‘States can consider giving Hindus minority status if they are not in majority in their jurisdictions’: Centre tells SC

On March 27, in an affidavit to Supreme Court, the Centre said that the states have the right to give minority status to Hindus if they are not in majority in their jurisdictions. Notably, the Supreme Court had earlier refused to give minority status to Hindus in states like Mizoram, Nagaland, Lakshadweep, Jammu and Kashmir, Manipur, Punjab and Arunachal Pradesh.

This time, the Supreme Court accepted the petition filed by advocate Ashwini Upadhyay in August 2020 and gave the Centre multiple chances to file an affidavit, but it failed. Eventually, SC had imposed a fine of Rs 7500 on the Centre in January this year for failing to file the affidavit.

In the petition, Upadhyay had demanded minority status for the Hindus in states where other communities like Muslims or Christians were in the majority based on the principle laid down by the Supreme Court in the TMA Pai ruling of 2002. In that ruling, the apex court had stated that the rights of the minorities to administer and establish educational institutions have to be considered state-wise.

OpIndia accessed the affidavit submitted by the Government of India. In the affidavit, signed by Shubhendu Shekhar Shrivastava, Under Secretary, Union Ministry of Minority Affairs, on behalf of the Union of India, it was mentioned that the state governments could declare a religious or linguistic community as a ‘minority community’ within the state.

The onus is on the states

The Centre, in its affidavit, said the petitioners’ argument that the followers of Judaism, Bahaism, and Hinduism, who are “real minorities” in Ladakh, Mizoram, Lakshadweep, Kashmir, Nagaland, Meghalaya, Arunachal Pradesh, Punjab and Manipur, cannot establish and administer educational institutions of their choice “is not correct” since states can also “certify institutions as being minority institutions as per the rules of the said state”.

It said, “Religious and linguistic minorities are spread all over the country and are not related or restricted to any single state/Union Territory of India. A religious group that is in the majority in one state may be in the minority in another state.” It added, “In view of the provisions in the Constitution of India, the Parliament and the State Legislature have the concurrent powers to enact a law to provide for the protection of minorities and their interests.”

The Centre also mentioned that the Government of Maharashtra had notified Jews as a minority community in 2016. Furthermore, Karnataka had notified Urdu, Telugu, Tamil, Malayalam, Marathi, Tulu, Lamani, Hindi, Konkani and Gujarati as minority languages. “The states have the right to certify institutions as being minority institutions as per the rule of the said state,” the affidavit read.

It added, “Matters such as declaring the followers of Judaism, Buddhism and Hinduism who are in minorities in Ladakh, Mizoram, Lakshadweep, Kashmir, Nagaland, Meghalaya, Arunachal Pradesh, Punjab and Manipur can establish and administer educational institutions of their choices in the said state and laying down guidelines for identification of minorities at State level may be considered by the concerned State Governments.”

The timeline of petitions by Ashwini Upadhyay

In 2017, Ashwini Upadhyay moved to Supreme Court seeking minority status for Hindus in several states where other communities were in the majority. The apex court asked him to approach the National Commission of Minorities. The Commission said it did not have the jurisdiction to deal with the petition and states under Section 2(c) of the NCM Act, only Central Government has the power to declare a community as a minority.

He again approached SC, and the petition was listed by then-Chief Justice of India Ranjan Gogoi. He had sought the assistance of Attorney General KK Venugopal. However, by the time the case got listed, CJI Gogoi had demitted the office. CJI SA Bobde dismissed the plea without giving any reasons.

Upadhyay did not step down and filed a fresh plea in August 2020. He challenged the constitutional validity of Section 2(c) of the NCM Act. The SC accepted the plea and issued notice to the Central Government to file a counter-affidavit. Multiple reminders were sent, but the Centre did not respond. Finally, on January 31, 2022, the Supreme Court fined the government of Rs 7500 for not submitting the affidavit. It gave the final four weeks to submit the response.

“I am saying this with full responsibility. This is the situation but even after this, the Prime Minister is giving statements about Riyasat-e-Madina,” Shahbaz stated. Shahbaz Khan was referring to Imran Khan’s wife Bushra Bibi alias ‘Pinky Peerni’.

Shahbaz Sharif said in a conversation with a private TV channel that people are dying for food, children are begging for milk, but chicken is being burnt for witchcraft in Banigala.

There have been many reports on the supernatural claims of Bushra Bibi including some which reported that Bushra Bibi’s images don’t reflect in a mirror. However, Pakistan media had later clarified that her reflection can indeed be seen in the mirror.

‘Bushra Bibi is a descendant of a Hindu King’

Bushra Bibi, 41, is reportedly a descendent of Hindu monarch Jaisal, the founder of Rajasthan’s Jaisalmer region, according to media reports. Bushra hails from the Wattoo clan, which is well-known in Pakistan’s southern Punjab.

The Wattoo are a notable Rajput tribe in the Sutlej Valley, and they are closely related to the Bhati Rajputs. Baba Fariduddin is reported to have converted its members to Islam. According to sources, the conversion took place in the 14th century under the reign of Firoz Shah Tughlaq. The Wattoo tribe of Bahawalpur claims to be the 8th generation of Raja Jaisal’s dynasty, the founders of Jaisalmer.

Imran Khan, who is said to be superstitious, married Bushra Bibi in 2018, a semi-religious cult-like figure. Bushra bibi has five children from a previous marriage. Khan was married for the third time. It’s worth noting that Bushra Bibi is the subject of many supernatural claims and rumours in Pakistan. She is also known as ‘Pinky Peerni,’ a living saint with supernatural abilities. Her family members from the Wattoo tribe in Pakpattan, Pakistan, are followers of the ‘Baba Farid’ shrine.

According to a report in Vanity Fair, Imran Khan sought spiritual counsel from Bushra Bibi before becoming Prime Minister, and he used to pay her two vats full of cooked meat as a fee. According to the report, the meat was for Bushra Bibi’s two djinns (Jinns).

Bushra Bibi had dreamed years ago that Imran Khan would one day become Pakistan’s Prime Minister provided he married the ‘right woman.’ She allegedly sought to marry Khan to her sister and her daughter before concluding that she was the ‘right woman’ for him. Hollywood actor Will Smith won the ‘best actor award’ for his 2021 movie ‘King Richard’ at the 94th Academy Awards. The movie is a biographical sports film, which is based on the life of tennis star Serena William’s father Richard William.

While accepting the coveted award, the actor made a heartfelt speech and broke down into tears. He said, “Richard Williams was a fierce defender of his family. In this time in my life, in this moment, I am overwhelmed by what God is calling on me to do and be in this world.”

“…I’m being called on in my life to love people. And to protect people and to be a river to my people. I know, to do what we do, we got to be able to take abuse. You gotta be able to have people talk crazy about you. In this business, you gotta be able to have people disrespecting you and you gotta smile and pretend like that’s OK,” he added.

Will Smith also thanked the Williams family, including tennis stars Serena and Venus Williams, for trusting him with the biographical sports drama. He also apologised to the Academy for a brief physical altercation with comedian Chris Rock.

He emphasised, “I want to be an ambassador of that kind of love and care. I want to apologize to the Academy, I want to apologize to all my fellow nominees. This is a beautiful moment and I’m not crying for winning an award.”

“It’s not about winning an award for me, it’s about being able to shine a lot on all the people…Art imitates life. I look like the crazy father, just like they said about Richard Williams! But, love will make you do crazy things,” he concluded his acceptance speech.

The acclaimed actor had punched stand-up comedian Chris Rock for making fun of his wife Jada Pinkett’s appearance during the 94th Academy Awards. While on stage to present the best documentary award, Chris Rock said, “Jada, I love you. GI Jane 2, can’t wait to see you.”

The comment upset Smith so much so that he rushed on to the stage to physically punch the comedian. After returning to his seat, the ‘King Richard’ star yelled, “Keep my wife’s name out your f**king mouth.” 

Smith’s wife Jada Pinkett was seen sporting an emerald green gown at the Oscars. Although it remains unclear whether the ‘assault’ was in jest, a Twitter user (@Rocio2026) pointed out that Pinkett has been suffering from an autoimmune disease, leading to loss of hair.

“This joke is of bad taste,” she pointed out. In 2021, Pinkett had opened up about alopecia, an autoimmune disease that leads to the loss of hair in clumps. Last year, she also posted a picture on Instagram with a shaved head after being inspired to speak out about her hair-loss journey.

Another Twitter user explained the connection between the 1997 movie ‘GI Jane’ and comedian Chris Rock’s comment. The lead character in the movie, Demi Moore, played the role of ‘bald-headed Lieutenant Jordan O’Neil.

Although there has not been a sequel to the movie, the comedian suggested that a ‘bald’ Jada Pinkett can feature in ‘GI Jane Part 2’. Given that the hair loss of Jada Pinkett is due to the autoimmune disease of Alopecia, many social media users found Rock’s remarks as ‘insensitive.’

Mukhtar Ansari and his 12 aides charged with Gangster Act by Uttar Pradesh Police in the Ambulance forgery case

Mukhtar Ansari and 12 of his associates have been charged under the Gangster Act in the infamous ambulance case by the Uttar Pradesh Police in Barabanki. The Police has named 12 persons from Mau, Ghazipur, Lucknow, and Prayagraj for registering an ambulance with a false address and using it to carry them to and from Punjab Jail.

All accused in this case have been arrested.

Mukhtar Ansari is a former MLA from Mau and belongs from Yusufpur in Mohammadabad in Ghazipur district of UP. The ambulance case involves the alleged use of forged paperwork to register an ambulance that was used to transport Mukhtar Ansari from a Ropar prison to a Mohali court. The UP Police launched an investigation into the case in March 2021 when it was discovered that the ambulance was registered in Barabanki.

Authorities revealed that paperwork such as voter ID cards and PAN cards submitted for the ambulance’s registration was forged.

Further investigation revealed that the vehicle was registered using forged papers from Shyam Sanjeevani Hospital and Research Center’s Dr Alka Rai. According to the authorities, Ansari’s colleagues Rajnath Yadav and Mujahid went to Dr Rai to get her signature on fraudulent papers.

As per reports, the ambulance, with the registration number of UP 41 AT 7171 was registered in Barabanki in 2013 under a false address and was being illegally used in Punjab and UP for running errands for Ansari’s gang. Even the fitness testing had not been done since 2017.

Police had also said that the ambulance was also used to carry firearms by Ansari’s gang.

A charge sheet was filed against them all under IPC sections 419 (cheating by personation), 420 (forgery), 471 (fraudulently or dishonestly using documents as genuine), 467 (forgery of valuable security), and 468 (forgery for the purpose of cheating), as well as Section 7 of the Criminal Law Amendment Act.

Dr Alka Rai, the operator of Shyam Sanjivani Hospital and Research Center, Dr Sheshnath Rai, Rajnath Yadav, Anand Yadav of village Sarwan, Surendra Sharma, Mohd Shahid, Firoz Qureshi, Afroz alias Chunnu, Zafar alias Chanda, Salim, Mohd Suhaib Mujahid, and Mohd Jafri alias Shahid are the names of people accused in the case along with Mukhtar Ansari.

Mukhtar Ansari is facing more than 50 criminal charges across the country and not only in Uttar Pradesh. The ex-Bahujan Samajwadi Party (BSP) MLA has a long criminal record, having spent time in prisons in Ropar, Ghazipur, Mau, Agra, and Lucknow on extortion allegations. Ansari is now jailed at the Banda district jail after being moved from Punjab on the orders of the Supreme Court.

Mukhtar Ansari’s gang is listed in Uttar Pradesh’s records as IS (Inter-State) Gang 191, and his assets have been seized under Section 14 A of the Gangster and Anti-Social Activities (Prevention) Act.

Mukhtar Ansari, his family, and the gang have lost about Rs 390 crore as a result of Uttar Pradesh police actions.

Denying the genocide endured by the Kashmiri Pandits, Kejriwal took a jibe at BJP leaders and advised them to not promote the ”jhoothi” film.

Joined by his elected MLAs in the party, Delhi CM Arvind Kejriwal openly engaged in genocide denial on the floor of Delhi Vidhan Sabha during his speech on March 22. Deputy Speaker Rakhi Birla who once carried the cabinet portfolio for Women and Social Justice too was seen laughing out loud at Kejriwal’s repeated insinuations against Hindus in his speech. Rakhi took to Twitter to share Kejriwal’s open challenge to independent filmmaker Vivek Agnihotri to put the film on Youtube.

Rakhi Birla’s father booked on rape charges

In 2016, in the run-up to Delhi MCD elections, Rakhi Birla’s father Bhupinder Bidlan and local AAP leader Ram Pratap Goyal were booked for luring a 24-year-old married woman for offering her ticket. The woman accused both the leaders of rape charges. A case was registered against Bidlan and Goyal under IPC section 376 D (gang rape) and 506 (criminal intimidation). According to the complaint, the accused leaders established physical contact with the woman while promising her ticket from AAP in the MCD elections.

The victim accused Goyal of exploiting her at various instances and forcing her to have intercourse with Bhupinder Bidlan at a hotel in Cannaught Place on November 5, 2016. As per reports the accused leaders allegedly shot an MMS video of the crime to target the victim to ruin her life.

Earlier in 2015, Rakhi Birla’s sister-in-law had filed a complaint of domestic violence against her husband, Vikram Bidlan in Delhi’s Rohini (south) police station alleging that he had assaulted her and beaten her with a belt. ‘It was the British manager who stopped my hijab-clad friend’: Customer clarifies in the Bahrain Indian restaurant controversy

On March 27, an official statement of the woman who was allegedly stopped by the British manager of an Indian restaurant in Bahrain was released by Only Facts India’s Vijay Patel.

In the video statement, the woman, Mariam Naji, said, “Hello, first of all, I am very sad about the news and the rumours. Actually, the man wasn’t Indian. He was a British guy, and trust me, I can recognize Indian guys. So please stop doing that. Please, please stop doing that. I am not even happy about what I saw. So, I sat with the Indian owner. He was very kind to us. He apologized to us for what had happened. So, we closed the case, and this is it. This is the truth. Don’t even listen to the news. You have to know the true story. You can even see I am not wearing a hijab, but my friend was wearing the Hijab. Because of that, I made a video.”

Naji also lashed out at anti-Hindu professor Ashok Swain for his misleading tweet where he identified the manager as a Hindu. She said, “The British Manager named Llyod and I want to mention that I’m Muslim and I don’t like racism because God’s land is big. It can handle all of us. I hope we live in peace pls stop doing this I told you he’s British & I can identify the person if he is an Indian or not.”

The Bahrain Indian restaurant controversy

On Sunday, it was reported that an Indian restaurant, Lanterns, owned by a person of Indian origin, was shut down by the authorities of Muslim-majority Bahrain for allegedly stopping a woman from entering the premises as she was wearing a hijab.

Following the controversy, the restaurant issued an apology and acknowledged the involvement of the manager in the controversy. The restaurant said, “Everyone is welcome to Lanterns as how it has been for more than 35 years that we have been serving all nationalities in the beautiful kingdom of Bahrain. Lanterns is a place for everyone to come enjoy with their families and feel at home. In this instance, a mistake has been made by a manager who is now being suspended as this does not represent who we are.”

Several people used the controversy as an opportunity to target Hindus and the Indian community at large. Social media user @Mariam1597, who had earlier posted about the incident from her Twitter account on March 26, informed that the manager was British and not Indian. She posted this after some trolls were seen blaming the incident on “Hindu right-wing”.

It is noteworthy that Mariam was not the one who was stopped from entering, but it was her friend who was wearing Hijab. She was not stopped by any Indian employee but by the manager, who was British.

Bowling woes return to haunt RCB as Punjab chase down 206 to win

Punjab were 170 for 5 after 17, needing 36 from the last 3 when Smith came to life. Punjab had started their innings well while chasing the big target with newly appointed captain Mayank Agarwal and Shikhar Dhawan giving them an excellent start. Punjab: Patiala police lodge FIR against Tajinder Pal Singh Bagga after he criticizes Arvind Kejriwal for insensitive remarks on The Kashmir Files

In the city of Patiala in Punjab, a state ruled by Aam Aadmi Party (AAP), police has lodged an FIR against the National Secretary of Bharatiya Janata Party’s youth wing, Tajinder Pal Singh Bagga, after he criticized Kejriwal for his insensitive remarks on the movie The Kashmir Files.

Ramkumar Jha of Aam Aadmi Party informed from his Twitter handle about the FIR. He tweeted, “FIR registered against Tajinder Pal Singh Bagga in Patiala police station for his derogatory remarks against Delhi CM Arvind Kejriwal.”

Tajinder Pal Singh Bagga had earlier tweeted, ‘When a million scoundrels die, a Kejriwal is born.’ He tweeted this on 25th March 2022 reacting to controversial remarks by the Delhi CM in Delhi assembly mocking the genocide of Kashmiri Pandits, which have been depicted in the movie The Kashmir Files.

However, a day later, he made some changes in his statement. He tweeted, “According to the advice and appeal by all of you, I am taking my tweet back. I have committed a mistake and I will provide the explanation in the next tweet.”

In his next tweet, Tajinder Pal Singh Bagga wrote, “In my earlier tweet, I wrote one million by mistake. Please read it as one hundred million.” All these tweets by Bagga went viral.

When Ramkumar Jha of Aam Aadmi Party informed about the FIR from his Twitter handle, Tajinder Pal Singh Bagga gave him a befitting reply saying “Lodge 100 such FIRs but if Kejriwal calls the massacre of Kashmiri Hindus as a lie, I will speak, if Kejriwal takes a dig at the massacre of Kashmiri Hindus, I will speak, whatever be its consequences, I am ready to face them. I’m not going to spare Kejriwal, I’ll put a nail in his nose.”

Bagga has pinned the first tweet on his Twitter profile. The FIR is lodged probably for the same tweet, though further details are yet to come up.

Delhi Chief Minister Arvind Kejriwal had stoked a controversy last week when he used precious time of the Delhi assembly to criticize and mock Vivek Agnihotri’s film ‘The Kashmir Files’. In response to the pleas to make Kashmir Files tax-free in Delhi, Kejriwal asked the filmmaker to put the film up on YouTube for free. He went on to criticize BJP for supporting the film and even went on to call the film “Jhoothi film (film full of lies).

Meanwhile, The Kashmir Files continues to do well at the box office. The film based on the genocide of Kashmiri Hindus in the late 1980s and 1990s has already grossed well over 200 Crores and continues to attract the audience in the 3rd week of its theatrical run.

Imran praised non-Islamic countries in western Europe and Scandinavia for following the principles of Islam without following the religion by caring for the poor sections of the society. However, he also praised China for following Islamic principles even as China continues to persecute Muslim community in Xinjiang.

Further, Imran Khan went on to say that the Muslims in India also voted for the creation of Pakistan. He went on to say that Muslims in India wanted to see what an actual Riyasat e Madina looks like, that is why they voted for the creation of Pakistan.

The data for provincial elections in India in 1946 does suggest that majority of Muslims in India voted for Muslim League, which wanted a creation of separate Pakistan.

Imran Khan also said that India was ruled by slaves at one point of time, probably referring to Slave dynasty which ruled gangetic plains in the 13th century, without realizing that India is slightly bigger than that.

With the economy in doldrums, inflation shooting up, and country still in FATF grey list for its support to terrorism, religion was the only thing that Imran Khan could fall back on. He attacked his opposition relentlessly throughout his speech, and tried to list the achievements of his government.

With a united opposition and Pakistan Army not showing any willingness to help him, Imran Khan has gambled on religion to save his government, like every Pakistan politician.
