Kerala High Court cautions police against believing women blindly, asks them not to treat complainant’s statement as the gospel truth

On 24th February, the Kerala High Court cautioned the police against conducting unilateral investigations in sexual assault cases solely based on the complaint of a woman. The court highlighted the potential for false implications and irreversible damage to the reputation of the accused in such cases.

The court, presided over by Justice PV Kunhikrishnan, was hearing the bail matter in Noushad K vs State of Kerala case, and Justice Kunhikrishnan observed that the police must investigate the claims made by both the complainant and the accused instead of treating the woman’s statement as the gospel truth.

Police must assess all evidence

In the judgment, the court asserted that law enforcement officials have the right to take appropriate action against women who file false sexual assault complaints. The court said, “Merely because the de facto complainant is a lady, there is no presumption that, in all cases, her versions are gospel truth, and the police can proceed based on her statement without considering the case of the accused,” highlighting the need for a fair and thorough investigation.

Furthermore, Justice Kunhikrishnan assured police officials that there is no need to be afraid of the repercussions for pursuing the truth, as the law would protect them if they acted in good faith based on the investigation.

The court stressed that there is an increase in the trend of false accusations. It remarked that monetary compensation alone cannot undo the damage caused to the reputation of the accused if the allegations turn out to be false. Justice Kunhikrishnan said, “The damages caused to a citizen because of false implication cannot be compensated by payment of money alone. His integrity, position in society, and reputation can be ruined by a single false complaint.”

Case background

The case stemmed from allegations made by a female employee against her 57-year-old boss, Noushad K, accusing him of sexually harassing her on 20th December 2024. The complainant claimed that Noushad grabbed her arm with sexual intent. A case was registered under Section 75(1) (sexual harassment) of the Bharatiya Nyaya Sanhita at the Badiadka Police Station.

Noushad filed a bail petition before the High Court, claiming that the complaint against him was fabricated in retaliation for the termination of the employee due to poor performance. He submitted a prior police complaint against the woman, a receipt of the complaint, and an audio recording where the complainant was allegedly issuing threats.

Police negligence in handling the case

During the bail proceedings, counsel representing Noushad argued that the police registered the case against him without conducting a proper investigation. The counsel also pointed out that the complaint against the woman was filed before the complaint against Noushad. The prosecution, however, maintained that the allegations against Noushad were serious and required further investigation.

The court noted that the police failed to consider crucial evidence, including the audio recording, before proceeding with the case against Noushad. It stated that investigating officers must be vigilant while registering cases and ensure all material evidence is assessed.

The court said, “The police authorities should be alert and vigilant to find the truth in criminal cases during the investigation stage itself. It may take years for the courts to rectify the damage done to innocent persons if a charge sheet is filed against them. Investigating officers must think twice before proceeding in such cases.”

Bail granted with conditions

Considering the evidence, the court granted bail to Noushad under stringent conditions. Noushad has to cooperate with the investigation and refrain from influencing witnesses. He has also been asked to submit the audio recording to the police for further investigation.

From time-to-time courts have cautioned against misuse of laws including rape laws, SC/ST Act and 498A. In December 2024, the Supreme Court noted that while some laws were originally meant to protect women against domestic violence and harassment, they are being widely misused by some women to compel their husbands and families into complying with unreasonable demands. Moreover, laws like Section 498(A) of the Indian Penal Code are being misused by some wives to pursue personal vendetta against their husbands and families.

In June 2024, the Bombay High Court called for efforts to prevent the misuse of rape laws, especially in cases stemming from failed relationships between adults. The court stated that such cases waste valuable time for both the judiciary and the police.

In May 2024, the Allahabad High Court quashed criminal proceedings under the SC/ST Act against a couple, highlighting that the Act was being misused for personal vendetta.

Ghaziabad: Ahsan poses as Rahul to marry a Hindu woman, arrested along with his father and brother for forcing her to convert to Islam

In yet another case of Love Jihad and forced religious conversion, a man named Ahsan, his father Akhlaq, and his brother Imran have been arrested by the Ghaziabad Police over a complaint accusing them of forcing a woman to convert her religion after marrying her under false pretences.

The victim alleged she had met with Ahsan six years ago when he posed as Rahul and promised to find her a job. A few days later, they married at an Arya Samaj Temple.

However, after marriage, the victim realised her husband wasn’t a Hindu and his real name was Ahsan. After discovering his true identity, she accosted Ahsan, which led to frequent quarrels between them.

Shortly thereafter, Ahsan, his father, and brother forced her to convert to Islam. When she refused, she was subjected to physical and mental harassment, the complaint filed with the Ghaziabad Police said.

Subsequently, a case was filed against the three accused under applicable sections of the Indian Penal Code (IPC) and the Uttar Pradesh Prohibition of Unlawful Conversion of Religion Act at Teela Morh police station.

Pope put on assisted ventilation while Christian pastors like Baljinder Singh promise to ‘cure’ every ailment in India

The head of the Catholic Church and Sovereign of the Vatican City State, Pope Francis underwent bronchoaspiration. He was put on non-invasive mechanical ventilation on 28th February after suffering an isolated coughing fit that resulted in him inhaling vomit. He was hospitalised before that as he had been suffering from double pneumonia for two weeks. The Vatican informed that the 88-year-old pope remained conscious and alert during the treatment. Pope Francis has been receiving treatment at Rome’s Gamelli Hospital since 14th February.

“The Holy Father’s condition has shown a slight further improvement over the past 24 hours. The mild kidney insufficiency observed in recent days has subsided. A chest CT Scan carried out last night showed a normal progression of the lung inflammation. Blood tests today informed the improvement seen yesterday,” said a statement released by the Holy See Office on 26th February.

Pastor Baljinder and his miraculous healing powers

Reacting to the news, netizens remembered pastor Baljinder Singh from Punjab whose videos of healing ‘possessed people’ often go viral on social media. Commenting on the news of the Pope’s ill health, an X user said that only Pastor Baljinder could save the Pope.

Another X user wrote, “Critical? Are you implying that treatment by Baljinder is not effective?”.

Pastor Baljinder Singh‘s fame shot up after the ‘bolneee lagiiiii’ video went viral in which he is shown healing a speech-impaired girl. The internet is flooded the memes of Singh and his miraculous healing powers that can cure any disease from cough to cancer.

However, his famous ‘bolneee lagiiiii’ video landed him in legal trouble after the National Commission for Protection of Child Rights (NCPCR) wrote to Mandip Singh Brar, Deputy Commissioner of Chandigarh, seeking action against Singh for using a minor boy for forceful religious conversion activity. The letter noted that such videos promoted superstition and used children for such purposes, thus violating the Juvenile Justice Act, 2015. Taking the matter seriously, NCPCR directed the Deputy Commissioner to inquire into the matter and furnish an Action Taken Report within the next seven days

Sexual harassment cases against Pastor Baljinder

Baljinder Singh was born in a Jat family in Yamunanagar, Haryana. It is said that he converted to Christianity after coming into contact with a pastor when he was lodged in jail in a murder case. In 2012, he started holding Sunday prayer meetings for ‘healings’ and gained popularity gradually.

The self-styled Christian Godman was again arrested in 2018 for allegedly raping a woman from Zirakpur in Punjab. The victim has alleged that Singh lured her in 2017 by promising to take her abroad. He allegedly sexually assaulted her at his house in Chandigarh and recorded a video of the act which he used to blackmail her. He was also accused of taking money from her.

Uttarakhand: Afsan posing as ‘Arsh’ raped Hindu woman, attempted abduction and forced conversion, arrested

On 28th February, Haridwar police arrested a man named Afsan for posing as Arsh and allegedly sexually exploiting a Hindu woman on the pretext of marriage. When the woman discovered his true identity, he attempted to abduct her and force her to convert to Islam. However, she managed to escape and contacted Hindu organisations, who helped her file a complaint with the police.

Speaking to the media, Senior Superintendent of Police (SSP) Pramendra Doval said that Afsan had been arrested based on the victim’s complaint and that further investigation into the matter was underway. The victim has sought police protection, stating that she fears for her life from the Muslim man and his family.

OpIndia accessed the FIR filed in the case.

The FIR has been registered at Kankhal Police Station under Section 3 of the Uttarakhand Freedom of Religion Act and Sections 142, 190, 191(2), 351(3), and 69 of the Bharatiya Nyaya Sanhita (BNS).

According to the FIR, the 21-year-old victim came into contact with 30-year-old Afsan at a gym. Afsan, who was wearing a tilak at the time, introduced himself as a Hindu man named “Arsh”. As their friendship grew, Arsh proposed marriage to her and sexually exploited her by giving false hopes. When the victim pressed him for marriage, he asked her to convert to Islam.

Upon realising that his real name was Afsan and that he lived in Godewali village, the victim refused to marry him. After that, Afsan allegedly came to her house with his uncle and pressured her to convert to Islam. On 27th February, at around 8:30 PM, Afsan asked her to meet him at Khokhra Tihara Jamaalpur Kalan. When she arrived, Afsan, his father Bhura, his uncle, and two unidentified men were present. They attempted to abduct her and force her into a car but failed. While fleeing the scene, they issued death threats to the victim and claimed they would convert her to Islam by any means.

The SSP told the media that the accused repeatedly raped her on the pretext of marriage and pressured her to convert to Islam. The accused has been sent to judicial custody, and the police have assured strict action against those involved in the matter. The victim’s statement under Section 164 has been recorded.

Uttarakhand CM instructed police to take strict action in similar matters

The Chief Minister of Uttarakhand, Pushkar Singh Dhami, held a meeting with senior police and administrative officials in June 2023, where he instructed them to take strict action in cases where Muslim men reportedly hid their identities to befriend and exploit Hindu women. The CM’s instructions came after several such cases were reported in Chamoli, Haridwar, Uttarkashi, and other districts in the state.

West Bengal: Police arrest hospital staffer for allegedly sexually assaulting minor patient

On 28th February, a Group D employee at a hospital was arrested by North 24 Parganas Police for allegedly sexually assaulting a minor girl. Reportedly, the victim came to the hospital for treatment when the incident took place.

According to media reports, the accused allegedly took the minor to a toilet on the pretext of a medical examination, where he inappropriately touched the minor patient. When the minor raised an alarm, the accused was nabbed and handed over to the police.

Speaking to the media, the officer-in-charge of the local police station said that a complaint has been filed in the matter and a case has been registered against the hospital employee under the POCSO Act. The accused was produced in court and sent to police custody for seven days.

Reportedly, the minor patient was hospitalised a few days ago after she fell sick and started vomiting. A day after she was admitted, the accused had allegedly started harassing her.

When the villagers learned about the matter, they blocked the roads and protested in front of the hospital on the morning of 28th February. The blockade continued for around an hour and was cleared by the police. Some protesters alleged that the police were trying to “cover up the matter”.

A similar incident was reported last week, where a teenage girl was physically abused by a cleaning staff member in the Critical Care Unit (CCU). The accused was later arrested by the police. Another incident was reported in West Bengal last year in September when a man named Aman was arrested for molesting a minor girl in Howrah.

‘I am sorry for this’: Ukraine’s President Zelenskyy tries to extend an Olive branch to US President Trump after their public argument

After Ukrainian President Volodymyr Zelenskyy had a heated altercation with US President Donald Trump and Vice President JD Vance in the Oval Office yesterday (28th February), the former attempted to take the edge off the situation by saying that the altercation was not good for either side. He expressed hope that the relationship between the two countries can be improved.

After his meeting with Trump took an unexpected turn, Zelenksyy appeared on Fox News where he said, referring to the meeting, that it was not good. “I am sorry for this,” said Zelenskyy expressing regret over the heated argument. However, on being asked if he would apologise to the US President, Zelenskyy evaded the question and expressed gratitude for the support of the United States.

“President Trump said after your meeting that you disrespected him and the vice president and all of America in the Oval Office. Do you think you did and do you think you owe an apology to President Trump?” asked the news anchor Bret Baier. To this, Zelenskyy replied, “We have to be very direct to understand each other because it’s very necessary for us, very necessary to President Trump and I’m, with all respect, that he wants to finish this war but not – nobody wants to finish more than we because we, in Ukraine, we are in this war.”

When Baier asked him again about the apology, Zelenskyy said that he did not believe that an apology was necessary. He added that the discussion should have been held in private. “I respect President. And I respect the American people. And if – I don’t know if – I think that we have to be very open and very honest. And I’m not sure that we did something bad. I think maybe sometimes some things we have to discuss out of – out of media”, said Zelenskyy.

Zelenskyy thanked President Trump and the people of America through a post on X. “Thank you America, thank you for your support, thank you for this visit. Thank you, POTUS (President of the United States), Congress and the American people. Ukraine needs just and lasting peace, we are working exactly for that”.

The meeting between Donald Trump and Volodymyr Zelenskyy in Washington DC came to an abrupt end, as the Ukrainian president left the White House ahead of the scheduled time. Moreover, the joint press conference has also been cancelled after Trump accused Zelenskyy of disrespecting the United States. In a statement on Truth Social, Trump said that Zelenskyy wanted to take advantage of his meeting and that he did not want peace.

‘Scumbag, isolent pig’: Russian leaders slam Ukraine’s President Zelenskyy after his horror show in front of Donald Trump

On Saturday (1st March), the Russian authorities slammed Ukrainian President Volodymyr Zelenskyy following his heated confrontation with US President Donald Trump at the White House.

In a Telegram message, Russian Foreign Ministry spokesperson Maria Zakharova remarked, “I think Zelenskyy’s biggest lie of all his lies was his assertion in the White House that the Kyiv regime in 2022 was alone, without support.”

She further added, “How Trump and Vance restrained themselves and didn’t punch this scumbag is a miracle of endurance.” Maria Zakharova pointed out that the Ukranian President was being unpleasant with everyone and was biting the hand that fed him all the while.

Ex-Russian President Dmitry Medvedev also did not hold back and labelled Zelenskyy an ‘insolent pig’. He said that the Ukranian President received ‘a proper slap down in the Oval Office’.

The head of the Russian Direct Investment Fund, Kirill Dmitriev, has dubbed Zelensky’s horror show at the White House as ‘historic’.

The Deputy Chairman of the Upper House of the Russian Parliament, Konstantin Kosachyov, wrote on Telegram, “Zelenskiy lost this round with a deafening rattle. And he will have to crawl to the next one on his knees.” He added that the Ukranian President had revealed his true colours.

Ukrainian President Zelenskyy scolded over his opinions on Russia-Ukraine war

Donald Trump, who returned as the US President in January, met Ukraine’s President Volodymyr Zelenskyy at the White House on Friday (28th February).

During the meeting, Trump told Zelenskyy that Ukraine didn’t have a chance against Russia if USA hadn’t supported them.

Ukrainian President Zelenskyy tried to blame the United States administration for the current issues facing Ukraine, and the US Vice President JD Vance stepped up and told Zelenskyy off.

Following the meeting, Donald Trump said that he would like to solve the Ukrainian conflict, adding that Russian President Vladimir Putin wants to make a deal.

Zelenskyy should apologise: US Secretary of State Marco Rubio says after Ukrainian President’s public confrontation with Donald Trump and JD Vance

0

US Secretary of State Marco Rubio has said that Ukrainian President Volodymyr Zelenskyy should apologize following his meeting with President Donald Trump in the Oval Office. He stated that Zelenskyy should apologize for “turning this thing into the fiasco for him that it became.”

Rubio’s remarks followed Zelenskyy’s verbal clash with US President Donald Trump and Vice President Vance at the White House on Friday (local time). This shouting match between the leaders was witnessed by White House officials, mediapersons and other Ukrainian officials.

In an interview with CNN, Rubio said that there was no need for Zelenskyy to “go in there and become antagonistic.” He stressed that Trump wants to bring an end to the conflict and wants to get Russians to a negotiating table.

Asked whether he feels otherwise on Zelenskyy’s statement that he does not believe he owes an apology, Rubio said, “I do, I do because you guys don’t see. You guys only saw the end. You saw what happened today? You don’t see all the things that led up to this. So, let me explain the president’s been very clear, he campaigned on this. He thinks this war should have never started. He believes, and I agree, that had he been president it never would have happened. Now, here we are. He’s trying to bring an end to this conflict. We’ve explained very clearly what our plan is here, which is we want to get the Russians to a negotiating table. We want to explore whether peace is possible. They understand this. They also understand that this agreement that was supposed to be signed today was supposed to be an agreement that binds America economically to Ukraine, which to me, as I’ve explained, I think the president alluded to today is a security guarantee in its own way because we’re involved, it’s not us, it’s our interests. That was all explained. That was all understood.”

“And nonetheless, for the last ten days and every engagement we’ve had with the Ukrainians, there’s been complications in getting that point across, including the public statements that President Zelenskyy has made. But they insisted on coming to DC. This agreement could have been signed five days ago, but they insisted on coming to Washington. And it was a very and should have been a very clear understanding, don’t come here and create a scenario where you’re going to start lecturing us about how diplomacy isn’t going to work. So, as President Zelenskyy took it in that direction and it ended in a predictable outcome as a result. It’s unfortunate that was supposed to be this way, but that’s the path he chose. And I think, frankly, you know, sends his country backwards in regards to achieving peace, which is what President Trump wants at the end of the day, is for this war to end. He’s been as consistent as anyone can be about what his objective is here,” he added.

Speaking to CNN, he said that the verbal clash between the leaders started after Zelenskyy asked Vance on what kind of diplomacy they are talking about. Rubio said the meeting went “off the rails” after that interaction.

Asked on what does he want to see Zelenskyy apologise for, Rubio stated, “Well, apologize for turning this thing into the fiasco for him that it became. There was no need for him to go in there and become antagonistic. Look, this thing went off the rails. You were there, I believe it went off the rails when he said, let me ask you a question to the vice president, What kind of diplomacy are you talking about? Well, this this is a serious thing. I mean, thousands of people have been killed. Thousands and he talks about all these horrible things that have happened to prisoners of war and children. All true, all bad. This is what we’re dealing with here. It needs to come to an end. We are trying to bring it to an end.”

“The way you bring it to an end is you get Russia to the table to talk, and he understands that attacking Putin, no matter how anyone may feel about him personally, forcing the president into a position where you’re trying to go to him into attacking Putin, calling him names, maximalist demands about Russia having to pay for the reconstruction, all the sorts of things that you talk about in a negotiation when you start talking about that aggressively and the president’s a dealmaker. He’s made deals his entire life. You’re not going to get people to the table. And so you start to perceive that maybe Zelenskyy doesn’t want a peace deal. He says he does, but maybe he doesn’t and that active open undermining of efforts to bring about peace is deeply frustrating for everyone who’s been involved in communications with them leading up to today. And I think the campaign for wasting our time for a meeting that was going to end the way it did,” he added.

The Oval Office meeting began with warm exchanges and handshakes, with Trump at one point saying of Zelenskyy: “I think he’s a great guy.” But matters took an ugly turn after Zelenskyy attempted to explain Russian President Vladimir Putin’s lack of diplomacy to Vance in a heated confrontation in front of live cameras and journalists.

US Vice President accused Zelenskyy of “litigating” in front of the world’s press, criticized him for taking part in photo-ops with Democrats during the 2024 campaign, and said his remarks were “disrespectful” to the administration.

Raising his voice, Trump called the Ukrainian president “disrespectful” and told him he should be thanking the US, saying, “You don’t have the cards.” “You are either going to make a deal or we’re out and if we are out, you will fight it out. I don’t think it’s going to be pretty,” he added.

Trump and Zelenskyy were set to sign a deal that would have created a joint US-Ukraine fund investing in extracting the country’s rare-earth mineral supply. Friday’s meeting was supposed to ink a deal on rare earth minerals which are used to make a variety of tech products.
