University of Hyderabad professor arrested for molesting foreign student from Thailand

On Friday, a professor teaching at Hyderabad University was arrested for allegedly molesting and trying to sexually assault a student from Thailand. The incident reportedly took place when professor Ravi Ranjan, from the Hindi Department, took the student to his house on the pretext of giving her a book.

The professor reportedly dropped the student at the university a couple of hours later. The incident came to the fore when one of the victim’s friends found her crying. When asked, she narrated her ordeal and reported the case to the police.

According to the DCP, Gachibowli, “The incident took place on Friday when the professor took the student to his house at around 4 PM and she was dropped back at the university at around 9 PM. When her friends found her crying, they asked for the reason and she stated that the professor tried to molest her. The girl is a foreigner and only knows Thai.”

“We have registered a case and arrested the professor. Further investigation is underway,” the DCP added.

Meanwhile, Deccan Chronicle reported that the University management ignored the calls made to them by the student union on the matter. “There was a deliberate delay and shirking of responsibility by the concerned authorities,” alleged the students union.

According to the report, the union representatives had first congregated on the campus in support of the victim on Friday night. The next day, they again gathered at the campus front gate demanding action against the professor.

A complaint against professor Ravi Ranjan was subsequently lodged with the Gachibowli police station in Hyderabad in this matter and he was eventually arrested by the police.

‘India is a part of me, and I carry it wherever I go”: Google CEO Sundar Pichai after being awarded Padma Bhushan

On December 2, Friday, Sundar Pichai, CEO of Google and Alphabet, received the Padma Bhushan, India’s third-highest civilian award, in the Trade and Industry category in San Francisco, in the presence of close family members. Taranjit Singh Sandhu, India’s Ambassador to the United States, presented the award to Pichai, saying that his “inspiring journey reaffirms Indian talent’s contribution to global innovation.”

Taking to Twitter, Sandhu wrote, “Delighted to hand over Padma Bhushan to Google CEO Sundar Pichai in San Francisco. His inspirational journey from Madurai to Mountain View, strengthening India-America economic and tech ties, reaffirms Indian talent’s contribution to global innovation.”

The Google and Alphabet CEO in replied to the Indian Ambassador’s tweet and expressed his gratitude to the Indian government and people.

“Thank you Ambassador @SandhuTaranjitS. It was an immense honour to receive the Padma Bhushan and to have my family there with me today. Grateful to the Indian government and the people of India,” he wrote.

Notably, on the eve of Republic Day, Sundar Pichai was named the recipient of the Padma Bhushan, India’s third-highest civilian award, in the Trade and Industry category.

Pichai stated in his blog after receiving the prestigious award that India is a part of him.

“India is a part of me, and I carry it with me wherever I go.” I was fortunate to grow up in a family that valued education and knowledge, with parents who sacrificed a lot to ensure I had opportunities to explore my interests,” Pichai stated.

“I am deeply grateful to the Indian government and the people of India for this enormous honour,” Pichai added. It means a lot to be recognized in this way by the country that shaped me.”

Pichai also lauded Prime Minister Narendra Modi’s vision of technology saying that PM Modi’s Digital India vision has been an accelerator of progress. He also expressed his pride in investing in India. 

“We recently announced that we will invest USD 10 billion in India’s digital future, working to enable more affordable internet access, building products for India’s unique needs, assisting businesses of all sizes in their digital transformation, and using AI to tackle big societal challenges,”  Pichai said.

“I look forward to continuing Google and India’s great partnership as we work together to bring the benefits of technology to more people,” Pichai added.

Sundar Pichai also stated that with India taking over the G20 presidency next year, it will be an amazing opportunity to strengthen the global economy by advancing an open, connected, and secure internet.

Instagram agrees with a user that ‘Genocide against Hindus isn’t a crime against humanity’, refuses to take action

On a day when Twitter Files revealed how the former Twitter management blocked the New York Post’s Hunter Biden laptop story to help the Biden campaign in US presidential elections, a shocking incident of similar bias by another social media platform Instagram has surfaced. According to Instagram, Genocide against Hindus is not a crime, so it refused to take action against a user who claimed the same.

This was revealed in a screenshot posted by a Twitter user, which showed the response of Instagram to a complaint against a comment by an Instagram user. The complaint was filed against a comment by one user with the username muuhhsab, which said, “I didn’t do any crimes against humanity, and a genocide against Hindus isn’t a crime against humanity either because they aren’t humans to begin with xdxdxd.”

The comment by muuhhsab, which is private account with no posts on Instagram, was made in response to a user with the username shashankroyat. As the comment said that ‘genocide against Hindus isn’t a crime’, a complaint was made against the comment, but shockingly, Instagram found nothing wrong with it.

Responding to the complaint, Instagram wrote that their review team found that muuhhsab’s comment does not go against their Community guidelines. Instead of taking action against someone who said genocide of Hindus is not a crime, Instagram advised the complainant instead to unfollow, mute or block muuhhsab.

However, it is not surprising that Meta-owned Instagram does not think that Genocide against Hindus is a crime, because the Meta platforms including Facebook are openly biased towards left-liberals and Islamists.

Like Twitter, Facebook had also blocked the Hunter Biden’s laptop story, which was admitted by CEO Mark Zuckerberg recently. Facebook had also blocked the media reports about multi-million dollar real estate purchases by BLM co-founder Patrisse Khan-Cullors. The self-described Marxist was criticised on social media for purchasing four luxury houses valued at $3.4 million in the U.S., but Facebook had censored those criticisms, and also censored reports about the purchase on New York Post and the Daily Mail.

When TMC workers went on a rampage after winning the 2021 West Bengal elections, Facebook had blocked users who had posted about rape and torture of women by TMC goons for supporting BJP.

Karnataka Congress leader VS Ugrappa equates PM Modi with Bhasmasura after Congress president attacked him with a Raavan jibe

After Congress president Mallikarjun Kharge compared Prime Minister Narendra Modi with Raavan, now senior party leader and former Member of Parliament from Karnataka VS Ugrappa has made objectionable remarks against PM Modi. Ugrappa compared PM Modi with the demon Bhasmasura while speaking in Kannada.

According to reports, on Friday, Ugrappa said in Kannada, “I have already told that Modi is like modern Bhasmasura. The BJP government is playing with the future of the children.”

Ugrappa was alluding to Article 21-A, the fundamental right to education and scholarship for children, at the time he made the remarks.

Recently, recently elected Congress president Mallikarjun Kharge made an inflammatory comment against Prime Minister Narendra Modi, comparing him to the demon king Raavan, in an attempt to gain support for the approaching Gujarat assembly elections.

According to Hinduism, Bhasmasura was an asura and a demon who had the power to turn into ashes anyone whose head he touched with his hand.

Mallikarjun Kharge remarked at a public event in Narendra Modi’s home state Gujarat that Modi has 100 heads since he is present in every election. “We see your face everywhere in corporation elections, MLA elections, and MP elections. Do you have 100 heads like Raavan?” Kharge said at a gathering in Ahmedabad’s Behrampura.

“I’ve been seeing that votes are sought in the name of Modiji, be it municipality elections, corporation elections (or Assembly elections)… Ask for a vote in the name of the candidate… is Modi going to come and work at the municipality? Is he going to help you in times of your need?” Kharge added.

On Thursday, December 1, Prime Minister Narendra Modi addressed a public meeting in Kalol ahead of the second phase of polling in Gujarat. During his speech, PM Modi attacked Congress fiercely and hit back at Congress President Mallikarjun Kharge for his ‘Raavan’ remark and said that it is not Kharge’s fault. The PM said that Kharge was ‘ordered’ to call him Raavan in the land of Ram Bhakts.

PM Modi said, “There is a competition in Congress about who can abuse me more. I respect Kharge Ji, he will say what he will be ordered to say. The Congress party does not know that this is the Gujarat of Ram bhakts. On this land of Ram bhakts, Kharge Ji was ordered to call me Raavan with 100 heads and he did so.”

Narendra Modi further added, “Those who never believed in the existence of Lord Rama have now brought ‘Raavan’ from Ramayana and, I am surprised, he never repented, forget apologizing after using such expletives for me.”

Uttar Pradesh: 70-year-old Sadhu brutally stoned to death in his sleep, case registered

On Saturday, a 70-year-old Sadhu was stoned to death by unknown murderers in Uttar Pradesh’s Aligarh district. The murdered sadhu has been identified as Buddhasen.

The brutal crime reportedly occurred in the early hours of the morning when Buddhasen was sleeping by a tubewell in Lala Nagla hamlet, which falls under the district’s Vijaygarh police station area.

According to reports, some people approached him and hurled stones and bricks at him, leaving him gravely injured. The next morning, some villagers passing by saw him lying in a field in an injured state. The villagers informed the nearby police station about the same.

The police immediately reached the spot and took the body of the murdered Sadhu into their custody and sent it for postmortem. A case has been registered against unknown people under section 302 of the IPC.

Giving information about the murder, CO Barla Abhay Pratap Pandey said that the police registered an FIR based on a complaint filed by the sadhu’s family members.

Police said that Buddhasen had left his family and devoted himself to the path of spirituality seven years ago. The police went on to say that for the past seven years, he had always slept at Rahul Gupta’s tubewell. On the night of the incident, Buddhasen went to sleep at the tubewell, but some people went there and beat him to death with bricks and stones.

CO Barla Abhay Pratap Pandey has assured that the criminals would be identified and nabbed soon.

It is not the first incident of the murder of a Sadhu in Aligarh with multiple cases of murders preceding it in recent years.

Akhil Bharat Hindu Mahasabha seeks permission to recite Hanuman Chalisa in Shahi Idgah Masjid on Babri demolition anniversary; Section 144 imposed

The Akhil Bharat Hindu Mahasabha has requested permission to perform Laddu Gopal’s ‘Jalabhishek’ and recital of the ‘Hanuman Chalisa’ at the Shri Krishna Janmabhoomi-Idgah complex on Tuesday, December 6, despite the district administration’s prohibition on gatherings and rallies there. As per the claims made by Akhil Bharat Hindu Mahasabha, the sanctum sanctorum of the ancient Shri Krishna temple is situated in the Shahi Idgah mosque complex.

The district administration has imposed restrictions on December 1 and will remain in effect till January 28 in the wake of the 30th anniversary of the Babri Masjid demolition. 

The prohibitory order was issued by District Magistrate Pulkit Khare. It has been stated in the order that any political, social, or religious organisation, or any other gathering of five or more people, any kind of gathering, picketing, demonstration, etc. will not be allowed without permission. In the event of a violation, strict action will be taken against the person or organisation in question under Section 188 of the Code of Police Criminal Procedure.

Dinesh Sharma, national treasurer of the Akhil Bharat Hindu Mahasabha, released a video on Friday claiming that he had written a letter with his blood to Chief Minister Yogi Adityanath, requesting permission to recite the Hanuman Chalisa at the complex on December 6.

Earlier, Dinesh Sharma had written a letter with his blood to the President of India, demanding to seal the Shahi Idgah Mosque alleging that the Muslims are tampering with the historical evidence.

He has also asserted that “if you cannot grant permission to recite the Hanuman Chalisa, then grant us permission for euthanasia because we do not want to live if we are not allowed to worship our idol.”

Courts are hearing pleas to have the Shahi Idgah Masjid removed from its location near the Krishna Janmabhoomi temple. The mosque is said to be built on a 13.37-acre plot of land owned by the Sri Krishna Janmabhoomi Trust.

Journalist Sunil Namdeo hailed for questioning Saumya Chaurasia, ‘super CM’ of Chhattisgarh, as ED takes her into custody: How he was hounded in the past

Hours after the Enforcement Directorate (ED) on Friday arrested Saumya Chaurasia, the deputy secretary to the Chhattisgarh CM Bhupesh Baghel, in a money laundering case, a video is going viral over social media which shows a journalist being praised for intensely questioning Chaurasia while in the ED custody. The journalist has been identified as Sunil Namdeo who works for News Today Network based in Uttarakhand.

Namdeo who is a resident of Raipur, Chhattisgarh according to his Twitter bio, could be seen questioning the arrested Saumya Chaurasia while she was being taken away by the ED officials. “The ‘super CM’ has now been arrested. She has snatched the hard-earned money from Chhattisgarh citizens. The administrative officials used to worship her and now she is in the custody,” Namdeo could be heard saying. He also constantly kept on labelling her as ‘Bhrashtachaar Ki Murti’, the literal translation of which is ‘the Queen of Corruption’.

After the ED officials took Chaiurasia away, the journalist was hailed by people around including probable lawyers and government officers who had gathered at the spot during her arrest. “Ek Number, Behtarrin, Wahh Wahh (excellent)”, the crowd cheered as they lauded the journalist for fiercely voicing against the arrested official. The journalist also stated that the arrested official had threatened a journalist in the past.

Saumya Chaurasia, the deputy secretary to the Chhattisgarh CM Bhupesh Baghel was arrested by the ED on Friday for allegedly being involved in an illegal mining case involving over Rs 150 crore. Chaurasia is a Chhattisgarh Administrative Service (CAS) public official who joined the CM’s office when Baghel established the state government in 2018. She was under the surveillance of central authorities, and locations associated with her, including others, were also raided by the Income Tax (IT) department.

The senior bureaucrat had gained attention when the I-T department searched her residence in July and confiscated 14 crores of undisclosed cash and jewellery. She was also found to have cheated the government by evading taxes. In February 2020, income tax officers raided Chaurasia’s Bhilai residence, causing Baghel to write a scathing letter to Prime Minister Narendra Modi over what he called unconstitutionally and politically driven I-T raids in the Congress-ruled state. According to Baghel’s letter, the searches corresponded with a criminal inquiry launched by his administration into acts of corruption committed by the former Bharatiya Janata Party (BJP) govt.

Notably, the journalist identified as Sunil Namdeo stated on December 2 that the arrested official and the Baghel government have been targeting the journalists in the state for exposing their corruption. In November this month, Namdeo had written to Home Minister Amit Shah and the Prime Minister’s Office stating that the journalists in the state including himself were being tortured by the state government for reporting against them. “The State officials are harassing the senior journalists in the state for reporting the truth and exposing the corrupt state officials. The law and order in the state have also become a matter of grave concern,” he had said.

Namdeo in the letter further said that his life was in danger for the reason that constant threats were being issued to him by state CM Bhupesh Baghel and his administration including his deputy secretary Saumya Chaurasia, Anand Chhabra, IAS Anil Tuteja, and ASP Abhishek Maheshwari. He had also sent a similar letter to the Chhattisgarh Governor, Chief Secretary, State DGP, and Chief Justice of India.

In the letter, he alleged that the state officials mentioned above were all collaborating to bring him down. He claimed that after uncovering the NAN fraud, several cops had turned against him. Reports mention that Namdeo was the first to uncover that government officials were running an alleged extortion racket by imposing illegal levies and collecting Rs 25 per tonne from coal suppliers. “Following that, four bogus cases were brought against me, one after the other,” he said.

The journalist was reportedly arrested in the year 2021 for reporting news against a state IPS officer. He was also booked by the state police for interfering in a governmental job. However, he was lauded by many including probable lawyers and government officials as he fiercely reported against the arrested official.

Judiciary cannot become legislative, doing so may destabilise the system of governance: What VP Jagdeep Dhankar said taking on the Judiciary

On Friday, India’s Vice-President, Jagdeep Dhankar, hit back at courts overturning parliamentary amendments to the Constitution. According to the Vice President, the judiciary cannot become the legislative or the executive because doing so may destabilise the system of government as a whole.

Dhankhar stated during the eighth LM Singhvi memorial lecture that our judiciary, as one of the important institutions of government, cannot be the executive or legislative.

“The doctrine of separation of power is fundamental to our governance. Any incursion, howsoever subtle, in the domain of the other by one has the capacity or potential to unsettle the apple cart of governance,” the vice president stated.

Vice president Dhankar, who also happens to be a Senior Advocate, stated that the Supreme Court overturned a Change to the constitution that was voted unanimously in Lok Sabha and unchallenged in Raya Sabha in 2015-16. Such incidents, he remarked, have no counterpart in any other democracy in the world. The vice president was alluding to the Supreme Court’s decision to disband the National Judicial Appointments Commission.

“India in 2015-16 was dealing with a constitutional amendment act and as a matter of record the entire Lok Sabha voted unanimously and there was no abstention in Lok Sabha and that amendment act was passed. In Rajya Sabha, there was no opposition. We the people their ordainment came to be reflected through the most sanctified mechanisms through the applicable mechanisms. That power was undone. The world does not know of any such instance. I appeal to all judicial minds please think of a parallel in the world where a constitutional provision can be undone,” the vice president stated.

“Power resides in ‘We the People’ – their mandate, their wisdom… If a constitutional provision that carries the ordainment of the people at large in such a vibrant democracy is undone, what will happen?” he further stated.

“I appeal to the people here, they constitute a judicial elite class, thinking minds, intellectuals – please find out a parallel in the world where a constitutional provision can be undone,” vice president Dhankar stated in the lecture where Chief Justice of India DY Chandrachud, several Supreme Court judges, Union Ministers, Delhi Chief Minister Arvind Kejriwal and several lawyers were present.

Dhankar further stated that the Indian Constitution clearly states in Article 145(3) that the court may interpret the Constitution where a serious question of law is involved. “Nowhere it says a provision can be run down,” he stated.

The vice president made these remarks following Law Minister Kiren Rijiju’s remark that the Collegium may release notification for judge appointments if it believed the government was hesitating over its recommendations, the vice president made these statements. Rijiju’s remarks offended a bench chaired by Justice Sanjay Kishan Kaul on November 28.

The Bench asked Attorney-General R Venkataramani, “Names are not being cleared. How can the system work? … We have expressed our anguish. It appears that the government is unhappy that the NJAC did not pass constitutional muster… Can that be the reason not to clear the names for so long… if today, the government says it will not adhere to the law of the land, then tomorrow someone will not adhere to another part? You must think of the larger picture Mr Attorney.”

National judicial Appointments Commission

Notably, in August 2014, shortly after taking office for the first time, the Modi government passed the 99th Amendment to the Constitution and the National Judicial Appointments Commission bill in parliament, establishing the National Judicial Appointments Commission (NJAC). This was a planned organisation that would have been in charge of the appointment and transfer of judges to India’s higher judiciary. However, the measure was ruled unconstitutional by the Supreme Court of India in October 2015.

Judicial appointment process in India

In India, a collegium consisting of the Chief Justice of India and four senior-most judges of the Supreme Court scrutinizes and recommends the candidates for appointment to the Supreme Court. The government cannot suggest any names to the collegium. In the case of High Courts, screening of candidates for appointment to high courts is done by a collegium of chief justices of respective high courts and four senior-most judges on the HC bench.

In addition to this, the deliberations of this collegium are mostly opaque and not disclosed to the public. There is high scope for nepotism and elite self-recruitment to top courts in this collegium system. The reason cited for this system is to ensure the independence of judges.

Twitter communication reveals how ‘Hunter Biden story’ was censored using dubious justification, with Vijaya Gadde at the helm: What happened

Days after Elon Musk vowed to restore public trust in Twitter, he revealed all internal communications pertaining to the censorship of the Hunter Biden story on the social media platform. The development took place on Friday (US local time) during which the new Twitter chief shared a 37-tweet-long thread, posted by independent journalist Matt Taibbi.

The said Twitter thread detailed how the former Legal Head of the company, Vijaya Gadde, was at the helm of the censorship exercise under the garb of vague and arbitrary rules. It is pertinent to note that Gadde was accused of refusing to take down child porn even as the victim’s parents had pleaded for removal.

The internal communications revealed how the Twitter moderation team routinely received directives from the Biden administration to censor tweets. “More to review from the Biden team,” read a response by a Twitter executive dated October 24, 2020.

Thus, it came as no surprise when the social media platform censored an article by the New York Post, which published an explosive story about Hunter Biden’s problematic emails with a Ukrainian gas company executive from Burisma in the run-up to elections. It is pertinent to note that when the Hunter Biden story was censored, Biden was not in power.

“Twitter took extraordinary steps to suppress the story, removing links and posting warnings that it may be “unsafe.” They even blocked its transmission via direct message, a tool hitherto reserved for extreme cases, e.g. child pornography,” Matt Taibbi revealed.

According to the independent journalist, the Twitter moderation team went ahead with their crackdown and even locked the account of former White House spokeswoman, Kaleigh McEnany.

This prompted an angry letter from the campaign staffer of Donald trump, Mike Hahn, who said, “All she did was cite the story and firsthand reporting that has been reported by other outlets and not disputed by the Biden campaign.”

“I need an answer immediately on when/how she will be unlocked…Like I said, at least pretend to care for the next 20 days,” he took potshots at the partisan behaviour of the Twitter moderation team.

“Several employees noted that there was tension between the comms/policy teams, who had little/less control over moderation, and the safety/trust teams,” Matt Taibbi emphasised.

Twitter’s internal communication exposed how the censorship was justified under the guise of the ‘hacked materials policy.’ “Per checking, the user was bounced by Site Integrity for violating our Hacked Materials policy. Adding them here for further insights and guidance,” a Twitter executive had justified.

Matt Taibbi emphasised that the decision to censor the ‘Hunter Biden story’ was made at the highest level of the company but Twitter founder Jack Dorsey was apparently not privy to it. He added that the former Legal Head of Twitter, Vijay Gadde, played a crucial role in the process.

“They just freelanced it. Hacking was the excuse, but within a few hours, pretty much everyone realized that wasn’t going to hold. But no one had the guts to reverse it,” a Twitter employee described the decision-making process.

Former U.S. Policy Communications Manager at Twitter, Trenton Kennedy, had expressed doubts over the manner in which the New York Post article was gutted.

“I’m struggling to understand the policy basis for marking this as unsafe, and I think the best explainability argument for this externally would be that we’re waiting to understand if this story is the result of hacked materials,” he remarked during the internal Twitter discussion.

“We’ll face hard questions on this if we don’t have some kind of solid reasoning for marking the link unsafe,” Kennedy had highlighted. However, former Head of Trust & Safety at Twitter, Yoel Roth, had justified the move.

He had said, “The policy basis is hacked materials – though, as discussed, this is an emerging situation where the facts remain unclear. Given the severe risks here and lessons of 2016, we’re erring on the side of including a warning and preventing this content from being amplified.”

Several other top Twitter executives, including Brandon Borrman, had indicated that the ‘hacked materials policy’ invoked to withhold the Hunter Biden story was questionable. “Can we truthfully claim that this is part of the policy?” he had inquired.

Matt Tabibi emphasised, “A fundamental problem with tech companies and content moderation: many people in charge of speech know/care little about speech, and have to be told the basics by outsiders.”

The independent journalist also pointed out how Indian-origin Democratic Congressman, Ro Khanna, expressed concern about the censorship of the New York Post article.

Vijaya Gadde, the former Legal Head at Twitter who was sacked after Elon Musk took charge of the company, had justified the decision to lock the account of White House spokeswoman, Kaleigh McEnany. She also tried to rationalise the gutting of the ‘Hunter Biden story.’

“We put out a clarifying thread of Tweets earlier this evening to explain our policy around the posting of private information and linking directly to hacked materials,” she had said.

“The press secretary’s account was not permanently suspended – we requested that she delete the tweet containing material that is in violation of our rules and her account is restricted until she complies,” Gadde further remarked.

Matt Taibbi pointed out how Jack Dorsey was allegedly kept in darkness over the ‘Hunter Biden laptop story coverup.’

“An amazing subplot of the Twitter/Hunter Biden laptop affair was how much was done without the knowledge of CEO Jack Dorsey, and how long it took for the situation to get “unfucked” (as one ex-employee put it) even after Dorsey jumped in,” he concluded.

The Background of the Controversy

It is notable here that in the last weeks of the 2020 US presidential elections, the New York Post published an explosive story about Hunter Biden’s problematic emails with a Ukrainian gas company executive from Burisma.

In its report, the news outlet alleged that they had accessed material from a damaged Macbook that was brought to a service centre for repair. The customer who brought the laptop never collected or paid for the services.

The shop owner said he repeatedly tried to contact the client. Though he could not identify the owner as Hunter Biden, he said the laptop had Beau Biden Foundation’s sticker.

The report has several documents and mentions a video that proves that Joe Biden met a high-profile businessman from Ukraine when he was Vice President of the United States. 

Reports suggested that Biden may have helped his son Hunter using his influence as the VP of the United States in his business in Ukraine. The Biden Camp categorically denied all the allegations.

It was heavily censored by both Twitter and Facebook and was branded as a piece of fake news. Initially, the left and liberal cabal dismissed the report as a hoax, but it was eventually confirmed that the laptop’s contents did really belong to Hunter Biden.

Following the restriction of the NYP report, Twitter justified the action by claiming that its policies forbid the sharing of compromised information. After the elections were over and Joe Biden was declared president, it later became clear that the NY Post story was true.

Twitter’s former head Jack Dorsey then expressed regret over censoring the story and blocking NY Post from their Twitter account.

Madras HC rejects ‘backward quota’ claim of man who converted to Islam, had missed merit list after being treated as ‘general category’: Details

The Madras High Court ruled on Friday that a person “cannot carry his caste after conversion to another religion.” The remark was made while rejecting a man who converted to Islam from Hinduism’s claim of backward class reservation.

Justice GR Swaminathan on December 1 dismissed the plea of a petitioner challenging the action of the Tamil Nadu Public Service Commission (TNPSC) treating him as the ‘General’ category in the Combined Civil Services Examination-II (Group-II Services) instead of Backward Class Muslim. 

Justice Swaminathan citing multiple Supreme Court judgments observed that once a person born a Hindu converts to another religion that does not follow or recognize the caste system, the converted person would no longer belong to the caste he was born into.

Relying on the Supreme Court judgment in the Kailash Sonkar vs Maya Devi case which ruled that the caste of a Hindu is determined by his or her birth. Therefore, if a Hindu converts to Christianity or Islam, or any other religion that does recognize the caste system, he or she ceases to belong to that caste. Upon reverting to the original religion the person automatically will belong to the caste he was originally born into.

The High Court also stated that whether a person who has converted to another religion is eligible for community reservation is a matter before the Supreme Court. As a result, it will not be appropriate for the High Court to decide on the matter.

The TNPSC’s decision was therefore upheld by the court, which declined to intervene and held that the decision of the commission was right.

Notably, the petitioner informed the High Court that he and his family were Hindus from the Most Backward Class (MBC). In May 2008, the petitioner and his family converted to Islam. The petitioner took the Tamil Nadu Combined Civil Services Examination in 2018.

He did not make the merit list, and the response to his RTI request revealed that the TNPSC treated him as a general-category applicant rather than a Backward Class Muslim applicant.

He claimed that by converting to Islam, he was exercising his fundamental right to practice any religion he desired. However, prior to his conversion, he was an MBC, and the state of Tamil Nadu identified some Muslim communities as belonging to the Backward Class.

The petitioner argued that the TNPSC should have considered his candidacy in the Backward Class community.

The petition was opposed by the state government, which claimed that the TN government did not recognize all Muslims as belonging to the Backward Class.
