Additional Sessions Judge/Fast Track Court (Crimes Against Women), Badaun, Neha Garg, convicted and sentenced a man named Shakir Hussain on 20th July to 10 years’ rigorous imprisonment for keeping a Hindu woman and her minor daughter in captivity, repeatedly raping the woman and forcing them to convert to Islam. The incident happened in the Bilsi Police Station area of the Badaun district of Uttar Pradesh.
62-year-old Hussain, who claimed to be a religious healer, came in contact with the woman and her family in the name of healing her mentally disabled son. He visited the victim’s house many times and promised to completely cure his illness. The unsuspecting victim trusted him for healing her son. Taking advantage of the victim’s trust, he took her and her daughter to a secluded place and kept them confined within a rented house.
Hussain repeatedly raped the Hindu woman and forced her to convert
The woman, along with her daughter, was taken away by Shakir Hussain on his motorcycle while she was on her way to her paternal house. Hussain took the mother-daughter duo to Jidhpura in the Kasganj district and confined them to a rented house for three months.
That’s where the ‘healer’ turned out to be a monster and subjected the woman and her daughter to unforgettable horrors for three months before they were rescued by the police. Hussain repeatedly and brutally raped the woman and threatened to kill her minor daughter if she refused him sexual favours. The woman was found to be carrying a 6 weeks and 5 days old pregnancy in the medical examination conducted after she was rescued.
As testified by the woman and her daughter before the court, Hussain forcefully made them offer namaz and forced the daughter to refer to him as ‘Abba’ (father) and her mother as ‘Ammi’ (mother). He forced the woman to convert to Islam and perform Nikah with him. Hussain forcibly removed a tattoo on the woman’s hand with some toxic chemical, which has left her hand permanently scarred.
The court found Hussain guilty of all the charges
After examining the testimonies of the victims and the witnesses, medical reports and evidence adduced by the prosecution, the court found Hussain guilty of all the charges levelled against him. Considering the gravity of the offences committed by Hussain, the court granted him stringent punishment.
He was convicted under Sections 137(2) (Kidnapping from lawful guardianship) and 87 (Abduction of a woman for marriage/illicit intercourse), Section 64(2) (Repeated rape), Section 351(3) (Criminal intimidation) and Section 127(4) (Wrongful confinement for more than three days) and Section 3/5(1) of the Uttar Pradesh Prohibition of Unlawful Conversion of Religion Act (Forced religious conversion) and was sentenced and fined separately for each offence.
The court granted him 10 years rigorous imprisonment for the offence of rape and imposed a total fine of ₹1,50,000. The court ordered his sentences to run concurrently and set off the time already spent by him in jail against his sentence.
A timeline of the case
A missing report was filed against Shakir Hussain on March 27, 2025, at Bilsi Police Station based on the complaint of Prem Shankar, about a week after his wife and 10-year-old daughter went missing. His wife, along with their daughter, disappeared on March 21, 2025, while she was on her way to her paternal home.
Two months later, Prem Shankar submitted another complaint to the police, suspecting Shakir Hussain’s involvement in the disappearance of his wife and daughter. Based on his complaint, an FIR was lodged by the police on May 27, 2025, under Sections 137(2) (Kidnapping from lawful guardianship) and 87 (Abduction of a woman for marriage/illicit intercourse) of the BNS. The provisions relating to rape and forced religious conversion were not added in the FIR at this stage as the victims were not yet found.
Eventually, on June 27, 2025, the mother and the daughter were recovered. Based on their statements, medical examination and investigation, Section 64(2) (Repeated rape), Section 351(3) (Criminal intimidation) and Section 127(4) (Wrongful confinement for more than three days) of the BNS and Sections 3/5(1) of the Uttar Pradesh Prohibition of Unlawful Conversion of Religion Act (Forced religious conversion) were added to the FIR.
The trial of the case went on for about six months before the court passed the verdict, declaring Hussain guilty.
