A week after Bombay High Court dismissed FIRs filed against foreign Tablighi Jamaatis booked under the various provisions for violating their tourist visa, one of the two judges of the bench has now disagreed with certain observations made by his fellow judge who had claimed that action against the foreign nationals was an “indirect warning to Indian Muslims” for protesting against CAA, reports Indian Express.

Justice Mukund G Sewlikar, one of the two judges who delivered the judgement on foreign Tablighi Jamaat members on August 21, has now written a dissenting note against the observations made by the senior judge on the bench – Justice Tanaji V Nalawade.

Justice Sewlikar, on Thursday, in a separate order, said that while he agreed with Justice Nalawade on quashing the FIRs, however, he had differing views on a few observations made by the fellow judge.

Disagreeing with his fellow judge, Justice Sewlikar in his dissenting order on August 27 said that it was difficult to concur with these observations as allegations in this respect are neither made in the petitions nor there is any evidence in this regard.

“Therefore, in my opinion, these observations are outside the scope of the petitions,” the judge observed.

Maintaining that he agreed with all observations made by Justice Nalawade except the one pertaining to CAA protests, Justice Sewlikar said that since none of the offences could be proved by the prosecution, the chargesheets against the petitioners deserved to be quashed.

Action against Foreign Muslims created fear in the minds of Muslims: Justice Nalawade

Linking the Tablighi Jamaat case to anti-CAA protests, Justice Tanaji V Nalawade had opined that action against the foreign nationals, who had attended Nizamuddin Markaz in Delhi, had created a fear in the minds of Muslims. The Bombay HC judge had claimed that such action indirectly gave warning to Indian Muslims that action in any form and for anything can be taken against them.

In the 58-paged judgment quashing FIRs against foreign Tablighis, Justice Nalawade had observed, “There were protests… at many places in India from at least prior to January 2020. Most of the persons (who) participated in the protests were Muslims. It is their contention that the Citizenship (Amendment) Act, 2019, is discriminatory against Muslims…They were protesting against the National Register of Citizens.”

Continuing to link Anti-CAA protests with Tablighi Jamaat case, Justice Nalawade added, “It can be said that due to the action taken, fear was created in the minds of those Muslims. This action indirectly gave warning to Indian Muslims that action in any form and for anything can be taken against Muslims. It was indicated that even for keeping contact with Muslims of other countries, action will be taken against them. Thus, there is a smell of malice to the action taken against these foreigners and Muslim for their alleged activities. The circumstance like malice is an important consideration when relief is claimed of quashing of FIR and the case itself.”

On August 21, the Bombay High Court dismissed FIRs filed against foreign nationals booked under the various provisions for violating their tourist visa conditions by attending the Tablighi Jamaat congregation at Nizamuddin in Delhi.

The Aurangabad bench of the Bombay High Court, hearing a petition filed by 29 foreign nationals noted that Maharashtra government had acted under political compulsion and police also did not dare to exercise powers given to them under provisions of procedural laws and substantive laws.

Launching a scathing attack on Maharashtra government, the Aurangabad bench of the Bombay High Court had observed, “A political government tries to find the scapegoat when there is pandemic or calamity and the circumstances show that there is probability that these foreigners were chosen to make them scapegoats”.

Hearing the arguments, the Bombay High Court bench had said that there was no violation of visa by foreign Tablighis as there are no restrictions on foreigners for visiting religious places and attending normal religious activities like attending religious discourses.

The court noted that the allegations against Tablighi Jamaat very vague in nature and from these allegations it cannot be said at any stage that they were spreading Islam religion and there was the intention of conversion.

Another fellow judge had dissented against Justice Nalawade in the past

Interestingly, this is not the first time that a fellow judge has expressed his dissent against the judgement delivered by a bench comprising of Justice Nalawade.

In October 2019, another senior Bombay High Court judge Justice KK Sonawane had strongly dissented with Justice Nalawade while dealing with pleas alleging misappropriation of funds. Justice Sonawane had called the decision an outcome of a “lack of consultation and coordination”.

Justice Sonawane, in his dissenting judgement, had noted that the judgement delivered by Justice TV Nalawade in the same case was made in a “very cryptic” and “obscure manner” by simply declaring that “both petitions are allowed”.

The Supreme court too had repatriated this particular case back to the Aurangabad bench of Bombay high court asking it to pass an order that can be understood.

Unable to understand the order written by Justice Nalawade, the Supreme Court in its order has said, “On perusal of the impugned order, we find it is unintelligible and we could not decipher what has been decided by the High Court”.

Sadak 2 stars Alia Bhatt, Sanjay Dutt and Aditya Roy Kapoor in lead roles and is a sequel to the 1991 movie Sadak. The movie marks the directorial comeback of Mahesh Bhatt, who took to direction almost after 2 decades. According to Krishna, he has been subjected to abuses, threats of violence and death by Anand for simply asking for an appraisal and turning down his request to write negative things about Modi government on the social media websites.

“You are an insect and I will do whatever I wish to. I will give responsibilities to donkeys and promote them because their ideology matches with mine. However, I will bring you to the streets and ruin your family. If you don’t mend your ways, I will beat you with shoes and get you murdered. Your corpse will be eaten by dogs. Neither Modi nor BJP will come to your rescue,” Panini Anand had reportedly threatened Krishna.

According to the journalist Ram Krishna, this conversation happened when he had called Anand one night, asking him why was he being removed from the Whatsapp group. When people tried to oppose such unethical activities, they were threatened with dismissals and death threats.

Those who did not, their promotions were stalled and appraisals deferred.

Krishna also recalled about the incident when his colleague was not denied leaves even when his health deteriorated. It was later revealed that the journalist had coronavirus, which led to his death. Krishna feels profoundly sorrowful for his colleague’s predicament, adding that he worked till a few days before his death.

Panini has also been accused of making false promises by Krishna. The journalist claimed that after his promotion and appraisal were stopped, he had managed to grab a new job in another organisation. However, Panini coaxed him into staying at AajTak, promising him that he will get appraisal and promotion. A lot of time passed after that, but there was no increment in his salary. When he asked again, he got the answer that unless you please Vijay Rawat (Senior Assistant Editor), it is unlikely that he will get an appraisal.

He alleges that anyone who does not conform to the ideology of the editor and senior assistant editor at the organisation, is persistently harassed such as forced to work in odd shifts, asked to accomplish pressurising tasks etc.

Refuting the allegations on himself, Panini Anand alleged that Ram Krishna was fired from AajTak due to indiscipline and carelessness in his work. “All the accusations made by Ram Krishna in this story are baseless, gibberish and unprecedented, and these hold no truth whatsoever. While firing him the organisation took care of the due process. The words spread out by Ram Krishna are malafide and targeted. Editor has only provided help and encouragement during this time. These kinds of accusations are baseless and unfortunate,” he said in a statement.

BJP leader Tajinder Pal Singh Bagga staged a protest against the AAP government in Delhi alleging food grain scam. Bagga has said that Delhi CM Arvind Kejriwal and AAP’s Hari Nagar MLA Rajkumari Dhillon are involved in the scam, and demanded resignation of the MLA.

According to the BJP leader, the AAP government has kept thousands of tonnes of food grain locked in the classrooms of the Pratibha Vikas Vidyalaya located in the Mayapuri Road in Hari Nagar in the national capital. He said that the food grains were meant to be distributed among the people during the lockdown, but it was not distributed and kept locked in the school building.

Tajinder Pal Singh Bagga has shared videos showing sacks of food grain kept inside the school, shot through the windows of classrooms. He said that thousands of tonnes of food grains are rotting in the school premises. He also said that the rooms are locked, and the school principal said that the rooms can’t be unlocked without the permission of food permission. The authorities are not allowing media to enter the premises, Bagga informed.

After getting information about the food grain stockpiled in the school, Tajinder Pal Singh Bagga along with other BJP workers visited the school and recorded evidence of the presence of food grains stored there. Due to the ongoing Coronavirus Lockdown, the school is closed, which has been used as a warehouse to keep the food grains by the state government.

After the school administration didn’t allow the BJP workers to enter the classrooms, they sat on a dharna shouting slogans against the AAP government in front of the school. “Kejriwal chor hai” (Kejriwal is thief), they chanted slogans, demanding resignation from the CM and the local MLA. Weeks after the Mumbai Police Commissioner had claimed that the actor Sushant Singh Rajput had searched for words like ‘painless death’, ‘schizophrenia’ and ‘bipolar disorder’ before his death, fresh details have emerged in the case that is contrary to the claims made by the Mumbai Police Commissioner, according to a report by Times Now.

According to Times Now report, the 34-year-old actor had searched for properties, farms in Himachal Pradesh, Kerala and Coorg his death. The investigation into the Sushant Singh Rajput’s laptop by the CBI has reportedly revealed his activities on the internet.

Reportedly, the actor wanted to do organic farming and was in search of farms, properties in these three states.

Interestingly, during an interview recently, Rhea had also talked about how Sushant wanted to shift to Coorg and was thinking about the same.

Assamese TV serial ‘Begum Jaan’ banned temporarily for 2 months after Hindu groups accuse it of promoting ‘Love Jihad’

On Monday, the Assam police ordered a ban on the airing of a contentious TV serial ‘Begum Jaan’ for a period of two months. The said show was being aired on Rengoni TV since July this year, and was facing massive backlash from Hindutva groups accusing it of promoting love jihad.

In its order, the Assam police informed that the ban was imposed under the Cable Television Network (Regulation) Act, 1995 for outraging the ‘religious sentiments’ of a particular section of the society. The police intervention came after one Gunajit Adhikary and Hindu groups such as All Assam Brahmin Youth Council, United Trust of Assam and Hindu Jagran Manch filed complaints against the Assamese TV show for portraying ‘love jihad’.

Cast and Makers of ‘Begum Jaan’ defend show

According to the Preety Kkongana, the female protagonist in Begum Jaan, the serial is about a troubled Hindu woman who is helped by a Muslim man. Besides, Chairman and MD of AM Channel that controls the operations of Rengoni TV, Sanjive Narain, had dismissed claims of love jihad. He said, “Just because a Muslim boy and Hindu woman are the protagonists of the show, they are saying all this. To further their politics, they are making these allegations…If the court provides respite, we will resume (telecast)”.

Preety Kkongana had also filed case with he police alleging that she was receiving rape and death threats, abuses on social media for appearing in the TV show.

Derogatory portrayal of Hindu society, argues civil society and Hindu organisations

However, the civil society at large and Hindu rights organisations have come forward to express their displeasure regarding the content of the show. In a letter addressed to the Tezpur Sadar Thana, a concerned citizen complained about the derogatory portrayal of Assamese culture and the Hindu religion in ‘Begum Jaan’.

The letter pointed out that the show has tried to legitimise and transmit the ‘epidemic’ of love jihad. “I suspect that the makers of the TV show had received funds to create social unrest. As a citizen, I want the show to be banned and an investigation to be initiated against the director, producer, and writer of the show,” the letter emphasised.

According to the state chief of Hindu Jagran Manch, Mrinal Kumar Lashkar, the show did not depict the Assamese culture and the Hindu society in the right manner. “It belittles the Brahmins, in the Assamese society already love jihad is there and this serial can trigger it more,” he was quoted as saying.

When the show was first aired in July this year, the Hindu Janajagruti Samiti ran online campaigns with hashtags such as #BoycottBegumJaan and #BoycottRengoni, demanding a ban on “Begum Jaan’ for allegedly glorifying love jihad.

District-level monitoring committee finds violation of programme code in ‘Begum Jaan’

The Assam police had informed that the complaints against the airing of the show were raised before a district-level monitoring committee. It further stated that the said committee found violation of Programme Code laid under Rule 6 of the Cable Television network Rules of 1994. “The Committee with overwhelming majority has come to a conclusion that the said serial has outraged the religious sentiment of certain section of the society which may lead to breach of peace and tranquillity in the society, unless the telecast of the serial is stopped with immediate effect,” it said in a statement.

Assam Police justifies ban on TV serial

Guwahati Commissioner of Police M P Gupta informed that a show-cause notice has been issued to the makers of Begum Jaan and that they have asked to reply within a month. He emphasised that the temporary ban on the airing of the TV serial was imposed in accordance to Section 19 of Cable Television Networks (Regulation) Act, 1995.

He reiterated that the law provides power to ‘prohibit’ transmission of programmes that are “likely to promote, on grounds of religion, race, language, caste or community or any other ground whatsoever, disharmony or feelings of enmity, hatred or ill-will between different religious, racial, linguistic or regional groups or castes or communities or which is likely to disturb the public tranquillity.” The makers of the TV show have now decided to move the Court, seeking a repeal of the ban.

According to one of the reports shared by the Prayagraj police, her uncle, who has a cloth shop in Allahabad’s Roshan Bagh locality. It is believed that he was the one who had encouraged Heer Khan to participate in the anti-CAA and NRC protest at Prayagraj’s Mansoor Ali Park where she had vociferously spoken against the government and its decision.

Apart from her uncle, the police are also searching for one of her relative who is said to be associated with Jamaat-e-Islami-Hind and also the son of this relative, who is a member of the Student Islamic Organization. According to reports, this father-son duo had radialised Heer Khan and inspired her to pilot her hate-campaign against Hindus, the government and India.

According to reports, the police are also in search of another Heer Khan’s associate of currently lives in Saudi Arabia. He was allegedly arranging for the funds for the vile YouTuber to carry out her a hate-campaign.

Investigations have revealed that the Islamist YouTuber was in regular touch with two Pakistani youths over Whatsapp, besides being in contact with some youths from Saudi Arabia. She also regularly interacted with some youths from Hyderabad, Kanpur, Delhi, a student of Aligarh Muslim University and a Maulana.

We had reported that in the past two years, Heer Khan had participated in many debates, protests and anti-India campaigns organised across the country. The Anti-Terrorism Squad (ATS) and the Intelligence Agency which interrogated the YouTuber before she was sent to custody, also revealed that Heer indulged in spewing hate and venom on the social media after getting inspired by videos of Jaish chief Masood Azhar.

The arrest of the vile YouTuber came on the heels of a massive social media outrage against her for the video she posted on her YouTube channel with many demanding her arrest for the same. The Uttar Pradesh police subsequently lodged an FIR against her and has now arrested her. As per the report, Khan had initially tried to evade the cops.

In a video uploaded on August 23 on a now removed YouTube channel named “Black Day 5 August”, Khan went on an expletive filled rant which included making very derogatory comments against Goddess Sita. In the subsequent video posted the next day, she was seen threatening Hindus with rape and violence. Her vile videos soon went viral on social media sites after which many called for actions against her.

WhatsApp chats of Rhea Chakraborty leads to two drug suppliers, detained and questioned by Narcotics Control Bureau

After the drug angle appeared in the Sushant Singh Rajput’s death case, two men has been detained for involvement in supply of drugs. The Narcotics Control Bureau (NCB) detained the two men for selling marijuana in the Andheri area in Mumbai.

According to reports, the two men used to sale dried flower of the marijuana plant that sells for around Rs 5000 per gram. They allegedly used to sell drugs to actors and artists in the city. Reportedly they used to import drugs from Europe and America through couriers during the lockdown.

An official said, “The suppliers will be placed under arrest on the charge of possessing narcotics. We will be questioning them to find out who all they supplied the contraband to and what was Rhea’s role in this.”

The drug angle in the case had emerged after WhatsApp chats of Rhea Chakraborty with her acquaintances were recovered by the ED where they were seen discussion about the purchase of drugs. A series of WhatsApp messages which was allegedly sent from Rhea Chakraborty’s mobile phone revealed Rhea’s occasional use of drugs like MDMA, marijuana, etc. The chats were deleted and have been retrieved during the investigation by ED. The messages also contained communications with a drug dealer named Gaurav.

After recovery of the messages, ED had informed the same to the NCB, after which NCB had registered a case in the matter and started a probe. ED is probing the money laundering angle in the case.

The CBI, which is probing the main death case, is expected to probe the connection of drug dealers with the film industry in Mumbai.

Taking cognisance of the horrifying viral videos in which a woman was seen brutally crushing a speechless puppy under her feet, the Lucknow police have filed a case against the accused and arrested her.

The action was taken after Ms Kamna Pandey filed an FIR against the accused, Pooja Dhillon, and her husband Raj Dhillon, under Animal Rights Acts and Section 429 (Mischief by killing or maiming cattle) of the Indian Penal Code. The police then filed a complaint against Pooja Dhillon and arrested her from her Lucknow residence.

However, according to reports in the media, the woman and her husband have been able to secure bail in the case.

Video showing a woman torturing a speechless puppy had gone viral on the Internet

Just a couple of days ago, social media websites were awash with horrifying visuals of an innocent puppy being trampled on by accused Pooja Dhillon. In the video, one can see the puppy howl in agony as the woman keeps crushing it.

Another video that has made rounds show the woman (presumably the same person) crushing another puppy at the back of her car. She is accompanied by a man who seems to be giving her suggestions on how to torture and kill the puppy.

The scandalising video had caused massive outrage on social media websites, with users demanding exemplary action against the offender for seeking sadistic pleasure from needlessly torturing a speechless animal.

Months after China refusing to acknowledge the death of People’s Liberation Army (PLA) soldiers who lost their lives during the Galwan valley clash, reports are emerging that provides evidence of Chinese casualty in the recent clash with the Indian troops.

According to M Taylor Fayler, a Chinese expert from the Massachusetts Institute of Technology, one particular image showing the tombstone of a 19-year-old Chinese soldier who died in the “China-India Border Defense Struggle” in June 2020 has gone viral on Chinese social media platform Weibo.

The images of a tombstone of a Chinese soldier in Galwan valley was shared on a military forum in China, which describes details of the slain soldier. The picture identifies the soldier as Chen Xiangrong.

“Tomb of Chen Xiangro. Soldier of the 69316 troops, from Pingnan, Fujian. He sacrificed his life in the struggle against India’s border troops in June 2020 and was posthumously remembered by the Central Military Commission.” read the epitaph, written in Mandarin.

The tombstone also reportedly read that the soldier, who was ‘Killed in Action (KIA) was born in December 2001 and was just 19-year-old.

According to Fravel, the tombstone also reveals information regarding the deceased soldier’s unit. The 69316 unit, mentioned in the tombstone appears to be a border defence company based in Tianwendian near the Chip Chap River valley, north of the Galwan Valley. He added these new set of images provided a narrow glimpse into the Chinese units that were deployed the Galwan River Valley.

Another source close to Fayer also said to him that the unit is part of the 13th Border Defense Regiment. This unit was named as “united combat model company” by the Central Military Commission.

As these images have gone viral on social media platforms in China, the Chinese government has arrested the soldier who put up the photo on the internet.

These are the first set of evidence linking to the heavy casualties PLA troops suffered in the recent skirmish between India and China along the Line of Actual Control (LAC).

However, the Communist Party of China (CPC) and the People’s Liberation Army have remained tight-lipped about the casualties of its soldiers. Most importantly, China is yet to issue any official information regarding the number of casualties it suffered during the Galwan clashes.

China had denied funeral services to its fallen soldiers

Earlier, we had reported on how the Chinese government had strictly denied an opportunity to the family of deceased PLA soldiers to hold a public funeral.

After a severe loss of face for China against India in the clashes along the Line of Actual Control in Ladakh, the Chinese government had reportedly passed strict orders to the family of the deceased PLA soldiers not to hold a public funeral for them as it could reveal details regarding the real losses to the Chinese in the recent clashes along the LAC.

China had failed to accept the fact that its soldiers were killed in the border clash with the Indian soldiers at Galwan Valley. Apparently, the CPC wanted to hide the losses in the incident and present a tough image to the world.

The Chinese Ministry of Civil Affairs has reportedly directed the family members of deceased Chinese soldiers who killed in the Galwan Valley that they should abandon conventional burial services and instead cremate the soldiers in a discreet manner.

The Indian intelligence had revealed that the Chinese side suffered 43 casualties including the dead and seriously injured. Even, American intelligence estimates that 35 of the Chinese soldiers were killed in the Galwan clash.

According to experts, China fears that images of gravestones for its fallen soldiers of the People’s Liberation Army could further stoke those sentiments if spread on Chinese or international social media.

Galwan valley clash

On June 15, the Chinese troops had attacked the Indian troops along the LAC near Ladakh border. The clashes had resulted in India losing 20 of its soldiers.

The fallen Indian soldiers were honoured by the government and their last rites were performed in the presence of government representatives, accorded them the due status of martyrs. PM Modi and the COAS had also visited to meet and speak to the injured soldiers.
