With AAP leaders accused of taking part in Delhi riots, Kejriwal govt rejects lawyers proposed by Delhi Police as public prosecutors

The Delhi cabinet meeting chaired by Chief Minister Arvind Kejriwal on Tuesday rejected the panel of six public prosecutors suggested by Delhi Police to defend itself in the February 2020 riots as well as anti-CAA protests in the Delhi High Court and Supreme Court. Delhi government claimed that a ‘free and fair trial’ would not be possible if Delhi Police itself selects a panel of lawyers to defend itself. Instead, Kejriwal government has asked state home department headed by Satyendra Jain to set up a panel of ‘impartial panel of best lawyers’ to fight the case.

It is imperative to note here that former AAP councillor Tahir Hussain has been charge sheeted and accused of murder and orchestrating the riots. He has been accused of leading a mob to godown and setting it on fire. Delhi Police charge sheet also states that the IB officer Ankit Sharma was specifically targeted by the mob led by AAP leader Tahir Hussain. He is also accused of masterminding the Delhi riots and funding the violence in Chand Bagh. AAP MLA Amanatullah Khan has consistently defended Hussain and alleged that he is being ‘targeted’ for being a Muslim. Khan himself is also accused of inciting the violence in Delhi on 15th December 2019 amid the anti-CAA protests.

A Delhi government cabinet meeting was held on Tuesday on the direction of LG Anil Baijal who, in his letter dated 16th July 2020, gave the Kejriwal government a week’s time to decide on the panel of lawyers it wanted to appoint to fight the cases. On 10th July, the Delhi Police had proposed six names of lawyers to act as public prosecutors defending Delhi Police in the 85 cases related to the riots and violence during anti-CAA protests. This included solicitor general Tushar Mehta and additional solicitor general Aman Lekhi. Deputy chief minister Manish Sisodia rejected the idea of the panel proposed by the Delhi Police. He has demanded that the Delhi government’s team of lawyers led by Rahul Mehra be assigned the task.

As reported by Hindustan Times, Delhi government rejected the proposal of Delhi Police on grounds that the investigation was biased. Delhi government cabinet stated that the lawyers should be ‘independent’ of the police and the LG should not ‘interfere’ as the matter is not ‘rarest of the rare’ case. According to Hindustan Times, the cabinet note read, “The judiciary has also made adverse remarks against Delhi Police’s investigations on several occasions… Therefore, in order to ensure that all facts are presented before the judges, it is extremely critical that the government advocates are independent of the Police. Therefore, the panel suggested by Delhi Police should be rejected”. The Cabinet also alleged “repeated interference” by the LG in appointing the panel of lawyers and asserted that the Delhi government has the right to appoint public prosecutors.

Recently, the Delhi government had rejected a panel of 11 lawyers appointed as public prosecutor for Delhi Police in lower courts for over 750 cases regarding the riots. The LG had then referred the matter to President Ramnath Kovind. Following which, Delhi state home minister Satyendra Jain had approved the appointment of public prosecutors.

Sweden’s Lund University asks people to stop defaming them and making fun of their name: Fact check

Social media post has been making rounds that the University of Lund in Sweden – one of the world’s top 100 universities recently took to social media to express their deep disappointment over disparaging comments made on the university, especially by several social media users who made fun on university’s name.

In a viral post on Facebook, it was claimed that Lund University said that they have spent hours deleting comments defaming them on their official Facebook page.

Lund is the name of a medieval town in Southern Sweden. The word means “green area”, but in Hindi, lund is colloquial term for male genitalia.  

The viral message claimed that University said that social media users from certain countries spoke about the name of the university and how it is ‘rediscovered’ by students from various countries again-and-again. The statement read that the university is aware of the fact that its name means ‘absolutely something else in their language’.

The viral message read, “We have had this Facebook page for ten years now and every now and then it is ‘rediscovered’ by students in certain countries who spread it to their friends. We are well aware that our name is entertaining to you and with thousands of languages in the world, there will of course always be words that sound funny in another language”.

“If you are not a prospective student, we would appreciate if you could write your comments directly to your friends and not on our page. As admins of the page, we need to spend hours deleting hundreds of comments to keep the page manageable, relevant and available for serious students questions. Thank you (sic),” read the viral Facebook post of ‘Lund University’.

However, while the viral Facebook post had a message from ‘Lund University’ with a blue tick, meaning that the message was from official Facebook page of Lund University, OpIndia could not find the Facebook page stated. Instead, the official page of international desk of Lund University is not verified by Facebook.

OpIndia has reached out to the university for a comment on the same and to know if the university is indeed deleting comments which it finds ‘offensive’ on social media. We shall update the report once we hear back from them.

Karnataka drops Tipu Sultan, Hyder Ali, Prophet Muhammad and Jesus Christ from school syllabus due to Coronavirus

The BJP government in Karnataka has taken down chapters on controversial 18th century figures Tipu Sultan, Hyder Ali from the Class 7 social science textbook. The decision was taken after Karnataka decided to trim down the 2020-21 syllabus due to the raging coronavirus pandemic.

Though, official sources claimed that chapters on Tipu Sultan have been retained in Class 6 and Class 10 books. The amended curriculum uploaded on the Karnataka Text Book Society (KTBS) website shows that chapter 5 that mentions Hyder Ali and Tipu Sultan in the social sciences textbook of class 7 has been removed.

Furthermore, Karnataka government has also dropped lessons on Jesus Christ and Prophet Mohammed in Class 6 as Students will study the same in grade 9. The move to remove the chapters came in the wake of the Coronavirus pandemic. It was taken for the ease of students as working days had been reduced to 120.

Talking about the removal of several chapters from the textbooks, Karnataka Text Book Society director Madde Gowda said, “The chapter on Tipu Sultan for Class 7 has been dropped to reduce the syllabus by 30 per cent for this academic year due to delay in reopening of schools due to no let-up in coronavirus spread.”

He further added that as Class 7 students would have already read about Tipu in Class 6 and will read more on him in Class 10, dropping it for this academic year won’t be a loss to them.

Opposition slams Karnataka government for dropping Hyder Ali, Tipu Sultan, Prophet Muhammad from school syllabi

However, the omission of chapters on the controversial figure Tipu Sultan drew the opposition’s ire, who slammed the government for viewing everything from a political prism. KPCC President DK Shivkumar said, “BJP government views everything from a political perspective. They want to make their personal agenda as a historical agenda. This is unacceptable. Whether they may accept it or not, Tipu, Hyder Ali and Prophet Muhammad are a part of our history.”

Kumar also added, “Whether we celebrate Tipu Jayanthi or not, it is a different issue. History is history. The draft committee which is trying to change the syllabi, it is not right. It should be debated. We can’t change history, preaching things might be different. We will have to take this issue very seriously. I will set up a committee on this issue.”

Karnataka CM BS Yediyurappa had earlier claimed of removing references to Tipu Sultan

Tipu Sultan has been a polarising figure in the state of Karnataka where people’s opinion about him range from him being a fierce freedom fighter to a tyrannical despot.

Last year, chief minister of Karnataka, BS Yediyurappa had asserted that his government was contemplating expunging references to Tipu Sultan from textbooks. Yediyurappa said that Tipu Sultan was not a freedom fighter and he doesn’t deserve a place in the school textbooks.

Following the statement by Yediyurappa, Karnataka BJP tweeted saying that the “textbooks must be rewritten to portray the real Tipu Sultan to our Children”. They added that children “should be made aware of the Tyrant’s cruelty against Hindus & his anti Kannada rule.”

The Karnataka chief minister had last year also overturned the previous Congress government’s decision of celebrating Tipu Jayanti by ordering a state-wide cancellation of all Tipu Jayanti celebrations observed in Karnataka.

While the BJP considers Tipu Sultan as a cruel oppressor who committed unspeakable atrocities against his Hindu subjects, the Congress party regards him as a freedom fighter.

Kalyan Singh refused to give orders to shoot Karsevaks: Here is his speech from 1992

Numerous people have made an immense contribution to the movement to ensure the construction of the Ram Mandir at Janmabhoomi. Following the demolition of Babri Masjid on December 6, 1992, Kalyan Singh resigned from his position the same evening taking moral responsibility for the events that transpired.

While addressing a public gathering, Kalyan Singh said, “I take responsibility for everything that happened. If you want to file a case in Court, then file it against me. If you want to set up an inquiry commission, then make me appear before the commission. If you want to punish someone, then, punish me.”

“Would I have shot the Karsevaks? I had made it clear in the NIC meeting that shots would not be fired at the Karsevaks (under any circumstance). When I received a call from the Home Ministry around 1 pm on December 6, I was told that several Karsevaks had climbed atop the dome. I told him that as per my information, the Karsevaks not only reached for the dome but has also started breaking it. I told him to record my statement that no permission to shoot Karsevaks will be given.”

Kalyan Singh explains the rationale behind his statement

In an interview with NDTV in 2009, Kalyan Singh said, “Lakhs of Kar Sevaks were present but no bullets will be fired. This was my order.” He explained that doing otherwise would have led to the death of 1000s of people. He emphasised, “If I had allowed it to happen, thousands of people would have died, from bullets and stampede, and the structure still wouldn’t have survived.” On being accused of dividing crores of people by trying to save 1000 lives, Singh proudly said that he did not commit the sin of killing Kar Sevaks.

The interviewer said, “A thousand Kar Sevaks would have died if you had fired bullets as per your own estimation. To save yourself from that sin, you committed the sin of dividing crores of people.” Kalyan Singh aptly replied that he had no regret, repentance, sorrow, or grief about the events of the red-lettered day. “Many people say that the events of the 6th of December, 1992 are a matter of national shame. I say that the 6th of December, 1992 is not a matter of national shame but of national pride,” he was quoted as saying.

The political significance of the decision

The decision of Kalyan Singh to not allow police to fire at the Kar Sevaks holds significance, in light of the political event that led to the killing of 16 Kar Sevaks 30 years ago on the orders of Samajwadi Party patriarch Mulayam Singh Yadav. The incident which occurred in Ayodhya, all those years ago, left an ineradicable mark in the history of India.

On November 2, 1990, a large group of Karsevaks, including the Kothari brothers, started to gather in front of Hunumangarhi, a stone’s throw away from Babri Masjid that was eventually demolished couple of years later. They started moving ahead but were stopped by police. All of them sat on the road in protest and started singing ‘bhajans’ (religious songs) when suddenly, the security personnel at the behest of then CM Mulayam Singh, started firing at the crowd and chased Karsevaks across the area.

Many people died from head wounds. There was a stampede at the Saryu Bridge, which killed a number of people. According to eye-witnesses, the Kothari brothers mounted a saffron flag atop the Babri Masjid, however, fell prey to the brutality meted out on the Karsevaks. “We had to fire. When I tried to justify my action, the Bharatiya Janata Party (BJP) members called me the murderer of humanity. If we had not fired at them, imagine what the Muslim population would have thought. Then how would I justify my position as a chief minister, Mulayam Singh was quoted as saying.

Kalyan Singh has earned immense respect for his conduct during the Ram Janmabhoomi Movement. At no point in time has he expressed any regret over what happened on that fateful day. He did not open fire at the Kar Sevaks and yet sacrificed his position as the Chief Minister for it. For that, he remains one of the icons of the Hindutva Movement.

NIA arrests DU Professor in Bhima Koregaon Elgar Parishad case for Naxal activities

The National Investigation Agency (NIA) has arrested one Hany Babu Musaliyarveettil Tharayil, son of Kunhu Mohammad, in the Bhima Koregaon Elgar Parishad case. The accused is a 54-year-old associate professor in the English Department at Delhi University and is a resident of Gautam Buddha Nagar, Uttar Pradesh.

The NIA has said that Hany Babu Musaliyarveettil Tharayil was engaging in Naxal activities and propagating Maoist ideology and was a conspirator along with others in the case.

What is the Bhima Koregaon Elgar Parishad Case?

The event by the name of “Elgar Parishad” was organised to commemorate the Battle of Bhima Koregaon of 1818, wherein the Peshwas fought against the between East India Company. In the war, an army of Dalit soldiers had fought under the British forces against the Peshwa, the reason for the celebration by Dalits. In 2018, it was the 200 year anniversary of the war and extreme violence erupted over the matter.

Soon after, the case was transferred to the NIA. The Pune police had arrested a total of nine supposed “intellectuals” such as Sudha Bharadwaj, Rona Wilson, Surendra Gadling, Mahesh Raut, Shoma Sen, Arun Ferreira, Vernon Gonsalves, and Varavara Rao for inciteful speeches.

Patna police file FIR against Rhea Chakraborty on the complaint of Shushant Singh Rajput’s father

KK Singh, Sushant Singh Rajput’s father, has filed a complaint against Rhea Chakraborty at Rajiv Nagar Police Station in Patna. Police have registered the FIR under various sections, including abetment of suicide. Sushant’s father alleged that Rhea took money from Sushant. He added in the complaint that she is the reason behind Sushant’s extreme step.

Rhea and Rajput dated for a while before he committed suicide on 14th June 2020. Sushant’s father did not file any complaint to the Mumbai police. He was called for questioning by the Mumbai police in June. At that time he said that he had nothing against anyone. An investigation is being conducted by the Bandra Police, Mumbai, in this case. When police questioned Rhea in Mumbai, she said that Sushant ended his contract with Yash Raj Films and was asking her to do the same. As of now, police have interrogated more than 40 people. Recently, Rhea requested Home Minister Amit Shah to intervene and order CBI inquiry in the case.

YRF had a three-film contract with Sushant. Two of the films under contract were released, but the third one got shelved. Sanjay Leela Bhansali said in his statement to the police that he offered three films to Sushant, but because of his contract with YRF, it didn’t go through. Police also called Mahesh Bhatt for questioning on 27th July and before the interrogation he posted a cryptic message on Twitter.

The death of Sushant Singh Rajput

The 34-year-old actor ended his life on 14th June 2020 that left the whole country in shock. He was known to be a loner and often claimed in interviews that he was not able to spend time at parties and crowded places. Known for his intelligence and interest in science, the actor was seen in various movies including Dhoni, Byomkesh Bakshi, Shudh Desi Romance etc. and received appreciation for his roles by the public.

His last film Dil Bechara was recently released on Disney Hotstar. However, there are allegations that he was forced out of work by the “movie mafia” that comprises Karan Johar, Mahesh Bhatt and likes. Many celebrities, including Kangana Ranaut have raised voice and demanded justice for him.

Muslim leader Owaisi says nonexistent disputed structure will remain a mosque, suggests Kashi-Mathura might be next

‘Secular’ political parties have initiated a concerted campaign against the Bhoomi Pujan ceremony to be conducted at Ram Janmabhoomi on the 5th of August. Suggestions have been made that the ceremony should be conducted through video conferencing and others have suggested that Prime Minister Modi should not attend it. Now, AIMIM leader Asaduddin Owaisi has also entered the fray.

In an interview with Outlook Magazine, Asaduddin Owaisi said that Narendra Modi should clarify whether he is attending the event in his official capacity or as an individual. He said the same thing on Twitter and claimed that attending the event as the Prime Minister would violate his constitutional oath as secularism is part of the basic structure of the Constitution.

During the same interview, Asaduddin Owaisi also claimed that the nonexistent disputed structure at Ram Janmabhoomi will always remain a Mosque. He said, “Babri Masjid is a mosque and it will always remain as one. This is my faith. That cannot be taken away from me or anyone.” He added, “As far as Muslims and people who believe in justice are concerned, we will keep telling the new generation that our masjid was demolished. It doesn’t matter if our voices are suppressed. We will tell it in our own way.”

Asaduddin Owaisi remained insistent that faith had won over facts in the Ayodhya verdict. However, he appears to have mellowed down since the day of the verdict. He said, “Now that the Supreme Court has given the final verdict on Ayodhya, we have to accept it. As former CJI J S Verma rightly said, “the SC is supreme, but not infallible’’.”

The greater concern for the AIMIM supremo as of now appears to be the Place of worship Act 1991 which was recently challenged in the Court. The Act forbids the conversion of a place of worship and provides for the continued maintenance of the religious character of a particular place of worship as it existed on the 15th of August, 1947. The said Act is considered by to be the biggest impediment towards the reclamation of Kashi-Mathura.

Asaduddin Owaisi is of the opinion that the BJP government could repeal the Act. He told Outlook, “Yes, they can do it. They have the majority in the Parliament and it is as simple as that. If that happens, we will definitely take the battle to the courts. If Article 370 can be removed for Jammu and Kashmir, the same can be done by the BJP. Stripping the special status of Jammu and Kashmir was a constitutional breach by the BJP government.” he also said that the Kashi Mathura case should be thrown out of the Court.

Asaduddin Owaisi was fiercely critical of the Ram Janmabhoomi verdict but he appears to have reconciled himself to the inevitability of the construction of a Bhavya Ram Mandir at Ayodhya. However, it is quite clear that he will not stop complaining about it any time soon.

‘Ready to join hands with Shiv Sena for the betterment of the State’: Maharashtra BJP Chief

The BJP State Unit in Maharashtra has reportedly expressed its desire to join hands with its former ally, Shiv Sena. According to BJP Chief (Maharashtra) Chandrakant Patil, the party is willing to forge an alliance with the Sena for the ‘betterment of the people of the State’.

As per the report, the statement from the BJP comes at a time when Shiv Sena has openly announced in the party mouthpiece ‘Saamna’ that they have deliberately allied with the ‘secular’ Congress and the Nationalist Congress Party (NCP) to keep BJP out of power in Maharashtra. Reportedly, the BJP is trying to take advantage of the disagreements within the Maha Vikas Aghadi, an uncanny coalition between the erstwhile saffron party Shiv Sena, Congress and the NCP.

As per reports, Patil said this after BJP President JP Nadda asked the state unit to work towards bringing the BJP back in power in the state on its own.

As per a report in India Today, Patil said in a virtual address to party workers in Kolhapur, “Even if we come to power and have to forge an alliance with Shiv Sena, we will still contest the elections on our own. We can form the government together, but that does not mean we will contest the elections together.”

Shiv Sena had ditched pre-poll alliance after assembly elections

Following the Assembly elections result, Shiv Sena supremo Uddhav Thackeray had upped the ante over the ’50-50′ agreement he claimed to have with the BJP. After being refused CM seat, Thackeray joined hands with arch-rivals NCP and Congress to keep the BJP out of power. Despite having a pre-poll alliance with the BJP, Shiv Sena ditched its ally in pursuit of the CM seat. However, it soon turned out to be the loser in the grand alliance.

The BJP, despite being the single largest party, had to stay away from power after Sena reneged on the pre-poll alliance for the CM’s post. The BJP had made it clear that no 50-50 formula was agreed upon and they won’t compromise with the CM’s post.

The party had to cede important portfolios such as Home and Finance to its alliance partner NCP. Deputy Chief Minister and Nationalist Congress Party (NCP) leader Ajit Pawar have been allocated the finance ministry while NCP leader Anil Deshmukh is the Home Minister of the state. The other important portfolios such as Revenue and PWD have also been given to the Congress party.

Ayodhya: Mosque construction on govt granted site lags, Sunni Waqf Board yet to form a trust

While the preparations for Bhoomi Pujan of Ram Temple are on schedule, the construction activities for the Mosque on the alternate land have slowed down amid Covid-19 pandemic. Sunni Central Waqf Board of Uttar Pradesh said that they got the land from the Uttar Pradesh government on Supreme Court’s instructions on time. However, the other formalities are still pending.

Hindi daily Live Hindustan reported that the Waqf Board was the major Muslim party in the lawsuit related to the ownership of the disputed site. The board had earlier said that apart from Mosque, they are planning to construct an Islamic research centre, hospital and library. Zufar Ahmad Farooqui, board president, said that the government allotted five acres of land in Dhunipur village of Sohawal tehsil in Ayodhya district. The allocation was on time, but then everything slowed down because of the pandemic followed by the lockdown.

Farooqui said that the formation of trust that will handle construction of Mosque etc. is still pending. The trust will have 15 members, and they have only confirmed eight names. He said that they would choose those who have progressive thinking and can provide support and resource for the construction and other work. The construction work should boost after Bhoomi Pujan of Ram Mandir in Ayodhya.

Hindustan asked him if he expects any support from All India Muslim Personal Law Board and other leading Muslim organizations, Farooqui said that he has no hope from them. He added that they would take support from the public to complete the construction work. The trust will decide on how the funds will be raised.

Since the verdict awarded the Ram Janmabhoomi site to the Hindus and the rejection of review petitions effectively shut down any scope for further politicisation, the enthusiasm that Muslim groups had previously shown is nowhere visible. Farooqui said that the Muslim Personal Law Board already said that they are not happy with the land allotted for the Mosque. Thus expecting any support from them will not be right.

Though the Muslim Personal Law Board and several other organizations said they do not accept the land, the Waqf board announced that they would build a mosque, Indo-Islamic Research Center, Hospital and Library on the land.

Ram Mandir Bhoomi Pujan to be held on 5th August

On 9th November 2019, the Supreme Court of India gave its decision in favour of Ram Lala Virajman and allowed construction of Bhavya Ram Mandir on the disputed site. The court also directed the Government of India to give 5 acres of land to the Muslim community to build a Mosque at an alternate site.

As per orders by the apex court, the central government had started the Shri Ram Janmabhoomi Teerth Kshetra Trust within 3 months of the verdict. Key Hindu spiritual leaders associated with the Ram Janmabhoomi movement were announced as the members and the Trust has been supervising the preparatory work for the construction of the temple.

In March this year, on the dawn of the first day of Chaitra Navratri, the idol of Ram Lalla Virajman was shifted from the tent and was placed in a temporary shrine made up of bulletproof fibre at the Ram Janmabhoomi site in the hands of UP CM and Gorakh Peethadheeshwar Yogi Adityanath. The idol of Ram Lalla was placed on a 9 kg silver throne.

Prime Minister Narendra Modi will visit Ayodhya on 5th August to take part in Bhoomi Pujan of the Ram Mandir, to formally inaugurate the temple construction.

Politicians against Ram Lalla: After Shiv Sena, Congress suggests conducting Bhoomi Pujan of Ram Mandir ‘virtually’

The Congress party has now come out and suggested that the Bhoomi Pujan ceremony for the construction of the Bhavya Ram Mandir at Ayodhya should be conducted virtually. Earlier, the same suggestion was made by their alliance partner in Maharashtra, Shiv Sena. The Bhoomi Pujan is set to occur on the 5th of August, 2020.

Former Chief Minister of Maharashtra from the Congress party and Cabinet Minister in the current government, Ashok Chavan, said, “All the religious places have been shut due to the Coronavirus outbreak. If Bhumi Pujan could be done virtually it would be good.”

Earlier, Maharashtra Chief Minister Uddhav Thackeray had called for conducting the Bhoomi Pujan ceremony through video conferencing. However, neither Thackeray nor Chavan have offered any opinion as to how it could be done and whether such a momentous occasion for the Hindu community could be compromised with. The Vishwa Hindu Parishad had slammed the Shiv Sena supremo for his remark.

Congress supporter Saket Gokhale had also filed a petition at the Allahabad High Court seeking a stay on the Bhoomi Pujan ceremony in the first week of August. Gokhale had alleged that the ceremony was in violation of ‘Unlock 2.0’ guidelines. The Allahabad High Court was not convinced and proceeded to dismiss the plea.

The Bhoomi Pujan ceremony has brought out the anti-Hindu nature of the ‘secular’ political parties in India. The Communists claimed that telecasting the event live was against ‘India’s secular image’. Previously, the Congress party and the NCP have also objected to Prime Minister Modi attending the event.
