Groping a minor’s breast without ‘skin contact’ not sexual assault: Details of the shocking Bombay High Court verdict

The Bombay High Court in a recent verdict has ruled that groping without skin-to-skin contact is not sexual assault. The Nagpur Bench of the Court said that the act involving a minor would not amount to sexual assault if the accused did not remove the top of the minor or slide his hands under her garment.

The Judge said, “Evidently, it is not the case of the prosecution that the appellant removed her top and pressed her breast. The punishment provided for offence of ‘sexual assault’ is imprisonment of either description for a term which shall not be less than three years but which may extend to five years, and shall also be liable to fine. Considering the stringent nature of punishment provided for the offence, in the opinion of this Court, stricter proof and serious allegations are required.”

“The act of pressing the breast of a child aged 12 years, in the absence of any specific detail as to whether the top was removed or whether he inserted his hand inside her top and pressed her breast, would not fall under the definition of ‘sexual assault’,” Justice Ganediwala observed, before adding, “it would certainly fall within the definition of section 354 of the IPC, which penalises outraging the modesty of a woman.”

The case pertained to an matter from 2016 where the appellant in the current case was accused of taking the minor victim, aged around 12 years, to his house under the pretext of giving her guava and then proceeded to press her breast and attempted to remove her salwar. Her mother, fortunately, reached the spot right then and rescued her daughter.

The Bombay High Court verdict noted that according to the mother, she was told by her neighbour that the accused took her daughter to his house. However, when she asked him about the whereabouts of her daughter, he denied that she was at his house.

“PW-1 (mother) searched for her daughter on the ground floor and then she went up to first floor. The room was bolted from outside. She opened it and found her daughter. Her daughter was crying. She took out her daughter from that room and her daughter narrated the incident that on the pretext of giving guava to her, the appellant brought her to his house and pressed her breast and when he tried to remove her knicker, she shouted. Thereafter he went out, after bolting the room from outside,” the verdict said.

Following the incident, an FIR was registered against the appellant (accused) under Sections 354, 363 and 342 of the IPC and under Section 8 of the POCSO Act. The Special Court in Nagpur, after a charge-sheet was filed by the Police, framed charges against the accused under Sections 361, 354, 342 and 309 of the IPC and under Section 8 of the POCSO Act. The accused was ultimately convicted of the charges against him but was acquitted of the section 309 (suicide) charge against him.

The victim confirmed the series of events. In light of the facts on hand, the Bombay High Court held that “the appellant is acquitted under Section 8 of the POCSO Act and convicted under minor offence u/s 354 of IPC and sentenced him to undergo R.I. for one year and to pay fine of Rs.500/-, in default of fine to suffer R.I. for one month. The sentence for the offence punishable under Section 342 of the Indian Penal Code i.e. six months and fine of Rs.500/-, in default to suffer R.I. for one month, is maintained.”

Karnataka: Big cats in Mysuru zoo to be served chicken instead of beef, here is why

In a major development, the Mysuru zoo has decided to provide chicken to the big cats in the zoo instead of beef. The development comes in the aftermath of the implementation of anti-cow slaughter ordinance by the BJP government in Karnataka.

As per reports, the Mysuru zoo is home to over 35 big cats, including lions, leopards and tigers. Their diet will now be shifted from beef to chicken after beef shops were shut down in the city. The zoo earlier had a requirement of about 350 kg of beef every day. Reportedly, the authorities have already begun feeding chicken to the big cats, although the quantity has been slashed down by 20% due to the high-fat content of chicken.

Veterinary doctors will be supervising the big cats at the Mysuru zoo to track any behavioural or psychological changes, following the change in diet. However, the outbreak of bird flu in the country has raised concerns among the zoo authorities. A disruption in the supply of chicken, amidst bird flu scare, might lead to added financial expenditure. The authorities will then have to feed mutton to the big cats, which is 3-4 times the price of chicken. As such, they are now exploring the option of feeding sea fish to the big cats.

Not much difference in parameters observed after discarding beef from diet

This is not the first time that zoo carnivores are being fed chicken instead of beef. Amidst the Coronavirus lockdown, authorities at the Bengaluru Bannerghatta Biological Park were fed chicken for 3-4 months during the period of April and July 2020. Member Secretary of Zoo Authority of Karnataka, informed that the unavailability of beef led to the change in diet.

Veterinarians took blood samples of the big cats from Bannerghatta Biological Park, who were on a chicken diet, and compared it to the blood samples of the carnivores from the Mysuru zoo, who were on a beef diet. BP Ravi informed, “Though there was not much change in the parameters, a noticeable difference was the weight put on by the Bannerghatta carnivores fed on chicken. So, the veterinarians reduced the quantity of chicken supplied to them.”

Tauseef, prime accused in the sensational Nikita Tomar murder case, in his plea filed in the Punjab and Haryana High Court demanding reinvestigation in the case, has claimed innocence. He has claimed that the FIR was registered against him on behest of Nikita’s family to ‘cover up’ their own act of ‘honour killing. The court has reserved its verdict.

Advocate Mehak Sahni on behalf of Tauseef has claimed that the investigation against him is politically motivated and he is being ‘wrongly dragged’ in the ‘love jihad’ angle. The lawyer claimed that the man who shot Tomar, had his face covered and anyone could have used the number plate, which has been used as evidence to zero in on Tauseef.

Nikita Tomar murder

In October 2020, a 21-year-old student Nikita Tomar was shot dead in full public view by two men outside the Aggarwal college in Ballabgarh, Faridabad. A video of the gruesome act caught on camera had gone viral.

In the CCTV footage, the assailant could be seen stepping out of his car and pulling out his revolver. Nikita is seen struggling to get free and manages to flee for a brief moment before the accused grabs her again. While Nikita struggles to free herself from the man, he then shoots her in the point-blank range.

The other accused, Mohammad Rihan, can be seen pullng Tauseef back into the car.

Tomar had filed a molestation complaint against Tauseef few months prior to her murder. However, the family later dropped the case. Her family has alleged that Tauseef started hounding her again and pressuring her to embrace Islam.

According to reports, Tauseef is the grandson of Kabir Ahmed, a Congress leader who was elected as an MLA from Haryana’s Nuh constituency in 1975 and from the Tauru constituency in 1982. He continued to be Khanpur and Raisika village sarpanch for almost 20 years. Khanpur and Raisika are located in Nuh Tehsil of Mewat district in Haryana.

Moreover, Tauseef’s late uncle Khurshid Ahmad was a Congress MP of Haryana and was an ex-Cabinet minister of Haryana. Khurshid Ahmed’s son and Taufeeq’s cousin brother Aftab Ahmed was elected as MLA from Nuh, Mewat on the ticket of Congress Party and has been a Minister as well.

Republic TV hits back at Times Now over TRP manipulation scam, alleges political-media conspiracy to target Arnab Goswami

A day after Times Now threatened to sue nodal TRP measuring body, Broadcast Audience Research Council (BARC), over its supposed inaction against Republic TV for manipulating data, the latter has now debunked all allegations levelled by Times Now.

In a statement, Republic TV hinted at a large political conspiracy against its Editor-in-Chief Arnab Goswami and exposed attempts made to tarnish the image of the news organisation. While addressing the issue of Whatsapp chats leaked by the Mumbai Police, Republic TV said, “…there is not one line, suggestion or shred of evidence in these purported WhatsApp chats which contain any wrongdoing or TRP manipulation by the Republic Media Network.”

Besides, the news channel also rubbished the allegations of bribery by emphasising that not a single sentence in the chats support the claims. While threatening legal action, Republic TV stated, “TIMES NOW has led a group of media which has tried to attribute statements by a third party to Mr Arnab Goswami. The Republic Media Network believes there is a commercial conspiracy behind this and intends to take the strongest legal action against these “journalists”, who will be made responsible for every word and every falsehood they have uttered.”

Whatsapp chats expose data manipulation by Times Now

Republic TV said in its statement that the Whatsapp chats expose the misuse of landing pages by Times Now. Quoting an excerpt from the chats of Arnab Goswami, dating back to July 6, 2017, it said, “just bringing to your attention Gujarat 10-75 lac market growth in time spent from 2 min to 18 min and impressions up by 763% for Times Now seems suspicious.”

The news network further pointed out that the ratings of Times Now fell, following the implementation of the Outlier policy of BARC. Republic TV said that since Times Now used landing pages to artificially increase the ratings, it was cleaned by the computerised process used by BARC. “It shows that the reduction in TIMES NOW’s numbers was a result of the implementation of the Outlier Policy by BARC and NOT as a result of any TRP manipulation,” Republic TV reiterated.

The news channel emphasised, “The algorithmic implementation of the Outlier Policy came in the way of TIMES NOW’s rampant use of landing pages to shroud the reality that the channel was desperate to counter Mr. Arnab Goswami’s popularity by paying large amounts of money across India through landing pages.” It also added, “Therefore, it is clear that TIMES NOW is angry that their use of landing pages and other inappropriate action was exposed to both BARC and to the nation by the Republic Media Network. TIMES NOW should ask itself how far will it go to conceal facts, misreport realities, breach journalistic ethics, and perpetuate falsehoods.”

Nexus between Lutyens media, Congress and Times Now

In its statement, Republic TV accused Times Now of covering up key facts of the BARC Forensic Report, which has categorically named a Hindi news channel of pre-fixing the TRP ratings in collusion with some BARC officials to retain No.1 spot in the Hindi news genre. “Interestingly, the Hindi news channel which has been found guilty of conspiring with BARC officials to pre-fix ratings is part of a Lutyens industry cartel along with TIMES NOW,” the statement read.

Accusing Times Now of selectivity and keeping its viewers in darkness, Republic TV said, “It is, therefore, clear that TIMES NOW has only acted with malice, in breach of journalistic ethics and in contravention to all due expectations from a media house, with the sole motive to prejudice the minds of Republic TV’s viewers and the public at large, to settle a personal score, commercial gain and vengeance.”

Hinting at the ‘political nexus’ between Republic TV and There is open collusion between Times Now and the Congress Party, and others in the media industry, goaded on by the personal animosity these people have against Mr. Arnab Goswami, for his courageous but uncomfortable stands on matters of public importance. Republic TV, therefore, requested the Competition Commission of India to investigate collusion in the media industry and selective targetting of Arnab Goswami.

Times Network contemplates suing BARC

Amidst the ongoing controversy surrounding the fake TRP scam, Times Network has announced that it is contemplating legal action against the nodal TRP measuring body, BARC (Broadcast Audience Research Council). The new development comes days after Navika Kumar went on an emotional monologue about Republic TV Editor Arnab Goswami.

In a statement, it claimed that ever since the launch of Republic TV in 2017, Times Network has been suspecting foul play by its competitor channel through the illegal use of multiple LCNs (Landing Channel Numbers). The channel alleged that Republic TV has been engaging in ‘large scale manipulation of ratings’.

“We also found significant abnormalities in Market wise ratings of that channel clearly indicating ground level tampering and/or deliberate intervention at the raw data level to favour them,” it claimed. Times Network further alleged that BARC has been indifferent to the complaints raised by the channel against republic TV for almost 2 years, resulting in no resolution.

Tamil Nadu: Income Tax officials unearth unaccounted wealth of Rs 120 crore, 4.5kg gold during raids on Christian Evangelist Paul Dhinakaran

The Income Tax Department has seized gold weighing 4.5 kg and detected unaccounted income of Rs 120 crore from the raids it carried out at the premises of Tamil Nadu-based Christian evangelist Paul Dhinakaran.

According to the reports, the IT authorities wrapped up the three-day-long raids at the residences and offices belonging to prominent evangelist Paul Dhinakaran, who runs Christian evangelist organisation ‘Jesus Calls’ ministry.

During the raids, the officials unearthed unaccounted wealth amassed by Paul Dhinkaran to the tune of Rs 120 crore and also recovered 4.5 kg of gold from his residence.

“The gold was found at Paul Dhinakaran’s residence,” said from the Income Tax department as quoted by The Hindu. The tax sleuths are also looking at his companies and trusts situated across 12 countries, including Israel, Singapore, the UK, and the USA.

“They have over 200 bank accounts,” the IT officer pointed out.

On January 20, the Income Tax department conducted raids at 28 locations in Chennai, Coimbatore and other places connected to controversial Christian Evangelist Paul Dhinakaran and his Christian missionary organisation ‘Jesus Calls’.

The Income Tax sleuths had raided 28 premises associated with Dinakaran, including the ‘Jesus Calls’, an organisation run by Evangelist Paul Dhinakaran that preaches Christianity across Tamil Nadu. The IT raids were conducted based on complaints of tax evasion and foreign funds irregularities against Dhinakaran and ‘Jesus Calls’.

Paul Dhinakaran, the son of the late televangelist DGS Dhinakaran, has a large follower base among Christians in Tamil Nadu and runs several organisations.

At 1:00 AM on January 24, ‘Pakistan Zindabad’ slogans were allegedly raised at Delhi’s Khan Market metro station. The slogans cautioned the locals, after which a complaint was filed at the Tughlaq Road police station. The Delhi Police immediately got into action and picked up six people, including two men, one minor and three women, in connection to the incident.

During the initial interrogation, the Police found out that the group was racing bikes, and they were calling each other by the name of the countries, including Pakistan. As per a report published by news agency ANI, the Police said that the slogans were raised in a “lighter vein.” The group alleged that they were raising names in a lower voice, but some people heard them and called the Police.

In its statement the Police said, “Tughlaq Road police station received a PCR call that slogans of ‘Pakistan zindabad’ have been raised near Khan Market metro station. Reaching the location, police found 2 men, 3 women and a teenager on the spot with blue Yulu bikes. On questioning, it was revealed that two families along with their child had come for sightseeing around India gate and had rented e-bikes. They started racing on e-bikes and had kept each other’s name based on different countries including Pakistan. Further, while cheering they had said ‘Pakistan zindabad’ in a lighter vein.” Further investigation is underway.

Left-liberals, assorted trolls express their sympathy for scam convict Lalu Prasad Yadav, demand immediate release of ‘champion’ of secularism

On Saturday, Rashtriya Janata Dal (RJD) leader Lalu Prasad, a convict in a multi-crore fodder scam, was shifted to Delhi by air ambulance as his health deteriorated while undergoing treatment at RIMS hospital in Ranchi.

As former Bihar Chief Minister Lalu Prasad Yadav was airlifted to Delhi, the left-liberals, the trolls associated with the opposition parties and the self-proclaimed journalists shed their tears by sympathising for the scam-convict politician and demanded his release even as the courts have convicted him for amassing massive wealth by misappropriating public money.

The left-liberals, who are very much fascinated about the ‘secular’ credentials of Lalu Prasad Yadav, projected the scam-convict as some ‘messiah’ and a champion of developmental politics to insinuate that his conviction in the multi-crore scam is nothing but political vendetta. Amusingly, the usual propagandists on the social media platforms descended on Twitter on Saturday to blame the Modi government for deteriorating health conditions of Lalu Prasad Yadav.

Rohini Singh, an employee at the far-left propaganda portal ‘The Wire’, did not waste the opportunity to target the Modi government over Lalu Yadav’s conviction in the multi-crore fodder scam. Singh, who almost spends her time spreading false propaganda on Twitter, claimed that Lalu Yadav was a ‘rare’ politician who refused to bow down before PM Modi and BJP and hence he was in such situation today.

According to the likes of self-proclaimed Singh, Lalu Prasad Yadav conviction by the courts was not because of his role in looting the public money in the fodder scam but for standing against PM Modi and the BJP.

Jignesh Mevani, an elected representative himself, celebrated and praised corrupt leaders like Lalu Prasad Yadav for ‘saving’ India from sinking into the politics of hate for decades.

According to Mevani, Lalu Yadav gave voice to India’s backward castes and the poor. Calling the convict Lalu Yadav a political prisoner, the Gujarat MLA demanded the former Bihar Chief Minister’s release.

Hailing the champion of ‘secular’ politics – Lalu Prasad Yadav for arresting BJP stalwart Lal Krishna Advani during the Ayodhya Rath Yatra at Bihar’s Samastipur in 1990, Congress leader Hitendra Pithadiya claimed that Lalu Yadav is currently serving the punishment for bravely stopping the Manuwadi chariot of Sangh and BJP during the Rath Yatra.

Another Twitter account – Indian Muslims, which is known for posting Hinduphobic content on Twitter, also joined the social media campaign to demand the release of scam-convict Lalu Yadav. Sharing a video of a speech made by Lalu Yadav made before arresting LK Advani’s Rath Yatra in Samastipur in Bihar, the Twitter handle ‘Indian Muslims’ hailed the former Bihar CM of stopping the ‘communal’ forces during the Advani’s Rath Yatra.

Unsurprisingly, troll masquerading as a ‘Dalit activist’ – Meena Kandasamy, who has a history of making abusive casteist rants against upper caste communities, too joined the bandwagon to praise the scam-convict Lalu Yadav. Demanding the release, Kandasamy claimed that Lalu Yadav was one of the few politicians who had the foresight and spine to stop Hindutva in its tracks three decades ago.

In an act of absolving the crimes of Lalu Yadav in the name of secularism, the propagandists like Meena Kandasamy claimed that Lalu Yadav was consistently on the side of social justice and secularism.

It is rather shocking to see the audacity of left-liberals and the media ecosystem to whitewash the crimes of a man, who is considered to be not only one of the most corrupt leaders in the country but also someone who was known for practising extreme minority appeasement during his rule in Bihar, that devastated the state’s growth prospects forever.

However, the left-liberals continue to hail and celebrate Lalu Yadav for his the so-called ‘secular’ credentials and tries to portray him as some sort of ‘social justice’ hero despite the fact that his tenure as the Chief Minister of Bihar was one of the worst phase of country’s politics that plunged the state into further more poverty and deprivation.

For the ‘liberal-secular’ ecosystem, it does not matter whether Lalu Yadav is corrupt or unethical, as long he furthers their political narrative against the current political establishment in the country i.e., BJP. As Lalu Prasad Yadav and his party RJD’s political future is wading into dark, the ‘liberal-secular’ industry have now resorted to a new political theatrics to sympathise for the cause of Lalu Yadav by referring to him as a ‘political’ prisoner and are demanding his release.

Uttar Pradesh: Per capita income crosses Rs 70,000, says CM Yogi Adityanath, hails ‘Atmanirbhar Bharat’

On January 23, Chief Minister Yogi Adityanath, Uttar Pradesh, inaugurated 24th Hunar Hat Avadh Shilpgram in Gomtinagar Extension. He said that the per capita income in the state has increased from Rs 45,000 to more than Rs 70,000 annually.

CM Yogi said as India is becoming ‘Atmanirhbhar’ (self-reliant), per capita income is increasing. He said, “During the pandemic, we produced sanitizers in sugar mills and distilleries to fulfill the needs of the state. UP sent sanitizers to other states as well. Before the pandemic, we used to import PPE kits from China. We encouraged local manufacturers, and they started producing PPE Kits and face masks which were used in the state and sent to other states as well.”

Per capita income increased in Uttar Pradesh

CM Adityanath said that the per capita income in Uttar Pradesh had been continuously increasing. In the last three years since the Yogi-led BJP government came in power in the state, the income has increased from Rs 45,000 to over Rs 70,000 annually. As per a report [PDF] published in February 2020, the per capita income in UP has increased from Rs 32,000 in 2011-12 to Rs 66,500 in 2018-19. There has been a constant increment of approx Rs 5,000 since Yogi Adityanath became Chief Minister of the state.

Anti-farm law protestors storm into the hotel of actress Janhvi Kapoor, disrupt the shooting of ‘Good Luck Jerry’ yet again

Two weeks after a large group of anti-farm law protestors gheraoed actress Janhvi Kapoor while she was shooting for her upcoming film Good Luck Jerry at Bassi Pathana in Punjab, the protestors had yet again invaded a shooting venue in Patiala, reported The Times of India.

As per reports, ‘protestors’ reached the venue and began sloganeering against the shooting of ‘Good Luck Jerry’ in Patiala. They demanded that the actress Janhvi Kapoor came out of her hostel and show support for their anti-farm law agitation. While making an ’emotional appeal’ that issues pertaining to the agriculture sector affect everyone, they demanded that Janhvi and other Bollywood actors show solidarity with their cause.

Reportedly, the anti-farm law protestors not only trespassed into the shooting venue but also forcibly made their way into the hotel premises, where the cast and crew were lodged. The shooting for the upcoming movie had to be stalled for a day, owing to the ruckus created by the so-called farmers. They also complained to the media that they ‘disagreed’ with the silence of the Hindi film fraternity over the issue and warned that they would continue disrupting film shoots in the city of Patiala.

Protestors bully Janhvi Kapoor into giving an opinion about farm laws

Earlier on January 11, a large group of protesters gheraoed the actor and her crew demanding her opinion on the farm laws. Balwinder Singh, SHO, said that the protesters halted the shooting and told the workers and Director that Bollywood actors have neither said anything in support of the farmers’ protests nor made any comment. “When Director assured them that Janhvi Kapoor will make a comment on the protest, then they went back. The shoot is going on.”

As per the reports, the protesters allegedly said that they would allow shooting only if Jahnvi Kapoor makes a statement in favour of the so-called farmers sitting on the Delhi borders. They left the shooting location only after Janhvi posted an Instagram story in which she wrote, “Farmers are at the heart of our country. I recognise and value the role that they play in feeding our nation. I hope a resolution is reached soon that benefits the farmers.”
