Nirbhaya rapist Mukesh’s lawyer trying to further defer the execution: Know the legality

In another preposterous attempt to save the rapists of Nirbhaya from the death penalty, Advocate ML Sharma, on March 6, 2020, claimed that his client Mukesh must be given a chance to restore his legal remedy (curative petition). He said the limitation period to file a curative petition was three years from the date of dismissal of the review plea and therefore he still has till 2021 to file the petition.

The concept of limitation is simple- you cannot be given forever to file a case, there should be an end to litigation. If you have a just cause, come to the court within a time frame. Don’t sleep over your right! Therefore, Schedule given under the Limitation Act provides for the time period within which filing of any suit/appeal/application is permissible. It is important because if there is no time frame within which the suit or application can be filed, the case will go on for ages. He is relying on Article 137 of schedule given under The Limitation Act which states that for any application for which no period of limitation is provided in the Act, the limitation of such application is three years from the date when the right to apply accrues (in this case dismissal of the review petition).

Therefore, Mukesh Singh through his lawyer is now asking the court to “restore” the rights available to him, and allow him to file curative and mercy petitions till July 2021 (after 3 years from 2018 when his review petition was rejected). What he, unfortunately, forgot to refer was the Handbook on Practice and Procedure and Office Procedure of the Supreme Court of India that explains in detail the procedure and requisites that shall be fulfilled for filing a curative petition.

The handbook, apart from stating other important points related to the curative petition also specifically mentions that it shall not be governed by the provisions of The Limitations Act, 1963. Which means the law on which the defence lawyer is relying upon is not applicable in this particular case. The handbook, however, mentions that the same must be filed within a reasonable time from the date of the judgment. Now, it is a trite law that reasonableness is a ‘question of fact’, meaning thereby that it will depend upon the facts of the case to decide the time frame under which curative petition can be filed. In the present case, everything that had to be done has already been done. The saga has been going on since the last 8 years. The convicts were given chances time and again to prove their case. Court, just to make sure that their right of being heard is not violated, kept postponing the dates.

Sometimes the convict is not mentally fit, sometimes his lawyer is not available. Everyone knows that there is no legality in their claims. The defence lawyer is not only ‘creating’ the loopholes in the law, a law which is well established but also maligning the image of the amicus curie without any basis. He claims that Vrinda Grover “falsely” informed him that Mukesh had to file a curative petition within 7 days of the death warrant on January 7. This argument holds no water for two reasons, first being that, as per the order passed by the Delhi High court on Feb 5, 2020, all four convicts in the Nirbhaya gangrape-murder case have been directed to avail all their legal remedies within the next seven days. Second, is that all the petitions have been entertained and decided by the courts on merits. Filing the petition again on the same grounds is defeating the purpose of curative petition i.e. “to meet the ends of justice”. Unfortunately, the one who should be protecting the law is abusing it. As per a study, in 91% of delayed cases, it was lawyers who sought more time as compared to a much lower 36% in cases that were disposed of in time.

Having done the analysis of counsel-side and court-side delays, it concludes that 82% of all delays could be attributed to lawyers and not the judges per se. It is time that our Supreme court take strict actions against those who are deliberately trying to twist the law as per their own convenience.

Mamaji Returns? Main gaya hi kahan tha? Shivraj Singh Chouhan’s cryptic tweet amidst MP crisis

Amidst the Madhya Pradesh government crisis, former Madhya Pradesh Chief Minister and senior BJP leader Shivraj Singh Chouhan today took to Twitter to let everyone know he has been around all the time.

Early this morning, Chouhan wished his ‘brothers and sisters’ and ‘nieces and nephews’ a very good morning. Quoting the tweet, The Hindu journalist Nistula Hebbar said, ‘#MamajiReturns?’. Chouhan has earned the monicker ‘mamaji’ (maternal uncle) from his supporters in Madhya Pradesh.

To that, Chouhan replied, ‘Nistula ji, main gaya hi kahan tha? (Nistula ji, when did I even leave?)’.

On Monday, senior Congress leader Jyotiraditya Scindia tendered his resignation along with 20 other Madhya Pradesh Congress MLAs. This led the MP state government on the verge of collapse. The BJP has maintained that should the Congress government in MP fall and should BJP come to power, Chouhan will be the Chief Minister.

Jyotiraditya Scindia had finally resigned from Congress after over a year of speculations and sidelining. As is usual with the Congress, internal feud, nepotism and lack of leadership in the Congress are being blamed for it. Scindia’s displeasure was evident right after he was denied the CM’s chair and his resignation, for many political watchers, was not surprising.

Even Congress stalwarts like Natwar Singh, many senior journalists and commentators have opined that Scindia’s resignation was only a matter of time. The feud in MP congress between the Scindia faction and Kamal Nath faction was out there for everyone to see. Scindia was regarded by many as the more deserving candidate for the CM’s chair.

Scindia going incommunicado was reported in media on 9 March. Congress leader Digvijay Singh had even claimed that they are not able to speak to Scindia because he had ‘Swine Flu’. Scindia had met with PM Modi, Home Minister Amit Shah and finally announced his resignation publicly.

Like a petty jilted lover, Congress went ahead and ‘expelled’ Scindia from the party, after he had resigned. Just like a miffed jilted lover exclaims ‘I dumped her first’ after being rejected.

Congress leaders and office bearers too had launched soap opera style attacks on Scindia soon after his resignation. They had called him traitor, selfish, shameless, and many more things. They even dragged his family into it, ignoring that Scindia’s father had been one of their tallest leaders.

Then Congress supporters and IT cell workers descended upon Scindia’s Wikipedia page. They tried vandalising his page, calling him a traitor, coward, comedian, power-hungry and whatnot

With Scindia, over 22 Congress MLAs resigned. It is not clear what is more shocking for Congress, that a chunk of their MLAs has resigned following the footsteps of a senior party leader, or that someone has just ‘dared’ to refuse to be a Gandhi family slave.

A day later, the whining from Congress still continues. Taking their very-filmy meltdown a notch further, they are now crying over how the ‘traitor’ broke their ‘trust’.

The official handle of the Madhya Pradesh Congress has shared a dramatic image of broken ‘Trust’ with a text announcing how they ‘made’ Scindia. They have claimed that in Scindia’s 18-year-old political career, they had ‘made’ him an MP for 3 terms, a Union minister twice, and made him general secretary and campaign head too. Yet, he broke their trust.

What Congress does not add here is how the UP Congress general secretary post was specially crafted for Scindia after denying him the CM’s post in MP. As Congress was facing an existential crisis in UP, Scindia was made the in-charge, along with Priyanka Gandhi, the congress princess with zero election wins, and zero political credentials to lead the party. Probably they thought that ‘granting’ a position on par with the princess is a benevolence bestowed upon the 3-time MP. Or maybe Congress’ idea of ‘making’ leaders is equating ‘grandmother’s nose’ with a strong political base in Madhya Pradesh and 3 Lok Sabha wins.

It is also possible that Congress’ anger and frustration over Scindia are partly due to Scindia and partly due to the growing fears about the next leader who has been ignored and sidelined in an equal manner, Sachin Pilot. Pilot comes with a similar political strength, was equally expected to be the CM of the state, holds similar political support among Congress workers and leaders in Rajasthan, had a father who was a strong Congress leader too. Not to mention another Congress leader whose ascent within the party was cut short due to sudden death.

It is also pertinent to note that like both Madhavrao Scindia and Rajesh Pilot were seen as strong Congress leaders rising to the top, Jyotiraditya Scindia and Sachin Pilot are also seen as strong ‘competitors’ for Rahul Gandhi, the prince who is slated to inherit the Congress throne.

Senior Congress leader Rahul Gandhi today walked away in a huff when journalists asked him to comment on Jyotiraditya Scindia’s resignation.

Many have blamed the Nehru-Gandhi family for Scindia quitting Congress. There have also been reports that the Gandhis, despite knowing Scindia’s unhappiness over the way things were being handled in Congress, did little to make changes.

In his resignation, Scindia had written that his only wish is to serve the people of the country and he could not see himself doing so in Congress. Following his resignation, Congress indulged in petty politics and ‘expelled’ him from party for ‘anti-party activities’. He was even abused on social media by Congress leaders and supporters and called a ‘traitor’ for ditching Congress.

Geneva: PoK activists hold Anti-Pakistan protests against oppression and terrorism in Gilgit Baltistan

Political activists from Pakistan-occupied Kashmir (PoK) held a protest against Pakistan alleging the nation of conducting oppression of indigenous people, exploitation of natural resources and sponsoring terrorism in the region, as per an ANI report.

It was the 43rd session of the UN Human Rights Council in Geneva, where the protesters were seen holding banners like “Release all political prisoners from Gilgit-Baltistan” and “CPEC and mega projects in disputed areas of Gilgit-Baltistan are unacceptable” challenging Islamabad.

Nasir Aziz Khan, spokesperson of United Kashmir People’s National Party (UKPNP) was quoted by ANI, “Since the last 73 years, we have been deprived of our basic fundamental human rights. That is why we have no say at any platform in Pakistan. We do not have any representation in Pakistani institutions, for example, Pakistan National Assembly or Senate or anywhere, we cannot raise our voice. Those who dare to raise their voices are victims of the state.”

He added, “Pakistan is marginalizing our people, there is a witch-hunting of the political opponents. If you see Gilgit-Baltistan, people like Baba Jan, Iftikar Hussain, and their colleagues were tried under anti-terrorism laws and they are facing 40 to 90 years of life imprisonment. This is the irony of society. We are facing cross-border terrorism sponsored by the state and there are extremist groups roaming freely in our region. They are recruiting youngsters in that region. We can say that Pakistan Tehreek-e-Taliban spokesperson Ehsaan Ullah Ehsaan who was in custody of the army managed to escape.”

The protestors strongly condemned cross-border terrorism as it has severely affected the peace and harmony in the region.

He further added, “Same is the case for Jaish-e-Mohammed chief Masood Azhar, who was also in custody. Now they say that he has escaped with his family. This is the clear message for the people that the state is still protecting them, sponsoring them and sending them to different areas.”

Junaid Qureshi, a Kashmiri from Srinagar who is heading the European Foundation for South Asian Studies (EFSAS) said, “PoK belongs to Jammu and Kashmir. It is a part of Jammu and Kashmir and people have been facing huge difficulties. If you look at Pakistan and the people there, the Baloch have been facing difficulties. The Pashtuns have been facing it and we are under illegal occupation. Pakistan- occupied Kashmir is illegally held by Pakistan. So, you can imagine the kind of attitude they have towards their own citizens. That is slavery and that is the colonization of us.”

He added, “At the same time, they are trying to sell part of our state, which is Gilgit-Baltistan to the Chinese. So, this cross-border terrorism which Pakistan is perpetrating – there is no fault of people of PoK in that. This is happening because they have put lent officers, who run the state of affairs there. This cross-border terrorism is imposed on them to function as a launchpad in the valley, create disturbance and kill people. This is the agenda of Pakistan to keep that part boiling while they keep their colonial masters in power in PoK.”

Earlier this month Activist from POK Senge Sering accused Pakistan at UNHRC saying, “Pakistan is an occupier, Pakistan wants to prolong the occupation. It is in Gilgit Baltistan of an illegal basis and the only way it can prolong the occupation and abuse of resources is by spreading lies and myths about Jammu and Kashmir and confusing the international community and confusing the local people.”

Digvijaya Singh wants Congress to purge everyone with RSS roots, netizens point out his own legacy

Senior Congress leader Digvijaya Singh had a meltdown on Twitter on Wednesday, a day after senior Congress leader Jyotiraditya Scindia quit the grand old party. Taking a dig at Scindia, whose father was with Jana Sangha, the political arm of the RSS which ceased to exist in 1971, Singh said Congress should purge those who are closer to Sangh ideology.

Scindia’s father was with Jana Sangh and his aunts, Yashodhara Raje and Vasundhara Raje have been senior BJP leaders. His grandmother, Vijayaraje Scindia had contested 1957 elections on a Congress ticket. However, she later quit Congress to join the Jana Sangha.

However, in his attempt to subtly label Scindia a ‘Sanghi’, Digvijaya Singh seems to have forgotten his own roots.

Twitter user ‘db’ claimed that Singh’s father was also a member of the Hindu Mahasabha.

Digvijaya Singh and RSS ties

Hindu Mahasabha was founded by Madan Mohan Malviya. Veer Savarkar was a prominent member of the Hindu Mahasabha. RSS founder, Keshav Hedgewar, was a former Hindu Mahasabha member.

Singh’s own brother, Lakshman Singh, had switched to the BJP from Congress before 2004 Lok Sabha elections. He then went back to Congress in 2013. Moreover, by Singh’s own admission, their family has ties with the Jana Sangh.

As per an Outlook Magazine report from 2009, when Digvijaya Singh’s father contested as in independent candidate in 1952 against Congress, the Jana Sangh had supported him.

Aligarh: Communal tension over dead goat found after Holika Dahan

Communal tension prevailed in Jallupur Sihor village, Aligarh, Uttar Pradesh, after a dead goat was found in the remains after the Holika Dahan on Tuesday morning. As per a report in Jagran, people of a community got together and expressed anger over the incident.

As per the report, when some people went to the place where Holika Dahan had taken place the previous night, they noticed a dead goat lying next to it. This angered them. They believe that the dead animal was placed there knowingly to create communal tension. Soon, more people gathered and it led to communal tension.

To stop the situation from worsening, one Vishnu Sharma called up the police. When Police assured the villagers of proper investigation, they calmed down.

Madhya Pradesh crisis: Congress decides to move its legislators to Jaipur, BJP MLAs in Gurugram

A day after former Union Minister and four-time parliamentarian Jyotiraditya Scindia resigned from the Congress, the Kamal Nath-led government has further plunged into crisis. Following his lead, 22 MLAs have resigned in Madhya Pradesh and 200 workers of the party in Gwalior have followed suit.

Following the crisis in the Congress party, BJP is not willing to take any chance and have moved their MLAs to Gurugram from Bhopal late on Tuesday night.

The BJP MLAs are reportedly staying at ITC Grand Bharat in Gurugram.

“We have come here in a festive mood and we will stay here and enjoy for the next few days,” Kailash Vijayvargiya told reporters after arriving at New Delhi.

The Congress party after losing 22 MLAs have now decided to move their flock to Congress-ruled Rajasthan to keep them away from the BJP. Madhya Pradesh Congress MLAs are likely to leave for Jaipur from Bhopal on Wednesday amidst the political crisis in the state.

In a dramatic turn of events on Tuesday, Jyotiraditya Scindia met Amit Shah and Prime Minister Narendra Modi in Delhi and tendered his resignation from Congress membership to Sonia Gandhi.  In his resignation letter to Sonia Gandhi, Jyotiraditya Scindia said it is time for him to move on. 

With Jyotiraditya Scindia and 22 other MLAs loyal to him quitting the Kamal Nath government in Madhya Pradesh, the Congress-led government is on the brink of collapse as the numbers stack up in BJP’s favour.

Meanwhile, Madhya Pradesh Chief Minister Kamal Nath on Tuesday put up a brave face to state that he was confident that his government will not collapse following the crisis triggered by the resignation Congress leader Jyotiraditya Scindia and the resignation of at least 22 MLAs loyal to him.

Liberals suffer meltdown on social media after actor Milind Soman reveals his ‘Sanghi’ background

Supermodel Milind Soman has spoken about his experience in an RSS-run Shakha as a child in his memoir ‘Made in India’. In an excerpt published on The Print, the actor speaks of the childhood memories he has of the Shakha. He wrote that he was surprised by the accusations of communal diatribe that is leveled against the Shakha and described it as a ‘Desi Scouts Movement’.

Soman wrote in his memoir, “When I read today all the subversive, communal propaganda the media attributes to RSS shakhas, I am frankly baffled. My memories of what happened at our shakha between 6 and 7 p.m. each weekday evening are completely different—we marched about in our khaki shorts, did some yoga, worked out in a traditional outdoor gymnasium with no fancy equipment, sang songs and chanted Sanskrit verses that we did not understand the meanings of, played games and had a bunch of fun with our fellows.”

Milind Soman further wrote, “The whole thing was overseen by a team of mostly-well-meaning—if not always inspirational—adults, who truly believed they were helping raise good ‘civilian soldiers’— boys respectful of authority, well-behaved in the presence of adults and well-aware of the importance of physical fitness— who would put their efforts into nation-building when they grew up.” He also said that his dad was a member of the RSS and a ‘proud Hindu’.

As expected, liberals on social media are not pleased to learn that one of the most popular and attractive models comes from an RSS background. They have taken to social media to troll the actor.

Others are making poor jokes on the social media platform to cope with the fact.

The reaction from liberals on the revelations made by Milind Soman is along expected lines. They find it tough to fathom that normal everyday ordinary human beings find the RSS a healthy organization contributing fruitfully to society, much less any accomplished individual. While people on the right do not take the political opinions of celebrities too seriously, liberals hail them as intellectuals as it serves their propaganda purposes. Hence, when one of them turns out not toeing the line, the liberal camp suffers an intense meltdown.

Former Congress leader Jyotiraditya Scindia likely to join BJP tomorrow: Report

Jyotiraditya Scindia is likely to join the Bharatiya Janata Party on Wednesday, the 11th of March. The senior Congress leader had submitted his resignation on the 9th of March. Following his lead, 22 MLAs have resigned in Madhya Pradesh and 200 workers of the party in Gwalior have followed suit.

Sources have reportedly told India Today that the former Congress leader is likely to join the BJP on March 11. Meanwhile, the BJP is expected to declare its Rajya Sabha candidates on Wednesday. Reportedly, even an hour after the BJP’s CEC meeting at the party HQ in Delhi ended on Tuesday, Prime Minister Narendra Modi, Home Minister Amit Shah and party president JP Nadda were still discussing the party’s nominees for the upper house.

The Bharatiya Janata Party (BJP) has also handed over the resignation letters of 19 MLAs from the Congress party to the Speaker of the Madhya Pradesh Assembly. Despite the obvious political connotations of the gesture, the BJP, for its part, claims that they are merely helping their colleagues in the Assembly. The BJP hasn’t yet sought an appointment with the Governor thus far.

Meanwhile, Congress supporters have resorted to trolling Jyotiraditya’s son Mahanaryaman on social media for saying that he is proud of his father. Amidst all of this, the return of Shivraj Singh ‘Mamaji’ Chauhan to the seat of Chief Minister appears imminent.
