15 state elections could be held simultaneously with the Lok Sabha in 2019

The Law Commission and the Election Commission are scheduled to meet on 16th May to discuss simultaneous elections in India according to news reports. This idea of simultaneous elections is not new in India. India for the first four of its general elections from 1952-1967 followed the proposed line of a simultaneous election where the electorate elected the state assembly and the central government representatives.

The need for simultaneous elections was also brought up by The Law Commission of India in its 117th report on Reform and Electoral Law (1999). It will ensure that no government development schemes get halted due to the imposition of Model Code of Conduct as a state enters an election cycle and also the loss of productivity that comes with such an undertaking. It will also drastically reduce the manpower and resource deployment needed for conducting elections.

There are of course many hurdles that need to be sorted before achieving the said results. Political consensus among different political parties remains the biggest challenge and this initiative also requires a constitutional amendment which may be subject to judicial inquiry.

Despite all of this, Narendra Modi may very well be able to walk the talk. The Lok Sabha election in 2019 may turn out to be a mini showcase of simultaneous elections, with a few variables of course. There are five states slated to go into polls alongside the Lok Sabha general elections. These states are –

  1. Andhra Pradesh goes to poll tentatively on- 18.06.2019
  2. Arunachal Pradesh goes to poll tentatively on 01.06.2019
  3. Odisha goes to poll tentatively on 11.06.2019,
  4. Sikkim goes to poll tentatively on 27.05.2019 and
  5. Telangana goes to poll tentatively on 08.06.2019.

There are four other states whose elections, if postponed for 6 or lesser, can also be conducted simultaneously –

  1. Rajasthan goes to poll tentatively on 20.01.2019.
  2. Madhya Pradesh goes to poll tentatively on 07.01.2019.
  3. Mizoram goes to poll tentatively on 15.12.2018.
  4. Chattisgarh goes to poll tentatively on 05.01.2019.

There are another three states whose elections, if brought forward for six or lesser, can be conducted simultaneously –

  1. Haryana goes to poll tentatively on 02.11.2019.
  2. Jharkhand goes to poll tentatively on 05.01.2020.
  3. Maharashtra goes to poll tentatively on 09.11.2019.

There are also three states with very unstable assemblies and there is a possibility that they could be dissolved in the future, Jammu & Kashmir, Goa and Tamil Nadu. All three states have a significant influence of the BJP in the incumbent state governments.

All the above stated indicates that there is a chance that India could witness fifteen states going to poll simultaneously with the Lok Sabha general elections in 2019, without any need for constitutional amendments or otherwise.

Five Ways in which Congress tried to divide people in Karnataka

The Congress has ruled for so long and at so many different levels that there is hardly a dirty trick out there that it hasn’t used. But creating a new religion overnight by government flat ten days before the election is announced?

That’s a new one, as far as I know.

Politics is a dirty game. We all know that. But has anybody ever gone this low?

This gambit from Sonia Gandhi’s party may actually have been a first in history. Indeed, I would request experts in political science to find out: has any ruling party anywhere on the planet ever done something like this? Sonia Gandhi’s attempt to divide the people puts the British to shame.

Here is a brief look at all the ways in which Congress tried to divide the people during its five-year rule in Karnataka.

(1) The new “doctrine of lapse”: The forcible takeover of Lingayat Mutts

The Congress didn’t start working on a “Lingayat policy” today. Back in 2014, the Congress government introduced the Karnataka Hindu Religious Institutions and Charitable Endowments Amendment Bill. It was a draconian bill under which the government could just take over any Hindu religious charity that it suspected of some form of malpractice or corruption at some level.

The Bill was obviously aimed at breaking the power of Lingayat Mutts in Karnataka. Also notice that only Hindu religious institutions were to be placed under this repressive act, reinforcing the status of Hindus as second class citizens in the state.

But the furore around the Bill was such that the government had to back down and withdraw it.

(2) Tipu Jayanti and the insult to Kempe Gowda

After Lingayats, it was the turn of the Vokkaligas to be kicked in the teeth by the Congress government. In order to pander to the Muslim voter, the Karnataka Government created a whole new thing called “Tipu Jayanti”  and organized big celebrations around it.

Muslims didn’t ask for Tipu Jayanti to be celebrated. In fact, Islamic practice is generally suspicious of “Jayantis,” seeing the practice of celebrating birthdays as vaguely un-Islamic. Saudi Arabia, for instance, does not even celebrate the birthday of Prophet Mohammad.

But this was not about Islam. This was about the Great Divider of Indian politics trying to pamper Muslim egos and show Hindus their place. Not surprisingly, the government could not even find solid references for the precise birthday of Tipu Sultan. It wasn’t about birthdays: it was about votes.

And so a grand celebration of Tipu Jayanthi was held across Karnataka. At the official celebration in Vidhana Soudha, Mr Girish Karnad declared that he would rather have named Bengaluru’s Kempe Gowda International Airport after Tipu Sultan.

What’s the calculation here? You see in the Old Mysore Region from where the Congress draws the most seats, its main opponent is JDS, not BJP. The JDS’ vote base consists of Vokkaligas (essentially Gowdas) and Muslims. So what does a typical Congress intellectual say at the official celebration of Tipu Jayanti in Vidhana Soudha? He tries to make an issue out of comparing Muslim ruler Tipu Sultan with legendary Gowda ruler Kempe Gowda, the builder of Bengaluru.

Who gains if the Muslims break with the Vokkaligas of Old Mysore Region? Now you get it.

(3) Mahadayi waters and Goa as the enemy

In 2007, Sonia Gandhi announced at an election rally in Margao in Goa that she will not allow the waters of the Mahadayi river to be diverted from the state. At that time, Goa had a Congress government and Karnataka had a BJP supported government.

In 2017, it was the BJP that was in power in Goa and the Congress that was in power in Karnataka. What do you think happened?

Of course, the Congress found an enemy in the people of Goa. It is Modi, Parrikar and the BJP government in Goa that is responsible for North Karnataka farmers not getting water! How could Sonia ji not have realized this while speaking to Goans in 2007?

Recently, a reporter dared to confront Siddaramaiah with Sonia ji’s 2007 pledge to Goa. The Chief Minister had the most democratic-minded response ever to this question: “You don’t understand. Keep quiet.”

(4) “North Indian imports” and Hindi as the enemy

No, seriously, this is an elected Chief Minister tweeting from his official handle:

Untitled.png

First of all, PM Modi is from Gujarat, which is not North India. But it is not like Siddaramaiah doesn’t know his geography. This tweet is a calculated attempt to spread casual xenophobia: a two-nation theory; one nation north of the Vindhyas and one south of the Vindhyas.

And so it was that Siddaramaiah discovered the sudden need for a new Karnataka state flag. After almost sixty years of India being ruled by a Hindi speaking Dynasty from the extreme north (Kashmir), it is during the term of a Gujarati Prime Minister that Congress Party finally discovers how much historical injustice has been done to the South of India. To help Siddaramaiah’s divisive campaign along, the intellectual ecosystem activates and starts feeding the public articles about how the South loses money for every rupee of tax it sends to the Center and how the Northern states get subsidized.

Someone tell Siddaramaiah that his party’s President is from Uttar Pradesh and represents Amethi in Parliament. That family pocket borough is one of the most backward places in the country. Now if taxes from Karnataka are being “diverted” to make up for the development deficit in a place like Amethi, whose fault is that?

Someone tell Siddaramaiah that India has had only one full term PM from the South : P V Narasimha Rao. He was from the Congress. But he did not belong to the Dynasty. So when he passed away, the Congress government in 2004 would not even provide flowers for his dead body. His mortal remains were packed off from Delhi and sent to Hyderabad. He had lived in Delhi for 30 years. But there was no place for him there. If there was ever a moment when the South was humiliated, this was it.

(5) The Lingayats as a separate religion

Remember how I pointed out earlier in the article that in 2014 the Congress tried to crush the Lingayat Mutts. That didn’t work. So Sonia Gandhi’s party unfolded Plan B. This time the plan is to give Lingayats the status of a new religion, a minority, thus breaking them away from the Hindu body. The same Lingayat run institutions that Siddaramaiah tried to crush in 2014 are to be redesignated as “minority institutions,” freeing them from the paws of RTE and a host of other regulatory regimes that apply only to Hindus.

This led to the spectacle of a government in a secular country creating a new religion by fiat ten days before the election was announced. A new low for democracy anywhere.

Campaigning for the Karnataka elections ended yesterday. Thankfully. Who knows what else the Congress would have had up its sleeve? Offering another partition of India? They did it once and reaped a rich harvest for sixty years. Who knows what they are capable of?

Janki Temple at Janakpur Dham, the grand, gorgeous temple at Sita’s birthplace

Prime Minister Narendra Modi arrived in Nepal today on a 2-day visit. He went with his Nepali counterpart PM KP Oli to Jnakpurdham to offer prayers at the Janki Temple.

PM Modi also inaugurated the Jnakpur-Ayodhya-Janakpur bus service there. Hailing tourism as the fastest emerging sector, he added that the bus service will strengthen the age-old ties between the two holy sites for Hindus.

Janakpur is the birthplace of Sita. Located in the Dhanusha district in the Terai region in Nepal, this town boasts of numerous temples, monasteries and artistic centres. It used to be the capital of ancient Mithila kingdom, where Sita’s father, Janak was once king. This town houses Nepal’s biggest temple, the Janki temple, built for its Princess Sita who married Lord Ram at this very town.

The temple, built in a unique style of Hindu-Koiri architecture is a huge complex with the three-storied structure standing 50 metres tall and has 60 rooms. Though ancient temples are believed to have existed on the site, the temple that stands today was built by Queen Vrisha Bhanu of Tikamgarh in 1910. It is said that it had cost 9 lakh rupees at that time. The temple attracts millions of Hindus from all over the world and is in the tentative World Heritage site list of UNESCO.

Built-in bright white and decorated with colourful artwork, flags and paintings, the temple has a stunning view. Lord Ram and Sita are worshipped here.

Ram -Janki temple

A number of festivals are celebrated here. Ram Navami, Chhath, and Bibaha Panchami are the main ones. Bibaha Panchami commemorates the wedding of Lord Ram to Sita and is the biggest festival organised here.

Bibaha Panchami is observed on the Panchami of the Shukla half in the Margasira month (November-December) and the festivities continue for a week. Grand processions with artists and the deities are taken out and the wedding is performed in the temple.

Every corner, every square of Janakpurdham is dedicated to Sita and Ram. The town celebrates its beloved princess till date and every year on Bibaha Panchami celebrates her wedding with all pomp and glory.

PM Modi talked about the connectivity between Ayodhya and Janakpur today. Hopefully, one day Lord Ram’s birthplace in Ayodhya will have an equally glorious temple to welcome the princess of Mithila with equal festivities and pride.

CBI denies confirming rape charges against Kuldeep Sengar, media spreads fake news again

Many leading national dailies today ran the news of the Central Bureau of Investigation confirming Kuldeep Sengar as the perpetrator in the Unnao rape case. The news, seemingly first reported by Times of India then picked up by others, was proved to be a fake news.

The Times of India today ran the headline “CBI confirms rape charges against Unnao MLA Kuldeep Singh Sengar”. The news report can be found here. The report stated that the CBI has confirmed that Kuldeep Sengar raped the victim in his house while his accomplice Shashi Singh stood guard. The report also stated that the CBI has alleged that the UP police had shielded the MLA and his accomplices in the FIR as well as the charge sheet.

TOI circulated fake news
CBI denied confirmation

India Today ran the report with the headline “CBI finds proof against Kuldeep Sengar, cops who helped him in Unnao rape case.

India today claimed CBI confirmation too

The report was also carried by many other media outlets, including Business Standard and leftist propaganda website The Wire.

The Wire carried the fake news of CBI confirmation

However the CBI today issued a press statement denying any such confirmation. The press statement said that the news reported by leading media outlets is false and the investigation in the case was still ongoing. The report also stated that the CBI has not given any update or confirmation in the three cases relating to violence/rape in Unnao and all such stories in the media are purely speculative.

The Unnao rape case was covered widely in the media with many national media outlets continuously alleging that the police and the government are shielding the rapists. Despite the alleged perpetrators being arrested and the state government providing all possible security to the victim and her family, the circle of misleading news does not seem to stop.

Sadly, news outlets are not showing the same kind of hurry to rectify their headlines and admit the mistake as they showed while reporting the fake news of CBI confirmation. At the time of this report being written, out of the four media outlets mentioned here, only India Today has run the correct news report with updates of the CBI statement. It is indeed amusing that Times Of India is now getting into the business of ‘fact-checking fake news makers’ when the daily itself has troubles keeping their facts straight.

Congress cracks down on FoE as it files complaint against a spoof video featuring Rahul Gandhi

0

It seems that the Congress party has decided that it is not going to entertain any of those funny memes and videos allegedly targeting Rahul Gandhi. After getting normal Twitter users suspended and complaining against online streaming channels hosting ‘funny’ videos, the party has now taken the fight to the police.

J.P. Ghamopiya, spokesperson and in-charge in M.P. Congress committee, has filed a complaint against Suresh Nakhua, BJP Mumbai spokesperson, at cyber cell in Bhopal for allegedly mocking and causing damage to the image of members and the Congress party itself.

The complaint mentions that on 3rd May, Nakhua had posted a video on social media platforms of a song with modified lyrics and morphed faces which allegedly mocks and taints the image of the Congress party, especially president Rahul Gandhi, M.P. Congress president Kamal Nath, General Secretary of All India Congress Committee Digvijay Singh, M.P. Congress Campaign Committee Jyotiraditya Scindia and Leader of opposition in M.P. assembly Ajay Singh.

The complaints alleged that the video was being circulated in social media for 6-7 days resulting in the defamation of the leaders and party and should be booked under section 66 of the Information Technology Act. Ghamopiya confirmed to OpIndia that he was offended because of the morphed faces and the lyrics as mentioned in the written complaint.

The video was a spin-off on the ‘3 idiots’ song that featured the Congress leaders including Rahul Gandhi.

[youtube https://www.youtube.com/watch?v=CdHqw4RUIoE]

Though the Supreme Court had asked police officers to be extra careful while dealing with complaints under the IT act, it remains to be seen what step is taken in this case. The video prima facie is just one of those thousands on social media that parodies a popular song. Such videos can be found in abundance covering all political parties, sportspersons, newsreaders etc.

Perhaps the use of the word ‘Pappu’ in the song has offended Madhya Pradesh Congress as earlier, a Congress leader was suspended for using this word in a rather appreciative way.

Read why these three men are undertaking a road trip across 15 states of India

Back in 2013 when the political atmosphere in India was heating up as a run-up to the 2014 General Elections, three friends wanted to know more about Gujarat’s chief minister Narendra Modi and the much talked about ‘Gujarat model of development’. So they took their bikes and in 7 days covered around 3,750 km across Gujarat, covering cities, towns and villages and witnessing concrete roads even in remote areas.

That was in 2013. Much has changed in the political landscape of India. That Gujarat chief minister is now the Prime Minister of India and is now looking at second innings in the upcoming elections. He came to power with a lot of promises. So now, with a year of elections, the three friends have decided to embark on a 15 state tour in the eastern and northeastern states of India to get the on ground report.

‘We have been tracking Modi through media and news reports, but we don’t really know what is happening on the ground. So we decided to go on a ‘governance tourism’. Every momentous milestone will have struggle behind it, we want to know the story behind such milestones achieved.’ said Ashutosh Muglikar, who is undertaking this trip with two of his friends.

‘We want to check whether the electricity has reached, highways have been made, as per claims. Whether the roads are constructed, does it have potholes or are in good conditions or whether the road has not been constructed as per claims,’ said Muglikar.

On a lighter note, we asked about his dog, who makes frequent appearances on his Twitter updates, if he will also be joining him on his expedition. Muglikar laughed and said, ‘he doesn’t eat when I’m not around. So we will do video calls daily.’

Taking time off their professional lives and pitching in the money for the trip, with help of family and friends, the three friends, Ashutosh Muglikar, Maneesh Godbole and Chandrabhushan Joshi, will cover about 8,000 km in 15 days.

PM Modi connects birthplaces of Lord Ram and Goddess Sita as part Indo-Nepal Ramayana circuit

Prime Minister Narendra Modi and Nepalese Prime Minister SP Sharma Oli on Friday inaugurated an Indo-Nepal bus service between Ayodhya and Janakpur, as part of the development of a Ramayana Circuit:

This bus was flagged off after PM Modi offered prayers at the Janki Temple in Janakpur which is believed to be the birthplace of Goddess Sita. This Janki temple was built back in 1910, and all the three stories comprise solely of stone and marble. The Prime Minister is currently on a two-day tour of Nepal from 11 to 12 May. Following the temple event, the PM would be given a civic reception at Barhabigha Rangabhoomi ground.

As reported by Times Now, PM Modi while addressing a crowd at the temple, called the introduction of the bus service connecting the birthplaces of Lord Ram and Goddess Sita as a historic moment. He also informed the crowd that India and Nepal would work towards building a Ramayana circuit. A video of the PM’s temple visit was tweeted out by the BJP:

As per a PTI report, the Ramayana circuit would comprise 15 locations in India including Ayodhya, Chitrakoot, Nashik, Hampi and Rameshwaram.

Going by a Moneycontrol report, this Ramayana circuit is part of a grander tourism plan under the Swadesh Darshan scheme, which comprises of a total 13 such plans, including a Krishna circuit. The Ramayana circuit would retrace the destinations where Lord Ram is believed to have travelled. The development would include extending facilities like accommodation and drinking water to the pilgrims.

If ‘propaganda’ is a symphony, Ram Guha is Beethoven

0

Propagandists in India are prone to tawdry and tacky methods. There is very often no elegance in their methods. No poetry. No finesse. They lie clumsily, their hypocrisy, as bright as day, for all men to behold. The kind of propagandists who use photoshop to morph images and don’t dress their lies up just enough so they don’t get caught. Not Ramchandra Guha. Watching him propagate is like watching poetry in motion. The lies rolling off his tongue like airy butter cookies melting in one’s mouth, his hypocrisy, misrepresentations and half-truths, blending so effortlessly to falsely present a mirage of truth. His nonchalant brazenness that has almost become a part of his charm, only amplified by those Harry Potteresque glasses, albeit rimless, that give him the natural air of nerdy, intellectual superiority.

How can someone not believe a man with his salt pepper, dishevelled, quintessentially “intellectual” look? And therein lies the beauty of his con. Look so immaculately tousled, that every bit of lie and hypocrisy is taken at face value. And lord knows, Ram Guha is a treasure trove of hypocrisy and lies.

Recently, a video surfaced where a citizen was seen visibly angry with a shabby propagandist called Rajdeep Sardesai. The techie questioned Sardesai on his anti-India, anti-Modi slant. Of course, if Sardesai was as good at the art of propaganda as Ram, he would have never been publicly confronted, but that’s for another time. News later surfaced that this unwashed citizen who had dared to question the court jester was ‘detained’ by Bangalore police because let’s face it, how dare the villager assume to have the same levels of Freedom of Expression as the perfumed elite.

Some rejoiced. Some questioned. Among the ones who questioned, was TV Mohandas Pai, who is the Chairman of Manipal Global Education. He was a former director of Infosys.

He dared to speak up.

Ram Guha proceeded to do what he does best. Obfuscate by confusing his readers to an extent that his half-truth starts to appear as the whole truth.

A seasoned propagandist like Ram Guha did two things here. Firstly, addressed Pai by his first name. Mohan. Thereby establishing the obligation that comes with a supposed acquaintance. Secondly, before calling Pai a liar, he slipped in an underhand compliment: “A man of your stature”. Put together, these two tools can work wonders, Establish a personal connect thereby convincing the adversary that he is a friend and doesn’t detest him for his differing ideology (he does) and remind him of his “stature” so he backs off owing either because of the fear of ostracisation or the realisation that the “perfumed elite” aren’t supposed to fight for the unwashed masses, but lofty ideals that may (or may not, most probably won’t) help the unwashed masses.

Owing to his “natural charm” and “stature”, none of the intellectuals and fellow (far less poised) propagandists would dare point out that he was obfuscating facts to justify the harassment of a citizen.

Nobody would remind him that there lies a world of difference between ‘detention’ and ‘arrest’. Police can ‘detain’ someone on mere suspicion without charging him of any crime whereas, when an arrest is made, a person is charged with a crime, seeks bail, and appears in court to prove his innocence. A citizen is held on ‘reasonable suspicion’ for questioning. Now, while detention is legimite in law, nobody bothered to ask why a citizen was detained on “reasonable suspicion” simply for being angry at a public personality and using words to express the same without being abusive, threatening or menacing.

TV Mohandas Pai said the citizen was being ‘detained’. Ram Guha refuted Pai and called him a liar by saying that he had not been ‘arrested’. Both were right. But Ram made Pai look like a bald-faced liar. This example of blatant propaganda was like Beethoven’s fifth symphony. Effortless.

Ramchandra Guha has picked a side and he is sticking to it. People, facts, figures, truth, logic are mere tools. To be used, twisted, abused, as and when it suits the side he has picked.

In the run-up to this brazen lie, Guha indulged in another form of trickery. As any propagandist, he tried his best to maintain the charade of neutrality by praising a fellow intellectual who doesn’t belong to his ideological leaning. Arun Shourie. The ‘right-wing’ intellectual who is credible, in Guha’s eyes.

Just as before, he starts with appealing to the ‘stature’ of the individual he wants to use to aide his propaganda. This time, Shourie. And then progresses to his real agenda. Using Shourie to malign Modi and Shah.

This argument would hold if Guha always held Shourie in high regard. But that is not the case and that is again something a seasoned propagandist like Guha would never reveal.

As pointed out by TrueIndology, this wasn’t the case when Shourie wasn’t serving Guha’s propaganda by speaking out against Modi and Shah. Some excerpts from his essay “The use and Abuse of Gandhi” from his book “An Anthropologist Among the Marxists.”

He had called Shourie a “pamphleteer masquerading as Historian”

via @TrueIndology

He had almost compared Shourie’s nationalism to that of white supremacists.

via @TrueIndology

He had called Shourie a “bilious polemicist and baiter of the minorities”

via @TrueIndology

He had also called Shourie ‘woefully ill-informed’ because Shourie had dared to disagree with Congress and its supporters.

via @TrueIndology

Propaganda is information, especially of a biased or misleading nature, used to promote a political cause or point of view. It is said that only the mob and the elite can be attracted by the momentum of totalitarianism itself, the masses have to be won by propaganda (Hannah Arendt). The ecosystem of the left, that Ram Guha belongs to is a totalitarianist system. It is dictatorial and demands complete submission and subservience to the “cause” it espouses. And for the left, it is extremely easy to have the elite and criminals favour them by their sheer momentum. Look how quickly abusive, criminal and downright stupid people are turned into overnight stars. But to get us, us unwashed masses on their side, it takes a well-oiled propaganda machinery. To subvert the truth. Further the lies. Obfuscate facts. Give people the carrot of being a part of the ‘elite squad’ and the stick of being labelled and called all sorts of heinous names. The subtle fear of being harassed if one doesn’t conform. It is propaganda and propaganda alone that can get the unwashed masses drawn to their totalitarian system.

Ramchandra Guha is a maestro and this propaganda is his symphony.

Congress’ latest allegations against BJP leader Sriramulu have gaping loopholes that cannot be ignored

0

Yesterday, the Congress party launched a last-minute effort to influence the voters with an unverified video where in the BJP leader Sriramulu is allegedly talking about bribes paid to the judiciary. While the veracity of the video is yet to be confirmed, there are multiple loopholes in the allegations of ‘bribing the judiciary’.

It is amusing to see the Congress party believe in an allegation based on four screenshots! Considering the prowess of Congress social media head, a video with subtitles must have been provided.

The video and audio of BTV are of very poor quality. The characters in the video speak Telegu and Kannada intermittently. The channel has not provided any subtitles or translations to the Kannada speaking audience. It has not pointed out the exact spot where the alleged bribe was mentioned. Is this a deliberate omission or just poor quality of journalism on the part of the channel?

https://www.youtube.com/watch?v=Vqg06Xul4KE

The allegations of the Congress regarding the CJI’s judgement are deliberately kept vague. There are no specifics regarding how Reddy brothers have been benefited by the order. In addition to this, there is no evidence of the money trail of the alleged bribe.

Several questions arise regarding this part of the allegation.

  • What does one mean by a favourable judgement?
  • Which part of the judgement was favourable to Reddy brothers?
  • How did CJI’s judgement bailout Reddy brothers from the Hyderabad HC’s judgement?
  • In fact, what was the judgement delivered by CJI Balakrishnan?

CJI Balakrishnan delivered two judgements in relation to the Obulapuram mining company. The first one was on 14 January 2010 and the second one before his retirement (on 10 May 2010). CJI retired on 12th May 2010.

Below are the excerpts from a judgement delivered by CJI related to Obulapuram mining company on 14 January 2010. (emphasis added) :

The State of Andhra Pradesh has filed these appeals challenging the interim order passed by the High Court of Judicature of A.P. at Hyderabad in different Writ Petitions which were jointly heard by the High Court. The respondents herein were granted three leases for mining and there were allegations that the lease/licence holders had extended the mining activities beyond the boundaries of the leasehold properties and that the Central Empowered Committee (for short ‘C.E.C.’) has filed a Report on 19.11.2009 and in the Report it was stated that there were certain violations of boundaries of the lease-hold area.

After the report of the C.E.C, the State Government passed an order stopping the mining operations on 25.11.20090. This order was challenged by the respondents in these two appeals. By the impugned order, the High Court permitted these respondents to go on with the mining subject to certain conditions. The operative portion of the order is as follows :

1) The applicants are entitled to carry on mining operations within the designated mining areas covered by the leased deeds;

2) the applicants shall not carry on mining operations to the extent of the area of about 40 meters towards the Karnataka boundary as pointed out by the Three Member Committee in respect of Compartment Nos.698 and 699 of Bellary reserved forest, pending further orders;

3) the State Government shall be free to identify, demarcate and fix the boundaries of the leased areas after giving notices to the applicants;

4) on such demarcation, if the State Government finds that the applicants have occupied any area beyond the leased areas, it is entitled to invoke its power under Section 21 of the Act, evict the applicants from such unauthorized areas and exercise all the powers vested in it under the said provision, after following the prescribed procedure; and

5) the applicants shall furnish bank guarantee for the entire A stock(iron ore) of 1,95,000 tons, which is said to be lying in their stock yards, at the rate as fixed by the competent authority as per Rules in force, before transporting the iron ore from their stock yards.”

This Court, while entertaining these appeals, granted stay of the impugned order on 17.12.2009.

In the order passed on 10 May 2010, the Supreme Court says the following (emphasis added)

13. On the submissions as having been advanced by learned counsel for parties, we have given our serious thought and deliberations to the same. In our considered opinion, respondent No.1-Company can be allowed to start the mining operation only with regard to undisputed area which neither falls in the State of Karnataka nor would be abutting Karnataka boundary.

It will also not be permitted to do any mining operation in those areas which according to the base Map dated 4.5.2010 Annexure ‘A’ fall within its leased area but may be falling in the leased area of other lessees. To clarify further, we direct that mining operations, if at all are to be carried out by respondent No.1, then it shall be done only and only in the undisputed areas. If they try to encroach upon any other area, then it shall be open for the petitioners to forthwith stop the mining operations of respondent No.1.

This permission is granted to Respondent No.1 to work out equities between the parties but on account of it Respondent No.1 shall not be able to claim any right as the same would be finally adjudicated upon at the time of hearing of the Special Leave Petitions.

In summary, the CJI ordered the state government to evict the Obulapuram mining company from the unauthorized areas. In addition to this, it is following the recommendations of the independent committee that was looking into the illegal mining activities of Obulapuram mining company. The Congress must explain as to how this was favourable to Reddy brothers.

It appears that the Congress is extremely nervous about its prospects on election day. Therefore it might have launched a poorly conceived allegations based on an unverified video. Whether the public will be swayed by such allegations is something that remains to be seen in coming days.

‘The Wire’ lands in trouble again as ‘Sunday Guardian’ Editor threatens to sue for their ‘falsehoods’

The leftist propaganda website ‘The Wire’ might be in a tight spot again, with the Editor of Sunday Guardian threatening to take legal action against the portal for allegedly spreading rumours and falsehood against the daily, SundayGuardian, MD Nalapat and herself.

‘The Wire’, in one of its recent articles, headlined ‘Despite an increasingly censored mediascape, hope for change remains’, had made certain allegations which the Editor of the Sunday Guardian, Joyeeta Basu has strongly refuted and condemned warning ‘The Wire’ with legal consequences.

Atul Dev, a writer working with The Caravan, previously working for The Sunday Guardian said in the article published by ‘The Wire’ – “My first job was at the Sunday Guardian as a feature writer. Towards the end of the year that I worked there, Joyeeta Basu and M.D. Nalapat were killing stories every week that was even slightly critical of the BJP government. To sit in editorial meetings with them was torturous, so I quit. The fake story on Kathua rape that they published in their opinion pages recently came as no surprise to me, it’s the logical conclusion of the prevailing editorial practice in that paper.”

Joyeeta Basu, Editor with the Sunday Guardian strongly refuted these claims. In fact, ‘took offence at such a charge made’. She claimed that ‘The Wire’ did not print the emails she wrote to them, misrepresenting her side of the story and the clarification she had provided.

Dev accused that every page of the features section was screened by Joyeeta Basu before it could be sent to the press by the features team: “So despite our best intentions, we had to engage with their ideas about what is printable and what is not every week”,

Basu, refuting those claims said that as the editor of the paper she was just doing her job and no one should have a problem with that.

This is not the first time that ‘The Wire’ this predicament for itself. Earlier too they had published a report on its website that alleged financial misconduct on part of Piyush Goyal in the transaction related to him selling his investment in a private firm, to the Piramal Group. The Piramal Group had also made a statement on the allegations made by The Wire, calling them ‘baseless’ and ‘devoid of any merit’. Piramal Group, contemplated immediate and appropriate measures, including defamatory action against the ‘malicious article’ published in ‘The Wire’.

The media portal is also fighting a defamation case worth Rs. 100 crores for a report it published against Jay Shah, son of Amit Shah. We had exposed the inaccuracies in that report as well.

Recently, Opindia.com had preemptively busted ‘The Wire’s’ impending hitjob against Finance Minister Arun Jaitley. A source had informed us that ‘The Wire’ was planning to target him, by trying to establish a link between his daughter’s legal firm and scam ridden Mehul Choksi’s Geetanjali Gems Limited.

It is rather concerning that this constant endeavor of sensationalizing stories by ‘The Wire’ is forever escalating. It is time ‘The Wire’ stops doing political hitjobs and starts doing some real journalism. It is perhaps time they understand that real journalism demands to bring out all facets of the story honestly. To have an undying pursuit of truth and facts without casting aspersions, sensationalizing stories and raising conjectures.
