Rajasthan HC adjourns a bail plea after lawyer appears in ‘Baniyan’ for the hearing through video-conference, second such incident in a month

In a bizarre incident, an advocate appearing before the Rajasthan High Court appeared wearing a “baniyan” (vest) during a video-conference hearing forced the judge to adjourn the matter.

According to the reports, on Saturday, the Rajasthan HC was hearing cases via video-conferencing when an advocate named Ravindra Kumar Paliwal appeared before the judge in “baniyan” angering the judge Justice Sanjeev Prakash Sharma. The court was hearing a bail application by one Lalaram through video conferencing.

Earlier this month, Justice Sanjeev Prakash Sharma had already instructed the High Court Bar Association to urge all advocates to appear in their uniform during hearings that are conducted through video-conferencing amid coronavirus lockdown. 

However, advocate Paliwal failed to follow the decorum of the court, forcing Justice Sharma to adjourn the case to May 5.

In his order, Justice Sharma said, “Learned counsel for the petitioner was contacted through video conferencing he was found to be wearing Baniyan.”

Further, the order stated, “This court has already observed that during this pandemic where court functioning is being done through video conferencing, lawyers must appear in proper uniform. Even though video conferencing a decorum of the court is required to be maintained. The Advocates Act provides for lawyers to wear the uniform while pleading the case for their clients.”

Not the first appearance in Baniyan

This is the second incident of an advocate not being in uniform while hearing through video conference at the same court. On 7th April, an advocate named Naval Singh Sikarwar had appeared in a vest during a hearing for an urgent bail application. On that day too, Justice SP Sharma had adjourned the hearing saying lawyers must be uniforms during hearings, even if it through video conferencing. The advocate had defied the uniform norm despite the fact that the causelist had specifically mentioned that uniform is mandatory for lawyers. After that, justice Sharma had asked the High Court Bar Association to urge all advocates to appear in their uniform during hearings conducted through video conferencing.

After this, the bar association had assured the court that all advocates will be asked to follow the rules of the court. But it seems some advocates are still not complying with the rule.

Union govt allows all shops outside municipal limits and standalone shops within municipal limits to open, malls to remain closed

In a major relief to the public amid the ongoing Coronavirus Lockdown, the Ministry of Home Affairs (MHA) has issued an order on Friday night, permitting the shops providing non-essential goods and services to open from Saturday onwards. 

The latest order from the government allows the registered neighbourhood and stand-alone shops to open amid the coronavirus lockdown.

The shops that are allowed to open during the coronavirus lockdown from Saturday include those located in residential complexes within and outside the limits of municipalities and municipal areas. However, market complexes within the limits of municipal corporations and municipalities will not open from Saturday, while shops in market complexes outside municipal limits can open. Shops in single and multi-brand malls will remain closed in all areas.

Shops to be open with 50 percent staff, mandatory social distancing norms

The MHA statement has permitted shops in market complexes outside municipality areas to resume work with a maximum of 50 per cent staff during the ongoing lockdown. The order also added that the mandatory precautions such as social distancing norms and wearing masks should be followed strictly.

The MHA statement also states that the order applies only to the local shops registered with the municipal corporation. However, shops in multi-brand and single-brand malls are not exempted and will remain shut till May 3.

The shops that have been exempted from the current lockdown include neighbourhood shops and stand-alone shops, the shops in residential complexes, those under municipal corporation and municipalities and registered under the Shops and Establishment Act of the respective State/UTs.

However, the restrictions will continue in hotspots and containment areas, said Ministry of Home Affairs in its new order.

Traders’ Federation thanks PM Modi, asks shop vendors to wait for state govt order

Following the order issued the Ministry of Home Affairs (MHA) to exempt certain shops, the Confederation of All India Traders (CAIT) thanked Prime Minister Modi for allowing to open shop across the country.

However, Praveen Khandelwal, the National General Secretary of Confederation of All India Traders (CAIT) on Saturday said that people should wait for the state governments to take a decision in this regard.

“I want to thank PM Modi for allowing to open shops across the country. The Home Ministry has given the responsibility to state governments. We have to wait for the state government to take a decision on this. But I think state governments will take a decision,” Khandelwal said.

He added that whenever the shops will be opened, people should sanitise their shops and markets first. Masks, gloves and sanitisers should be used. Shopkeepers should also ensure social distancing, he said.

Prime Minister Narendra Modi on March 24 announced a 21-day nationwide lockdown as a precautionary measure to contain the spread of Chinese pandemic coronavirus. Later, the lockdown was later extended till May 3.

Meanwhile, a total of 24,505 confirmed cases have been reported in India till Friday. There are 18,668 active cases of coronavirus cases in the country, while 5,062 positive cases have recovered. 775 people have lost their lives due to coronavirus in the country.

Clarification on the MHA order

As the legal jargon issued in the order had created some confusion on what is allowed and what is not, the ministry later issued a clarification.

The clarification says that all shops in rural areas will be open, except shopping malls. But in urban areas, both shopping malls and shops in market complexes are not allowed to open, and only standalone shops, neighborhood shops and shops in residential complexes can open.

The clarification further adds that ban on sale of non-essential items by e-commerce companies continues, they can sale only essential goods only like groceries. The ministry also says that sale of liquor sale continues to be prohibited.

“I pleaded for my life but they continued to attack me”, Sadhu in Punjab mercilessly beaten, Rs 50,000 stolen as he lay bleeding

On Friday, a Hindu Sadhu named Swami Pushpendra Swaroop was attacked and injured by two assailants at his ashram in Hoshiarpur, Punjab. He was resting alone around 10 pm when the duo climbed the wall, entered the ashram, and attacked Swami Pushpendra with sharp-edged weapons.

He was then rushed to a local hospital. The Sadhu informed the police that the unidentified assailants tied his hands and feet, prior to attacking him. The duo also tried to strangle him, before fleeing the crime scene with ₹50,000 and some other items from the Ashram. “I pleaded them to spare my life and take the money instead. But, they continued to injure me”, Swami Puspendra recounted. He was also hit on his head with a weapon that aggravated his injuries.

According to reports, the condition of the seer remains critical.

The lynching of 2 Sadhus in Palghar

On April 16, two Sadhus associated with the Juna Akhara, 70-year-old Kalpavrishka Giri Maharaj, and 35-year-old Sushil Giri Maharaj along with their driver 30-year-old Nilesh Telgadewere were on their way from Mumbai to Gujarat to give Samadhi to another Sadhu. At Gadakchinchale village, a wild and frenzied crowd of over more than 100 people attacked them. The villagers deemed them as thieves and started attacking them. The police claim that their team which had rushed to the spot to rescue the 70-year-old man also came under the attack of the violent mob.

But later videos emerged which completely debunked the claim of police, as it was seen that the sadhus were in the custody of the police, but the police personnel handed them over to the mob. The mob then proceeded them to beat them to death in front of the policemen.

The Crime Investigation Department(CID) of Maharashtra police has taken over the investigation in the Palghar lynching incident of two Sadhus and their driver last week. The Maharashtra government had earlier ordered a high-level probe and suspended two policemen who showed complete dereliction of duty.

‘Body utha raha hai’: West Bengal BJP shares video of health workers wearing PPE trying to dump a corpse in a residential locality

In a 3-minute video shared by the official Twitter handle of BJP West Bengal Bengal, a group of locals could be heard objecting to the presence of health workers who were allegedly trying to dump the dead body of a Coronavirus infected patient in the colony, in the wee hours of the night.

The BJP unit of West Bengal accused the West Bengal government of “unceremoniously” dumping corpses of Coronavirus patients in residential areas by flouting official governmental norms and procedures. Pointing out the Coronavirus scare, they asked, “Will Mamata Banerjee show some ‘mamta’ (sympathy) for the people of West Bengal?”

Locals object to dumping body in their locality

“We are not loading or unloading anything”, a health worker draped in PPE overalls said at the very start of the video. For the next 1 minute, one could hear the barking of dogs and the indistinct chatter of the people in the background. The locals continued yelling at the health workers who had mysteriously parked their ambulance in a residential colony.

Body niya asacho toh tumra! Darao (You brought a corprse, didn’t you? Wait)”, the video creator could be heard telling the health workers. Another enraged local issued a veiled threat, “Tumra akhan thaka body ta niya palao, na holey ki korbo hospital jalabo (Take the corpse away, else we will burn the hospital).”

The three men in PPE overalls then stood cluelessly in the middle of the road while the locals vehemently objected to their presence and the alleged action of dumping the body of a deceased.

Aee, ki hoccha akhana (What is happening here?)”, a person asked from afar. “Chole jaa na hola toder gadi jaliya debo (Leave else we will burn down your vehicle)”, another irked local could be heard saying in the background. “Gadi niya pala (Run with your vehicle)”, another rebuked.

The mysterious black bag

At exactly 3 minutes into the video, two health workers could be seen carrying a heavy black bag and loading it back into the ambulance. It must be remembered that they had initially denied “loading or unloading anything.” The initial statement made by one of the health workers directly contradicted the action of the other two in the viral contentious video.

Ya dekho body utha raha hai (See! They are taking back the body)”, a man pointed out. The crowd kept booing the trio while they continued to put back the mysterious black bag into their vehicle. One of the healthworkers could be seen waving at the people, suggesting that they were leaving the colony. At that point, a localite inquired, “Toderka ke boloche (Who had told you…to come here?)”

The video has sparked controversy on social media with netizens questioning the West Bengal Chief Minister of withholding facts about Coronavirus-related cases from the public.

Corpses lying next to suspected Coronavirus patients

Earlier, in a video shared by Babul Supriyo, BJP MP from Asansol, a person admitted to an isolation ward in M.R.Bangur Hospital in Tollygunge in West Bengal narrated the deplorable conditions under which suspected Coronavirus patients were being quarantined. 45 seconds into the video, the man holding the camera pointed towards a dead body lying unattended on a bed for over 2-3 hours.

The video creator then highlighted the lack of proper social distancing provisions in the ward by citing the example of two other suspected Coronavirus patients who were sitting in close proximity to the body of the deceased. Given that the people in the ward were crammed together with little space between two beds, the probability of everyone getting infected from the Chinese virus thus increased.

After this incident came to light, the West Bengal government led by CM Mamata Banerjee had banned the use of mobile phones inside hospitals, saying that they could carry the coronavirus around. 

Acid attack victim, who worked with Deepika Padukone in Chhapaak, struggles for father’s cancer treatment

Jeetu Sharma, an acid attack survivor who worked with Bollywood star Deepika Padukone in movie Chhapaak, has been struggling to get her father treated for cancer amidst the coronavirus lockdown. According to the reports, Jeetu Sharma, who lives in Aligarh’s Baraula Jafrabad, is fighting to get her father treated, who is suffering from throat cancer.

Jeetu Sharma was attacked with acid in 2014, when she was just 17 years old, by a 55-year-old man who had been stalking her. Last year, Sharma had performed the role in Deepika Padukone’s “Chhappak”, a movie made on the life and struggles of acid attack survivors.

Unable to visit hospital due to lockdown

Jeetu Sharma’s father, Somdutt Sharma, 55, is a head constable with Uttar Pradesh Police currently, posted at Mainpuri district in the western part of the state. He was diagnosed with throat cancer in January and was receiving treatment at a private hospital in Noida.

Speaking to the media, Sharma said that her father was not even able to drink water as his condition has deteriorated in the last five days.

She added, “He was under treatment for throat cancer at a private hospital in Noida since January. However, we are unable to take him there now due to the lockdown. Even AMU’s medical college is not ready to admit him as they are not taking any new patient.”

According to the family, her father’s last chemo session was done in March and the next one was due on March 26. However, it was extended after the lockdown was announced, she said.

“I contacted the district administration and police but received no help. They advised me to hire a taxi and go to Noida on my own,” she said. She had also posted her plight on the social media tagging UP CM Yogi Adityanath and Aligarh DM.

Auhtorities come to rescue of Jeetu Sharma

Meanwhile, in response to Jeetu Sharma’s Twitter post, Chandra Bhushan Singh, the District Magistrate of UP’s Aligarh, posted, “The daughter of a cancer patient has been informed to submit an application before Aligarh city magistrate. She will be given permission to take her father to another city for treatment”.

The UP government has also said that there is an e-pass system for those forced to travel during lockdown because of medical emergencies.

Chhapaak and the controversial PR stunt

Chhapaak is a movie based on the real-life story of Laxmi Agarwal, an acid attack survivor whose character is played by Bollywood actor Deepika Padukone. However, despite being such a sensitive issue with profound social importance, the movie failed miserably in dazzling the viewers, leaving them with a feeling of betrayal, which was reflected in the negative reviews and poor box office collections.

Deepika Padukone had tried to pull off a PR stunt by doing a cameo in JNU controversy to express her ‘solidarity’ with students who had unleashed violence inside JNU in February, inviting severe criticism against the Bollywood entertainer for standing with anti-India elements.

Madhya Pradesh: Minor girl dragged, raped in Bhopal, accused Abd and Shafiq arrested

In a horrific incident, a minor girl was forcefully dragged into a car and was raped by two men on April 18 in Bhopal. According to the reports, the 17-year-old girl and her friend were on her way to JP hospital in Bhopal, when she was abducted by two men near the hospital at 07:30 PM on April 18. One of the accused brutally raped her by taking her to the BHEL township and left her near the city’s Mayur Park.

One of the accused – Shafiq dragged the girl into an open ground where he raped her at a deserted area of BHEL township. The minor girl said that she screamed for help but there was no one around.

No checks at checkpoints

Shockingly, the car carrying her must have passed through police checkpoints in the 6-8km between JP Hospital and Govindpura including Board Office Square, however, the culprits were not stopped anywhere.

According to the victim, the accused threatened to kill the minor girl if she spoke to anyone about the rape. Terrified and traumatised by the threat, the victim kept quiet. Following the heinous incident, a friend counselled her and advised her to file a complaint.

The victim filed a complaint at her local police station, which initially did not register an FIR and transferred it to Habibganj police station, which has jurisdiction of the area around the hospital. In the complaint, the girl has named the accused as Shafiq Khan and his friend Abid Khan. A case has been registered against the accused under the POCSO Act.

“Based on the minor victim’s complaint, we have arrested Shafiq Khan (24) and Abid Khan (22),” inspector Rakesh Shrivastava of Habibganj police station said.

NCP leader’s arrival energised the mob which chanted “Dada aala dada aala”: Sarpanch recalls the Palghar mob-lynching incident

The brutal lynching of Swami Kalpvriksha Giri, Sushil Giriand their driver has shocked the entire nation. BJP Sarpanch Chitra Choudhary, who lives exactly between the border point and the Maharashtra forest department check post outside which the lynching occurred, was not only an eye-witness to the entire incident but had also attempted to discourage the vexed mob from committing the horrific crime. In a shocking revelation, the Sarpanch recalls how the mob was pumped up seeing NCP leader Kashinath Choudhari.

NCP leaders’ appearance energised the mob

NCP leader Kashinath Choudhari is a Palghar Zilla Parishad member and the party’s losing candidate from Dahanu in the 2014 Assembly election. While speaking to The Indian Express, the sarpanch recalled how the NCP leader’s arrival at the time of the incident, had appeared to energise the mob which began chanting: ‘Dada aala, Dada aala’ (big brother is here) on seeing the leader. The NCP leader is seen in the video clips of the incident, wearing a T-shirt, standing back from the assailants.

The NCP leader had, however, said that he tried to calm the mob but by then, the Eeco (the car the Sadhus were travelling in) had been upturned. “Police tried their best, but the men were drunk, unwilling to reason. Still, we managed to get one sadhu to sit inside the chowki because he had been injured and put the other two in another police vehicle. But suddenly, when police were escorting the man from the chowki into the police vehicle, the attack began again, and it was over in minutes.” The NCP leader said there was no political motive to visiting the spot, and he confirmed that the BJP sarpanch had tried hard to calm the crowd. “But the police were also attacked and beaten, and we couldn’t do anything,” he said.

Role of the Police in the Palghar Sadhu lynching case

It is pertinent to note here, that by their own admission, the police force with one API and two PSI’s were at the scene of crime well 20 min before the final and deathly reign of hits took place. What transpired afterwards is shrouded in mystery as the accounts in the complaint don’t match the horrific video of the incident doing rounds on social media and indicate a major omission of facts by polices. While the police say that they were overpowered by the mob, the videos show that the sadhus were simply handed over to the crowd by the police personnel.

Chitra Choudhary recalled that when the commotion erupted it was around 8.30 pm and she went to the spot. “There were men from our village and from nearby villages, it was a thick crowd screaming around the car. It was impossible to reason with them. I was trying to pull one back and then another, but the men were screaming at me too. They told me I was free to hand over my children’s Kidneys to the men in the car — they had absolutely no doubt who these outsiders were. The WhatsApp messages had said the kidnappers could be impersonators, performers, dressed even as policemen,” Choudhary told The Indian Express.

Vicious rumour-mongering being common in the area, the victims were accused of a theft which occurred in Gadchinchale village. Rumour of child abduction and organ harvesting were also cited as the cause of violence.

The BJP Sarpanch lamented that she could do little to save the Sadhus and their associate. “For the two hours that I was there, the mob was raining stones and shaking the car, but the men inside were still unharmed,” she said. She left a little after the police arrived, in two batches.

Chitra Choudhary was picked up along with her husband Shevak for questioning around 2 am later that night and asked to name those involved in the violence. “Now the families of those arrested are threatening me, the women came here and said my house should be broken down. That’s why I placed a new sign saying ‘Sarpanch’ on my door two days back — at least if there’s an attack on me some people may see the sign and back off,” she said.

BJP Sarpanch threatened

Days after the horrific incident, relatives of those arrested in the case have reportedly threatened BJP sarpanch Chitra Choudhary of dire consequences for colluding with the police. The relatives suspect that it was the sarpanch of the village who released the details of the murderers to the police.

Palghar Sadhus lynched

The blood-curdling incident happened on 16th April 2020 in Palghar, Maharashtra. Two Sadhus, 70-year-old Kalpavrishka Giri Maharaj and 35-year-old Sushil Giri Maharaj along with their driver 30-year-old Nilesh Telgade associated with the Juna Akhara and were on their way from Mumbai to Gujarat to give Samadhi to another Sadhu.

The Eeco was stopped barely 1 km from Gadchinchle, at a lockdown barricade manned by guards from Dadra-Nagar Haveli, and turned back. It was then the wild and frenzied crowd of over more than 100 people attacked them. The villagers deemed them as thieves and started attacking them. The police claim that their team which had rushed to the spot to rescue the 70-year-old man also came under the attack of the violent mob.

Horrifying visuals of the Palghar lynching incident where a mob of over 100 people killed two Sadhus and their driver even as the Police stood there as mute spectators, just letting the barbaric act unfold, had gone viral on the social media.

People of the Sadhu community say that this village is tribals dominated and most of them are Christians while some are Muslims. Some even say that the police, out of fear of the tribals, handed over the Sadhus to the mob which later beat up those Sadhus to death with sticks. Reportedly, when the tribals of a particular religion started beating up the Sadhus, the police did not intervene.

Ahead of Ramzan, all rules of lockdown and social distancing tossed away as people throng to markets across India

On one side when the country is observing the lockdown to avoid getting contracted by the novel coronavirus, avoiding celebrating festivals that call the social gatherings in various places, some Muslims on the other hand seem to be uninterested in showing minimal empathy towards in the severe health crisis situation in the country, as markets are seen huge crowds ahead of Ramzan.

As the month of Ramzan has commenced, crowds were seen shopping and moving around at various places completely flouting the lockdown and joining the public gatherings. One of the areas is the Shastri Park area of North-east Delhi, that witnessed a huge crowd on Friday morning despite lockdown orders.

It is notable that the Shastri Park area is one of those areas which are listed as containment zones in Delhi which were sealed by the government authorities to break the chain of coronavirus.

In another instance, the Lal Kuan area of Delhi, a highly populated and a minority-dominated area, was the busiest market on Friday.

Akali leader Majinder S Sirsa alleged that the Lal Kuan area which is currently under Imran Hussain of Aam Aadmi Party is non-serious regarding the deadly epidemic of Wuhan coronavirus.

Several pictures of Juhapura and Kalupur areas of Ahmedabad are circulating which is exposing the ignorance of the Muslims towards the pandemic.

Similar situations were seen in financial capital Mumbai also, where authorities have been unable to enforce the lockdown from the beginning. The Ramzan has increased the crowd in the markets in the city, which has the highest number of Coronavirus positive cases in the country.

Several photographs and videos were shared on social media, which showed large number of people crowding the markets ahead of Ramzan flouting social distancing norms in various places.

Despite the requests made by several politicians and religious leaders even before Ramzan started, some muslims have decided not to cooperate with the authorities. In several instances they have been defying safety norms, attacking the health workers and roamed freely with an intention to spread the virus.

News portal MyNation announces campaign to initiate legal action against those who threatened livelihoods of Indians in Gulf

News Portal MyNation has announced that it will pursue legal action against trolls who have organized a concerted campaign to harass Indians living abroad. “We will ensure that the trolls are brought to justice and need your support for that,” it said. MyNation condemned the organized doxxing of Indians that has been taking place during the Wuhan Coronavirus pandemic. It said that fringe elements and extremists were trying to use the religious laws of ‘friendly foreign countries’ to instigate them against India and accused them of jeopardizing India’s relationships with other countries by indulging in false propaganda.

MyNation announced that in the coming days, it will compile a crowd-sourced report which will be submitted to the relevant law enforcement authorities. It appealed to people on social media to share screenshots and links of all such doxxing tweets, Facebook posts and other such posts that was used by trolls to leak sensitive information of Indian citizens. After the report has been compiled, MyNation will register an FIR against the troll accounts that jeopardized the safety and security of Indians abroad.

MyNation emphasized that although India doesn’t have any specific laws to punish doxxing, “people are well protected by other laws from defamation, cyber harassment, online stalking, voyeurism, and any explicit or sensitive or obscene content being shared about them.” The News Portal emphasized that doxxing violates our Fundamental Right to Privacy and Right to Dignity as guaranteed by the Constitution of India.

The Organized Campaign Against Hindus in the Middle East

An organized campaign was launched against Hindus living in the Middle East by a section of Muslims living in India. The motivation behind the campaign was clear: To harass Hindus by whatever means necessary. As a consequence, several Hindus in Gulf countries have lost their jobs.

The matter of concern is that Hindus are being targeted for criticism of organizations such as Tablighi Jamaat whose Islamic fundamentalism has jeopardized the health of individuals in numerous countries, not just in India. Criticism of one specific organization cannot be labeled as Islamophobia and attempts to equate criticism of a single Islamic missionary organization with spreading hate against the entire Muslim community and Islamophobia reeks of malice on the part of the individuals concerned. Quite clearly, it was a thinly veiled attempt to unleash the state machinery of Islamic countries against Hindus under the garb of fighting Islamophobia.

Coronavirus scare at Rajasthan village after several Rs 500 currency notes found thrown at a villager’s house

Yet another shocking incident of currency notes being thrown with a suspected intention to propagate the infection of Wuhan coronavirus has come into notice. The incident took place in village Sarasar of Rajasthan when an unidentified person threw currency notes of Rupees 500 at the residence of one Ghadseiram. Some of the notes were torn. A total amount of thirteen thousand five hundred was thrown at his house.

A large number of people gathered at the spot after the news of the incident broke out. The villagers were apprehensive about the notes received this way that it was done with the intention to spread the novel coronavirus.

The police reached at the spot on being informed and seized the notes. Police is investigating whether any kind of chemical is there on the notes, or if the notes are counterfeited, said police officer Mahendra Dutt Sharma.

Another incident of thrown currency notes

In another incident, currency notes were found on the roadside near a cement factory in the industrial area of Sujangarh, Rajasthan. Factory Director Anand Bagda informed the police about this.

After that Sub-inspector, Dilip Singh, and the sanitization team personnel from the Municipal corporation reached the spot. Precautions were taken according to coronavirus protocol. The team sprayed sanitizer all over the area. After that, the police picked up the notes lying on the ground between the road and the factory.

Other incidences

Two bike-borne miscreants had dumped five currency notes of ₹100 near the village of Bijhera in Tehsil Iglas in Aligarh after they reportedly spit on them. The incident had triggered a state of panic among the villagers who dubbed their action as a deliberate attempt to spread the Wuhan Coronavirus infection.

According to the villagers, the miscreants had covered their faces with cloths who stopped on the road, spat on the notes and threw them on the ground before leaving the spot. Soon the news spread in the village and the villagers gathered at the spot. The cops were called in to investigate the matter. 

The Nasik rural police had arrested a Muslim man, whose video of licking and wiping nose with a bunch of currency notes and calling Coronavirus a punishment by Allah was doing rounds on social media.

The video showed a Muslim man taking a bunch of currency notes and licking them with his tongue and wiping his nose with them. He says that the coronavirus has no treatment because it is sent by ‘Allah’, implying that he is going to pass those currency notes around, to spread the disease.
