C Voter survey shows losses in UP, gains in Bengal for NDA, if Lok Sabha elections were held today

0

Republic TV has yesterday released the projected numbers from their C-voter survey for seven remaining states. Last week they had released opinion poll projections for 256 of the total 543 seats. Opindia.com had published the tally of seats C Voter had predicted.

Yesterday the projected numbers for the remaining 287 seats poured in and though the NDA is projected to retain a majority in the Lok Sabha, they may lose several of their current seats in Uttar Pradesh and still fail to emerge as a strong power in Tamil Nadu. West Bengal, however, is expected to see a saffron surge.

The projections for the seven new states are as follows:

The seat projection for Sikkim, Tripura, Tamil Nadu, Telangana, Uttar Pradesh and Uttarakhand

In West Bengal the BJP is set to gain, jumping to 12 seats from the 2 in 2014 while the UPA will sink further to a mere single seat from their 2014 number of 4 seats. The TMC is losing several seats too, as predicted by the C-voter survey.

In Sikkim, though the NDA is set to retain their seat, they are set to lose vote share. The vote share of UPA is predicted to rise.

In Telangana, The NDA is set to win 3 seats as compared to 2 in 2014 although it may see a 5.7% surge in vote share.  The UPA vote share will see a very slight dip as they retain the 2 seat tally.

In Tamil Nadu, the NDA is losing a seat to reduce to 1 from 2 in 2014. The UPA as before will fail to win a seat while others (DMK chiefly) will be the majority force. The NDA is looking at a 7.8% dip in vote share while the UPA is looking at a 3.1% increase, as reported by the survey.

In Tripura the BJP is not expected to win a seat, however, they are looking at a significant 25.4% increase in the vote share as compared to a dip of 3.2% for UPA.

In Uttarakhand, the  NDA is set to retain all 5 of its current seats while expecting a slight 4.1% dip in vote share.

In Uttar Pradesh, the BJP is expected to lose several of its current seats. The BJP which won 73 of the 80 seats in UP in 2014 is expected to come down to 60, though the overall dip in vote share is not very significant. The UPA is set to win big, upping its tally to 18 seats from the current 2 (Rae Bareilly and Amethi for Sonia& Rahul Gandhi ).  The UPA is looking at a massive surge of 22% in its vote share.

The overall tally for all the states and union territories is as follows:

Actor who says he will choose ‘Quran over Constitution’, gets support from AAP, Hardik Patel and Pakistan

Little known TV actor Ajaz Khan, who is best known for making the threatening-ish video against singer Sonu Nigam after his ‘controversial’ tweet about azaan, is back in news, this time for saying that he will choose Quran over Indian Constitution ‘any day any time’.

Muslim actor from India says he will choose Quran over Constitution of India
link to the tweet

He was responding to a Twitter user who was critical of Khan for referring to Israeli Prime Minister Benjamin Netanyahu, who was on a maiden visit to India, as a murderer.

Soon enough support poured in from Pakistan and #IStandWithAjazKhan was also trending on Twitter (as per Ajaz’s claim on his Twitter page). It is also noteworthy how Ajaz gleefully retweeted the tweets from Pakistan supporting his stand of choosing the Quran over the Constitution, thereby undermining the sovereignty of India for religion:

Aam Aadmi Party’s Ved Prakash, also came out in support of Ajaz:

Congress’ recent ally Hardik Patel too supported him:

Interestingly, Jignesh Mevani, an aide of Hardik Patel, had recently asked BJP leaders to choose between Manu Smriti or Constitution, but appears that the new ‘youth leaders’ have no problem supporting someone who openly says he chooses Quran over constitution.

It is thus surprising that the very elements who resort to citing the constitution when things don’t go as they please, are today endorsing views that undermine not just the “secular ethos” that they like to tom tom, but also the same constitution they swear by to justify their skewed version of secularism.

Ajaz, whose extremist views are not new, and who today finds unbridled support from the “torch bearers of secularism and constitutional supremacy”, had earlier too taken to social media to ask for ‘donations’ for his ‘political party’ which started out as an NGO ‘Allah Ke Bandey’.

He is also of the opinion India will be declared a ‘Hindu Rashtra’ after 2019 elections and hence more and more Muslims should join Allah Ke Bandey. Sharing a video on Prime Minister Modi on Godhra riots, Khan posts “Chup Rahegi Zubane Khanjar To Lahoo Pugarega Aasteen ka – Ye Hai Sacchayi Narendra Modi ki Yaro dekho aur share karo inko Bhul mat Jana”. In an earlier video, which is now deleted, Ajaz Khan referred to Modi as Hitler after the BHU incident.

Ajaz who had spoken against Modi and fear mongered about India turning into “Hindu Rasthra” after 2019, is today endorsing Islamic identity over the constitution of India. One wonders then, whether such elements are not really opposed to religious supremacy, but religious supremacy of a religion they dont practice themselves.

IT department further tightens the noose by issuing notices to 2 lakh people for deposits during demonetisation

0

About two lakh people have been issued an Income Tax notice by the government for depositing more than Rs 20 lakhs in the now defunct Rs 500 and Rs 1000 notes, in the aftermath of demonetisation. The notices have been specifically issued to those persons who have either failed to file IT returns or haven’t responded to the IT department’s request for information in this regard.

As per a senior IT officer, these depositors in question were given a lot of time to come clean in the IT returns, but their failing to do resulted in them getting a notice which asks them to furnish details my filing the IT returns in question.

The IT department as per the report, has identified chasing tax payers as a key priority for the year, and the Central Board of Direct Taxes is carrying out a recovery action to ensure that evaders do not escape the brunt of law.

The total amount of suspected deposits is pegged at about Rs 2.9 lakh crores, which is less than 20% of the total amount deposited during demonetisation. In total, about 5 lakh people haven’t filed their Income Tax returns, but the department is currently going after the big fish.

The latest development comes after the other slew of measures which the Income Tax department has undertaken post demonetisation.

Earlier this year, the Department had launched Operation Clean Money, involving e-verification of large cash deposits made during 9th Nov to 30th Dec 2016. In only the “first batch”, about 18 lakh persons had been identified in whose case, cash transactions don’t appear to be in line with the tax payer’s profile.

Later the IT Department had issued detailed guidelines to tax officers, which are to be considered while ordering scrutiny assessments pertaining to filing of revised/belated returns by assessees, post demonetisation period. Scrutiny assessments refer to the cases which are picked by the IT Department for detailed investigation, and verification with supporting documents.

Further the Income Tax Department has slapped notices on 1.16 lakh individuals and firms who made cash deposits of more than Rs 25 lakh in bank accounts post note ban but failed to file returns by the due date.

Even though there have been a sizeable number of persons who have failed to file the IT returns, overall the total number of people paying Income Tax has increased by 22% in the 2016-17 Financial year. This jump was also considered significant as a mere 3% of the Indian population is currently believed to be paying the Income Tax.

Sonia and Rahul Gandhi’s company took loan from Hawala operator, authorities suspect black money involved

0

By now most of us the know the crux of the National Herald case. It revolves around allegations that Young Indian, a company owned by Gandhi’s, acquired assets of Associated Journals Limited (AJL), by paying Rs 50 lacs to purchase a loan of Rs 90.21 crore, and later converting the loan into shares. While the transactions seem complicated, there is one transaction which enables all of this.

Young Indian (YI) was incorporated on 23.11.2010, with a share capital of Rs 5 lakhs. In December, the loan which AJL owed to AICC, was transferred to Young Indian by AICC. So now AJL owed the money not to AICC but to YI. YI was supposed to pay Rs 50 lacs to AICC to purchase this loan.

But at this time, YI, a company which was just 1 month old, and had a share capital of just Rs 5 lacs, had no money to pay AICC against the loan. YI arranged this money a good 2 months after the loan was transferred. YI took a loan of Rs 1 cr and paid Rs 50 lacs to AICC on 01.03.2011.

In all of this, let us forget issues such as why did AICC hand over rights to collect Rs 90.21 crores to YI, for a mere Rs 50 lacs. Let us further forget how this right was then converted to shares in AJL. Let us also forget how AJL’s properties became YI’s properties by virtue of the above.

Let the focus be solely on one transaction: How did YI, a 3 month old company with nothing in its books, manage to get a Rs 1 crore loan.

The Income Tax department’s order goes into this aspects and the findings are shocking. The order states the following:

1. YI took a loan of Rs 1 crore from M/s Dotex Merchandise Pvt. Ltd. (Dotex) on 15.02.2011.

2. The order states that till the finalizing of the original income tax case, neither the principal nor the interest was paid back to Dotex by YI.

3. The terms of the loan, as per the confirmation letter furnished by YI, said that the tenure of the loan was 1 year from date of cheque. Thus the non repayment of the loan was in contravention of the terms and conditions of the loan, yet Dotex never took any action against YI. Dotex also failed to give any reasonable explanation as to why it did not demand return of the loan.

4. As per the order, the loan was finally repaid only in Financial Year 2015-16 “when the investigation proceedings were continuing and YI was confronted with the facts that M/s Dotex Merchandise Pvt Ltd was a paper company engaged in providing hawala entries.”

5. Mr Sunil Bhandari and Mr Sunil Sanganeria were directors of Dotex. Along with Dotex, they were directors of 50 other Kolkata based companies. The order states that during the course of raids/surveys by the Income Tax Department, many of these companies had been found engaging in the business of providing “accommodation entries“. Copies of bank accounts “had proved that these companies were engaged in business of accommodation entries” which typically involved “deposits of cash and issue of cheque of equivalent amount“.

6. The order explains what this business of accommodation entries is: issue of cheques by these companies in lieu of cash payments of equivalent amount by the recipient of the cheque i.e. a company approaches these companies with cash, and they give an equal amount of cheques in return. The companies charged a commission of 1% to 5% on such dealings. The cheques issued were shown as “loans” in the recipient’s books and were never repaid because “that loan represented the laundered money” of the same recipient.

7. The order observes that the loan of Rs 1 cr was given to YI, a new company with a capital base of just Rs 5 lakhs, without any guarantee.

8. The order further refers to Dotex as a “known Hawala entry operator” and “a company engaged in providing hawala
transactions“. It also says that this entry of Rs 1 crore loan given to YI, was already reported in the “Suspicious Transaction Report” of the Financial Intelligence Unit of the Government of India.

9. Later on, the order states that to prove the existence of the loan, YI only filed a copy of confirmation where address and name of person issuing such confirmation was not disclosed. YI neither proved the genuineness of the transactions nor creditworthiness of Dotex. YI could not even prove that Dotex was engaged in any meaningful business and had source of income and capacity to advance the loan.

10. The order observed many defects in the confirmation letter given for the loan. For example, it did not bear address of Dotex nor the name of authorised signatory. PAN of Dotex was not mentioned. Address of YI was not mentioned.

Based on all the above, the order concluded that:

“The amount of Rs 1 crore in this case represents own laundered money of M/s Young Indian“

All of the above is from the Income Tax order. This leaves us with some questions.

The findings of the order imply that Rs 1 crore was in fact black money of Young Indian itself, which was funneled to Dotex, and was returned by Dotex to Young Indian, as a loan of Rs 1 crore. But Young Indian as a company was merely 2-3 months old when all this happened, and had no transactions to generated such black money. Then who might have arranged such money? Was it the promoters of Young Indian:

Can the above shareholders and director of Young Indian explain the source of this Rs 1 crore black money which is alleged to have been paid to Dotex, in order for Young Indian to receive it back as a “loan”, which was repaid only after the Income Tax department highlighted to Young Indian that Dotex was in fact a hawala operator?

In a major boost to India’s NSG membership claim, it becomes part of 3rd export control group

0

In what might potentially be a major boost in staking a claim for a Nuclear Suppliers Group (NSG) membership, India has now become part of the “Australia Group” which strives to check the proliferation of chemical and biological weapons.

Broadly speaking, the group works towards countering the spread of materials, equipment and technologies which could lead to the development or acquisition of Chemical and Biological Weapons (CBW) by either states or terrorist groups.

In a statement issued on Friday, the Government announced that it became the 43rd member of the Australia Group (AG), following the successful completion of the internal procedures. The Ministry of External Affairs as a result thanked each of the AG members for supporting India’s membership.

With this membership, India becomes part of a total of three export control groups, the two others being Missile Technology Control Regime (MTCR) and Wassenaar Arrangement.

MCTR aims to restrict the proliferation of missiles, complete rocket systems, unmanned air vehicles which can carry a payload of 500 KG for a minimum distance of 300 KM. This restriction also applies to the systems which are intended to carry weapons of mass destruction (WMD). The induction into the MCTR meant that India could start buying high-end missile technology.

Waseenaar Arrangement is an arms export control group similar to MCTR and the NSG, which is composed of 42 members except China.

Incidentally in all the three export control groups, China is absent as a member, which might be the reason why India has almost seamlessly become part of these groups. When it comes to the 48 member NSG, China has repeatedly opposed India’s entry by first demanding that India sign the Non-Nuclear-Proliferation treaty.

NSG is chiefly a multilateral export control regime (MECR), which seeks to prevent nuclear proliferation and basically controls the nuclear trade. If India manages to become a member of NSG, it would mean access to cutting edge technology from fields which vary from nuclear energy to medicine.

With India now successfully being part of three prominent export control groups, and the US too claiming that it is working closely with its international partners to secure India’s entry into the NSG, it remains to be seen whether China can be finally forced to forsake its opposition.

Petitioner who got 20 AAP MLAs disqualified seeks protection

0

Following the approval of recommendation of disqualification of 20 Aam Aadmi Party MLAs by President Kovind, petitioner Advocate Prashant Patel has appealed to the Delhi Police and Home Ministry to provide him with security, urgently.

The Election Commission had recommended to disqualify 20 AAP MLAs, originally 21, but one Jarnail Singh had resigned from MLA to contest elections in Punjab, on the charges of office of profit. The recommendation was sent to the President, who on Sunday approved of the same, thereby disqualifying 20 MLAs. The AAP MLAs were appointed parliamentary secretaries and their appointment was described as them holding offices of profit by Patel.

This matter has earlier claimed big names such as Jaya Bachchan and even Congress President Sonia Gandhi. While Bachchan lost her Rajya Sabha seat via disqualification, Sonia Gandhi had to resign from all her posts which could have been considered as falling under “office of profit”.

Arvind Kejriwal though tried another method, by passing a bill which had retrospective impact, trying to bless his 21 MLAs with legal sanctity. Unfortunately the bill was rejected by Pranab Mukherjee, the then President of India and ever since a new saga of victimhood has played out. Kejriwal has cried foul that Modi is behind all the happenings.

Meanwhile, Arvind Kejriwal has attacked Centre for disqualification of his 20 MLAs and accused of ‘harassment’. Among those disqualified are Alka Lamba, who spreads fake surveys and likes to delay rescue operations by climbing fire brigade in her free time. Another MLA facing the axe is Naresh Yadav, who had allegedly desecrated Quran during the run up to the Punjab election.

World Economic Forum: What will Modi say?

0

Leaders across the Globe will gather at Davos, in the Swiss Alps, for the World Economic Forum (WEF) and Narendra Modi will be the first Indian Prime Minister since HD Deve Gowda in 1997 to attend the annual meet. As he seeks to woo Business leaders from around the world to boost his Make in India initiative, special delicacies from the Indian cuisine will excite the taste buds of the foreign delegates. India will host a welcome reception for the WEF members with Narendra Modi to present the inaugural keynote address.

Yoga will feature at the WEF for the first time in its history, with one session each in the morning and evening.  “We are showcasing various achievements, we will also give a taste of Indian cuisine, a taste of culture and heritage,” Ramesh Abhishek, heads of the department of industrial policy and promotion, told reporters.

Nearly 2000 CEOs from top companies around the world will participate in the annual meeting of the WEF. The Indian delegation to the forum, largest with its 130 participants, will include stalwarts from the country such as Mukesh Ambani and Gautam Adani.

Last year, Xi Jinping firmly staked his claim as a global leader and pitched China as a credible alternative to fill the vacuum that was expected to be created following the “America First” foreign policy of the United States under President Donald Trump. Amidst tensions with China over Doklam and India’s attempt to attract global investors, the keynote address by Narendra Modi at the World Economic Forum is expected to be of similar significance. India has been trying to present itself as a potential alternative to China as the manufacturing hub of the world and Narendra Modi will pursue the same objectives in his visit to the forum. Although the speech is expected to focus primarily on the economy, it will not be surprising if the Indian Prime Minister drops hints on India’s geopolitical concerns and ambitions.

Apart from his keynote address, Narendra Modi will have a bilateral meeting with the Swiss President Alain Berset where the two leaders are expected to talk about mutual participation and commitment towards global initiatives. The Prime Minister will also interact with 120 members of the business community on January 23rd. Other than Narendra Modi, Union Ministers Arun Jaitley, Suresh Prabhu, Piyush Goyal, Dharmendra Pradhan, Jitendra Singh and MJ Akbar will also address sessions at the WEF.

After ‘Free Balochistan’, ‘Free Karachi’ campaign started by Muhajirs grips US

0

Following ‘Free Balochistan’ campaign which has raised awareness about human rights abuses by the Pakistan government, a group of Muhajirs in the US launched a ‘Free Karachi’ campaign to highlight the alleged state sponsored atrocities against their community in Karachi, Pakistan. Led by a mini-truck, about half a dozen cabs displaying ‘#FreeKarachi’ posters participated in the Martin Luther parade.

#FreeKarachi movement was triggered following the murder of Professor Hasan Zafar Arif, who was found dead in the Ibrahim Hyderi area of Karachi earlier this month. “We want Karachi free from the control of Islamabad. We want Karachi to be free from atrocities of the security forces. We want an immediate end to the human rights violations of the people of Karachi,” Nadeem Nusrat, the US-based former convener of Muhair’s mainstream political party, Muttahida Quami Movement (MQM) is reportedly said to have said.

However, the political parties in Pakistan have condemned and called it a ‘smear campaign’. Sadaruddin Shah Rashdi of Pakistan Muslim League Functional (PML-F) also blamed India to have helped ‘stage the drama’.

The United States, on the other hand, has assured Pakistan that it does not support any group threatening country’s national integrity. Pakistan had reacted strongly to the campaign, following which, the US government agencies assured Pakistan that none of the US agencies support these campaigns.

Jharkhand woman claims Muslim man married and tried to convert her to Islam by deceit and force

0

Yet another case of ‘love jihad’ has been reported from Jharkhand where the woman herself has come up and lodged complaint against her husband. A Muslim man named Tanveer Akhtar Khan aka Tannu has been accused of cheating, torture and attempt to convert the woman by deceit and force after marrying her.

Rama Kumari Ojha, a resident  of Jamshedpur had married Tanveer in 2015. At the time of her marriage there had been a ruckus in the same police station (Uldiha) where Hindu groups claimed it was a case of ‘love jihad’ because Rama had eloped with Tanveer. Rama’s parents had left Jamshedpur and settled in Delhi because of this ‘humiliation‘.

Despite all the tensions and ‘controversy’, Rama decided to stay with Tanveer and marry him, though she claims that he had befriended her by hiding his religious identity. She had been living a married life with Tanveer of her own will even after discovering about his religion.

However, things started turning ugly after a year. According to Rama, Tanveer Khan fed her beef by deceit and told her that now she had lost her religion. As a result, she even started to believe herself as a Muslim though she did not convert. In her complaint to the police, Rama had said that she was held captive for six months after she refused to convert to Islam.

Rama reportedly even attempted suicide due to such abusive behaviour by her in-laws, though she survived. Later she could convey her tribulations to her family in Delhi, which returned to Jamshedpur and took the matter to police. Some Hindu groups too helped the family in taking the issue to police, media reports indicate.

Tanveer Akhtar Khan aka Tannu has been charged of assault, domestic violence and adultery by the police. He was arrested on Friday. Rama has been sent back to her mother’s home.

Jharkhand has recently seen many reported cases of what is claimed as ‘love jihad’. It all started when a national level shooter Tara Shahdeo reported about her forgettable experience of marrying a Muslim man, who had lied about his religious identity to marry and who later tortured her for accepting Islam. Just last month another case was reported where a girl was murdered by her in-laws because she refused to accept Islam after marrying a Muslim.

National Herald case: Congress threatened tax officers with legal consequences for asking ‘irrelevant’ questions

Subramanian Swamy’s “nuclear bomb” in the National Herald case is still causing havoc. A detailed study of the 105 page Income Tax Order received by Young Indian documents throws up some very serious irregularities. We have already seen how Young Indian, via its promoters (Sonia Gandhi and Rahul Gandhi) tried their best to thwart the investigation proceedings. Now, some more perusing reveals that the Congress party too tried its very best.

The crux of the case lies in the fact that the Indian National Congress/All India Congress Committee (AICC) had over the years advanced a loan of 90 crore rupees to Associated Journals Limited (AJL), which published its mouthpiece, the National Herald. These loans were later sold cheap for just 50 lakhs rupees and were used to give a 99% stake in AJL to the Gandhis, via the company Young Indian (YI), thus transferring the ownership of valuable assets owned by AJL to YI.

The Income Tax department decided to verify the nature and genuineness of these loans. For this, they had to write to the parties involved in the transaction, which included the AICC. The order quotes replies from AICC, which show AICC too, like the Gandhis, was not very cooperative in the investigation.

In response to a summons dated 04.05.2017, the AICC sent a letter to the tax department dated 15.06.2017. A portion of the same, which was quoted in the tax department’s order, is mentioned below:

The paragraph shows how AICC tried to divert the questions by asking the ‘relevance’ of the questions to the case. While this in itself may not be a major problem, the next reply quoted in the order speaks volumes.

In a reply dated 24.08.2017, the AICC wrote to the tax officer (relevant portions reproduced):

In this reply, the AICC went into complete attack mode. They first alleged that the tax officer was being misused in a “politically motivated” contest. The next paragraph though was even more revealing:

Here the AICC has directly threatened legal action against the tax officer because they believed that he was seeking information which was not relevant to the case.

Let us step back here, this is the oldest political party in India, which has held office for the most number of years, threatening legal action against an Income Tax officer, who is investigating a matter involving a company owned by the Gandhis, not the Congress. And all this is being done in writing!

The Gandhis can very well be expected to say these things since their own company was in the dock. But the AICC was being questioned only to gain information to verify the transactions of YI. Yet AICC stepped in to defend the Gandhis and used its muscle and clout to influence the officer by threatening him with legal action.

Non-cooperative attitude while replying, or questioning the motives of an officer can to an extent be accepted, but this was a direct threat given in writing. Did AICC try any other extra-constitutional means off the record?
