Union Cabinet approves adaptation of 37 central laws under concurrent list in Jammu and Kashmir

The newly formed Union Territories of Jammu and Kashmir will soon be acting under various Central laws under Concurrent list which were not applicable to the erstwhile state of Jammu and Kashmir, as it was an autonomous state with its own constitution prior to the abrogation of Article 370 and 35A.

On 5 August 2019, the Modi government revoked the special status granted under Article 370 to the state of Jammu and Kashmir that barred many Central laws to be applied to the state of Jammu and Kashmir.

The Union Cabinet approved a proposal on Wednesday for issuing orders of application and adaptation of central laws under concurrent list to Jammu and Kashmir. 37 Central laws including important acts like All India Services Act, The Census act, The Central Goods and Services Tax Act, Income Tax Act, Insolvency and Bankruptcy act, etc., which were not applicable to the state of Jammu and Kashmir will now be applied in the UT of Jammu and Kashmir.

Information and Broadcasting Minister, Prakash Javadekar while briefing the reporters, termed it as an “important decision” after the reorganization of the newly formed Union Territory.

IB Minister said, “We have also decided to pass an order for an adaptation of central laws under the concurrent list. So 37 laws that were not applicable to Kashmir valley are now applicable. This will ensure that throughout the country, the laws passed under the constitution are applicable.”

Kamal Nath said anti-CAA movement is going in ‘another direction’, benefitting BJP, says Congress MLA Arif Masood slamming Congress: Read details

Congress MLA from Madhya Pradesh, Arif Masood, while speaking at an event in Ratlam hit out at his own party members and claimed that “Congressmen are sitting in BJP’s lap.”

While venting out his outrage, Arif revealed a startling conversation that he had with Madhya Pradesh Chief Minister Kamal Nath. He informed, “The Chief Minister told me that this movement is going in another direction and BJP is taking advantage of it. CM is correct. We are talking about Ambedkar and Gandhi and your Congressmen are sitting on BJP’s lap. That’s why our movement is getting weaker.”

Arif added, “I want to say to the Congress leaders that where are you? Why are you hiding in houses? If you are quite, then, people will say you are on their (BJP) side.” He also urged people to question Congress politicians about their whereabouts when they come to their doorsteps.

While Arif Masood proposed for active participation of his fellow party members in protests against the Citizenship Amendment Act (CAA) and the National Register of Citizens (NRC), it comes as a stark contrast to what party veteran Jairam Ramesh stated in an interview with the Press Trust of India (PTI) at the launch on his new book.

“We (The Congress Party) should maintain an arm’s length from these people’s protests. We should not try to politicise and hijack them.”, Ramesh was quoted as saying.

Ever since the CAA has been passed by the Parliament, the Congress party has resorted to bizarre and inconsistent claims over time. The story became murky when prominent Congress leaders shifted from one rhetoric to the other. It was initially alleged by the grand old party that CAA was Anti-Muslim. When the claim failed to hold water, Rahul Gandhi claimed that NRC was anti-poor, just like demonetisation.

Ashok Gehlot, the Chief Minister of Rajasthan, and Kamal Nath claimed to not implement CAA in their respective states. Captain Amarinder Singh, the Chief Minister of Punjab, even passed a resolution in the State Assembly against the humanitarian law that aims to fast-track the citizenship of persecuted minorities from the three neighbouring Islamic republics who are staying in India illegally.

Congress leader and lawyer Kapil Sibal categorically stated that States do not have the power to stop implementation of a law that has been passed by the Parliament. His comments directly contradicted the rigid stance that the CMs of the Congress-ruled States had assumed.

Sibal’s views were also shared by Congress old guard, Bhupinder Singh Hooda on Monday. He stated that a State cannot say no to a law passed by the Parliament from a Constitutional perspective. Even Jairam Ramesh had confessed that resolution passed in the Assemblies of Congress-ruled States against the CAA was more of a “political signal”.

Nevertheless, the Congress party saw a political opportunity in CAA to mobilise the public against the current political dispensation but to their horror, the protests soon took an Islamist turn. The party found itself in a state of dilemma such that it could neither endorse the violent mobs nor sideline the Islamist resistance to Parliamentary democracy. The comments made by Arif Masood is a reflection of that confusion within the party.

Delhi riots ground report: Women from Chand Bagh say ‘rioters took off our girl’s clothes, sent them back naked’

The fear of the anti-Hindu riots that gripped East Delhi is still visible on the faces of the Hindus staying in the riot-affected areas. While some sort of normalcy has returned, when moves from the drain towards Karaval Nagar, Hindus, staring at the close door of the lane still express great fear. This is the area where Tahir Hussain’s building has emerged as one of the epicentres of the riots. In Tahir Hussain’s building, Islamists had mercilessly murdered Ankit Sharma, a young IB official, who died with 400 knife gashes, his intestines torn apart and was then discarded in the drain.

OpIndia reporters spotted one such closed gate to a lane. From the other side of the gate, dozens of scared Hindus looked on – they saw the Media trying to report and the police going about their job of investigating the scene. About 50 metres away from the building belonging to Tahir Hussain, where the brutal murder of Ankit Sharma had taken place a group of men and women stood. They were surprisingly not interested in what was happening on the main road – as the others from the lane were. They stretched their neck and were staring at Tahir Hussain’s building. When they were approached, some walked away, while others, couldn’t hold their tears back.

An elderly woman said, “Look, we have no malice in our hearts. The Muslims brothers who stayed here have left their houses. Even we could have broken their locks and set their houses on fire, but we Hindus would never do this. We are so scared after the riot that we neither sleeping nor eating. They want to turn India into Pakistan, though that is not possible, we will now demand a solution for this. We will not let Tahir Hussain’s building remain here. We will demand that the government demolishes it. They have made Chandbagh their stronghold”.

Another woman said, “When acid bottles and stones were being thrown at us from this building it is then that we realised that this plan was made a long time ago. We have been living in this area for decades. Every day we come and see this building from our roofs, but never realized that plans are being made to kill us here. But even though we live here, we have never really understood what is it that takes place inside such a huge building. This is all a part of their politics”.

A woman standing with the others then said, “We have come out of our houses for the first time in three days. Whatever these people (Muslims of the area) did with us, is being reported, but they didn’t even leave our daughters returning from tuitions. They took off their clothes and sent them to us naked. In front of our daughters, the rioters took off their own clothes and gestured indecently. We can never dream of ever wanting to kill our neighbours, but it is evident from their preparation that they wanted to finish us all off that day”.

Seeing that these women were talking to the reporters, the others, who were earlier hesitant, also came forward. They said that Hindus only have two or three children while the Muslims have ten or twelve, all of them, armed with guns and stones attacking the Hindus.

“We also closed our windows due to fear and did not leave the house for three days. The rioters took advantage of this and burnt our temple as well. Even the houses of most of the Hindus present in the locality were set ablaze. The rioters did not even spare the poor Shyam Chaiwallah and the medical store. They first looted their shops and then set them on fire”, she said.

A woman who had mostly not said much chimed in. She said that the people of Delhi voted for free amenities and it is now them who are bearing the brunt of it.

During the Delhi riots, 38 people had lost their lives in the riots, while more than 200 have been injured. The injured include around 70 persons from the security forces. 48 FIRs had been filed and 514 suspects had also been rounded up by the police. The cops have set up 2 SITs for investigating serious cases of offence that took place during the riots.

A Delhi police constable, Ratan Lal, was shot dead during the riots. Another DCP has been injured during clashes between two groups in Delhi’s Gokulpuri. 42-year-old Hindu Activist Vinod was lynched by a Muslim mob in front of his son Monu for sporting a “Jai Shree Ram” sticker on his bike.

An Anti-CAA rioter by the name of Mohammed Shahrukh was seen firing 8 rounds and intimidating a police officer. But, this did not prevent the cabal of left-liberal journalists to claim “Bhagwa terror” and cast aspersions about the name of the perpetrator.

The body of a young officer of the Intelligence Bureau, Ankit Sharma, was recovered from a drain in Chand Bagh. He was stabbed 400 times for four to 6 hours before being dumped into a ditch.

7000 CRPF personnel had been deployed at ground zero along with 3 Special CPs, 6 Joint CPs, 1 Additional CP, 22 DCPs, 20 ACPs, 60 Inspectors, 1,200 other ranks and 200 Lady Police to contain the situation and prevent further damage to life and property.

To pacify the situation, the Delhi police has held close to 330 Peace Meetings with different sections of the society. These meetings had members of Civil Society Groups, besides representatives of various political parties. The cops also held meetings with Residents Welfare Associations (RWA) and Market Welfare Associations (MWA).

Besides Amit Shah, Prime Minister Narendra Modi had earlier appealed, “Peace and harmony are central to our ethos. I appeal to my sisters and brothers of Delhi to maintain peace and brotherhood at all times. It is important that there is calm and normalcy is restored at the earliest.”

Delhi riots ground report: Eyewitness tells Muslims were prepared for riots, women, children were armed to attack Hindus

Islamist mobs have gone on a rampage in Delhi where the anti-Hindu riots have claimed several lives and given rise to horror stories in the process. As time moves on more and more proofs have emerged, making it sufficiently clear that these riots are nothing but a selective, well-coordinated and planned outrage against the Hindus by Islamist fundamentalists.

It has been claimed by multiple eyewitnesses that AAP’s leader Tahir Hussain was one of the key conspirators behind these anti-Hindu riots which engulfed 37 lives and left more than 200 seriously injured. The quantity of stones, bricks and petrol bomb recovered from Tahir Hussain’s terrace proves that this was not an impulsive reaction but a well-planned and coordinated outrage against the Hindus by Islamist fundamentalists in the national capital.

Mostly all the eyewitnesses OpIndia got in touch with have revealed that the Islamists had been preparing for these anti-Hindu riots since a long time under the pretext of anti-CAA protest.

An OpIndia reporter who has been covering the Delhi anti-Hindu riots extensively reached the Shastri Park by metro on Friday to take stock of the situation. While getting down from an autorickshaw he got the opportunity to meet a Hindu woman who had reportedly eyewitnessed the outrageous atrocities meted out against the Hindu’s in her locality.

On condition of anonymity, the Hindu woman, living in a rented house in Sonia Vihar, agreed to speak to OpIndia. She said that the previous night when she stayed awake in fear, she heard loud noises from the neighbourhood. As she tried to get a closer look, she saw that a group of frenzied Muslims were running across the street towards the main road with sticks, brick-stones, bars, rods, pistols etc. in their hands.

Many woman and children were also amongst the crowd. The eyewitness divulged that she then noticed that the men of their families were giving out stones, bricks and lathis to these women and children and urging them to participate in the attack. They instructed the female members and children of their houses to attack the Hindu’s they come across. “I was stunned to see this,” said the eyewitness.

The woman further stated: “All the Islamist rioters had hoarded bricks and stones inside their respective houses in advance. They were constantly bringing out the bricks and stones from there. Seeing all this, I was so scared that I could not even sleep the whole night. The area we live in, predominantly belongs to the Muslims and our locality is the only locality which houses Hindus,” said the eyewitness.

The woman kept wondering how these Muslims allowed their children and women to participate in such deadly riots, asserting that Hindu’s would never allow their children to do so.

The eyewitness originally from Bihar lives in a rented house in the Muslim dominated area of Sonia Vihar. After the death of her husband seven years ago, she works as a domestic help to raise her children. She has been so scared since the violence that she has not gone to work for the last three days and is compelled to think whether she should stay in Delhi now. Afraid of violence, the woman kept saying the same thing again and again, “Do not take my name, otherwise they will kill me.”

Since the time Delhi has been gripped in violence, many Hindus affected in the Delhi anti-Hindu riots, have come out to narrate their ordeal. One such smalltime shopkeeper identified as Shyam ‘Chaiwala’, who lost his livelihood due to a rioting mob in Delhi’s Bhajanpura, had recounted his horror to OpIndia.

Shyam told us that he watched this horror unfold hiding in a bylane, but he could not do anything. Then he heard that a large Muslim mob has attacked the houses of Hindus in Yamuna Vihar area. Since Shyam’s house was located in that area, he ran fearing for the lives of his wife and children. He reached his home and told his wife to take their four children and leave, away from the Muslim-majority locality and to the house of a family friend in another lane.

Shyam narrated that they were so scared that they spent the rest of the day and night holed up in a corner, hungry and thirsty. When police forces came the next morning, Shyam mustered the courage to come out and go towards his shop. When he reached and saw what had become of his shop, the means of livelihood, he broke down.

After a Hindu man told OpIndia how the Delhi anti-Hindu riots are creating a situation where a devout man has to hide every symbol that gave away his religion, another man from Delhi’s Chand Bagh divulged how he saved himself from the frenzied Islamist mob by hiding his true identity. He says that he wore a “topi” and called himself “Imran” to keep safe from the Islamists who attacked him while he was returning from his work.

Delhi has been burning as Islamists ran amok, resorting to stone-pelting, arson and vandalism, destroying public properties worth crores and hurting several police personnel and civilians in the ensuing mayhem. The Islamist mob have been selectively targetting the Hindu’s in the national capital.

Be it from the murdered IB official Ankit Sharma to head Constable Ratan Lal, from Vinod Kumar to Dilwar Singh and many others, Hindus in several areas of Delhi have been attacked in a planned manner by Islamist mobs.

When I looked back, all three, including Ankit Sharma had disappeared: Boy who escaped the Muslim mob in Tahir Hussain’s building speaks to OpIndia

The National Capital of the country was in the throes of unprecedented violence as anti-CAA rioters went on a rampage, clashing with the pro-CAA supporters and wantonly indulging in acts of violence, arson and vandalism. Soon, the quagmire segued into Hindu-Muslim riots as largescale violence was unleashed against the Hindus.

In one such incident that has captured the national attention, IB sleuth Ankit Sharma was mercilessly dragged by a ferocious Muslim mob operating from AAP leader Tahir Hussain’s building. Later, Sharma’s badly mutilated body with hundreds of stab wounds was found abandoned in a ditch in Chand Bagh.

According to the multiple eyewitnesses accounts, along with Ankit Sharma, there were three other people too who were dragged away by the frenzied Muslim mob inside Hussain’s building. However, one of them managed to make a miraculous escape and perhaps dodged an excruciating death. OpIndia got in contact with this escapee to seek more details about the gory incident.

The minor boy, who was successful in rescuing himself, laid bare his experience in chilling details about the carnage unleashed by the Muslim mob sheltered inside now expelled AAP leader Tahir Hussain’s building. “They were dragging us inside the building. I somehow evaded their grip and extricated myself. But when I looked back, all three were missing,” the boy said in a trembling voice while referring to the three people including Ankit Sharma who were dragged inside Hussain’s building by the murderous mob.

“Violence was raging in Chand Bagh. A large number of rioters were gathering near Tahir Hussain’s house. The rioters attacked the Shiva temple, this infuriated some Hindus, but looking at the sheer number of Muslim miscreants, no one could muster the courage to attack them. Meanwhile, while returning from duty, Ankit Sharma was stunned to see the utter collapse of law and order in Chand Bagh. Proceeding to pacify the rioters, he tried to calm them down, saying that we all have to live here together. However, the rioters gave short shrift to Sharma’s exhortations. Ankit Sharma then proceeded from Chand Bagh to Karaval Nagar, trying to dissuade people from indulging in violence. Some people joined and followed him, including me,” the boy recounted.

He continued, “When Ankit Sharma and others reached near Tahir’s house, the mob instantly attacked us. They tried to drag us inside Tahir’s house. However, I yanked my hand and freed myself from their grip. The rioters dragged two more people to the house along with Ankit Sharma. When I looked back, all three had disappeared. It struck me as a realisation then they would not come back. I ran as fast as I could and locked myself up inside my house.”

The minor said that he had no acquaintance with Ankit but he knew who he was and where he worked. Therefore, when Ankit started out to placate the rioters, he too joined him. However, he adds that since that incident, he and his family are profoundly frightened. The minor is scared of leaving his house. He fears that if his identity becomes public, the rioters will come after him. At the same time, he also regrets that he couldn’t help Ankit and the other two while they were being dragged by the murderous mob right in front of his eyes.

IB sleuth Ankit Sharma’s body was found abandoned in a drain at Chand Bagh. According to the post-mortem report, Sharma was stabbed at least 400 times at different parts of his body and his intestines were torn apart. The fate of the other two who were dragged inside along with Sharma remains in limbo as the police are yet to track them down.

Locals told Opindia that there were about hundreds of goons in Tahir’s building. From there, stones and petrol bombs were hurled at Hindus. Some videos have surfaced in which Tahir is also seen with a rod in his hand. Tahir is absconding soon after an FIR was registered against him.

Supreme Court to expedite hearing on plea seeking revision of definition of the term “Hindutva”

0

A Bench of the Supreme Court headed by Chief Justice of India SA Bobde has said that it will hear a pending petition seeking for a revision of the term “Hindutva”, which was defined as a way of life by the apex court earlier. The court will hear arguments from both sides whether a candidate could be disqualified for the use of “Hindutva” while seeking votes.

CJI Bobde noted, “Their prayer is to offset the ‘Hindutva’ judgment. It will take time as long arguments are expected on the issue. We will try to hear this petition after completing hearing in the Sabarimala case.”

In Dr Ramesh Yeshwant Prabhoo vs Shri Prabhakar Kashinath Kunte judgement in 1995, a 3-Judge Bench of the Supreme Court headed by Justice Verma had said, “Mere use of the word ‘Hindutva’ or ‘Hinduism’ or mention of any other religion in an election speech does not bring it within the net of sub-section (3) and/or sub-section (3A) of Section 123 (of the 1951 Representation of People Act) unless the further elements indicated are also present in that speech.”

The Supreme Court observed that Hindutva/Hinduism is a way of life of the people in the sub-continent. The Bench had further added, “no precise meaning can be ascribed to the terms `Hindu’, `Hindutva’ and `Hinduism’; and no meaning in the abstract can confine it to the narrow limits of religion alone, excluding the content of Indian culture and heritage”.

Read- Origins of Hindutva: Re-arming Hinduism in an era of nation states

Justice Verma had dismissed the idea of equating the abstract terms “Hindutva or Hinduism” with the “narrow fundamentalist Hindu religious bigotry”.

The Supreme Court ruling came after Dr Ramesh Yeshwant Prabhoo, the candidate from Vile Parle Constituency in Maharastra State Assembly elections of 1987, had filed an appeal seeking for revocation of his disqualification ordered by Bombay High Court for asking votes in the name of religion. Nevertheless, Prabhoo’s disqualification was upheld by the Supreme Court.

In 2016, a seven-judge Bench of the apex court led by Chief Justice of India, T.S. Thakur, dismissed a petition filed by social activist Teesta Setalvad, author Shamsul Islam and senior journalist Dilip Mandal who argued that the interpretation of the 1995 judgement has supposedly led to “Hindutva becoming a mark of nationalism and citizenship.”

While Islamists burnt Delhi, these are the people who came together in Patna’s anti-CAA rally to foment trouble further

While Delhi continues to burn with Islamists wreaking havoc, targetting the Hindus in the national capital, the left brigade had joined hands at the ‘Samvidhan Bachao, Nagrikta Bachao’ Maha Rally at Patna’s Gandhi Maidan on Thursday.

This anti-CAA-NRC-NPR rally was convened by former JNU Students’ Union president Kanhaiya Kumar. It was joined by the usual coterie of self-proclaimed ‘liberals’, namely JNU Students’ Union president Aishe Ghosh, Rohit Vemula’s mother Radhika Vemula, actress and ‘activist’ Swara Bhaskar, actor Sushant Singh and film director Anurag Kashyap amongst others.

Congress MLA Shakeel Ahmed, Chandrashekhar Azad, Yogendra Yadav, Jignesh Mewani, Arudhanti Rai, Hyderabad University Students Union President Abhishek Kumar, besides Tushar Gandhi of all left parties were also present to address the rally.

Incidentally, all these self-proclaimed ‘activists’ who were present at the Gandhi Maidan in Patna on Thursday have recently played a vital role in spreading rumours and fanning violence over the new Citizenship Amendment law. From the JNU violence to the Jamia protests to Delhi’s Shaheen Bagh protests, these perennial members of the ‘left-wing coterie’ have not left a single opportunity to fear monger and spread false propaganda against the central government and its newly implemented Citizenship law.

JNU Students’ Union president Aishe Ghosh:

The JNUSU president Aishe Ghosh, against whom two FIRs have been lodged for her alleged involvement in the vandalism of server rooms in Jawaharlal Nehru University on January 4, 2020, has been an important part of the anti-CAA and anti-Modi propaganda in the recent times. She was seen actively participating in the anti-CAA Jamia protest and inciting students against the Citizenship law.

Referring to the abrogation of Article 370, Ghosh had added a new dimension to the protest against the CAA by dredging up the Kashmir issue and linking it with the demonstrations against the citizenship act.

JNUSU president Aishe Ghosh’s mentioning Kashmir during the anti-CAA protests had unmasked the real intentions behind the demonstrations. It vindicated Union Home Minister Amit Shah’s stand who had earlier claimed that the anti-CAA protests are politically motivated and orchestrated by those having ulterior motives.

It is noteworthy to mention that Aishe Ghosh belongs to the hotbed of seditious elements, Jawaharlal Nehru University, where anti-India slogans of “Bharat tere tukde honge inshallah inshallah” and others were raised in 2016. Besides, JNU students also routinely indulge in chanting “Azaadi” slogans.

Actress and ‘activist’ Swara Bhaskar:

In December 2019, to express solidarity, the protesters at Delhi’s Shaheen Bagh were visited by Bollywood entertainer Swara Bhaskar where she spoke against CAA-NRC-NPR and also instigated the crowd against the government. The actor was also joined by Sharjeel Imam, the mastermind of the Shaheen Bagh protest, in her endeavour.

In a video uploaded on Youtube on January 1, Swara Bhaskar could be heard provoking the crowd by saying that they have shown others the true path and people should be drawing inspiration from them. While she instigates the gathering she is also seen giving false and malicious statements against the government and it’s newly implemented Citizenship Amendment Act and NRC.

Moreover, Swara Bhaskar on several occasions has been caught spreading lies about the implementation of CAA and NRC, stating how those Hindus who are left behind in NRC will get ‘back door entry’ through the CAA.

In a conversation with The Wire employee Arfa Khanum Sherwani, Bhaskar indulged in fear-mongering and said that not only is the new law ‘unconstitutional’ but also ‘lays the foundation of Hindu Rashtra’.

Actor Sushant Singh:

Claiming that he was kicked out of his job for speaking against CAA, the ex-host of the crime based show Savdhaan India, Sushant Singh has been time and again seen mindlessly ranting against the CAA and NRC. From claiming that CAA will be withdrawn even after refugees have already been granted Indian citizenship under the amended Act in his anti-CAA speech at Mumbai’s Azad Maidan on February 16, to his mindlessly ranting that the CAA, NPR and NRC will deprive the Muslims held in detention centres of their right to have sex and procreation, Sushant Singh has consistently been displaying ignorance and spreading falsehood against the new Citizenship law.

Film director Anurag Kashyap:

The ‘anti-Modi’ hatred of the ultra-left wing intelligentsia of the country, which Bollywood director Anurag Kashyap is an indispensable part of, had compelled the propagandist filmmaker to go to Jamia and Shaheen Bagh to express solidarity with the Islamist protestors present there, agitating against the Citizenship Amendment Law since over two months.

Prior to this, Anurag Kashyap had also joined the ‘Mumbai Bagh’ anti-CAA protest on February 5, which the Islamists in Mumbai have launched on the lines of Shaheen Bagh of Delhi.

Following the violence at Jamia Nagar in Delhi where rioters ran amok, vandalising public property, setting buses on fire, Prime Minister Modi took to Twitter to appeal for peace. However, Anurag Kashyap, being the fake new peddler that he is, chose that moment to blame the ‘BJP IT cell’ for ‘creating propaganda about students being violent’. This when there were ample video evidence to prove that the protests were far from peaceful and how buses were set ablaze systematically.

Bhim Army chief Chandrashekhar Azad:

Bhim Army chief Chandra Shekhar Azad had been arrested in connection with the violence in Old Delhi’s Daryaganj on December 21, a day after his outfit defied a Police ban and organised a march from Jama Masjid to Jantar Mantar against the new citizenship law.

The Delhi Police had denied permission to Chandrashekhar Azad’s protest march against the Citizenship (Amendment) Act from Jama Masjid to Jantar Mantar. Reports say that thousands of Muslims gathered at Jama Masjid after the Friday prayers, joined by Bhim Army members.

On the day of the march, Azad had given a slip to the Delhi Police after the security personnel tried to detain him. He came outside Jama Masjid early Saturday (December 21) and was detained. He was arrested later, police said. After being detained, Azad was kept at the Crime Branch office in Chanakyapuri since he said he was unwell. He was later handed over to the central district police.

Police had suspected Azad instigated the crowd which turned violent near Delhi Gate and burnt a car.

Swarajya Abhiyaan’s chief Yogendra Yadav:

In the view of violent Anti-Citizenship Amendment Act (Anti-CAA) protests that have broken throughout the country where rampaging mobs have indulged in mindless violence, Section 144 had been imposed in several parts of the country to ensure that peace prevails. Swarajya Abhiyaan chief Yogendra Yadav was detained by the police in December last year for protesting against Citizenship Amendment Act (CAA) despite Section 144 being imposed in parts of Delhi.

Only recently, OpIndia had exposed how NSUI (Congress’ student wing), Swarajya Abhiyaan and the Left were hands in gloves trying to foment trouble on the 19th of December by instigating and coordinating several protests across the nation.

It’s not surprising that all these ultra-left wings who share a common yearning to break India got together in Patna to address the CPI’s ‘Samvidhan Bachao, Nagrikta Bachao’ maha rally to once again spread rumours against the Citizenship Amendment Act, which grants citizenship to persecuted minorities like Hindus, Buddhists, Sikhs, Jains, Parsis and even Christians from neighbouring Islamic nations.

Bangladeshi JMB terrorist and his Indian aide convicted by Kolkata court in money laundering and terror financing case

On Thursday, the Calcutta City Session Court in Kolkata convicted a Bangladeshi man and a member of Jammat-Ul-Mujahideen, Rahmatullah alias Sajid, and an Indian National named Mohammed Burhan SK on charges of terror financing under the under Section 3 of Prevention of Money Laundering Act, 2002 (PMLA).

The duo was booked in 2014 by the National Investigation Agency (NIA) under the Explosive Substances Act and Unlawful Activities Prevention Act (UAPA). The quantum of punishment would be announced on March 17. The Enforcement Directorate (ED) filed a charge sheet under PMLA in November 2018 and had attached two land plots and bank accounts.

Complaints filed against WSJ with Delhi Police and Maharashtra Police for spreading fake news over Delhi riots and Ankit Sharma’s murder by a Muslim mob

Complaints have been lodged against the American daily ‘The Wall Street Journal(WSJ) with Delhi Police and Maharashtra Police on the charges of “defaming a particular religion and propagating communal hatred” in connection with its misreporting on the murder of IB sleuth Ankit Sharma during the vicious anti-Hindu Delhi riots.

The Wall Street Journal is accused of misquoting victim Sharma’s brother, alleging in its report that the young IB officer was murdered by a mob of shouting “Jai Shri Ram”. According to the WSJ article, it was the frenzied Hindu mob who were responsible for carrying out the ghastly murder of Ankit Sharma.

On Wednesday, the Wall Street Journal (WSJ) published a report titled, “India’s Ruling Party, Government Slammed Over Delhi Violence”. In its report, the WSJ claims that Ankur Sharma, the brother of the deceased IB officer allegedly said to them that the rioters had come armed with stones, rods, knives, and even swords, and shouted slogans ‘Jai Shri Ram’ before attacking his brother Ankit Sharma.

It is notable here that Ankit’s family has been consistent in their statements that their boy was dragged by a Muslim mob that had come from Tahir Hussain’s house.

Multiple eyewitnesses had corroborated that Sharma was dragged by an enraged Muslim mob from inside the house of AAP leader Mohammad Tahir Hussain and subsequently killed by them. Sharma, having stabbed hundreds of times with his intestines pulled out, was found dead and abandoned inside a ditch in Chand Bagh neighbourhood.

Legal activists group Legal Rights Observatory has filed the complaints against WSJ. They have also reportedly filed complaints to the Ministry of Home Affairs, and Delhi Police commissioner’s office to investigate the role of WSJ in Delhi riots to demean India.

Ankit Sharma’s brother Ankur Sharma categorically denied the WSJ fabrications and invalidated its report. “I have never given such a statement to the Wall Street Journal. This is a ploy to defame my brother and my family. The Wall Street Journal is lying,” he said to Prasar Bharati News Service.

Earlier, Speaking to Times Now, Ankur Sharma had alleged that at least 40-50 people associated with AAP leader Tahir Hussain took his brother and had murdered him. “They killed my brother and some others and threw them in the drain. They have recovered three more bodies from the drain. Tahir Hussain is behind the incident,” said Ankur SharmaAnkur also reiterated that it was the mob inside the AAP leader Tahir Hussain’s house who mercilessly dragged him inside and inflicted unspeakable atrocities on him.

However, despite Ankur’s repeated assertions blaming Muslim mobs under Tahir Hussain’s tutelage being responsible for his brother’s murder, the Wall Street Journal went ahead to demonise Hindus by blatantly misquoting Ankit Sharma’s brother and passing the buck of barbarity on Hindus.

John Oliver’s anti-Modi show is full of lies, fake narratives and rumour mongering on everything from CAA-NRC-NPR, Modi to RSS

In his show Last Week Tonight that was uploaded on YouTube on Feb 24, 2020, comedian John Oliver recently had a trending show revolving around PM Narendra Modi and India. However, not only did he use an incorrect map of India, he also managed to use sources that had already been pointed out for inaccuracy and linked occurrences without proper context. Here are some of the inaccuracies of John Oliver’s narrative. Here are the inaccuracies of John Oliver’s narrative.

Gujarat Riots

John Oliver referenced the 2002 Gujarat Riots where he pointed out how Modi was denied a visa by the United Kingdom and the USA. The Gujarat riots were sparked by a horrific incident- the death of 59 pilgrims trapped in a train returning from Ayodhya in 2002 which was burnt by Muslims at Godhra station.

First of all, the Supreme Court had appointed and monitored a Special Investigation Team to probe the riots. The team found NO connection- I repeat- NO connection between PM Modi- who was at that time chief minister of Gujarat- and the riots.

To add to that, Oliver added that “it was just not okay” for PM Modi be silent on this issue. But he has left out the fact that PM Modi has spoken on the Gujarat Riots. Modi has said, “Grief, sadness, misery, pain, anguish, agony—mere words could not capture the absolute emptiness one felt on witnessing such inhumanity.” He added, “In decisively confronting this great turmoil, I had to single-mindedly focus all the strength given to me by the almighty, on the task of peace, justice and rehabilitation; burying the pain and agony I was personally wracked with.”

Persecuted Minorities

John Oliver states that under PM Modi, there has been an ‘steady increase and escalation of persecution of religious minorities.’ He claims that PM Modi is an increasingly and I quote ‘controversial figure’ in India because of this.

However, statistics of the National Crime Records Bureau, communal/religious crimes show a steady and significant decline under the Modi government. In 2014 [when Modi first came into power] there were over 1200 incidents. As of 2018, the number is less than half of that.

Moreover, the Modi government has made specific efforts to modernize education so that economically weaker Muslim children are better equipped and skilled for jobs. There are financial incentives for Muslim girls and even things like air travel for Hajj (that’s the Muslim pilgrimage to Mecca) was pointedly reduced under the Modi government. The cost? Previously Hajj cost approximately Rs. 97000 (appx. $1350 USD). Now the cost is only Rs. 20000; that is $278.69.

CAA+ NRC+NPR

Speaking of persecuted minorities- Oliver highlights the misinformed liberal narrative of the CAA, NPR and NRC.

The Citizenship Amendment Act is aimed towards refugees. It does not affect citizens. It actually helps refugees out- fast tracks the citizenship process of persecuted religious minorities from Afghanistan, Bangladesh and Pakistan. A mention of these three countries was conveniently missing from Oliver’s piece.

The logic for why Muslims are not included in the list of religiously persecuted minorities is simple. The CAA only applies to refugees in three countries- Pakistan, Afghanistan and Bangladesh. These countries are Islamic nations- therefore, Muslims in these countries are not the persecuted minority. This is an internationally recognized fact. If John Oliver is speaking about making Muslims stateless, this is absolutely an unsubstantiated statement. The CAA has nothing to do with Indian citizens; including Muslims carrying an Indian passport and paperwork. Second, Muslims can still come to India and seek citizenship under the normal provisions, just any other legal foreigner seeking citizenship in India. CAA does not bar Muslims, or anyone, from becoming Indian citizen.

The next thing John Oliver does is incorrectly tie the NPR and the NRC to the CAA.

The NPR is a regular exercise of the country- very similar to how the USA Census works. The last NPR was conducted in 2010 – by the way, this was when PM Modi was not even the prime minister yet. The purpose of the NPR, like census information gathering in the USA, is to ensure that India, like other countries has a record of its demographics and citizens. With this information, the government is able to serve targeted, more effective services to the people.

Regarding the NRC- John Oliver also mixes it in with the CAA and NPR. However, he leaves out the very simple fact that there has been no NRC officially announced. This means that NRC does not exist.

So why does NRC even come up?

Misinformed CAA protestors are mixing it with the NRC of Assam that was updated on the instructions of the Supreme Court- and this was because the state of Assam has constantly dealt with the issue of illegal immigration for decades. Moreover, original NRC was prepared way back in 1951, under the orders of Jawaharlal Nehru government, which was only updated recently as per the provisions of Assam Accord, signed by Rajiv Gandhi led Congress government in 1985.

As for detention camps, they were set up by the Congress government to keep persons facing prosecution for being illegal foreigners, and such camps are operating in Assam for more than a decade. What John Oliver is trying to incite is that Muslims could be put in detention camps because of the NRC. The actuality is that there are no detention camps under PM Modi in the country for this purpose.

Inaccurate Reporting by John Oliver

Here are the other flaws of John Oliver’s piece.

He first uses an incorrect map of India with a part of Kashmir illegally occupied by Pakistan cut off. I mean, John, fo’ real?! Simply googling a correct map of India gives you a plethora of accurate options!

Next, all of Oliver’s video reporting footage is either from NDTV- that’s a well-known left-leaning television channel in India or from Al Jazeera- who is funded by the state of Qatar and has been criticized internationally for biased reporting. The remaining footage Oliver uses comes from BBC; a channel that has been repeatedly criticized for covering conflicts in South Asia with an anti-India bias.

Oliver also talks about RSS and claims that the organization is inspired by Adolph Hitler. The Nazi ideology was to conquer all foreign lands and eliminate the Jews. Oliver is inciting that RSS ideology is similar to that of the Nazis towards Muslims. Since PM Modi is affiliated with the RSS, he wants to ‘wipe out’ Muslims.

This is so uncorroborated that it’s not even funny. The reality is that official 2018 estimates show a significant percentage increase of the Muslim population in India. Additionally, PM Modi has been verbose and pro-active on his non-partisan stance. His huge successes in welfare schemes like implementing electricity and LPG connections are available for everyone without discrimination.

Furthermore, under PM Modi, India has the strongest bilateral relations than ever before with Islamic countries like Palestine, Iran, Saudi Arabia, the UAE and Jordan. The Maldives and Bahrain have even bestowed their highest civil honours on PM Modi. Over the last five years, many Indian prisoners have been released by Saudi Arabia, Kuwait, Qatar and Bahrain under PM Modi. Business relations with Bangladesh have also significantly improved.

The thing to keep in mind here; John Oliver is fundamentally an entertainer. He is not a legitimate journalist or an accredited academic. His show comprises of simplified one liners without full context for a niche audience. This is not just this particular show. This is all of his shows. Oliver puts out an entertaining show and people watch. That’s his job. But it becomes a problem if you start believing it as fact. It is integral to deep dive into statements made and the evidence used before formulating an opinion. This is not just for John Oliver, but for any content consumed. As for John Oliver’s show; consume a comedian’s content in the way that is meant to be consumed. Comedy.
