‘Have already recommended CBI probe in Palghar lynching case’, Maharashtra government tells Supreme Court

On Friday, April 28, the Maharashtra government informed the Supreme Court that it has already recommended a CBI investigation into the case involving the lynching of Hindu Sadhus in Palghar in 2020. In March this year, the Supreme Court had nodded to allow a CBI probe in the case. It is notable the previous Maha Vikas Aghadi (MVA) government led by CM Uddhav Thackeray had submitted an affidavit opposing the CBI probe in the case.

A Supreme Court bench comprising Chief Justice DY Chandrachud and Justice PS Narasimha noted the state government’s novel affidavit that a communication to that effect had already been issued.

The bench disposed of four pleas seeking a CBI investigation alleging that the Maharashtra police probe in the matter was biased. “At this stage, no further direction is required on these petitions in light of the state government’s decision. The petitions are thus disposed of,” the bench said.

Notably, the former MVA government in Maharashtra not only opposed the transfer of the Palghar case but also asked the court to levy a fine on the petitioner, Shashank Shekhar Jha, for wasting the Supreme Court’s time.

Palghar Lynching case

On the night of April 16, the two sadhus and their driver were travelling from Kandivali in Mumbai to attend a funeral in Gujarat’s Surat amid the nationwide lockdown when their vehicle was stopped and a bloodthirsty mob had attacked and lynched them brutally in Gadchinchile village. The brutal lynching had taken place while police officers stood there like mute spectators. In later CCTV footages, it was also seen that the police officials had handed the Sadhus over to the mob.

On April 28, two Hindu persons from Maharashtra were wrongfully detained by the Hyderabad Police after the authorities at Makkah Masjid in the city of Hyderabad complained that the duo had allegedly raised the slogans of ‘Jai Shree Ram’ in the Masjid. Makkah Masjid is considered to be one of the largest historic Muslim places of worship in the city.

According to the reports, three Maharashtrians identified as Anmol, Vishal and Venkat had arrived at the Makkah Masjid as a tourist on Thursday. The Masjid authorities called the police after they allegedly heard the slogans of ‘Jai Shree Ram’ from within the Masjid. The authorities alleged that the three Hindus raised the slogans inside the Masjid premises. The Hussaini Alam police officers were then informed about the matter, after which the police immediately detained two of the individuals and launched a manhunt to nab the third one who went absconding.

However, during the interrogation, the Police confirmed that the men did not raise any slogan but the sound came up from the mobile phone of one of the persons. The Hindus stated that the ‘Jai Shree Ram’ slogan was a ringtone on a phone and it was heard when the phone rang, and they did not shout it. The Police also confirmed that the Masjid authorities mistook the ringtone and alleged that ‘anti-minority’ slogans were raised.

The Masjid authorities also later released a video to confirm that the Hindus didn’t raise the slogan after checking CCTV footage, and therefore no FIR in the case has been filed. “Police say that the boys had ringtone of ‘Jai Shree Ram’ set on their phone. They said that the boys had not raised the slogans. We also then checked our CCTV footage for confirmation but could not find any proof that the boys had raised the slogans,” Masjid superintendent said.

Advocate Neelam Bhargav Ram also confirmed that the two boys who were detained earlier had been released by the police after the preliminary inquiry in the case. Also, SHO Hussaini Alam confirmed to him that no FIR had been registered in the case.

The incident is said to have happened on Thursday, April 27, a day before the Friday prayers at the Makkah Masjid when hundreds of Muslims congregate for the afternoon prayers. Security officers remained intact after the incident at the Mosque which is located in the Charminar area and is a major tourist attraction as well.

Priyanka Gandhi visits protesting wrestlers at Jantar Mantar after Delhi Police filed 2 FIRs against WFI chief Brij Bhushan

On Saturday (April 29), Congress leader Priyanka Gandhi paid a visit to the wrestlers, who have been protesting at Jantar Mantar in the National Capital against Wrestling Federation of India chief Brij Bhushan Singh.

In videos shared on social media, she could be seen interacting with professional wrestlers Vinesh Phogat and Sakshi Malik.

“No one is aware of what is there in the FIR which has been lodged. Why they are not showing it? When these wrestlers win medals we all tweet and feel proud but today they are sitting on the road and not getting justice. All these women wrestlers struggle a lot to come to this stage. And I am not able to understand why the govt is saving him (Brij Singh)?” asked Priyanka Gandhi.

She also sought the ouster of the Wrestling Federation of India (WFI) chief to save the careers of professional wrestlers.

“Whose pressure is on the Delhi Police? Why are the leaders of the opposition being questioned by the same police on hearing the pain of a girl during the Bharat Jodo Yatra, but the pleas of the sportspersons who raise the country’s honour are ignored,” the Congress scion earlier said in a tweet.

Earlier, on Friday (April 28), the Delhi police registered two First Information Reports (FIRs) against the chief of the Wrestling Federation of India (WFI) Brij Bhushan Sharan Singh.

As per reports, the FIRs were lodged at the Connaught Place police station on the complaint of two female wrestlers (one of whom is said to be a minor).

As per reports, Delhi Chief Minister Arvind Kejriwal is also scheduled to meet the protesting wrestlers later in the day.

Gujarat High Court to hear Rahul Gandhi’s plea in ‘Modi surname’ defamation case today

On Saturday, April 29, the Gujarat Court is slated to hear the Congress leader and former MP Rahul Gandhi’s plea against a Surat court’s refusal to give a stay on his conviction in a criminal defamation case. Rahul Gandhi was convicted in the defamation case stemming from his statement about the “Modi surname”.

The matter was earlier brought up by Gandhi’s lawyer P S Champaneri on April 26 before Justice Gita Gopi of Gujarat HC but the justice refused to hear the case by saying, “not before me”. The development came a day after the former MP moved to the High Court. Now, the court of Justice Hemant Prachchhak is slated to hear his case.

On April 20, A Surat court of Additional Sessions Judge Robin Mogera rejected Gandhi’s plea seeking a stay on the conviction. “If such power is exercised in a casual and mechanical manner, the same would have a serious impact on the public perception of the justice delivery systems and such order will shake public confidence in judiciary,” the court had said.

Gandhi petitions the High Court to overturn his conviction on the grounds that it was disproportionately harsh and that losing his Lok Sabha membership as a result has done him irreparable injury.

Rahul Gandhi was convicted and sentenced to two years in jail by the court of Chief Judicial Magistrate in Surat on March 23 for his defamatory comments against people with Modi surname in a speech in 2019.

A criminal defamation case was filed by Gujarat BJP leader Purnesh Modi after Rahul Gandhi in an election rally had asked why everyone with the Modi surname is a thief, mentioning Nirav Modi, Lalit Modi, and Narendra Modi. Gandhi was convicted under Indian Penal Code (IPC) sections 499 and 500 (criminal defamation).

A day after the conviction, the leader was disqualified from Lok Sabha.

BSF personnel are committing atrocities on villagers: Mamata Banerjee once again targets the border guarding organisation in West Bengal

On Wednesday (April 26), West Bengal Chief Minister Mamata Banerjee stirred the hornet’s nest by claiming that the Border Security Force (BSF) personnel have been committing atrocities on villagers in the State.

During a press conference at Nabanna (State Secretariat), she alleged, “I have come to know that BSF personnel are going to villages and harassing people in areas that fall under their jurisdiction.”

“Law and order is a State subject. This is not the work of BSF. If cows go missing, then, they file a case against the Trinamool Congress,” Mamata alleged.

She claimed that the Union Home Minister is responsible for the protection of cows. “How do cows end up in West Bengal from other places? We don’t want such smuggling in our State,” Mamata Banerjee was heard saying.

“Why would you send cows from Uttar Pradesh to West Bengal border and then blame it on TMC for cow smuggling? Is this some kind of a joke? I want to alert everyone about such conspiracies (by the Centre),” she brazened it out.

As per reports, the West Chief Minister also accused the Border Security Force of assaulting and killing villagers and even dumping them on the other side of the international border.

“Don’t allow BSF to enter 50 km of the area beyond the international border in the state because they are entering the village, killing people, and throwing them on the other side. Ask the BSF to take state police in confidence while working on any operation,” she was quoted as saying.

West Bengal CM accuses BSF of conspiring with BJP in elections

On April 17 this year, the West Bengal CM hit out at the Union government for increasing the area of jurisdiction of the Border Security Force (BSF) from 15 km to 50 km.

“Why did they do this? Because they know Panchayat elections are coming and that the new operation limit will cover several villages that will cast their vote. In this way, the BSF personnel can ‘harass’ the voters. They do this anyway,” she was heard saying at about 16:00 minutes into the press conference.

Later, at the 45-minute mark, Mamata Banerjee claimed, “Previously, we used to salute the BSF jawans. But BJP has turned BSF, CRPF ‘political’…The Central government is using them for their political work. They might harass TMC workers so that they cannot go out for election campaigning and do their work.”

“So we will not allow this. We have earlier announced that BSF cannot operate beyond 15 km area from the international border. And West Bengal police will look into it,” she said.

Haryana cracks down on cyber criminals in Mewat, 5000 police personnel conduct raids across 14 villages

On late Thursday (April 27) night, Haryana Police conducted multiple raids in the Nuh district as part of its massive crackdown against cyber criminals. 102 police teams comprising over 5,000 personnel raided 14 villages in Nuh and apprehended 125 cybercriminals or hackers.

Giving details of the raids, Nuh SP Varun Singla said that 65 of the 125 people detained by the police have been arrested. One of those detained is a criminal with a cash reward on his head. There are twenty cases filed against them. “We will seek police remand for them when they are presented in court on Saturday,” Singla said.

He also added that among the arrested youths, three are from Tijara, Rajasthan, and one from Mathura.

During the raids, the police teams seized a sizable quantity of items, including card swipe machines, smartphones, computers, Aadhaar cards, and ATM cards. According to the police, the suspects are being questioned to find out more information.

At a press conference on Friday in Bhondsi, DIG (STF) Simardeep Singh stated that the police had started this operation against cybercriminals on the orders of DGP PK Agrawal.

The crackdown against cyber offenders was carried out by more than 5,000 police officers, including an SP, six additional SPs, and 14 DSPs. The majority of the 31 cybercriminals were found in the Nai village, followed by 25 in Luhinga Kalan, 20 in Jaimat, 17 in Khedla, 20 in Tirwara, and 11 in Aminabad.

In addition to 166 Aadhaar cards, 66 cellphones, 65 fake SIM cards, three laptops, 128 ATM cards, two ATM swipe machines, an AEPS machine, six scanners, and five PAN cards were also recovered by the police. Furthermore, 22 motorcycles, two cars, four tractor-trailers, seven country-made weapons, and two cartridges were also seized.

The 14 identified villages in the Punhana, Pinangwa, Ferozepur Jhirka, and Bichhore areas were simultaneously raided by the police. The drive started at 11.30 pm on late Thursday night.

Khedla, Luhinga Khurd, Luhinga Kalan, Gokalpur, Godhola, Aminabad, Mahu, Gulalta, Jaimat, Jakhopur, Nai, Tirwara, Mamlika, and Papda were among the hotspots for cybercrime that the police had previously identified. A senior police officer stated that over the past two years, uneducated or 12th-pass youths involved in theft, livestock smuggling, and other crimes switched to cybercrime after getting trained.

Delhi: Caught smoking, 2 minors bludgeon 12-year-old classmate to death

Delhi Police on Friday apprehended two juveniles accused of killing their 12-year-old classmate who caught them smoking, in the Badarpur police station area of Delhi.

The body of the 12-year-old boy was found dumped in a drain near a government school in Badarpur, in the national capital. According to Delhi Police, a PCR call was received around 8.20 pm that a body of a school child had been found floating in a drain.

Upon receiving word, a team from the Badarpur Police Station reached the spot. The deceased was identified as a class 8 student of an MCD School.

After the body was medically examined, it was found that the child was bludgeoned to death with a blunt object.

“Further during the investigation, two juveniles studying in the same class were apprehended. During the investigation, it was revealed that the deceased child saw these two juveniles smoking cigarettes on the school premises and threatened to report it to the school authorities. The accused then lured him to an isolated spot and assaulted him, resulting in him sustaining several head injuries that eventually proved fatal,” Rajesh Deo, deputy commissioner of police (DCP)m South East, said.

The police added that both juveniles were apprehended and will be produced before the Juvenile Justice Board.

‘Modi Teri Kabar Khudegi’ slogans raised at wrestlers’ protests at Jantar Mantar after Pappu Yadav used the protests to target Yogi Adityanath

On Friday, 28th April 2023, ‘Modi Teri Kabar Khudegi’ slogans were raised at the wrestlers’ protests at Jantar Mantar in Delhi. India’s ace wrestlers including Vinesh Phogat, Bajrang Punia, and Sakshi Malik are protesting at Jantar Mantar in Delhi against Wrestling Federation of India’s president and BJP MP Brij Bhushan Sharan Singh. The wrestlers have accused him of sexual harassment and intimidation.

A video from the protest site shows anti-Modi slogans raised during the protests by some people. Several people were present today at the protest site. It is seen in the video one of them took up the mic and shouted various slogans. However, the slogans were against prime minister Narendra Modi, not Brij Bhushan Sharan Singh. Others joined him in raising the slogans.

The controversial slogans included “Modi Teri Kabar Khudegi, Aaj Nahi To Kal Khudegi” which means ‘Modi you will be buried, tomorrow if not today’. The person raising slogans also said that if justice is not done, all people from Haryana will come there.

When these slogans were being raised, several wrestlers including Bajrang Punia, Sakshi Malik, Vinesh Phogat, Sangeeta Phogat etc were also present there. However, they didn’t participate in raising these slogans. But when asked about the anti-Modi slogans, some wrestlers defended it, saying that people are angry. Wrestler Sangeeta Phogar said that people are angry against PM Modi for not taking action against Brij Bhushan Sharan Singh over allegations against him. She claimed that everyone present at the protest site is there to support the protesters, not to indulge in any politics.

On the other hand, Vinesh Phogat tried to distance from the slogans, as she said that nobody can dig anyone’s grave, and she does not believe in such thoughts.

However, the slogans were not the first politicisation of the wrestlers’ protests. Politicians have already started to use the protest for their political benefit by using the protests to target the Modi govt. Politician Pappu Yadav, who is accused in multiple criminal cases including allegedly misbehaving with an air hostess and threatening to hit with slippers, today joined the protest at Jantar Mantar and addressed the gathering. More importantly, he targeted and mocked UP Chief Minister Yogi Adityanath in his speech, clearly indicating his objective behind attending the protests.

Former governor Satyapal Malik also joined the protests on 26 April, who have created controversies by making several comments attaching the Modi government recently.

On Friday, 28th April 2023, the Delhi police told the Supreme Court that it is ready to file an FIR against Wrestling Federation of India (WFI) president Brij Bhushan Sharan Singh, amid a second round of protests by several wrestlers demanding action against him alleging sexual harassment. In his initial reactions to this, Brij Bhushan Sharan Singh has said that he respects the court order. 

When asked whether he will resign, the BJP MP has an indirect answer saying that even if he resigns, wrestlers will say that his term was already over and he is doing no favour by resigning. However, he added that he is ready to resign if that will satisfy the protesting wrestlers.

Wrestlers, including Bajrang Punia, Sakshi Malik and Vinesh Phogat, are protesting at Jantar Mantar in Delhi against Brij Bhushan Sharan Singh alleging sexual harassment and intimidation. After the hearing in the Supreme Court, the wrestlers demanded that the WFI president be put in jail and the protest will continue until this happens.

Similar slogans raised in the past

This is not the first time that Modi Teri Kabar Khudegi slogans are raised. On 23rd February 2023, Pawan Khera and other Congress leaders raised slogans against Prime Minister Narendra Modi saying “Modi Teri Kabar Khudegi”. the opponents of the BJP government in the centre and various states have often used the phrase of burying somebody while registering their so-called protests. Many other Islamists have also raised slogans to bury Hindutva in the past few years, especially during the protests against the Citizenship Amendment Act in 2019 and 2020.

A complaint was lodged with the Aligarh police station regarding certain slogans that were chanted against Uttar Pradesh’s chief minister Yogi Adityanath at Aligarh Muslim University. The shocking slogan in the protest in AMU was ‘Yogi teri kabar khudegi, AMU ki dharti par’ meaning “Yogi, you will be buried in the AMU’s soil”. Similarly, AMU students had raised slogans during the anti-CAA protests saying Hindutva, Savarkar, etc. will be buried in AMU.

Now, politically motivated people attending the protests staged by wrestlers have raised “Modi Teri Kabar Khudegi” slogans against PM Narendra Modi at Jantar Mantar in Delhi saying.

The SG’s argument in ‘same sex marriage’ hearing that people will soon demand legalisation of incest is not hollow rhetoric: Here is how it is a real possibility and threat

On Thursday (April 27), Chief Justice of India (CJI) DY Chandrachud chided Solicitor General Tushar Mehta for arguing that recognition of same-sex marriages could raise a defence for incest in the near future.

“Visualise a situation, when a person is attracted to those persons who are mentioned in prohibited relationships. Incest not uncommon in the world and world over it is prohibited,” Mehta submitted.

“Suppose a person is attracted to his sister, can they say we are consenting adults, we’re entering into activities privately and we claim our right of autonomy, choice,” he added.

“Based on that very argument can someone not challenge this definition (of prohibited degrees)? Why this restriction? Who are you to decide with whom?”, the Solicitor General emphasised.

CJI DY Chandrachud was quick to dismiss the possibility and claimed that such an idea is ‘far-fetched.’ Tushar Mehta then pointed out that the argument for the legalisation of same-sex marriage appeared far-fetched at one point.

“…These are all subject to regulation by law. So these are very far-fetched for anybody to even argue before us that orientation is so absolute that I can therefore commit an act of incest. No court will ever countenance this,” he stated.

As expected, the usual suspects pounced on the opportunity to mock and berate Tushar Mehta. Congress loyalist Dr Pooja Tripathi claimed, “Solicitor General just compared incest to homosexuality! The moral and intellectual bankruptcy is for real!”

“Comparing same-sex relationships to incest is morally wrong and disgusting! This comparison is fueled by the belief that only heterosexual relationships are ‘normal.’ These lawyers are in urgent need for education and sensitivity programs. Their words are unbearable,” posted one user.

‘Journalist’ Rohinin Singh tweeted, “Outrageous to compare homosexuality with incest. The government’s lawyer needs to stop arguing like a parochial RWA uncle.” This is despite the fact that the Solicitor General did not compare homosexuality with incest.

Another ‘journalist’ named Maya Mirchandani said, “For the government’s lawyers to use incest as an argument against legalising same-sex marriage is beyond repugnant. Just truly sickening.”

“It is not a legal argument. It is the kind of point that a schoolboy might make up. And it reveals something about his psychological make up that is worrying.
The term is Adelphogamy,” one Twitter user brazened it out.

“Tushar Mehta you spineless M೦ron LGBTQ+ is different from incest,” wrote another Twitter user (@ChekrishnaCk).

Normalisation of incest is not far-fetched

It must be mentioned that just a decade ago, the Supreme Court of India upheld the criminalisation of homosexuality in 2013. But 5 years later, the same apex court struck down Section 377 of the Indian Penal Code (IPC) and decriminalised same-sex relationships.

Fast forward 5 years, and the Supreme Court is deliberating on giving a legal sanction to same-sex marriages. Given the trajectory of the demands, nothing seems to be unprecedented at this point.

It is thus difficult to rule out demands for the legalisation of incest, a hypothetical scenario proposed by the Solicitor General in the apex court on Thursday (April 27).

Attempts have been made from time and again to legitimise sexual relationships between extremely close relatives and immediate family members, on grounds of autonomy, consent and privacy.

As early as September 2014, the German Ethics Council had justified incestuous relationships.”Criminal law is not the appropriate means to preserve a social taboo,” it had said.

“The fundamental right of adult siblings to sexual self-determination is to be weighed more heavily than the abstract idea of protection of the family,” the Council further added in its statement.

Such a proposal was also floated in the Parliament of Switzerland in 2010. “Incest continues to be a taboo in our society, but it’s not up to criminal law to stop every morally reprehensible aspect of behaviour. Rather, the law should be for punishing behaviour that’s particularly socially damaging,” a Justice Department spokesperson had said then.

In April 2021, advocates of such ‘forbidden relationships’ came out in support of a New York parent who wanted to marry his/her own adult child. There is a global campaign to legitimise incest on the ground that two consenting adults must be allowed to live the way they deem fit.

Given the recent arguments about gender, privacy, and sexual autonomy in the Indian Supreme Court, petitions seeking legal sanction for incest are not ‘far-fetched’ five years down the line.

Mukhtar Ansari grabbed temple land worth crores of rupees to build Ansari University, officers fear to take action: OpIndia Ground Report

The Yogi Adityanath government in Uttar Pradesh is taking strict steps against mafias. The crime empire of mafia-turned-politician Mukhtar Ansari is also crumbling in the last few years. Recently, an order has been issued to attach the property worth Rs 50 lakh of Anand Yadav, a close aide of jailed gangster Mukhtar Ansari. Also, preparations have been made to bring Angad Rai – a shooter in his gang – from Bhabhua in Bihar to Ghazipur. He was arrested by the Bihar police.

Mukhtar Ansari is lodged in jail along with several members of his family. His wife Afsa Ansari is absconding. The police have announced a reward of Rs 50,000 for her. The police are also conducting search operations at various places to nab her, but she is not arrested so far.

There were times when leaders and officials would fear even speaking about the dreaded mafia. Mukhtar Ansari used to literally rule his district Mau. He also had a significant influence on other adjacent districts in Purvanchal. However, as the government is taking action against his crime empire, people and officials are opening up and sharing their views and experiences about this mafia.

Speaking to OpIndia about this, Mau DSP Dhananjay Mishra said that Mukhtar Ansari has no merit other than being a leader of a particular community and there are five dozen cases registered against him.

Mukhtar Ansari had become so brazen that he even grabbed the land of Hindu shrines. He occupied 4.60 acres of land belonging to a 125-year-old Hindu temple at Dakshin Tola under Sadar tehsil in Mau. In this regard, social activist Chhotelal Gandhi filed a complaint at the police station in 2016.

OpIndia has accessed a copy of this complaint wherein it is said that Mukhtar Ansari had prepared fake land documents in connivance with employees of the revenue department and took possession of the land by getting done an agreement on his own. The complaint also said that along with the documentary preparations, he also gathered criminals in the area and took possession of the land of the Deity by deploying a JCB machine.

However, even in that difficult time, Chhotelal Gandhi stood against Mukhtar Ansari and continues to fight that battle even today. Speaking to OpIndia, Gandhi said, “In 2016, the then MLA Mukhtar Ansari in the presence of 50,000 people laid the foundation stone of Ansari University. He also started occupying land worth about Rs 15 crore adjacent to it belonging to Thakur ji (the Hindu deity – Vishnu).

He further said, “When I came to know about this, I wrote a letter to all the officers in this regard. When no action was taken, in May 2016, I staged a sit-in protest continuously for seven days. When the District Magistrate came to know about this, he brought other officials and said that in seven days the entire land will be returned in the name of Thakur ji.”

Recalling the incident of political persecution by Mukhtar Ansari, Gandhi further said, “At that time, there was a Samajwadi Party government in the state and Mukhtar Ansari was an SP MLA. No DM or other officers would dare to conduct an inquiry against Mukhtar Ansari. There was no investigation. In 2019, Mukhtar Ansari’s close aide Ganesh Dutt Mishra fraudulently registered the land in his name.”

According to Gandhi, Ganesh Dutt Mishra, with the help of Mukhtar Ansari’s political influence, used to occupy large lands and make plotting layouts and sell them. In 2019, he got the deity’s land in his name as he involved some revenue officials and then he started making plotting layouts and selling them. Gandhi told that as soon as he knew this, he immediately informed the District Magistrate. Following this, an FIR was lodged against 60 people, including Mishra.

Chhotelal Gandhi further said, “SDM Nirankar Singh removed the names of all the people on that land record within two months and transferred the land in the name of Thakur ji and made the Mau Collectorate its manager. Mukhtar Ansari’s men still hold significant power in Mau. Even after the formal procedure of land transfer, that land has not been vacated to date.” He told that even today there are so many officers who are afraid of Mukhtar Ansari.
