Delhi excise policy scam: CBI files supplementary chargesheet, accuses 5 of hawala transfer of illicit profits

On Thursday, July 14, the Central Bureau of Investigation (CBI) filed second supplementary chargesheet against five accused persons in connection with the Delhi Excise Policy Case.

According to the reports, Rajesh Joshi, the director of Chariot Productions Media Private Limited, joined by Damodar Prasad Sharma and Prince Kumar, as well as Arvind Kumar Singh, a staff member at India Ahead News, and Chanpreet Singh Rayat, are among those charged.

According to the CBI, the accused were involved in the hawala channel transfer of illicit profits of around 44.54 crore to Goa.

On August 17, 2022, the agency had filed a case against then-Delhi Deputy Chief Minister Manish Sisodia and 14 others. The Delhi government’s then Commissioner (Excise), Deputy Commissioner (Excise), Assistant Commissioner (Excise), 10 licensees of alcoholic beverages, and unidentified friends were among the accused.

It appears that there were inconsistencies in the formulation and application of the excise policy and that the licensees received improper advantages, such as the waiver or decrease of the licence fee or the extension of the L-1 licence without authorization.

The agency additionally asserts that the beneficiaries, who made fraudulent entries in their books of accounts for the purpose, expressed the illegal proceeds resulting from these crimes to the public workers in question.

Additionally, the CBI searched in Delhi, Gurugram, Chandigarh, Mumbai, Hyderabad, Lucknow, and Bengaluru, where it later made additional arrests. Sisodia was taken into custody on February 26.

In November 2022, the CBI had filed a chargesheet against seven the accused, including the Deputy Commissioner and Assistant Commissioner of Excise at the time. In April, Sisodia and another three individuals were named in a subsequent chargesheet.

The ED is undertaking a money laundering investigation based on the CBI case and has already attached assets totaling Rs. 128.78 crore. The “proceeds of crime” are said to have been estimated to be worth at least 1,934 crore. Furthermore, the agency has charged five people and arrested 12 suspects.

The now-scrapped excise regime, according to the ED, extended an incredibly high 12% profit margin for wholesalers and nearly 185% profit margin for retailers. Also, favors were extended through cartelization.

Last week, Manish Sisodia, senior Aam Aadmi Party leader and former deputy chief minister of Delhi, filed a petition with the Supreme Court in an effort to overturn a decision by the Delhi High Court that had refused him bail. He had sought bail from court citing his wife’s ill health and his son being abroad.

Jammu and Kashmir: Three migrant workers from Bihar injured in a terrorist attack in Shopian, security forces launch search operation

Terrorists shot at and injured three laborers in South Kashmir’s Shopian on the evening of 13 July, marking the first attack on laborers from outside Jammu and Kashmir in the Valley this year.

Altaf Thakur, the state spokesperson for the Bharatiya Janata Party, denounced the assault on the defenseless non-local workers. He stated, “This reflects the frustration, inhumanity, and cheapness of terrorists involved in the gruesome attack on three non-local laborers who had gone to buy grocery items. Urge police to track those involved in the gruesome act and punish them sternly. Praying for the speedy recovery of all three injured men.”

UPI payments at Eiffel Tower, India’s economic success story and democratic principles: Key takeaways from PM Modi’s address to the Indian diaspora in France

On Thursday (July 14), Prime Minister Narendra Modi addressed members of the Indian diaspora at the La Seine Musicale centre in the western suburbs of Paris in France.

At the very onset of his address, PM Modi emphasised, “Away from the country, when I hear the call of Bharat Mata Ki Jai, it feels as if I have come home. Wherever we Indians go, we definitely create a mini India.”

He added, “Be it climate change, global supply chain, terrorism, extremism, India’s experience in dealing with every challenge is proving helpful to the world.”

“The land of India is witnessing a big change. The command of this change lies with the citizens of India, with the sisters and daughters of India, with the youth of India. Today the whole world is full of new hope and new hope towards India,” he emphasised.

PM Modi said, “I came out of my home with a resolve. Every part of me and every moment of time is dedicated to my countrymen.”

India’s success story

PM Modi pointed out that India is the ‘mother of democracy’ and the country is a ‘model of diversity’. While speaking about India’s economic success story, he said, “You will be filled with pride knowing that India has become the world’s 5th largest economy in 10 years.”

“Today the world believes that it will not take long for India to become a 5 trillion economy,” he added. PM Modi also spoke about the report by the United Nations Development Programme (UNDP), wherein it congratulated India for lifting 415 million people out of poverty in the past 15 years.

While speaking about the G20 Summit, he said, “Today, the world is moving towards new world order. The capability and the role of India is changing fast. At this time, India is the President of the G20 group. It’s for the first time, in a country’s Presidency, that more than 200 meetings are being held across the country.”

UPI revolution in India

“Today 46% of the world’s real-time digital transactions take place in India. I also challenge you that when you come to India next time, come without keeping a single penny in your pocket and just download the UPI app on your mobile phone. You can travel all over India and live without cash,” he emphasised.

PM Modi applauded India’s 24/7 banking service and direct benefit transfer, which has brought about a massive social transformation in the country.

“In France, an agreement has been made for the use of India’s UPI…It will be started from the Eiffel Tower, and now Indian tourists would be able to make payments in Rupees, through UPI, at Eiffel Tower,” he announced.

Enhanced bilateral relations with France

PM Modi informed that owing to enhanced bilateral ties with France, the post-study visa for Indian students has been increased to 5 years from 2 years.

“Very few people know that India and France are working on archaeological missions for a long time. It’s expanded from Chandigarh to Ladakh. Digital infrastructure is another sector that strengthens the ties between India and France,” he added.

Prime Minister Narendra Modi also heaped praise on French footballer, Kylian Mbappe. “He is superhit among the youth in India. Mbappe is probably known to more people in India than in France,” he was heard saying.

The Indian Prime Minister also thanked the French government for paying respect to the Indian soldiers, who fought for the country over 100 years ago.

He said that he was the first member of a French cultural centre, named Alliance française in Ahmedabad, when it opened 40 years ago.

Invest in India and tourism

PM Modi also congratulated the ISRO scientists for the launch of the Chandrayaan-3 space mission. He also urged the world to come and invest in India.

During his address, the Indian Prime Minister called upon the Indian diaspora to encourage French citizens to visit India and discover the richness of the country.

Modi in France: Five-year post-study work visa for Indian students, UPI agreement, and new consulate in Marseille

Prime Minister Narendra Modi during his historic two-day visit to France made several announcements bringing in great benefits for India and the Indians in France. PM Modi announced that Indian students pursuing Master’s degrees in France will now be granted a five-year post-study work visa. Indian students were previously granted a two-year work visa.

PM Modi also announced the opening of a new Indian consulate in Marseille.

“Last time when I came to France, it was decided that Indian students studying in France would be given a 2-year post-study work visa. Now it has been decided that Indian students will be given a five-year post-study work visa,” while speaking to the Indian community at La Seine Musicale in Paris.

It is interesting to note that over the past three years, the number of Indian students studying in France has steadily increased. Over 6,000 people who wanted to study abroad in recent years picked France. It is estimated that around 40% of students are enrolled in master’s programmes, 21% in bachelor’s, and 39% in higher education, including PhD programmes.

Laying emphasis on connecting academicians and professionals to India, PM Modi said, “Friends, there are a lot of people in France who work in academics and research, including professors and teachers. When I encounter academics and professionals from other countries, they often ask how they may relate their knowledge, experience, and experience to India. Let me give you some good news that we have respected these teachers as well. Such friends now have it simpler to study in Indian institutions.”

PM Modi praises India’s growth in UPI

Prime Minister Modi outlined that digital infrastructure is a prominent sector bolstering the partnership between India and France. He also boasted the fact that 46% of worldwide real-time payment transactions take place in India.

“You will be proud to learn that 46% of global online payment transaction takes in India. I urge you all (Indian diaspora in France) to visit India without any cash but only with your mobile phones having the UPI app. You can travel and stay in India without having to spend cash,” PM Modi said.

Interestingly, in the year 2022, India recorded 89.5 million digital transactions. India accounted for 46% of all real-time digital payments made globally in 2022, and its total digital payment transactions exceeded those of the other four top economies put together.

UPI in France

Prime Minister Narendra Modi in a major boost to India’s ambitions in the arena of the digital economy, announced that an agreement is in place for the use of the Unified Payments System or UPI in France.

“An agreement has been made for the use of India’s UPI. It will be started from the Eiffel Tower, and now Indian tourists would be able to make payments in Rupees, through UPI, in Eiffel Tower,” PM Modi said.

It is worth recalling that in 2022, the National Payments Corporation of India (NPCI), the regulating organization that provides UPI services, signed a Memorandum of Understanding (MoU) with Lyra, France’s major online payment system. The UPI payment system is already used in the UAE, Bhutan, and Nepal.

After the agreement announced by PM Modi goes into effect, Lyra Networks’ terminals and machines will accept payments made with UPI and Rupay cards from Indians, making it simpler for Indian tourists and students to pay.

On the invitation of French President Emmanuel Macron, Prime Minister Modi will attend the Bastille Day Parade as a Guest of Honour. This visit also commemorates the 25th anniversary of the India-France Strategic Partnership.

On Thursday, French President Emmanuel Macron bestowed the Grand Cross of the Legion of Honour on PM Modi. It is the highest French honor in military or civilian orders. With this, PM Modi becomes the first Indian PM to receive this honor.

US Senate Committee passes resolution declaring Arunachal Pradesh as an integral part of India

0

The United States Congressional Senatorial Committee on Thursday passed a resolution recognizing Arunachal Pradesh as an integral part of India.

The resolution was passed by Oregon’s Senator Jeff Merkley, Tennessee’s Senator Bill Hagerty, and Texas’ Senator Jon Cornyn. The resolution was cosponsored by Senators Tim Kaine (D-VA) and Chris Van Hollen (D-MD).

The legislation reaffirms that the US recognizes the McMahon Line as the international boundary between China and the Indian state of Arunachal Pradesh. It refused China’s claims that large portions of Arunachal Pradesh are their territory, which is a part of the PRC’s increasingly aggressive and expansionist policies, a media statement said.

“America’s values supporting freedom and a rules-based order must be at the center of all of our actions and relationships around the world—especially as the PRC government pushes an alternative vision,” said Senator Merkley, who serves as the Co-Chair of the Congressional-Executive Commission on China.

“Committee passage of this resolution affirms that the United States views the Indian state of Arunachal Pradesh as part of the Republic of India—not the People’s Republic of China—and commits the US to deepen support and assistance to the region, alongside like-minded international partners,” he added.

Meanwhile, Senator Hagerty said at a time when China continues to pose grave and gathering threats to the Free and Open Indo-Pacific, it’s critical for the United States to stand shoulder-to-shoulder with our strategic partners in the region—especially India and other Quad countries—and push back against the CCP’s broader strategy of territorial aggrandizement that it has pursued in the South and East China Seas, the Himalayas, and the southern Pacific, according to an official statement.

“As tensions between India and China escalate over their shared border, the United States must stand strong in our defense of democracy by supporting a free and open Indo-Pacific,” said Senator Cornyn.
Cornyn said further this resolution would reaffirm that the US recognizes Arunachal Pradesh as “part of the Republic of India”.

‘Focus on your own internal issues, no need to interfere in India’s affairs’: India reacts over EU Parliament adopting a so-called Urgency Resolution on Manipur

On 13th July 2023, the Ministry of External Affairs said in its response to a media query regarding the discussions held in the European Parliament about recent developments in Manipur that the current situation in the northeastern state is an internal issue of India and interference of the European Parliament in the issue is unacceptable. Arindam Bagchi – the official spokesperson of the MEA shared the statement on Thursday 13th July 2023.

The MEA said, “We have seen that the European Parliament held a discussion on developments in Manipur and adopted a so-called Urgency Resolution. Such interference in India’s internal affairs is unacceptable and reflects a colonial mindset.”

The MEA statement further read, “Indian authorities at all levels, including the judiciary, are seized of the situation in Manipur and are taking steps to maintain peace and harmony and law and order. The European Parliament would be advised to utilize its time more productively on its internal issues.”

It is notable that the European Parliament held an urgent debate on the Manipur situation on 12th July 2023 in its current plenary session in Strasbourg. This discussion came just before Narendra Modi’s state visit to France on the invitation of President Emmanuel Macron as the Guest of Honour at the country’s Bastille Day Parade. The discussion was scheduled under ‘Debates on cases of breaches of human rights, democracy and the Rule of Law’.

Pierre Larrouturou, a Member of the European Parliament (MEP) representing the Progressive Alliance of Socialists and Democrats in the European Parliament, took the lead in proposing the resolution titled ‘India, the situation in Manipur’.

A press statement from the Parliament on the passed resolution read, “Parliament strongly urges the Indian authorities to put in place all necessary measures to promptly halt the ethnic and religious violence and to protect all religious minorities. Parliament reiterates its call for human rights to be integrated into all areas of the EU-India partnership, including in trade.”

The statement added, “MEPs also advocate for the EU-India Human Rights Dialogue to be reinforced and encourage the EU and its member states to systematically and publicly raise human rights concerns, notably on freedom of expression, religion and the shrinking space for civil society, with the Indian side at the highest level.”

This is not the first time that some foreign entity has interfered or unnecessarily opined about the ongoing Manipur issue. Earlier, the USA ambassador to India Eric Garcetti pontificated on this issue on 6th July 2023. Eric Garcetti made sanctimonious remarks about the situation in the Indian state. While doing so, Eric Garcetti comfortably ignored how his own country has seen 332 gun attacks claiming thousands of lives in 2023 so far.

The Manipur Violence

Manipur has been burning amid conflict between the two ethnic groups, Meiteis and Kukis. Tensions flared up on May 3 following a ‘Tribal solidarity march’ which was organized against the Meitei community seeking ST status.

Meiteis account for the majority of the Manipur population whereas Nagas and Kukis account for about 40% of the population. About 130 people have been killed in the clash and several have been displaced after their houses were torched and razed.

A detailed analysis of the root causes and on-ground scenario can be read here.

Delhi High Court Bar Association opposes SC collegium’s recommendation to transfer judges, to abstain from work on Monday

0

The Delhi High Court Bar Association (DHCBA) on Thursday expressed its serious concern about the recommendation of the collegium of the Supreme Court of India in terms of which the proposal has been made to transfer Justice Gaurang Kanth, Judge in Delhi High Court to the Calcutta High Court.

Delhi High Court Bar Association unanimously resolves to request its members to abstain from work on Monday, i.e. July 17, 2023 as a token of protest as the said transfer is a rarest of rare case. “Members are requested to co-operate,” resoultion said.

DHCBA passed a resolution in this regard and strongly resents the said recommendation.

Needless to say that such transfer would adversely effect the dispensation of justice on account of consequent reduction of the existing strength of Judges, stated the DHCBA resolution.

It is a matter of regret that while no attention is being paid by all concerned regarding the process of filling up of the existing vacancies in the Delhi High Court, yet the transfer of sitting Judge is being made thereby further reducing the existing strength of Judges in Delhi High Court, resolution said.

Delhi High Court Bar Association requested the collegium of the Supreme Court to kindly revisit the aforesaid recommendation.

The copy of resolution is also sent to the Central Government thereby requesting them to not to act on the said recommendation and instead call upon the collegium to re-consider the aforesaid decision.

Advocate Amit Sahni, Lawyer and Activist said, “Justice Mukta Gupta and Justice Talwant Singh have recently retired. Justice Najmi Wajiri is retiring on July 14, 2023 and considering this, transfer of both Justice Gaurang Kanth to Kolkata High Court and Justice Siddharth Mridul to Manipur High Court as Chief Justice requires reconsideration.”

“The collegium of Supreme Court should have taken note of shortage of Judges in Delhi High Court and such decision should have been avoided for 6 months or till the appointment of new Judges in Delhi High Court,” said Advocate Amit Sahni.
