‘Please do something’, SC asks Centre to find a solution to the roads blockade due to the ongoing ‘farmers’ protest

Noting that the farmer’s protesting on roads and thoroughfares, for almost a year now, has been causing immense inconvenience to commuters, the Supreme Court has urged the central government to find a solution to this problem. “You now have enough time. Please do something”, Live Law quoted SC telling SG Tushar Mehta.

The 2-judge SC bench of justice SK Kaul and Justice Hrishikesh Roy were hearing a writ petition filed by Monica Agarwal, a resident of Noida. She alleged that travelling to Delhi from Noida for her marketing job has become a nightmare considering now it takes her over 2 hours for her to cover a distance which earlier could be covered in 20 minutes.

Taking exception to farmers blocking roads in Delhi and adjoining areas, Justice Kaul said that while farmers might have the right to protest but roads cannot be blocked indefinitely.

“They might have right to a place to agitate but roads cannot be blocked like this,” said Justice Kaul, directing the Central government and concerned States to devise a solution.

“You have to find a solution. The solution lies in the hands of the Union of India and concerned States,” the judges said.

On July 19, 2021, the apex court had directed the State of Uttar Pradesh and Haryana to file their response as to how the road blockade will be removed.

Responding to the SC, the Uttar Pradesh government said that they have been trying to talk and convince the farmers’ to clear the area for smoother traffic.

In an affidavit filed before the top court, the UP government said that efforts are underway to “make farmers understand the grossly illegal act of blocking roads”.

The Court, meanwhile, has granted time to the Central and UP government to examine the issue and come back to the Court with a solution.

In January, OpIndia reported how due to the farmers’ protest in Delhi, the economic activities in Delhi and its neighbouring states of Uttar Pradesh, Haryana, Punjab and Rajasthan have come to a halt. The trader’s body had stated that, until then, these states had incurred a loss to a tune of Rs 27,000 crore.

“Mike Pompeo had worked on a great deal (with the Taliban). I spoke with the head of the Taliban on numerous occasions and said upfront if anything bad happens to Americans or if you ever come to our land, we will hit you bad,” said Trump in the interview while talking about his ‘condition-based’ deal with the Talib. 

‘There is no plan’

Trump lambasted Biden for having no plan in place for the exit. “We were going to take out our military last. We would have first got out our citizens, then our military equipment, and then our military,” said Trump when asked how he would have handled the withdrawal of US from Afghanistan.

Trump listing his achievements said that not one American soldier had lost his life in the past one and half years in Afghanistan. He also revealed that the country was spending a whopping $42 billion a year defending the Afghans but got nothing in return. 

Trump highlighted how the hasty withdrawal of US forces has left behind world-class military equipment, heavy vehicles and choppers for the Taliban to use. He also stated that all those equipment will now fall into enemy hands. As per a report in Reuters, the Taliban has now taken control over more than 2,000 armoured vehicles, including US Humvees, up to 40 aircraft including UH-60 Black Hawks, scout attack helicopters, and ScanEagle military drones, apart from arms and ammunition.

‘Fighting for paychecks’

Divulging shocking bits of information, the outspoken politician nonchalantly disclosed that the Afghan soldiers were, in fact, fighting the Taliban only for the paycheck. “Our country was paying them a fortune to fight the Taliban,” said Trump.

“The Afghans were the highest-paid military and we were making them fight for the paychecks,” Trump said, adding that when the US stopped paying them, they just stopped fighting.

“40,000 Americans are potential hostages”

The former president reiterated his worry that close to 40,000 Americans have been abandoned in Afghanistan with no plan to bring them back. “They are potential hostages,” exclaimed Trump.

He also felt sorry for the Afghans who helped the US in the fight against the Taliban but are now left high and dry.

“We have the greatest military in the world but we are giving them a very bad reputation,” said Trump during the interview. 

Meanwhile, due to unprecedented pressure and bad press, POTUS Joe Biden has been forced to made amendments to his “vacation plans.” As per an AP report, president Biden was found at an official Camp David presidential retreat in Maryland when the Afghanistan government collapsed. 

Presently, as the US administration urged the American citizens stuck in Afghanistan to take ‘shelter in place’ and just ‘write’ to the US administration for rescue, Biden had plans to head to his Delaware home on Friday.

The schedule has been deferred but the fate of Americans in Afghanistan continues to be in the dark. 

Since August 15, the day the Taliban took over Kabul, thousands of Afghans have been flocking to the Hamid Karzai airport, creating chaotic situations and unfortunate incidents causing death.

On Sunday (August 22), an Indian national by the name of Tamal Bhattacharya sparked controversy after he praised the Taliban following his return to his home in Kolkata from Afghanistan.

Tamal, a 34-year-old resident of Nimta in the North Dum Dum area, was stranded in Afghanistan ever since the Taliban took control of the country. He had been working as a physics and chemistry teacher at an army school (Kardan International school) in Kabul since March this year. A mechanical engineer by training, Tamal was living in the staff quarters of his school. However, after the Taliban took over the city of Kabul, he was forced to lock himself up inside the principal’s residence.

He alleged to have contacted the Indian embassy and couldn’t reach the Hamid Karzai International airport despite several attempts. Later, he claimed to have reached the airport gate at 11 pm on Friday, only to be returned by the US security forces due to the absence of government officials and documents. He added that Talibs were surrounding the airport and had to spend the night in a nearby wedding hall. While speaking to Anandabazaar Patrika, he said, “Please Modiji, Amit Shah der apna ra bolun, jate amader kotha bhebe druto kono bebosta kora hoi (Please inform PM Modi and Amit Shah so that immediate action is taken for our evacuation).

According to his parents, Tamal was picked up by the Taliban on Saturday (August 21) afternoon. ABP Ananda reported that the Indian national had notified them about the development through a message on Whatsapp. His parents claimed that he was released by the radical Islamists after being interrogated. Eventually, Tamal was evacuated by an Indian Air Force (IAF) carrier along with 10 other Bengali residents. He boarded the flight late on Saturday night and reached the National capital on Sunday morning.

On the same day, he returned to Kolkata via a flight from New Delhi. Tamal, who was successfully rescued by the Indian government from his perilous state, heaped praise upon the Taliban after reaching home. As per a report in ABP News, Tamal Bhattacharya claimed that the Taliban has not only treated him well but also fed him good food. “They (Talibs) also played cricket with us,” he claimed. This is despite the fact that he had earlier pleaded with Prime Minister Narendra Modi and Home Minister Amit Shah to evacuate him immediately from Taliban-controlled Kabul.

Netizens question the doublespeak of the rescued Indian national

Netizens were aghast at the doublespeak of Tamal Bhattacharya. Twitter user, Vice President of BJP’s Mahila Morcha Keya Ghosh remarked, “Pic 1: A person stuck in Kabul desperately sends distress calls. Urges PM to make arrangements to evacuate him. Pic 2: Once landed in Kolkata, he has all praises for #Talibans. Even said they played “football (cricket)”. He revealed the nature of a true Communist.”

Another user lamented, “It is important to keep people like him under surveillance. One who supports terrorists is not less than a terrorist. People like him (Tamal) are dangerous for this nation.”

Another user remarked, “Who is this idiot? I urge the Government of India (GOI) to send him back (to Afghnaistan).”

Besides Indian Air Force, a special Air India flight carrying 87 Indians from Afghanistan’s Kabul also left for Delhi early on Sunday. The Indians were taken to Tajikistan’s capital of Dushanbe from Kabul on board a transport aircraft of the Indian Air Force (IAF) on Saturday. 

Mandatory masking of students at schools not effective against preventing spread of Covid, shows study

As the schools are slowly opening across the globe and Indian states are set to allow schools to reopen in a phased manner, there is a lot of confusion and debate happening around the importance of masking the school kids.

The experts are divided over the fact that initially, the masking measures looking promising, it is hard to assess what kind of effect would mandatory masking have among schools kids with no definite end-date. However, Centres for Disease Control (CDC) had published a study on Covid transmission in US Schools in May that suggested masking unvaccinated teachers and improved ventilation lowered down the incidences of virus spread in the schools.

However, in the month of July, CDC issued another set of guidelines in which they recommended that masks should be worn indoors by everyone above the age of 2 who are not vaccinated. The American Academy of Paediatrics echoed the guidelines and further added that everyone (both vaccinated and non-vaccinated) should wear a mask in schools. CDC later modified the guidelines in July to match AAP’s recommendations.

Notably, in the May study, stats showed that most common measures taken by the schools, including hybrid models, classroom barriers, HEPA filters, distancing, and student masking, did not show any significant benefit, and CDC was unclear if they had any impact on the spread of the virus.

The study covered over 90,000 elementary students in approximately 170 schools in Georgia from November 16, 2020, to December 11, 2020. It was a first-of-its-kind study by the CDC to see if the mitigation measures in schools had any effect on the spread of the virus.

Vinay Prasad, associate professor at the University of California, San Francisco’s Department of Epidemiology and Biostatistics, said in a statement that in the final conclusion, CDC should have included the summary of all measures taken by the schools. He further added that it should have mentioned, “That a masking requirement of students failed to show independent benefit is a finding of consequence and great interest.”

According to Tracy Hoeg, epidemiologist and senior author of a separate CDC study on COVID-19 transmission in schools, the study gives the impression that only masking among the staff was studied, but in reality, it included the student masking. The issue has become political for the United States. While the red and blue states hold different opinions on if the students should be masked or not, the leaders owe it to the children to have better information on the fact if the masks help in reducing the spread or not.

The problem with imposing the same guidelines for children and adults

Masking is believed to provide protection for adults from Covid-19. However, treating children like little adults may not be scientifically correct. For example, for many years, doctors kept prescribing a certain migraine medication to children based on studies done on adults. In 2017, scientists realised that the medicine did not make a significant difference compared to the placebo group in children, after which the doctors stopped prescribing the medicine.

In case of Covid-19, more studies are required to be done on the children to see if masks help them or not. Studies show that children are less likely to get severe Covid-19 infection. There were rumours that the third wave would affect children more, but that too has been denied by the majority of the experts. Masking among children is seen as a low-risk mitigation strategy. Experts believe that better ventilation in classrooms will have more benefit in controlling the disease.

Lack of exchange of expressions

With masks on all the time in school, the children can’t see and react to the facial expressions of the adults. Children under the age of five and children with special needs can only understand how to read emotions if they are able to see the expressions on the faces of peers and adults around them. Studies show that the understanding of expressions is not limited to early years but extends to teenage and further. Even World Health Organization suggests that children under the age of six are not required to wear masks.

In June this year, the Directorate general of health services (DGHS) under the Union ministry of health and family welfare also issued guidelines in which they said children between the ages of six to 11 may wear a mask but only under the supervision of the adults and after consulting with doctors. Children under the age of five years do not need to wear a mask.

Precautions, vaccination and ventilation

Experts believe that in the lack of evidence-based study to support masking among children, it is essential to protect people with multiple layers of mitigations. Both adults and children should follow protocols and take precautions. Schools should work on improving ventilation in the classrooms. Adults should follow masking mandates. Children between the ages of six to 11 should follow masking mandates if and when required, and everyone who is eligible for the vaccine should get it at the earliest so that the world, especially the children, can survive the pandemic.

Govt changes Mughal glorification page in Know India site after outrage on social media, still no mention of atrocities by Islamic invaders

Earlier today, author Ratan Sharda had highlighted how the government of India’s cultural website ‘Know India’ (knowindia.gov.in) displays an obscene and outrageous affinity for the Mughal invaders who had desecrated, destroyed hundreds of Hindu temples and had inflicted innumerable atrocities on native Hindus of the land.

An entire page of the ‘Medieval India’ segment was dedicated to the Mughal rulers, with the opening paras describing the Mughal rule in India as the “greatest empire ever”. Our detailed report earlier today on August 23 had highlighted the blatant glorification of external invaders and the complete whitewashing of their atrocities on the Hindus of India.

After much embarrassment on social media, the ministry of culture clarified in the afternoon that they do not run the website. The ministry further clarified that they are working with concerned entities to ‘accurately portray’ the events.

It is notable here that after the outrage by social media users about the sheer incompetency displayed by concerned government staffers regarding information about India’s history in a government website, the website now has changed some of the texts regarding the Mughal empire.

The entire section that praised the Mughals to the heavens and glorified them as “greatest ever” has now been removed. The current page now displays a brief summary of all Mughal rulers chronologically.

The earlier paragraphs singling glory of Jehangir as a “tolerant” ruler who loved Hindus, Jews and Christians have been removed. The false and factually incorrect details of the brutal murder of Sikh Guru Arjan Dev has also been removed. Subsequently, the lines falsely glorifying them as rulers of most of India have been removed.

The glorification of Aurangzeb has been mostly removed too. But it is still not understood why the Mughals get a full mention of all their rulers individually while the same courtesy has not been extended to other Hindu empires of India that existed before, or during the Mughal rule.

On the entire page, there is still not a single mention of the brutal atrocities inflicted by Mughals on the cultural, archaeological and religious wealth of India. There is no mention of how they destroyed hundreds of Hindu temples, including the holiest of Hindu shrines and converted them to mosques. No mention of how Islamic invaders plundered and looted Hindu temples.

Here is the entire para glorifying Aurangzeb earlier that has now been reduced to a brief 2-3 sentences. It had no mention of how the Islamist tyrant had destroyed Hindu temples and inflicted atrocities on Hindus and Sikhs alike.

Indic dynasties that ruled before or during Mughal rule ignored

In earlier pages, the great rulers of the Pala, Pratihara, Rashtrakuta and Sena dynasties only find very brief mentions, nowhere near the elaborate detailing that the Mughals have got. The reasons behind the Mughal obsession are still unknown.

No mention of Kalinga’s Gajapati empire, no mention of Ahoms, no Bajirao

Strangely, the Know India website has no mention of Kalinga’s Gajapati dynasty that bravely fought Muslim Sultans of medieval India and established a vast empire from Ganga to the Godavari in the 15th century.

The website focuses so much on Mughals but doesn’t mention how the Ahoms under the command of Lachit Borphukan gave them a crushing defeat and halted the spread of the Mughal empire in Assam.

Even the brief paragraphs about Marathas and the mention of Shivaji’s Hindavi Swaraj as a “small kingdom” has no mention of the conquests of Peshwa Bajirao.

In all the pages about the Islamic invasion of India, there is not a single mention of how the Islamic invaders looted Hindu temples, razed them to the ground and forcefully converted millions of people. There is not a single mention of Rajput women committing Jauhar to escape from Islamic brutalities, nor a single mention of how the Islamic invasion wreaked havoc on the Hindus and Buddhists, or how the Mughals killed Sikh Gurus with utmost brutality.

Curiously, the website only mentions Sikh Gurus were ‘martyred’. It does not say how or by whom they were killed.

The culture ministry has done well to acknowledge the problem, it is always good when the government addresses the grievances of their citizens. At the same time, one hopes that the other concerns raised here will be addressed too.

Union Ministry of Information and Broadcasting provides official recognition to the self-regulatory body of NBF

In what may appear as a major setback to the ‘Lutyens’ media, the Union Ministry of Information and Broadcasting (MIB) has officially recognised the News Broadcasters Federation (NBF)’s self-regulatory body. Getting an official status from the MIB, make NBF the only institution of its sort in the country to get accreditation from the Government of India.

In a press statement, the NBF, which is already India’s largest body of news broadcasters in India, said that on being recognised by the Government of India, the body is set to build a robust system with the highest standards of transparency and accountability, and one that has set an unmatched precedent in the domain of news media vis-a-vis self-regulation.

Presently, NBF’s Professional News Broadcasters Standards Authority (‘PNBSA’) is the only body in India that has successfully demonstrated compliance with national standards in the domain of news media. This accreditation is another symbol of high professional standards and excellence with which the NBF and the PNBSA operate, read the statement.

Over 50 channels had formed an alternate regulatory body- the National Broadcaster’s Federation (NBF) in 2019 to challenge the hegemony of the National Broadcaster’s Association (NBA).

The NBF is a body that was set up to function independently from the NBA which has exercised a stronghold on broadcasting media since its inception. Until the inception of NBF, the NBA had the exclusive right to negotiate with the government and deal with all concerns relating to the broadcasting industry.

The NBF was formed to perform independently of the NBA (National Broadcasters Association) which till now had the sole monopoly of negotiating with the government and dealing with all issues concerning the broadcasting fraternity thus far. The board of directors has members only from a select group of channels that often peddle fake news and misleading narratives, including NDTV which not only peddles fake news but is also under investigation for financial irregularities.

Other than the lacking representation, the NBA also seems to be rather politically motivated and biased. When Republic TV journalist was manhandled by goons at a Jignesh Mevani rally, the NBA insisted that Republic TV apologises on air for referring to the goons as… goons.

For long, the NBA seems to have exercised disproportional power in negotiating with TRAI, other regulatory bodies and the government, with the minimum presence of regional channels. NBF has challenged that organisational supremacy by getting regional channels together. 

Uddhav Thackeray’s PA Milind Narvekar demolishes his own sea-facing illegally constructed bungalow to ‘avoid action’: Details

Maharashtra CM Uddhav Thackeray’s trusted aide Milind Narvekar demolished his own 2000 sq ft sea-facing bungalow located on a plot spanning around 1.80 acres at Dapoli-Murud seashore in Ratnagiri district on Sunday, August 22. Narvekar was compelled to raze his own property fearing action by the authorities since the high profile Shiv Sena leader had erected the bungalow in violation of Coastal Regulation Zone (CRZ) norms. The unusual move of the Shiv Sena leader is being considered an attempt to save himself from any embarrassment.

On Sunday, BJP leader Kirit Somaiya took to Twitter to post a video of the demolition of Narekar’s bungalow. Taking credit for the same the BJP leader said that Shiv Sena Minister Anil Parab is next in line. “We have done it. I will be visiting the site today to see the demolition and will demand criminal action against Narvekar,” Somaiya said.

The action came after Bharatiya Janata Party (BJP) leader Kirit Somaiya, in June, complained to the central and state environment departments that the ground-plus-two-storey structure of Milind Narvekar was constructed illegally. He said that the bungalow was constructed without taking due permissions related to the coastal regulation zone (CRZ), which he said was mandatory, as the land in Murud village in Dapoli falls within the restricted area. 

Along with Narvekar, Somaiya had also filed a complaint against few other Shiv Sena ministers, including Anil Parab’s illegally contracted resort in the area.

Following Somaiya’s complaint, a team of officials from the ministry had visited the site about a month ago. The team reportedly directed the state authorities to take action. The state authorities had also warned Uddhav Thackeray’s PA of action against the illegal construction.

Delhi Chief Minister Arvind Kejriwal ‘inaugurates’ Delhi’s ‘first smog tower’, except, it may not be the first

Grabbing yet another opportunity to hog credit for work done by others, Delhi Chief Minister Arvind Kejriwal declared that his government on Monday inaugurated the city’s first ‘smog tower’ to curb the menace of pollution.

Kejriwal claimed that the ‘smog tower’ is not just the first one in Delhi, but the first such in the whole country.

Only, this is not the first ‘smog tower’ installed in the national capital. East Delhi MP and former cricketer Gautam Gambhir in January 2020 had installed and inaugurated a first-of-its-kind giant air purifier in Delhi’s Lajpat Nagar market. In the month of November, the BJP MP had installed two more such air purifies taking the total count to three. 

Gambhir on January 10, 2020, just five days after inaugurating the first smog tower had shared the results in a Tweet. “Intent combined with action will always yield results! Sharing initial readings of the prototype air purifier installed last week!” he Tweeted.

Just a year and eight months later, Kejriwal has claimed to inaugurate allegedly the first smog tower at Baba Kharak Singh Marg in the Connaught Place area. Sharing the same, the Delhi CM tweeted, “Congratulations Delhi. In the war against pollution, the country’s first smog tower has been started in Delhi. This smog tower made using American technology will reduce the amount of pollution in the air. If the results of this project started on pilot basis are good then more such smog towers will be installed all over Delhi.”

The tower will reportedly purify 1,000 cubic meters of air per second within a radius of around 1 km. In a media interaction post the inauguration, Kejriwal said, “The tower has been set up as a pilot project and initial trends will be available within a month.”

He also informed that a control room has been set up at the site to monitor its operations. Additionally, experts will undertake a study to ascertain the effectiveness of the air purifier. 

The tower funded by the Delhi government has been built at a cost of Rs 20 crore. 

On the other hand, the air purifier installed by Gambhir in association with Traders’ Association Lajpat Nagar (TALN) cost around Rs 7 lakhs, suggest reports. While the machine was funded by Gautam Gambhir Foundation, the maintenance which costs around Rs 30,000 per month is being borne by the TALN. 

The national capital is one of the most polluted cities of the nation and the government has done very little to curb the nuisance caused by air pollution. 

Truckers threaten to shut down Australia as country succumbs to Covid insanity, shoots dogs, thrashes citizens

Australia seems to be in the grips of COVID-induced insanity as people across the country are vigorously protesting against the lockdown measures imposed to curb the spread of the renewed bout of coronavirus outbreak.

After violent ruckus witnessed on the streets of major Australian cities, including Brisbane, Sydney and Melbourne, and dogs shot dead by a rural council in New South Wales to prevent volunteers from travelling during Covid restrictions, Australian truck drivers have threatened to shut down major highways across the country as a mark of protest against Covid lockdowns.

Social media websites are awash with a video of a truck driver who said in his video that truck drivers are ‘planning to shut down the country’ to ‘remove the s*** government’. He further warned the Aussies that their demonstration could end up choking supply chains and urged them to stock up on groceries to get them through the next couple of weeks.

“It’s on. The truckies are doing it. The truckies are going to shut down the country,’ the man says in the video. What that means is you need to go shopping now, get what you can for the next week or two, load your fridge, freezers,” the truck driver could be seen saying in the video.

The man in the video claims truck drivers in Australia have been in discussions with people from “around the world” and are collaborating with war veterans to carry out the protest.

As per a report published by the Daily Mail Australia, the social media page of the man in question is replete with anti-vax posts, including wild claims that the vaccine is a conspiracy hatched by America and China to ‘poison’ people.

“The truck drivers are in. So are the VETS. I’m in. I am willing to go to jail to save my country and children,” he says.

The man, however, did not reveal how many truck drivers have partaken in the protests. Since the video of the man had gone viral on the internet, other truck drivers from other countries have also surfaced online, advising measures to undertake to avoid authorities from towing away their trucks.

Dogs shot dead by an Australian rural council to prevent volunteers from travelling during Covid restrictions

Earlier yesterday, it was reported that a rural council in New South Wales, Australia, had shot dead dogs waiting to be rescued by a shelter in order to prevent volunteers from travelling during Covid-19 restrictions. According to the Office of Local Government, the Bourke Shire Council killed the dogs to prevent volunteers from a Cobar-based animal shelter from travelling last week.

“OLG has been informed that the council decided to take this course of action to protect its employees and community, including vulnerable Aboriginal populations, from the risk of COVID-19 transmission,” the watchdog’s spokesperson said.

One of the dogs was a new mother and as per the report, the animal shelter had the necessary precautions in place to transport the dogs safely. Moreover, Cobar has not seen any recent case of local transmission of Covid-19.

Police use rubber pellets, tear gas to disperse thousands of people who had come out on streets to defy COVID-19 restrictions

Widespread protests were witnessed in Australia over the weekend as thousands of unmasked protesters carried out anti-lockdown rallies in various cities throughout the country in defiance of the restrictions imposed by the government in the wake of the resurgent coronavirus outbreak. 

Violent clashes erupted between protesters and law enforcement officials in Melbourne, Brisbane and Sydney as the latter accused the former of having “violence in mind”. Hundreds of protesters were detained and seven officers were hospitalised as a result of clashes a day after the country saw its highest-ever single-day rise in COVID-19 cases.

The scene of violence and chaos was particularly stark in Melbourne, where more than 4,000 people had come out to oppose the coronavirus-induced lockdown in the country. Victoria police arrested 218 protesters and six police officers were hospitalised in a series of altercations that ensued between the two sides. 

The protests in Melbourne took place after Victoria’s premier, Daniel Andrews, announced that the strict lockdown imposed in the city would be extended across the entire state. The state recorded 77 new cases of coronavirus on Saturday.

Much like the anti-lockdown rallies in Melbourne, protesters in Sydney also took to the streets to register their protest against lockdown. More than 1,500 officers were deployed in the city to control the demonstrations. Taxis and Ubers plying in the city were banned until 3 pm on Saturday. Trains were not allowed to stop at city centre stations. 

Similarly, thousands of protesters also demonstrated on the streets of Brisbane in Queensland after restrictions were imposed in the city to curb the spread of the coronavirus outbreak.

Australian police on Saturday employed harsh measures, including the use of rubber bullets and tear gas, to disperse crowds that had gathered on roads in a nationwide protest to oppose the imposition of lockdown by the government. 

It is worth noting that Australia has been witnessing a steady uptick in COVID-19 caseloads, with the highest number of new cases in a single day reported on Saturday last week. With vaccinations dragging at a snail’s pace, the Australian government had announced a strict COVID-19 lockdown to tame the new wave of outbreak. However, it seems insanity and paranoia seems to be spreading at a much faster rate than the coronavirus outbreak.

‘Live without it’: Delhi High Court denies urgent hearing for Adv Sanjay Hegde’s application over suspension of Twitter account

The Delhi High Court on Monday in an ‘early hearing’ of a petition filed by senior Supreme Court lawyer Sanjay Hegde on suspension of his social media account, ordered the petitioner to ‘live without Twitter.’

As per Live Law India, when the Counsel brought to the Bench’s notice that his client’s Twitter account had been suspended for over two years now, Justice Rakhi Palli remarked, “It is not urgent, your client can do without #twitter.”

Justice Palli further advised the senior advocate to join other available social media platforms such as Instagram. “We have more important matters today. None of us are on Twitter, he can switch to Instagram or any other platform,” she said. Thus, the Court denied an urgent hearing over his petition.

‘Have right to suspend any account’

Twitter in response to the same plea in July this year had informed the Delhi High Court that it ‘can suspend the account of any individual user found in breach of their service agreement and that it has a “contractual obligation” to do so.’

“…the provision of services on Twitter is pursuant to a contractual obligation which the petitioner (Hegde) has signed up for, and the said contract gives Respondent No 2 (Twitter) the right to suspend an account if it is in violation of the user agreement and its policies. This shows that Respondent No 2 is merely discharging its contractual obligations,” read Twitter’s response. 

The micro-blogging platform further stated that it is not in any way obliged to further the freedom of speech and expression guaranteed under the Indian Constitution.

In December 2019, the senior advocate had moved the high court challenging the permanent suspension of his account by Twitter. According to Hegde’s petition, he was allegedly suspended for quoting Kavita Krishnan, secretary of All India Progressive Women’s Association and member of CPI(ML) Tweet.

Hegde had contested that the suspension of his account was illegal and that it is also in violation of his right to free speech and expression guaranteed by Article 19 (1) (a)of the Indian Constitution.

Prior to the final suspension, Hegde’s Twitter account was suspended multiple times. In October 2019, he claimed his account was suspended for having the Nazi resistance image as his header image. The platform restored his account only after he deleted the image.
