are in loss, foreign subsidiaries and in profit, hence it is “assumable that Chowksi has syphoned out India money abroad”.

The letters also claim that Chowksi has various cases filed against him, and there are several “victims” of his fraud all over India. The letters also say that Chowksi is also a partner of Times Group hence Times group has refused to cover the same.

While the letters which have been put in public domain speak of all the above, there is no mention of :

1. Nirav Modi

2. PNB bank

3. Letters of Undertaking/Credit

4. Collusion between 2 bank employees

5. unauthorised SWIFT messages etc.

All these points are the essence of the current Rs 11000 crore scam being discussed. Instead, the letters by Hari Prasad speak generally of “Rs 1000s of crores being syphoned off” that too by Chowksi and his companies.

The letters by Hari Prasad instead speak of how franchisees have been allegedly duped by Chowksi, and how his companies have huge loans as compared to fixed assets. The current PNB-Nirav Modi scam has nothing to do with franchisees. Neither does it have anything to do with huge loans on the balance sheet of any company, since the current scam deals with off-balance sheet items. In fact, the current scam went undetected for too long because Letters of Undertakings were not fund based credit facilities and were off the balance sheet of both PNB and the accused companies.

Thus, based on the letters of Hari Prasad presently in public domain, it is incorrect and misleading to say that he had informed PMO about the current PNB scam in 2016 itself. He had alluded to general financial irregularity since he was aggrieved as a franchise. If there are any other letters in which Hari Prasad has specified the key issues surrounding the current scam, then that letter should be made public.

Guide to trafficking 589 children : Get an award from Sonia Gandhi’s hands

0

On May 24, 2014, a train pulled into Palakkad Railway Junction in Kerala. Like numerous other Indian trains, it was overcrowded. Not only that, a number of passengers had travelled ticketless.

But there was something different about this overcrowded train. Its passengers were mostly children, as many as 456 of them. A vast majority of them were travelling without parents. Almost all of these children were from India’s poorest states: Bengal, Bihar and Jharkhand.

Not surprisingly, it looked like an obvious case of child trafficking to the Railway Police.

Untitled.png

The other thing was that a huge number of them were travelling to a certain “Mukkam Muslim Orphanage” in Kozhikode.

A day later, on May 25, 2014, as recorded by the Telegraph here, another 123 underprivileged children arrived in Palakkad from West Bengal. Like The Hindu says here:

Untitled.png

So what is the typical “cost of purchasing” a little child? Fifteen hundred rupees!

Untitled.png

Trafficking of 589 minor children, most of them below the age of 12 years. What kind of horrible people would have their names come up in connection with something like this?

Let’s find out from The Telegraph here:

Untitled.png

Oh dear! This is going to break my delicate secular heart! The chairman of the Mukkam Muslim Orphanage is none other than IUML leader Syed Hyederali Shihab Thangal, an ally of the Congress party, a constituent of the UPA of which Honorable Sonia Gandhi is the Chairperson!

And guess what? There is a beautiful, heartwarming moment of Mukkam Muslim Orphanage being honored earlier by Her Royal Highness Madam Sonia Gandhiji  herself, at an official function of the Ministry of Women and Child Development.

(Youtube screenshot below, however, I highly recommend watching the original video here, if only to enjoy Ms Renuka Chowdhary’s angelic smile)

Untitled.png

An Award for Women and Child Development? What a wonderful euphemism for an organization that was later accused of purchasing minor children for Rs 1500 each.

Yeah, that’s right. We the taxpayers paid for this Mukkam Muslim Orphanage to receive an award at an official function of the Government of India. Presented by none other than Ms Sonia Gandhiji, the Hon’ble Chairperson of the revered National Advisory Council.

It should be noted here that the first train carrying 456 children arrived in Palakkad on May 24, 2014.

The second train carrying the next 123 children arrived in Palakkad on May 25, 2014.

You might remember that Narendra Modi officially became the Prime Minister of India on May 26, 2014.

I guess the only question left for Rahul Gandhi to answer would be this: what was the hurry?
