FIR registered against Mithun Chakraborty’s son Mahaakshay and wife Yogeeta Bali alleging rape, intimidation of an actress-model

In a shocking revelation, a Bhojpuri actress has accused Mahaakshay, son of veteran actor Mithun Chakraborty, of rape and intimidation. A First Information Report (FIR) has been lodged against the actor’s son at the Oshiwara police station in Mumbai on Thursday.

Victim alleges that Mahaakshay raped her for 4 years

The victim has alleged that she was in a relationship with Mahaakshay, aka Mimoh, in 2015. In the FIR, she had accused Mahaakshay of providing her with a spiked drink and then raping her, while she lay unconscious at his house. According to the girl, the accused had also offered to marry her on several occasions. She has further alleged that Mahaakshay forced her to have sexual relations with him, under the pretext of marriage. As per the FIR, the accused continued to rape the victim over a span of four years.

Victim accuses Yogeeta Bali and her son of intimidation and illegal abortion

She also alleged that at the same time, he also resorted to mentally harassing her. The victim has claimed that Mahaakshay had coerced her into aborting their unborn child after she became pregnant. She has alleged that the accused gave her abortion pills, without her knowledge, resulting in termination of her pregnancy.

The victim has also named Yogeeta Bali, mother of the accused and wife of Mithun Chakraborty, of intimidation and threats to dispose of the case. The police have booked the mother-son duo under Indian Penal Code (IPC) Sections 34 (acts done by several persons in furtherance of common intention), 313 (rape), 328 (causing hurt by means of poison), 376 (2) (n) (repeated rape), 417 (cheating) and 506 (criminal intimidation)

Victim approached Court in 2018

Prior to Mahaakshay’s marriage with TV actress Madalasa Sharma in 2018, the victim tried to get an FIR registered against him. However, when the police refused to comply, she approached the Rohini court to get the FIR registered. After examining the prima facie evidence, the Court directed for the FIR to be lodged against Yogeeta Bali and Mahaakshay and commencement of the investigation. Two years after the Court order, a case has been registered at the Oshiwara police station in Mumbai.

A Muslim man wrote to Darul Uloom if he can have a marriage similar to shown in Tanishq ad, this is what he got as reply

In the spirit of Ganga-Jamuni Tehzeeb, a Muslim man wrote to Darul Uloom Deoband seeking guidance from the Islamic seminary on his proposed marriage with a Hindu woman. In the question that was communicated to the Islamic clerics, the Muslim man said that he had proposed a Hindu woman for marriage which had been accepted subject to certain terms and conditions.

The Muslim man listed a series of eight conditions set by the Hindu woman which are quoted here as follows:

  1. She shall not convert as a Muslim before or after marriage and shall continue as a Hindu through out her life.
  2. She shall be allowed to perform puja as per Hindu rituals in the in-law’s house without any hinderance and no one shall interfere in her faith and belief.
  3. Her name shall not be changed to a Muslim name after marriage.
  4. She shall not be asked to wear Burkha at any point of time in her life.
  5. I (her Husband) can not accept a second wife till she continues as my wife.
  6. The procedure of triple Talak for Divorce shall not be applicable in our case and Divorce procedure as applicable to Hindus shall be applicable in our case.
  7. Since Girl’s family will cut off all relations with her after marriage, she wants marriage should be performed through usual procedure of Nikahnama before a social gathering of my family members and relatives and the Nikahnama must contain the above conditions.
  8. Further to be assured that it is a legal marriage, she wants that I should take written permission and approval from Muslim Personal Law Board and Muslim religious authorities before marriage.
The Darul Uloom Deoband question

Pursuant to the conditions, the Muslim man posed a set of two questions to the Islamic clerics. “I again request your goodself to kindly give an early reply so that we can take a decission either to marry or to foget each other.I will remain obliged to you for your early reply throughout my life,” he said. The questions are quoted here as follows:

  1. Whether marriage with her conditions will be acceptable to Muslim community and Her conditions can be reflected in Nikanama?
  2. Whether such marriage will be legal and binding to our family members?

The answer to the inquiry came fairly quickly. The Islamic clerics in their answer declared that such a union was not acceptable. “All these conditions are against Islam,” Darul Uloom Deoband said. “The nikah will not be valid whether the conditions are written in the nikah letter or not,” it declared. The Muslim man was advised to “forget each other and you should not do any thing against the religion of Islam.” As small consolation, Darul Uloom Deoband said sympathetically, “Have patience, you may find other beautiful and desired Muslim girls to get married.”

What is clear from this interaction between the Muslim man and Darul Uloom Deoband is that the kind of marriage between a Hindu woman and Muslim man shown in the recent Tanishq ad normalising Love Jihad is utter fantasy. Such a union, where the Muslim family celebrates Hindu traditions, is simply not possible in the real world to any significant extent as it is mandatory for the Hindu woman to convert to Islam for the marriage.

Consequently, we have witnessed several murders, rapes and other heinous crimes being committed against Hindu women who refused to convert to Islam following their marriage with a Muslim man. Therefore, at a time when such crimes are not deliberately whitewashed and silenced by the media, efforts to normalise the same through advertisements appears to be remarkably culturally insensitive.

Two days after a Kashmiri woman had made allegations against her Delhi landlady claiming that they were assaulted and attacked for being a ‘Kashmiri’, the landlady of the residence against whom the allegations were made, has written a scathing letter to Delhi Commission of Woman chief Swati Maliwal asking the commission to allow her to submit facts pertaining to the matter before initiating actions against her.

The letter by Taruna Makhija comes after Delhi Commission of Women had taken suo-moto cognizance of the issue and had issued a notice to the Delhi Police in connection with the case.

However, in the light of Delhi Commission of Woman’s notice to Delhi Police seeking against her, the landlady of the property in which the two Kashmiri women were staying for a few months, has written a letter on Friday urging the women panel to allow her to present facts pertaining to the matter.

In her letter to Delhi Commission for Women chief Swati Maliwal, Taruna Makhija said that she was a first-generation struggling woman entrepreneur providing safe comfortable rental spaces for working women in Delhi. In the letter, accessed by OpIndia, Makhija said that she was sure that DCW cared for all women and would like to hear her side of the story.

“I hear that you are a very just person. You sent a letter to Police asking them to register a case without providing any opportunity to me. Maybe the social media activism by the Kashmiri girl moved you. But I think I am equally a citizen of India, You hold a very sensitive post in respect of security of the women in the city. I am sure you will give me an opportunity to meet,” Taruna Makhija wrote in her letter to DCW.

Narrating her ordeal, Taruna Makhija put forward the entire sequence of events and provided evidence that dismissed all the allegations made against her by the two Kashmiri women.

“One of the two sisters, Yuhana Manzoor Bhat approached me through a broker to take my serviced apartment on rent. She entered without paying complete advances. I had a struggle to get her sign on the agreement & obtain some security”.

She added, “Neighbours & RWA complained that strange 50-year-old people come on their floor & have late night parties and thereby creating nuisance. It seems some of them fired in the air on the birthday party of Ms.Fiza Noor Manzoor Bhat on 19th June 2020 (Copy of messages on RWA group & her passport is enclosed). I immediately informed that local Police & asked these girls to vacate. They were called by the local Police & warned.”

Have evidence to prove her side of story, says Makhija

In her letter, Taruna said she had a tough time asking them to pay their rentals and asserted that she had evidence and records to prove her statements. The landlady said that the two Kashmiri women attacked and assaulted the elderly meter reader who came to disconnect the electricity for non-payment of bills. They have assaulted the housekeeping lady Namita residing downstairs in the servant quarter, she added in her letter to Swati Maliwal.

“Day before Yesterday I got to know that they were vacating my place but in process have broken my furniture. I called 100 number helpline & rushed to the site along with Police. They hurled abuses at Police & me. Finally I left the space along with Police. I never accused them of being ‘Terrorists’,” Taruna Makhija said in her letter.

In her letter, Makhija asked Maliwal to allow her to share records with the commission. “Now that you have taken suo-moto cognizance of their false social media tweets, I have to struggle more to survive and spend on lawyers,” she added.

Requesting Swati Maliwal to be objective in the case, she said taking such suo-moto action against people without hearing the other side will only encourage girls to misuse the law without any base or evidence and will lead to these girls to get scot-free of dues and damages to her.

“Our country talks about women empowerment and when I am working hard to do establish myself is this really fair to what I have to go through? Have I done anything wrong in asking them to pay their rental and utility bills that I have to go through or am I expected to pay the rentals & electricity bills on their behalf,” Makhija asked Swati Maliwal in her letter.

The curious case of Kashmiri girls and their allegations of being attacked

On Wednesday, a Kashmiri woman residing in southeast Delhi had claimed that she was assaulted and abused by her landlady for being a ‘Kashmiri’.

Following that various media outlets had reported a story of an attack against a Kashmiri woman named Noor Bhat. The media reports suggested that the Kashmiri woman was assaulted and abused by her landlady and a man in Delhi’s Lajpat Nagar. A Kashmiri woman identified as Noor Bhat, who belongs to Srinagar in Kashmir, had taken to Twitter to claim that her landlady entered the house with a man whom “she had never seen before”. She alleged that the landlady called her a ‘terrorist’ because they were from Kashmir.

Soon after their allegations, DCW chief Swati Maliwal had jumped into the scene to take the matter into cognizance and also issued a notice to Delhi Police to look into the alleged attacks against the Kashmiri woman in Delhi.

However, days after Noor Bhat made strong allegations against her landlady, OpIndia had accessed details and evidence that were completely contradictory to the allegations made by Noor Bhat.

Speaking to OpIndia, the landlady Taruna Makhija had said that the allegations made by Noor Bhat were a blatant lie. Makhija alleged that two sisters were staying in their residence from the past four months and were extremely irregular in paying the rent. The landlady alleged that the Kashmiri women behaved in a most atrocious manner and also created repeated nuisance in the housing complex.

Taruna Makhija had also informed that her tenants have not paid their electricity bill for months, and around Rs 70000-75000 is due to be paid. Addition to that, the allegations put up against the landlady by Noor Bhat, claiming that she was attacked and abused as a ‘terrorist’ falls flat as there is no evidence to back her claim.

The evidence, images and videos had revealed that the two Kashmiri women, instead of clearing their dues, had created a ruckus to falsely accuse the landlady of harassing them. Shockingly, the ‘liberal-secular’ who are often desperate for stories which depict Kashmiri as ‘victims’ had latched onto it without even verifying facts of the matter.

 

DCP investigating Republic TV in ‘TRP scam’ transferred to Traffic police but the story might not be as simple: Here is what we know

The investigation into the TRP scam in which, while all evidence pointed towards India Today, the Mumbai Police has been adamant in naming Republic TV, has not been without its twists and turns. In another interesting turn, Arnab Goswami, the editor-in-chief of Republic TV made some startling revelations during his evening debate.

On air, Arnab Goswami said that he had information that the Mumbai Police Commissioner, Parambir Singh, had castigated rather rudely, one DCP who had informally told some reporters that there has been no evidence found against Republic TV and Arnab Goswami in the TRP scam.

He further said that the Mumbai Police Commissioner had made a list of the 4-5 top advertisers of Republic TV and he was planning to summon the top executives of these brands to question them in connection with the TRP scam. This claim was rather believable considering that way back on the 8th of October when Parambir Singh had named Republic TV in a press conference, even though the FIR named India Today, he had also mentioned that he would be summoning the advertisers of Republic TV and asking them if they had been duped or misled due to the Republic TV inflating its TRPs.

The first claim of Arnab Goswami, however, was rather interesting. He alleged that the police commissioner had screamed at one DCP who was involved in the TRP scam investigation because he essentially could not find any incriminating evidence against Republic TV.

OpIndia was told by a source, that the DCP who was being chastised by the Mumbai Police Commissioner was DCP Nandakumar Thakur. Interestingly, DCP of Crime Branch, Nandakumar Thakur, has now been transferred to the Traffic Police Department only 6 months after he was made the DCP of Crime Branch.

What we know about the theatre of absurd that played out, leading to the transfer of DCP Nandkumar Thakur

According to a journalist source who is a first-hand witness, on the 15th of October, DCP Nandkumar Thakur was holding an informal briefing with some journalists at the police headquarters. During the informal meeting, he allegedly told the journalists present that Republic TV was not an accused per se in the TRP scam case and that no incriminating evidence had been found against them.

Within 24 hours of that revelation, Thakur was unceremoniously shunted out from the Crime Branch. Thakur had been posted at the Crime Branch just recently and was part of the team that was investigating the charge of TRP manipulation that Parambir Singh had accused Republic with.

“He was talking to all of us in his office at the Mumbai Police Headquarters,” said a reporter who was present at Thursday, October 15th informal briefing. “It was as if he had dropped a bomb in the room. There were 8-10 reporters there and for a few seconds after he spoke there was pin-drop silence. And then there was an uproar. We asked him again. And he confirmed a second time: Republic is not an accused in the TRP scam.”

After this stunning revelation by Thakur, that was allegedly made during this press briefing, the fact that he had somewhat exonerated Republic TV in front of the reporters reached the ears of the Commissioner and then, the process of his shunting began.

The reporters were allegedly told by other senior officers that none of what was said by Mr Thakur was true or reportable. The reporter in the know also said that the Editors of their respective publications were also informed to not report this story.

What DCP Thakur said when OpIndia spoke to him about his ouster

OpIndia reached out to DCP Nandkumar Thakur and inquired about his transfer. While DCP admitted that he has been transferred from being the DCP of Crime Branch, handling high-profile cases, to being the DCP of Mumbai traffic police department, the DCP said that the information about him being shunted due to the TRP scam investigation is untrue.

When asked if he had held informal interaction with the journalists where the TRP scam case was discussed, Thakur refused to have participated in such an interaction. He even said that his transfer had nothing to do with the case and that he himself had requested for a transfer after only 6 months of being the DCP of Crime Branch.

While confirming that he had indeed been transferred to the traffic department when asked whether Republic TV is indeed an accused in the TRP scam case, unfortunately, the connection became bad and his response was inaudible.

Since then, OpIndia has been unable to reach the DCP.

How Nandkumar Thakur had come to be the DCP of Crime Branch – a battle between Shiv Sena and NCP

The saga of Mr Thakur goes right back to July. In July, Mumbai Police Commissioner Parambir Singh had transferred 10 DCPs to various other departments. That order was promptly overturned by the CM of Maharashtra, Uddhav Thackeray.

A Hindustan report says:

Four days after Mumbai Police commissioner Param Bir Singh’s order of transferring 10 deputy commissioner of police (DCPs) was overturned with immediate effect by the Chief Minister’s Office (CMO), a fresh list of transfers was issued by the home department on Friday, this time with approval from CMO.

It is being said that the fresh shuffling of nine DCPs, which includes three Indian police service (IPS) officers, was prepared keeping the CMO in the loop.

The previous staying of DCPs’ transfer order had indicated strong discontent among the ruling partners — Congress and NCP — over several decisions taken by Maharashtra Vikas Aghadi (MVA) government, led by chief minister Uddhav Thackeray.

The Hindustan Times report further said that, “In the fresh list of transfers which is approved by the CMO, most of the names and postings are from the same list which was cancelled by the CM earlier. Only some DCPs have been given different posting”.

It was per this order by the Home Minister (headed by NCP) that Nandkumar Thakur was moved to the crime branch in July, while the crime branch DCP Shahaji Umap has been transferred to special branch-1.

Since the Hindustan Times report says that most of the names were identical to the transfers made by Commissioner Parambir Singh, it could be safe to assume that it was per the Commissioners wishes that Thakur had been made the DCP of Crime Branch. This wish was then overturned by Uddhav Thackeray and reinstated by Home Department.

Other high-profile cases that were being handled by Thakur

Interestingly, another high profile case other than the TRP scam case that was being investigated by Nandkumar Thakur was the social media ‘fake likes’ scam. In July, DCP Nandkumar Thakur had said that while 25 celebrities had been identified in the fake likes scandal, the police will not be disclosing their names since it might hamper their investigation.

It is pertinent to mention here that singer Badshah was also interrogated by Nandkumar and it was reported in the media that he had said that Badshah had confessed. “The singer confessed that he wanted to set a world record for the most number of views in 24 hours on YouTube. That is why he paid Rs 72 lakhs to this company”, Nandkumar had said.

Home Minister Anil Deshmukh had taken a personal interest in the case and said that the Mumbai police will investigate the matter. Arrests in the case were also made.

The saga of the fake TRP scam and the curious case of Republic TV being implicated by Mumbai Police, while the complaint and FIR mentioned India Today

The TRP scam case investigation has been nothing short of a Bollywood thriller, ironically. While the Hansa Research report and the FIR filed on the basis of it named India Today, in less than 24 hours, Mumbai Police had seemingly made up its mind that Republic TV was the culprit instead and sent a notice to BARC to acquire their viewership data. In 48 hours, Parambir Singh had held a press conference naming Republic TV and not even mentioning India Today.

Later, the Hansa Research FIR, their report based on which the FIR was filed and a witness statement naming India Today surfaced, putting the Mumbai Police and India Today in a tight spot.

After it was revealed that India Today had earlier been implicated by BARC Disciplinary Council in the manipulation of viewership, the drama had reached its Zenith, or so it seemed.

Soon, the witnesses, after being guarded by Mumbai Police closely, told the magistrate that it was Republic TV that had paid them.

In the entire suspicious chronology of the case where Republic TV was being implicated, not a shred of evidence, except the inexplicably changed statement by the witness, has surfaced against the channel run by Arnab Goswami in the public domain. While their CEO, CFO, journalists and Arnab Goswami himself continue to be hounded by the Maharashtra coalition government and the state machinery, including the Mumbai Police, it remains to be seen how many more twists and turns this case throws up.

Delhi: JNU student pretending to be consultant to the PMO arrested for committing fraud

Delhi Police on Friday arrested a JNU student who described himself as a consultant to the Prime Minister’s Office (PMO). The young man, Aniket Dey (22), is studying MA from the Jawaharlal Nehru University and was apprehended for committing fraud in the name of being a PMO Consultant.

Delhi Police have asserted that Aniket was committing fraud by portraying himself an expert consultant and duping unwitting people and organisations. In order to ensure export order of face masks to Saudi Arabia, Dey had also submitted fake notifications. 

Accused fleeced Rs 7 lakhs on the pretext of obtaining custom clearance

On the pretext of getting custom clearance from Delhi’s Indira Gandhi Airport for the delivery of face masks, Dey had reportedly fleeced Rs 7 lakh from a company. When the officials asked him about his credentials, he claimed that he was a consultant working with the Prime Minister’s Office (PMO). 

However, when the officials conducted a detailed investigation, it was revealed that the man was a fraud. Airport officials immediately informed the police of IGI Airport police station about the forgery, after which Dey was arrested.

Dey was arrested earlier as well in connection with a fraud case

Police have recovered fake ID and visiting card of PMO from the man. The accused had a history of committing frauds and was also arrested once in connection with a cheating case. The police have now launched a probe to ascertain if the man had duped other people in the name of export as well. Reportedly, Aniket has tricked a businessman of sending face masks worth Rs 2.23 crores.

According to a report published in Amar Ujala, a clothing factory owned by Anuj Jain and located in East Delhi started manufacturing face masks after the work was stopped during the lockdown. He met Aniket, a JNU student who lured him into sending face masks to Saudi Arabia. He took Rs 5 lakh in advance. A letter with the permission of the Director General of Foreign Trade (DGFT) was also prepared.

During investigation, the letter was found to be fake. An FIR was registered in this case on September 11, 2020. Anuj Jain also lodged a case of cheating at Ghazipur police station. Now Aniket has been arrested from Assam. He had also taken a car from Anuj Jain. Aniket, who graduated from Amity University in Noida, has also written a book called ‘The Three Tales’. He also threatened custom officers. He is a ‘cyber expert’.

He also used to intimidate people on social media by projecting himself as PMO’s Youth Advisor. He was also able to secure a VIP pass during the lockdown and had also gotten Anuj a VIP pass. Based on forged documents, he had booked a hotel room in Bangalore a month ago where he was arrested after a quarrel.

On September 15 (Thursday) afternoon, the former CBI director M Nageswar Rao, put out a letter on Twitter addressed to Andhra Pradesh Chief Minister Jagan Mohan Reddy, raising serious questions about Andhra Pradesh police’s conduct while handling a rape case by an “influential” Church pastor in Tirupati.

In his letter dated October 15, the IPS officer informed that a young girl in Tirupati was brutally raped and assaulted by a Church Pastor-Mallem Deva Sahayam on October 3rd and it almost took the Andhra Pradesh police 9 days to file a complaint against the Missionary as he was a man of “means and influence”. Drawing the CM’s attention towards the case, Rao alleged that the arrest was delayed due to “political pressure” and religious bias, as the accused in the case is an influential Christian Missionary. Moreover, he said that the inordinate delay in registering the case itself proves that the police is trying to go soft on the accused, who he said is involved in the business of conversions.

According to reports, the incident had come to the fore after the human rights Chittoor District wing met the 20-year-old victim while undergoing treatment at the Tirupati maternity hospital after being allegedly raped and assaulted. The victim was working as sales-girl in the private company- Rainbow Cleaning Products, located in Renigunta, Andhra Pradesh, which belongs to the Christian pastor- Mallem Deva Sahayam, the alleged accused in the case.

In what had transpired on October 3 at around 7 pm the accused had allegedly picked up the victim from Tirupati renigunta road and reached Thukivakam village Rayal Sykam layout, where he assaulted and raped her.

After the incident when the victim went to the police station to lodge a complaint against the Pastor, but the Police allegedly refused to file a case.

Later the victim approached ASP Supraja. After the ASP’s intervention, the case was registered against Deva Sahayam under IPC sections 376 and 506 on October 12, 9 days after the gruesome crime.

Meanwhile, Tirupati Urban Superintendent of Police Avula Ramesh Reddy denied the allegations that there was religious bias in apprehending criminals. According to the SP the woman had reported the incident to the police on the morning of October 12 during the Spandana programme (a weekly grievance redressal programme), and that a complaint was immediately registered. He also that the accused had threatened to harm the victim if she approached the police. Scared of the threats the victim remained confined to her house for a few days before deciding to register a complaint, said the SP.

Interestingly, the Tirupati police had yesterday put out a Tweet in its defence. It said that “the complaint came to police on 12th and police acted with alacrity n arrested the accused.Police will do its duty & responsibilities without any urging from any quarters least of all your distorted comments”. The Tirupati police had also said that the accused was neither a pastor nor a missionary as alleged.

However, there are many pictures on various social media platforms which punctures the claims made by the Tirupati police. Responding to the Police’s claims, many Twitter users shared pictures of events where the evangelist was seen conducting prayers and programs.

Some local activists claim that Tirupati SP Avula Ramesh Reddy has political ambitions and is aiming to fight the next assembly elections. They claim that “vote bank politics” could be impacting his conduct. However, others blame it purely on inefficiency of the system. OpIndia’s attempt to get a reaction from the police officer over such criticism was not successful.

Fox News spoke to a source who was part of the email thread that appeared to portray a payout to Joe Biden himself as part of a deal with CEFC China Energy Co. It reported, “One email, dated May 13, 2017, and obtained by Fox News, includes a discussion of “remuneration packages” for six people in a business deal with a Chinese energy firm. The email appeared to identify Hunter Biden as “Chair / Vice Chair depending on agreement with CEFC,” in an apparent reference to now-bankrupt CEFC China Energy Co.”

The equity split proposed references “20” for “H” and 10 of which were held by “H” for “the big guy”. Fox News has confirmed from sources that the “big guy” referred here is none other than former Vice President Joe Biden. In another text from Hunter Biden to his daughter that has ben leaked, he can be seen telling her, “I hope you all can do what I did, and pay for everything for this entire family for 30 years and it has been tough. It’s really hard but don’t worry, unlike Pop, I won’t make you give me half your salary.”

Thus, now it is a matter of genuine concern as it appears that Biden demanded half of the payment his son received for his services which would indicate shady dealings with Ukraine and even China. Whether such money influenced his politics, which has been suspiciously soft on China for years, is a matter of anybody’s guess. It is also to be noted that Joe Biden and the Democrat establishment have slammed Donald Trump for hitting out at China for its poor, probably deliberate, mishandling of the Coronavirus crisis.

Such rhetoric could very well be due to Chinese money that he allegedly received although, obviously, the motivations for such actions cannot be concluded for certain.

New York Post ‘expose’ on Joe Biden

In the investigative report, the New York Post had asserted that they had accessed material from a damaged Macbook Pro, which revealed that Hunter Biden, Joe Biden’s son, had introduced a businessman from Ukraine to his father while the latter was Vice President of the United States. It is pertinent to note here that Hunter Biden at the time was appointed to the Burisma Board and received a salary of $50,000 per month.

The report had published several documents and mentioned a video that proved that Joe Biden met Vadym Pozharskyi, an adviser to the board of Burisma, where the extent of the Biden family’s involvement, and the sacking of a prosecutor, allegedly after pressure from the then VP Biden, is now under scrutiny.

A few days back, reports had suggested that there are chances that Biden had helped his son Hunter using his influence as the VP of the United States in his business in Ukraine. The Biden Camp has categorically denied all the allegations.

FIR against Kangana Ranaut and sister for ‘sedition’, ‘spreading communal hate’ etc after complaint by Munawar Ali and Sahil Ashraf Syed

In fresh trouble for Bollywood artist Kangana Ranaut and her sister Rangoli Chandel, an FIR has been filed against the two for supposedly spreading ‘communal hatred’ through their tweets and interviews.

The FIR was filed after Bandra Magistrate Court directed the cops to file the FIR. According to an AajTak report, the complaint in the matter was reportedly filed by two individuals called Munnawar Ali and Sahil Ashraf Syed.

The complaint was filed by the casting director in the Bandra court saying that the two have been spreading ‘communal hatred’ and ‘dividing people into Hindu and Muslims’, according to a report by Times Now.

Reportedly, the charges against Kangana Ranaut include sedition and blasphemy. The FIR has been filed under various sections included 295A, 153A, 124 and 34 of IPC.

Reportedly, the petition in the court that has now resulted in the FIR mentions several tweets of Kangana Ranaut that claimed that action was not being taken in the Palghar Sadhu lynching case, calling Mumbai Police the ‘Babur Sena’ etc. The complaint had also mentioned that Kangana Ranaut had blamed the Tablighi Jamaat of spreading Coronavirus in the country.

Only a few days ago, the Karnataka police had filed an FIR against Kangana Ranaut for her tweet concerning farmers after the passage of farm bills by the Narendra Modi government.

A Karnataka court had directed the lodging of an FIR against actress Kangana Ranaut for her tweet on the recent farmer protests. The order was passed by Judicial Magistrate First Class, Tumkur Vinod Balnaik on the complaint of Advocate Ramesh Naik. 

“Complaint filed under Application U/sec 156(3) of CrPC for investigation. The Office is hereby to issue intimation to the CPI of Kyathasandra PS (Police Station) along with photostat of copy of the complaint for report”, the order read.

The complainant has alleged that the Tweet posted by Ranaut has a clear intention to injure the people who are opposing the Farm Bills. It is further alleged by the complainant that the Tweet gives provocation with the intention to cause riots and promote the culture of non-violence in the young minds of society. The complainant has also questioned the government for not taking action on it and said that the government was waiting for some dangerous consequences before taking appropriate action. It was argued by the complainant that if such content was allowed, incalculable and irreparable damage will be caused to the farmers of the country.

Saharanpur Riots: Former Social Welfare Principal Secretary and District Magistrate booked under sedition charges for violating provisions of SC/ST Act

In a case pertaining to caste violence that had erupted in Saharanpur town of Uttar Pradesh in 2017, an SC-ST special court has booked the then District Magistrate Alok Pandey and Principal Secretary in the Social Welfare department Manoj Kumar under sedition charges for not granting the benefits to the SC victims in accordance with the provisions of the SC-ST Act, says a report published in Jagran.

Advocate Rajkumar argued that Dal Singh, a resident of Shabbirpur, had filed an application in the SC-ST Special Court that he was the victim of the caste riots. A case had been registered in this regard at the Budgaon police station.

Sedition charges framed against former DM and Principal Secretary of Social Welfare Department

Special Judge SC-ST Act VK Lal observed a clear contempt of Section-4 of the SC/ST Act and he framed sedition charges against the accused.

As per the court, three then District Magistrate Alok Kumar Pandey and Principal Secretary Social Welfare Manoj Kumar violated the legislation passed by the Parliament and issued by the President. It noted that a crime was perpetrated with a deliberate intent to harm the scheduled castes. The court has registered a case against both of them and has fixed the next date for hearing as November 19.

Benefits granted to victims not in accordance with the provisions of the SC/ST Act

A compensation of Rs 3 lakh was granted to the victim by the District Social Welfare Department but under the sections in which the case was filed, the provisions of the SC-ST Act mandated a compensation of Rs 8.25 lakh, along with dearness allowance and a monthly pension of Rs 5000. 

Besides, the provision under the SC-ST Act also guaranteed free education in government funded institutions and resident schools to the victim’s children until graduation. The current DM had written a letter to Principal Secretary Social Welfare on 17 June 2020 regarding pension and other facilities and sought guidance in this regard. But till date no reply has been received to this letter.

Marathi channel Loksatta censured by Press Council of India for publishing a fake story about the Statue of Unity

Two years after a leading Marathi daily of the Indian Express group, Loksatta, published fake news about the Statue of Unity, the Press Council of India (PCI), the self-regulatory watchdog of the press, has found the newspaper guilty of malice. In an order dated on September 30, the PCI accepted the report of the Inquiry Committee, which was constituted to examine the complaint, and has decided to censure the paper.

Activist Sadanand Ghodgerikar had filed a complaint against Loksatta and its Editor-in-Chief Girish Kuber for publishing a fake editorial dated November 3, 2018, about the Statue of Unity. The matter eventually came up before the Inquiry Committee of the Press Council of India on February 25 this year. While complainant Ghodgerikar appeared in person, the respondent Loksatta was represented by Abhijeet Negi and Mahesh.

Loksatta claimed massive contribution by PSUs for Statue of Unity

In the contentious editorial on November 3, 2018 in Loksatta by Editor-in-Chief Girish Kuber, he alleged that several Public Sector Undertakings (PSUs) had contributed ‘immensely’ for the construction of the Statue of Unity. The basis of his claims was supposedly a Comptroller and Auditor General (CAG) report from August 2018.

The editorial claimed, “Indian Oil, Oil & Natural Gas Commission, Bharat Petroleum, Hindustan Petroleum, Oil India, Gas Authority of India, Power Grid, Gujarat Mineral Development Corporation, Engineer India, Petronet India and Balmer Lawrie has contributed a sum of Rs. 900 crore, Rs. 450 crore, Rs. 450 Crore, Rs. 250 Crore, Rs. 250 Crore, Rs. 250 Crore, Rs. 125 Crore, Rs. 100 Crore, Rs. 50 Crore, Rs. 50 Crore and Rs. 6 Crore respectively for the construction of Statue of Unity of Sardar Patel.”

No money should have been spent by PSUs, Loksatta alleged

Later, in a rejoinder to the Inquiry Committee, Loksatta presented a purported extract of the same CAG report and alleged that not a ‘single rupee’ ought to have been provided by the PSUs for the construction of the Sardar Patel statue. “Contribution towards this project (Sardar Patel Statue) did not qualify as CSR (Corporate Social Responsibility) activity as per Schedule VII of the Companies Act, 2013, as it was not a heritage asset,” Loksatta claimed, citing the CAG report.

In its defence, the Marathi daily stated that the figures presented in the editorial were ‘not disputed’ by any of the PSUs and that no objections were raised even by the Government of India. It further claimed that the complainant Sadanand Ghodgerikar had ‘no personal knowledge’ about the funds contributed by the PSUs and that he has no locus standi in the matter. Loksatta also reiterated that the editorial was published in ‘good faith’ and ‘public interest’ without ‘malice.’

Complainant rubbishes exaggerated claims of Loksatta

The complainant had rubbished the claims of the Marathi daily as ‘false’ and ‘concocted’. He disputed the figures published in the editorial and pointed out that the said CAG report was also presented in the Parliament. Sadanand Ghodgerikar emphasised that the contribution of the PSUs were far lesser than what was alleged by Loksatta in its editorial. “Indian oil, Oil & Natural Gas Commission, Bharat Petroleum Hindustan Petroleum had contributed only Rs. 21.83 crore, Rs. 50 crore, Rs.25 crore and Rs.25 Crore respectively, ” the complainant reiterated.

Findings of the Inquiry Committee reveal factual incorrectness of the editorial

The Inquiry Committee of the Press Council of India noted that despite several requests to Loksatta to produce material, other than the CAG report, which they took into consideration before publishing the editorial, the Marathi daily had turned down the request citing confidentiality of sources.

While the Committee upheld the decision to not reveal the name of its sources, it emphasised, “The respondent cannot refuse to place the material, which has formed the basis of the story, particularly when the respondent newspaper in the story itself has disclosed the source and that is the report of the CAG.” The Inquiry Committee found that the claims made in the Loksatta editorial are ‘absolutely incorrect’ and ‘figment of imagination by the newspaper’. It emphasised, “The conduct of the respondent newspaper in publishing such a story and referring to the report of the Comptroller and Auditor General of India to give the story credence aggravates the misconduct.”

When Loksatta claimed that the editorial was based on external sources, the Inquiry Committee dismissed it by saying, “This submission of the counsel has only been noted to be rejected. The story itself had disclosed the source and hence this submission of the learned counsel that the newspaper relied on some other source is really beyond the comprehension of the Inquiry Committee.” It further reprimanded the newspaper and forwarded a copy of the report to the Mumbai Police Commissioner and the Director of Information and Public Relation of the Maharashtra government for legal action.

“The Press Council on consideration of records of the case and report of the Inquiry Committee accepts reasons findings and adopts the report of the Committee and decides to censure the respondent newspaper (Loksatta) with above-recommended directions”, the order read.

Press Council scolds Loksatta over fake claims about RSS Chief

This is not the first time when Loksatta drew the ire of the Press Council of India. Last year, the PCI had slammed the media group for spreading fake news after it had published a hit job article written by journalist Karan Thapar, one of the oldest members of the Congress-backed Lutyens media, against RSS chief Mohan Bhagwat by attributing fake quotes to him. Along with Karan Thapar, the editor of the Loksatta Girish Kuber wrote an editorial containing a fake quote of the RSS chief.

In the article, Girish Kuber had written that Mohan Bhagwat had said that, “The Vedas order the killing of the sinner who kills a cow,” in reaction to the death of Mohammad Akhlaq, who was allegedly killed on suspicion of consumption and storing beef. Loksatta later issued an apology, albeit in small fonts. In another article titled “Has the RSS ground shifted?” in Indian Express, Karan Thapar wrote, “In fact, Bhagwat himself is not averse to making inflammatory statements. In 2015, when Mohammad Akhlaq was lynched on suspicion of consumption and storing beef, he’s reported to have said: “the Vedas order the killing of the sinner who kills a cow.”

However, In reality, there is no reference of any such statements made by RSS chief Bhagwat. In fact, RSS chief had strongly condemned the violence and mob lynching.

Loksatta editor Girish Kuber found guilty of plagiarism

Earlier in May, netizens promptly called out Loksatta editor Girish Kuber for a highly plagiarised article. Several social media users pointed out how Mr Kuber blatantly lifted the entire article from a blog run by one Andrew Lilico, a PhD expert in economic modelling and policy impact simulations, and reproduced it in the Marathi language for vernacular consumption, without providing any credits to the source from where he shamelessly copied the article.

The blog titled as “A sense of proportion“, shares a perspective on how the approach embraced by the UK government in bringing down the mortality rate of the country in 2019 by instituting strict and exacting restrictions involved an apathetic indifference towards the relative importance of human happiness and flourishing that is being sacrificed in the country’s battle against the coronavirus.

This pithy observation about how human thinking is shaped by a pandemic was brazenly duplicated by Loksatta editor in his Op-ed titled ‘Covidscope‘, thinking his treachery of replicating a blogpost in the Marathi language will not be called out. Mr Kuber provided no provenance of the article in his Op-ed, misleading readers to believe that it was his wisdom and insight and not that of a foreign PhD expert.
