Engineering student from Jamia Millia Islamia held with country made pistols

0

A 20-year-old mechanical engineering student of Jamia Millia Islamia University, Aman Khan, was arrested on Tuesday with three countrymade pistols and six live cartridges near Lahori Gate in north Delhi. The police confirmed that Khan along with his two friends was planning to rob cash from a businessman.

According to Nupur Prasad, Deputy Commissioner of Police, North, the police got apprehensive when “a team was checking vehicles at main Chandni Chowk road near Bikaner sweets when all of a sudden they noticed a person on a TVS Scooty, carrying backpack took a U-turn on noticing the barricades. The suspicious act was noticed by police who asked him to stop but he ignored and tried to flee. Following which the team followed that person and nabbed him.”

The police recovered three country-made .315 mm pistols with six live cartridges.

The accused confessed to the police that he, along with his two friends hailing from Mandawali, had come to Lahori Gate to conduct a recce to rob a businessman. “He said they came to know that the businessman was carrying a huge amount of cash. He said while two of his friends were keeping a watch on their target, he was waiting for them on the two-wheeler,” the officer said.

A case under sections 25/54/59 Arms Act was registered against him.

Ahmed Azeem, public relations officer of Jamia Millia Islamia, said the university has not received any information from the police in this regard. He said that the university will look into the incident and take action upon receiving a complaint from the police.

Jamia Millia Islamia has been at the centre of controversy earlier when in May last year, a group of students had claimed that Hindu students in the Jamia Millia Islamia are being threatened and alleged that two Hindu students were beaten up inside the campus.

Similarly, in November 2018, the Jammu and Kashmir police while arresting three terrorists who went missing a year back, busting an Islamic State (ISIS) module in Srinagar, had confirmed that amongst the three accused, one was a student of Jamia Millia Islamia University.

Union Agricultural Minister lists the steps taken by Modi government towards welfare of farmers

Speaking at the round table organised by a media house, Union Minister of Agriculture, Radha Mohan Singh elaborated on the achievements of the NDA government and the steps that had been taken to improve the affairs of the agricultural sector.

Singh began by praising the late Atal Bihari Vajpayee for his contribution to rural areas. He said, “Had Vajpayee not been there, there wouldn’t have been rural roads.” He asserted that the former Prime Minister of India’s initiative to link villages to the rest of the country was crucial to improving the lives of farmers.

The Agricultural Minister also attacked the UPA government for failing to implement the recommendations of the Swaminathan committee. He said the recommendations were implemented post-2014 when the NDA came to power.

Singh also mentioned Swaminathan’s endorsement of the Modi government. The agricultural scientist had heaped praises on the NDA government and remarked that it had implemented several recommendations he had made earlier as Chairman of National Commission on Farmers while the earlier government only offered lip-service.

Singh also remarked that there were only 54 soil testing labs earlier. Now, there are over 10,000 to check the health of the soil.

The National Agricultural Cooperative Marketing Federation of India (NAFED), the Minister claimed, was on the verge of shutting down when Narendra Modi became the Prime Minister. But since then, it has purchased 6 million tonnes of pulses and oilseeds.

Singh also stated that the government was supporting horticulture, livestock and bamboo to increase farmers’ income. Bee production centres have come up in 15 regions, he said. Furthermore, marine products are being aggressively sold in overseas markets and their sale has gone up by 95%.

The Minister further stated in the five budgets of the last five years of the UPA regime, Rs. 1,2 trillion had been allocated for agriculture while the Modi government had allocated Rs. 2.11 trillion for the same. A Dairy Welfare Fund of Rs. 10,000 crore has also been set up.

Singh reaffirmed the government’s commitment toward doubling farmers’ income. “We are proud that with the policies of the government, time-bound implementation, budgetary provisions for 2018 and hike in MSP given to farmers will put India among the leading economies in the agriculture sector and help the government’s efforts in doubling the income of farmers,” he stated.

Recently, Minister of Commerce and Industries, Suresh Prabhu had also announced that the UAE and Saudi Arabia had decided to use India to address their food security concerns and that the two countries were looking to invest in the agricultural sector in India. He had further stated that the NDA government has removed restrictions on organic and processed products which will benefit Indian farmers who are looking for a higher price for their products.

Another farmer loan waiver scam? Rs 120 crore non-existent farm loans ‘waived off’ in Madhya Pradesh

The curious case of nonexistent farm loans being waived off in Madhya Pradesh has come to the fore. As the process of granting farm loan waivers is initiated, farmers, who had not even taken loans, started appearing in the list of debtors whose loans are being waived off by the government.

The farmers whose names have wrongfully appeared in the list of debtors have filed their grievances at the local branches of the District Co-operative Central Bank. Farmers have alleged that when there is no loan on their names, how can the government offer waiver?

In the run-up to the Madhya Pradesh assembly elections, Congress had promised farmers loan waiver after getting into power. As the Congress formed its government in MP, the process of loan disbursement has started. Lists of borrowers at the Panchayat level have been published. In these lists, the names of such farmers have cropped up, who have not even taken any loan. The farmers are registering their complaints to the banks. However, the local branches of these co-operative banks are unable to locate the past records of granting credit to the farmers.

The banks have started sifting out the list of borrowers amidst the increasing number of farmers registering their complaints of not being creditors. The farmers are asked to fill a red form and submit it to the local branch to register their grievances. The bank has no inkling of how many such cases exist and is in process of issuing an acknowledgement to the farmers who have filled the red form.

In one particular case, the creditor farmer had already paid his loan amount, yet his name appeared in the list of beneficiaries for the government’s loan waiver. His loan of Rs 31000 was waived off by the government. However, the farmer insists that he has already paid up his loan amount and has a bank receipt to support his claim.

It is notable to mention that a similar case of non-existent names appearing on the list surfaced in Rajasthan as well after the Congress government initiated the loan waiver scheme. Scores of names had then appeared in the list of beneficiaries for the farm loan waiver scheme who had no loans against their names.

The sop of farm loan waiver promised by Congress President Rahul Gandhi during his election is already under fire from various quarters. The lofty promises of farm loan waiver had already taken 3 lives in Madhya Pradesh.

The Congress after assuming power in Madhya Pradesh had cleverly altered the conditions to waive-off farms loans in contrast to their earlier stand. Apart from this, the Congress governments in both Madhya Pradesh and Rajasthan are facing severe outrage from the farmers within weeks of their government formation, for mismanaging the supply of urea.

Alok Verma forged evidence and had clear bias and prejudice against Rakesh Asthana: CVC

0

After the three-member selection committee had decided to remove Alok Verma from the post of CBI director based on a CVC report, more details about the report have been emerging.

According to a report, CVC has alleged that Alok Verma had “clear prejudice and bias” against special director Rakesh Asthana. This conclusion is based on a finding by CVC that Verma had prepared forged documents to block Rakesh Asthana’s appointment as CBI special director in 2017.

The appointment to the post of Special Director of CBI is done by a selection committee led by the CVC. Before Asthana’s selection, CBI special unit had prepared a ‘secret note’ against Rakesh Asthana which was to be submitted to the selection committee. But according to the CVC’s probe against Verma, the CBI director had forged the special unit secret note and inserted an additional note which was not there in the original, and this forged note was submitted to the selection committee.

The note submitted with the committee had 23 entries pertaining to amounts received by Rakesh Asthana from a company named Sterling Biotech. Verma had alleged that Asthana was receiving bribes from the company. The total amount of the 23 entries was ₹3,94,72,106, with a single entry of ₹3,38,21,000, the rest being small regular payments. But the CVC has found that this amount of ₹3.38 crore was not there in the original secret note prepared by the Special Unit of CBI, which had only 22 entries, and this 23rd entry was inserted by Alok Verma. According to reports, CVC had retrieved the hard copy of the original note from the office of DIG, Special Unit, which does not contain the 23rd entry.

Moreover, the CVC also found that the 23rd entry mentioned a transaction between Sterling Biotech and another company Thermax, and Asthana had no link with this deal. But still it was included in the note against Asthana.

Verma was asked to explain this discrepancy, but he chose not to respond to this point while submitting his response to the CVC report. Verma also failed to submit any evidence or document supporting the allegation contained in the secret note.

Another evidence of clear bias of Verma against Asthana is that the 22 other entries in the secret note are valid financial transactions supported by documentary evidence, but still, the note was presented before the CVC as evidence against Asthana.

A diary recovered from Sterling Biotech during an Income Tax raid had revealed the regular payments the company was making to Rakesh Asthana. But later it was revealed that this was rent for an office the company had rented from Asthana in Gandhi Nagar. The company was paying a rent of ₹40,000 per month for the office, and this was duly reported by Asthana in his annual property detailed filed with the government. The 22 entries in the secret note mentioned this rent payment and other expenses like repairs, flat expenses etc related to the rented premises. All these payments were done through banking channels, according to a CBI official. Based on this evidence, the charges against Asthana could have been dropped, but Alok Verma did not do so and persisted with the case.

The CVC report also said that Thermax had confirmed the 23rd transaction with Sterling and said that Rakesh Asthana was not involved in the transaction.

It may be noted that the CVC-led selection committee had already seen the secret note and found that it does not prove any corruption by Asthana and had cleared his appointment as Special Director of CBI. After that, Prashant Bhushan had filed three petitions in the Supreme Court against the appointment or Rakesh Asthana, quoting the allegations made by Alok Verma. The apex court also had found no basis in those allegations and dismissed all three petitions.

Denied visa, Pakistan delegation to not participate in Vibrant Gujarat summit

0

CM Vijay Rupani has turned down reports suggesting that Pakistan will be part of 52 delegations from various countries, attending the Global Conclave of International Chambers event at the Vibrant Gujarat Summit, to be held this month. It was earlier reported that 7 delegations from Pakistan will attend the event, out of which two delegations were to be from Faisalabad, and one each from Islamabad, Peshawar, Karachi, Punjab province and Khyber Pakhtunkhwa.

According to reports, Gujarat Chambers of Commerce had earlier sent an invitation to Karachi Chamber of Commerce to attend the summit. However, the delegation cancelled their visit as they have not got a visa.

“No delegation from Pakistan was coming for the Vibrant Gujarat Summit. There were discussions about it, but it is not true,” CM Rupani was quoted by reports.

Gujarat Chief Secretary JN Singh, last week created a controversy after he said that decision to invite Pakistan was undertaken by GCCI. He added that no invite was sent on behalf of Gujarat Government.

“Karachi Chamber of Commerce is also one of the global trade bodies invited by the GCCI. The government has not sent an invitation. And, there is nothing wrong in it.” J N Singh was quoted last week.

After the invitations were sent, Shiv Sena unit of Gujarat had written a letter to Gujarat government condemning the move. The letter said that Pakistan is an enemy country, and sending an invitation to it, is an anti-national act. It added that, amid a large number of ceasefire violations by Pakistan, and its continued backing of terrorism, the invitation should be immediately revoked.

GCCI President Jaymin Vyas has now confirmed that even though invitations were sent, no visa has been issued to Pakistan’s delegation by Government.

“…. we received a communication from them( Pakistan’s delegation), saying they have cancelled their India visit as they have not got visas,” Vasa told reporters in Ahmedabad. He also added that they had already received 13-member delegations’ travel plan.

This not the first time, that Pakistan has been declined invitation to Gujarat Summit. In 2013, Pakistan delegation had arrived in Gujarat to attend the summit however they had to go before attending the event, in the wake of escalating tensions at borders.

In 2015 and 2017 too, Pakistan was denied the invitation to the summit.

Government’s move to deny a visa to Pakistan delegation is in tandem with India’s stand that “terror and talks can’t go together”. Last year, India had severed talks with Pakistan and also had cancelled the proposed talks between India MEA Sushma Swaraj and Pakistan foreign minister at the sidelines of the UNGA meeting in the United States in the wake of dastardly kidnapping and killing of three policemen in Jammu and Kashmir’s Shopian.

The Vibrant Gujarat Summit is a biennial event, started by Former Chief Minister of Gujarat Narendra Modi. Its aim is to boost the commerce and trade relations with its foreign counterparts. It is a three-day event starting on 18 January. About 115 delegations from across the 15 countries will attend the event. PM Modi will inaugurate the event and will also take part in a one-on-one meeting with leaders of the delegations.

Amul issues legal notice to Google India for carrying fraudulent campaigns on fake websites

0

Gujarat Co-operative Milk Marketing Federation Limited (GCMMF), which markets the popular Amul brand of milk and dairy products has sent a legal notice to online search engine company Google India and internet domain registrar godaddy.com for carrying paid advertisements for Amul fake websites.

According to the reports, Amul has issued a legal notice on January 10 to Google India after they found that some fake websites have been indulging fraudulent B2B campaigns regarding Amul parlours and distributors that started through fake websites using Google search ads since September 2018. Amul has also issued a legal notice to web hosting firm goDaddy.com for the same.

“We have served a notice to Google India for carrying paid advertisements for Amul fake websites. As per fake websites, customers have to pay money Rs 3 to 6 lakhs to get Amul franchise. We’ve filed FIR also,” said RS Sodhi, Managing Director of Amul.

Earlier, Amul had raised the issue with Google India and sought their help to stop such “miscreants” from using their platform through paid advertisements. However, no action was taken against the complaints of Amul.

The GCMMF in a release said, “Miscreants have been running paid ads on Google Search engine against keywords such as Amul Franchisee, Amul Parlour, and Amul Distributor among others, with the intent of duping individuals with fake promises of business opportunities with Amul.”

Amul accused some individuals and organisations of running paid advertisements on Google platform using keywords such as ‘Amul Franchisee’, ‘Amul Parlor’ and ‘Amul Distributor’. The fake websites were reportedly scamming people by asking them to fill a form and pay them a “registration fee” ranging from Rs 25,000 to Rs 5 lakh. Once the money was paid, these fake websites would stop communicating with them, said Amul.

Reportedly, Google India works as a ‘non-exclusive re-seller’ of Google LLC`s AdWords program in India. The notice on fraudulent practices was issued on January 10. Google India is yet to respond to this.

After being denied permission for rath yatras, BJP to hold padyatras in West Bengal

After the Supreme court denied permission on Tuesday, to the BJP to hold their proposed ‘rath yatra‘ or the ‘Gantantra Bachao yatra’ in West Bengal, state party president, Dilip Ghosh stated that the party will now organise ‘padyatras’ instead.

“We had hoped we will get justice in the court of law. But from the start, the state government has made efforts to stop us. We will now hold rallies and public meetings as directed by the Supreme Court. It has given us an alternative, which we will follow.” he said.

BJP had planned three grand rallies from different parts in West Bengal, travelling across the state’s 42 parliamentary constituencies over one-and-a-half months to protest against the Mamata Banerjee led Trinamool Congress government.

Amit Shah was supposed to flag them off from Cooch Behar on December 7and PM Modi was meant to end the campaign by addressing a rally in Kolkata. The state police and administration had then denied permission citing threats of ‘communal disharmony’ in the state.

The Apex court on Tuesday while hearing BJP’s petition challenging an order of the Calcutta High Court, which had set aside a ruling of allowing the procession granted by a single bench, refused to give a go-ahead for the BJP’s rath yatra in West Bengal.

The bench led by the Chief Justice of India, while hearing BJP’s plea which said that its fundamental right to hold a peaceful yatra cannot be withheld, squashed the appeal by stating that “apprehensions expressed by the state government are not unfounded”. However, it did rule that the party can hold rallies and meetings in the state after providing the government with adequate and timely information about such events.

The Supreme Court also said that the BJP could further modify its plans for the yatras, address the state government’s apprehensions and seek permission again.

The BJP state national secretary, Rahul Sinha claimed the court’s decision manifested “the real picture of law and order” in Bengal and was of the opinion that Chief Minister Mamata Banerjee should give up her additional post of state home minister.

“Since coming to power seven years ago, the CM has failed to improve the law and order situation here. Rath yatras are being held across the state and there has not been a single incident of violence. In Bengal too, rath yatras have been held in the past but the law and order situation did not deteriorate. This proves it has deteriorated under the present TMC government and the chief minister is responsible for this. She must take responsibility for it”, he said.

Soon after the Supreme court stalled the party’s decision to hold rath yatras in Bengal, BJP on Wednesday announced dates for five public meetings, the party intends to carry out in the state of West Bengal. According to sources, Prime Minister Narendra Modi and party national president Amit Shah are also scheduled to attend some of them.

The party is planning to hold the first meeting on January 20, a day after the Trinamool Congress’s Brigade Rally.

The state BJP chief Dilip Ghosh, during a press meet at the party headquarters in Kolkata, said, “Amit Shah will visit on January 20 and speak at Malda. On February 21, he will speak at Siuri (Birhum) and Jhargram (West Midnapore). On February 22, he will speak at Joynagar (South 24 Parganas) and Krishnanagar (Nadia). We have planned a brigade rally on February 8, during which Prime Minister Narendra Modi will address people. He may be present at two other meetings as well. We are waiting for the green signal from PMO.”

Party sources said the BJP will approach the state government for permission to hold the public meetings.

“We want to cooperate with the administration. We do not want to do something which will hamper normal public life. We will fight it out with TMC politically,” said Ghosh.

Akshaya Patra, under attack by foreign funded NGO’s and ‘civil society’, among winners of Gandhi Peace Prize

The Government has announced the winners of the Gandhi Peace Prize for 2015 to 2018. The award, instituted in 1995 during the commemoration of Gandhi’s 125th birth anniversary, is conferred to individuals and institutions for their contributions to social, economic and political transformation through Gandhian methods.

Vivekananda Kendra, Kanyakumari, was given the award for 2015 for its work on rural development and education. For 2016, the joint winners were the Akshaya Patra Foundation for providing mid-day meals to children and the Sulabh International for its efforts towards emancipating manual scavenging.

The Ekai Abhiyan Trust will receive the award for 2017 for its efforts towards the education of rural and tribal children and for 2018, Yohei Sasakawa, Chairman of the Nippon Foundation, will receive the award for his efforts in the eradication of leprosy.

The decision was taken by a 5-member jury which comprised of Prime Minister Narendra Modi, Lok Sabha Speaker Sumitra Mahajan, senior BJP leader L.K. Advani, CJI Ranjan Gogoi and leader of Congress in Lok Sabha Mallikarjuna Kharge.

The decision to award Akshaya Patra the Gandhi Peace Prize is likely to displease many people from a certain quarter. As we have reported earlier, Akshaya Patra has been under attack from foreign-funded NGOs and a coterie of ‘civil rights’ organizations that have intimate links to ‘Urban Naxals’. Furthermore, one activist who has been demanding that Akshaya Patra’s mid-day meal contract be terminated appears to be motivated by a deep-seated hatred for the Brahmin community.

Prime Minister Modi personally congratulated all the winners through his Twitter account.

The winners will receive a monetary reward of Rs. 1 crore, a citation, a plaque and a traditional handicraft/handloom item as rewards for their exemplary work.

Sexual exploitation of women, corruption and arrogance: AAP Punjab MLA levelled serious allegations on party leadership

AAP Punjab MLA form Jaitu constituency, Baldev Singh had yesterday resigned from the party’s primary membership. In his letter, as per reports, Baldev Singh has alleged that the party under Arvind Kejriwal has given up its basic ideology and principles. Singh also accused Kejriwal of being ‘dictatorial and arrogant’.

Baldev Singh is the second MLA to quit the party this month. On January 6, MLA Sukhpal Khaira had resigned.

Singh has reportedly written in his resignation letter to party chief Kejriwal, “As a result of your dictatorial, arrogant and autocratic style of functioning, pioneers of AAP liPrashantant Bhushan, Yogendra Yadav, Medha Patkar, Kiran Bedi, Dr. Gandhi, H S Khalsa, Sucha Singh Chottepur, Gurpreet Ghuggi, Ashish Khetan, Ashutosh, HS Phoolka etc. have all left the party or have been thrown out in a humiliating manner,”

Lawyer and activist HS Phoolka had also quit from the party recently after resigning from his assembly seat. Baldev Singh, who is likely to join the newly formed Punjab Ekta Party launched by Khaira, has also called out Kejriwal for “Flirting with the Congress” and has called it ‘sheer political opportunism’.

Baldev Singh has reportedly also alleged that during the Punjab elections, the Delhi AAP leaders had indulged in rampant ticket selling and sexual exploitation of women. Rebel AAP MLA and former Delhi minister Kapil Mishra has Tweeted about it.

Mishra stated that former AAP MLA Gurpreet Ghuggi had also made similar allegations against the AAP leaders while quitting the party.

AAP Punjab leader Gurpreet Ghuggi had quit the party in May 2017 after Kejriwal had decided to appoint controversial leader Bhagwant Mann as AAP Punjab chief replacing Ghuggi.

Ghuggi had also made similar allegations against the leaders of AAP Delhi. He had reportedly alleged corruption and harassment of women on AAP Delhi leaders. Ghuggi had alleged that he was replaced as Punjab AAP convenor because he was raising his voice against the corruption and activities of women harassment by Delhi leaders.

AAP has seen many senior and founding leaders quitting the party in its short life span. Known for his frequent U-turns and also frequent apologies after giving derogatory statements, Arvind Kejriwal is now reportedly all set to form a pre-poll alliance with Congress with Shiela Dixit as its chief. Kejriwal had launched his political career on a foundation of standing up to the corruption of Sheila Dixit and her Congress government.

The Compulsive Contrarian and his Manufactured Logic: Arun Jaitley tears into Leftists and Congress

Arun Jaitley, India’s Finance Minister, took to Facebook today to write a scathing blog against Rahul Gandhi and Congress. He also tore into the Leftists who have tried their best to subvert democracy by weakening an elected government and skewed logic to create issues where none existed.

His blog, first published on Facebook, titled “The Compulsive Contrarian and his Manufactured Logic” is reproduced below:

In the run-up to the 2014 General Elections, there were many who never expected Prime Minister Narendra Modi to come to power with an absolute majority.

There are some in the political system who thought that they were born to rule. There are those who had managed to penetrate into positions of influence irrespective of the Government in power. Some who were part of the ideological left and the ultra-left obviously found the new Government wholly unacceptable. Hence emerged a new class of Compulsive Contrarians. The Contrarians believed that this Government could do no good. Every act of it must be opposed. They picked holes in the proposal to give 10% reservation in education and public jobs to the poor, compelling me to comment in the Lok Sabha that this was the first illustration in history where the Communists were obstructing a step taken to support the poor. Steps taken against black money were described as “Tax Terrorism”. The virtues of cash which was a source of black money and fuelled corruption were discovered after demonetisation. AADHAAR which became an instrument for saving money to ensure that it is fruitfully spent for the poor was questioned on the ground of violating personal liberty. Slogans which championed the breaking-up of this country into pieces was defended as free speech. The successful surgical strikes conducted by the Army were questioned either as a routine or as a dubious process.

The Compulsive Contrarians had no qualms about manufacturing falsehood. They could concoct arguments even if they went against the general interest of the country. They could masquerade corruption as a crusade. They could adopt double standards whenever it suited them. Let me now illustrate these with specific examples:

The Justice Loya case

Every fact alleged in the public space by the Compulsive Contrarians was manufactured. The Judge died a natural death due to a cardiac stroke. The only persons with him at the time of the stroke and in the hospital were his fellow Judges. No outsiders had any contact, and yet on friendly websites, social media campaigns, fake PILs, wild insinuations were made. The cause of the death was sought to be altered into a conspiracy for murder. The campaign went for months altogether. The Compulsive Contrarians included a retired Judge of the Supreme Court and a former Chief Justice of Delhi High Court. They had no hesitation in allowing themselves to support falsehood without factual verification. Eventually, a three-Judge Bench of the Supreme Court dismissed every claim made in the case. The judgment was delivered on behalf of the Bench by Justice Dhananjaya Chandrachud. He was criticized on the social media. What if the same had been delivered by Chief Justice Dipak Misra? Another vicious campaign of calumny would have been launched against him by the Compulsive Contrarians.

The Rafale case

The purchase of Rafale Combat Aircraft is yet another case of concocted falsehood by the Compulsive Contrarians. This is a deal where Prime Minister Modi should be credited with saving thousands of crores of the country. The Congress had compromised national security by delaying the deal for over a decade. Fake and concocted figures were put into the public domain as the purchase price of the Combat Aircrafts. The differences between a plain aircraft as a flying instrument and a Weaponised Aircraft was sought to be obliterated. Every fact was brought before the Supreme Court. The Court conclusively rejected the challenge. The need for purchase, the quality of the Aircraft, the pricing, the process, and the offset issues were all gone into and upheld by the Court. The Contrarians were proved to be liars and yet instead of stopping the campaign of falsehood, they started relying on an alleged dictational/typographical error to prove the judgment was wrong. Lobbyists and career nationalists joined the Compulsive Contrarians. Though the Court verdict should have been final, the Contrarians did not stop. They again raised it in Parliament. They conclusively lost the debate in the Parliament and yet the falsehood has not stopped.

The CBI issue

Anyone with even a nodding acquaintance of the state-of-affairs in Lutyen’s Delhi would know that a few individuals in our investigative agencies had over the last few years become a law unto themselves. Whispers of what was going on were not uncommon. It is the duty of the sovereign government to ensure the cleaning-up of each of the investigative agencies. The Government was only concerned with their accountability and integrity. The Contrarians chose to side with the questionable. Autonomy is always a great sounding idea. In the absence of accountability, an investigating agency can become a monstrosity. Let any informed person honestly ask himself a question – “post the two years fixed tenure functioning following the judgment in Vineet Narain’s case and the statutory amendments that followed, has the quality of the Heads of the Central investigative agencies improved or deteriorated?” Two views may be difficult as an answer.

Today the Contrarians have launched an attack on the Committee headed by the Prime Minister which transferred the CBI Chief. The only question before the Committee was whether there was any material available as a ground to transfer the CBI head? Prima facie, the CVC Report did constitute adequate and relevant material. The Committee is not an appellate forum against the CVC findings. If the same had to be challenged, it can only be challenged in Court. The Committee could not have ignored the CVC report.

The nominated Judge – Member of the Committee was attacked for a non-existent conflict of interest and the person who had a real conflict of interest and should have refrained from attending the meeting became the accuser. The leader of the largest single party in the opposition Mallikarjun Kharge was a petitioner before the Supreme Court claiming that the CBI Chief was an honest man and had been wrongly removed for mala-fide reasons and through a faulty process. Having been a campaigner for the ousted chief, he obviously could not have sat in judgment over his innocence or guilt in the Committee. His was a textbook case of bias. Any honourable man should have recused himself. His dissent as a biased man is non-est. Yet the conflicted man accuses one of the most honourable Judges of a conflict of interest.

On Judges

A Press Conference addressed by four Hon’ble Judges of the Supreme Court over a year ago has done more damage to India’s judicial institutions than many would have envisaged. It brought Judges into public gaze as factionalized and battling for their own turf space. There are a set of extra-adventurist lawyers practising in the highest Court, as in every other Courts. Their strategy is to over-awe the Court. They threaten to walk out of cases, they move impeachment motions in their Political capacity to flex their muscles and clout, they make public comments on Judges. They use media to intimidate the Court. Having involved themselves in ugly public conduct, Judges find themselves unable to exercise jurisdiction to stop such conduct by others. The last Chief Justice was attacked by the Compulsive Contrarians. A precedent has now been legitimised. His successors will find it difficult to escape similar treatment. The threat to the independence of the judiciary can also come from the public pressures that these Contrarians exert on Judges.

Collegium proceedings and conversations in the past two years have been faithfully reported in one particular newspaper (a Compulsive Contrarian), thereby underscoring the nexus. If the Law Minister invokes the seniority principle as he did last year in the case of one appointment to the Supreme Court, the Contrarians call it an attack on the independence of the judiciary. When the Contrarians raised the issue of inter-se seniority, as had happened recently, it becomes their crusade for the independence of the institution. Amazing double standards.

The Reserve Bank of India debate

The RBI has served this country extremely well. It has extremely important functions to perform. There are many instances of the past where Government and RBI have had different opinions.

The Government in recent months has strongly felt that certain sectors of the economy needed credit and liquidity support. Squeezing out both would eventually hurt this sector as also hurt growth. Recent data relating to some of those sectors have supported the position taken by the Government. Every stakeholder in the market was in agreement with the Government position but the Contrarians deflected the credit and liquidity issue to the issue of autonomy. After all the Government was only addressing the autonomous RBI and asking it to resolve the issues which lay in its domain.

I can go on and on with these examples. Free speech and the right to dissent are critical components of democracy but falsehood, subversion and institutional destruction are not. The right to campaign for stifling funds to the economy in the name of the autonomy, justifying corruption in the name of institutional independence, attacking Judges when the verdict is not favourable, manufacturing facts as in the case of Judge Loya’s death and the Rafale deal are indicative of the mindset of the Compulsive Contrarians.

Nations are built by those with positive mindsets and a national vigour, not by the Compulsive Contrarians. Didn’t left-liberals find fault with the various actions that Gandhiji took during the freedom movement? Weakening a Sovereign Elected Government and strengthening the unelectable is only a subversion of democracy.
